democrat witnesses. that statement is wrong too. there were a number of witnesses who testified the exact opposite, that security was conditioned and it is a simple is 2 plus 2 equals 4. they put it in writing and testified about it, they neglected to tell you gordon sondlasnd said no quid pro quo, but, here is the quid pro quo. no quid pro quo but zelinksy should want to. that is the quid pro quo. maybe they don't -- maybe they consider him a democratic witness. what about mulvaney? no words from the president's

mouth, he admitted in a press conference just like this of course we did. it happens all the time, get over it, no mention of the president's chief of staff. my final point before i turn it over. to look away from the fact the president's own chief of staff has admitted to the most pernicious part of the scheme to get ukraine to do these -- why would they make no mention of that. it gets back to something they argued in the first two minutes of their presentation when they were attacking the house managers, that the goal should be to give you all of the facts. that is our goal. but it is not there is because mick mulvaney has some of these facts. another name you didn't hear was john bolton. john bolton has some of these

facts. you didn't hear the name duffy or blair or other witnesses that the president who is so confident that this was about corruption and not trying to smear an opponent want you to hear, the one question they did not address at all is why they don't want to give the american people a fair trial, they want this to be the first impeachment case in history without a single witness and a single document turned over. that ought to tell you what you need to know about the strength and weaknesses of their case which is they know what the president did, the president's men know what the president did, we proved what the president did and the last thing they want is more of the truth to come out. mister nadler. >> thank you very much. i want to make a number of

points. first the general point. you heard adam and i and most of the managers say over the last few days that predict that the president's case would not deal with the substance of the accusations because they can't defend the accusations, they were going to process. talking about how -- the house procedures were denied due process but wouldn't address the reality of the case and they couldn't address the reality of the case. when they say the house should have brought the witnesses, where are the witnesses? remember the president gave a

blanket order to everyone not to testify. all members of the executive agencies, people who testified in front of the intelligence agency were defining direct orders from the president. there are witnesses we wanted in the judiciary committee and others in the intel committee, we have gone to court for them. we've been incorporated 9 months and haven't gotten them. why haven't they testified? the president told them not to testify. they will eventually when the courts force them to and you hear the president's council say they should have had the witnesses after doing everything they can to prevent any testimony. that is point one. .2, you heard them say today as they said the other day >> the democrats, the ones who made their case for the impeachment of the president of the united states were not

arguments in the days ahead. >> one of those legal arguments came from one of the president's lawyers who said he is being charged with obstruction of justice or not providing witnesses are asking requests for documents, those requests came from the judiciary committee, they were not authorized by the entire house, they were authorized by nancy pelosi. i thought it was an effective argument. >> i watched the congressional hearings and i don't know if i missed anything but that was the first time i heard that as well and what i liked about that lawyer whose name escapes me, he was a very intellectual, kind of an appellate lawyer. he wasn't gyrating. he was bringing out facts, responding to the house saying you have not done what you need to do for a compulsory process and i was like this is if it is
10:14 am
true that i'm hearing it, this is in my mind, the first time hearing it an absolute defense, you have not done the prerequisites of what you can do in ordering a subpoena and require compulsion of witnesses and documents, that is a strong defense and that is one of the reasons i'm saying if that is accurate they have data to back it up which i imagine they did or they wouldn't say it you may want to pull back a little bit and say we hit it out of the park, those three senators were not convinced they should get witnesses because we did such a good job today. when you stand well, an old judge told me when i won an objection in court in a homicide case and still argued afterwards, he brought me out of the courthouse and showed me something in latin, you know what that means? when you stand well, standstill. in other words, shut up and start making arguments.
10:15 am
>> when nancy pelosi was dragging her feet on impeachment, she was saying it is a serious issue that could split the country. when you look at a monmouth poll taken just before the senate testimony began this country is very much split. now that he has been impeached by the house you think he should or should not be removed from the presidency by the city? 49% say he should, 48% say should not, only 3% say they don't know. this country is very much split on this question. >> we just popped up some data on actio's.com showing how little any of these indicators have moved over the course of this trial. 49% figure you showed, it was september when they began this process, 47. some have 51. very little movement, mostly in the margin of error. look at the president's approval rating.
10:16 am
what was it when the impeachment inquiry began? 42. what is it today? 43. unchanged. the president's approval at 42%. the other one unchanged, move around a little bit but joe biden, the national front runner, 2020, also unchanged, i checked real clear politics, the very luxuriously appointed green room, 6.2% lead in national polls, those matters which are snapshot of the country unchanged through many months. >> it is luxurious because washington dc gets all the money. real quickly, the votes may or may not be there for witnesses that are the votes which their for impeachment? >> i don't think the votes for impeachment are there.
10:17 am
that is what i am saying what they are saying. the democrats did a good job presenting their case, it was very professional but what it comes down to is the jury. we already know where they are. don't mess that up. right now if you take a vote there would not be enough votes to move forward with this so they should consider slowing down, continuing in a professional way if at all and letting those people already making the decision not to move forward with it stay there before you do something to miss it. >> what is your crystal ball say? >> not only are there not votes to remove the president, to convict the president at this moment, all our reporting indicates there is not a single republican vote to convict the president. at the moment donald trump would not lose a single republican senator based on what we learned on capitol hill.
