jillian: additional troops are being thrown out of iraq to be evaluated for possible concussions. the soldiers may have been injured during the iranian missile attack earlier this month. 11 servicemembers are being examined for concussion. no one was killed. the strike was retaliation for the killing of iranian general qasem soleimani. rob: the supreme court will hear a school funding case that could have begin location for religious freedom. justices will determine whether the state of montana violated the first amendment when prohibiting several low income families from using attacks credit to pay for private religious school. the state supreme court struck down the scholarship program entirely. >> donald trump is planning to expand his controversial travel ban. the president telling the wall street journal he will add multiple countries by the end of the month. restrictions will be placed on the 7 countries the president is

just hours after a staggering out of the capital last night. what can we expect in day 2? shannon: john malcolm, good to see you here. a lot of people are making the argument you will hear a lot today that the democrats essentially spent all this time yesterday laying out their case for the american people, what they want them to hear and what in their mind the republicans are not allowing to happen. what do you say to that? >> that is right. the day was supposed to be arguing about amendments to propose rules from mitch mcconnell but they had a lot of time to use so they began by mixing in procedural arguments with their opening arguments but now they will have 24 hours to make their case including repeating whatever points they made supplemented by the record they were able to develop in the house.

rob: a lot of redundancy today. look at all the amendments mitch mcconnell was able to table by having the majority, a list of everything chuck schumer tried to get through and failed. a minor loss in the beginning but held his caucus together successfully. >> wasn't much of a loss. he originally said give each side 24 hour to make their case and they will each have two calendar days to do it which would make for two very long days for each side. he decided to make that three days for each side which is exactly how it was during the clinton 1999 impeachment trial. of the rules had been adopted, they are remarkably similar with one exception i can discern to the rules that were adopted for that trial. jillian: there were many heated moments, let's listen to a portion of it. >> the president sometimes relies on the theory of absolute

resolve constitutional issues and that is one of them. rob: the fight over witnesses, the biggest fight will be delayed until after the opening statements and there is this small group of democrats that are considering a hunter biden for john bolton swap. each side get some money they want. do you think any of the leadership on either side - >> ultimately it is not up to the leadership. you've got to get a majority of senators voted for witnesses deciding which witnesses to call. there are 53 republican senators was everybody talking about lisa murkowski, susan collins, mitt romney, the letter two indicated when they were going to vote to support these rules and wait until after the lawyers argue they are inclined to want to hear from witnesses including possibly john bolton and in order to get a fourth senator to join the democrats, lamar alexander, pat roberts.

what does that tell you about this being political in nature which democrats argue it is not? >> reporter: the point is in the house it didn't move the needle. people were not persuaded to lean more towards impeachment, republicans were not convinced of anything. the headline you had over parnas and adam schiff, you've got to get it right. trying to convince the majority in the senate, republicans to come to your side and what we saw in that marathon day was minority leader chuck schumer not getting enough republicans to call witnesses and issue subpoenas for documents. rob: you think mitch mcconnell was the big winner of the day? the republican party was worried about moderates, schumer sent these resolutions and they all failed. >> perhaps mcconnell could take a short victory lap but be careful because the strategy of
