enough information to decide president trump's impeachment while 44% say that the senate does need more witness testimony. so for more on how the president and team is responding for senate trial in preparing for tomorrow we turn to kevin corke who is standing by at the white house, hi, kevin. >> nice to see you, kristin. this particular poll is for democrats, there are more democrats nationwide than republicans, so let me show you how the survey shakes out very interesting and it's also important to note that it was actually taken before we heard all of the arguments with respect to the senate, both the democratic side and the republican side, i just want to share this number, i think this will interesting for your viewers, on impeachment 50 to 44, voters think the senate should convict and remove the president from office, democrats at an 81% clip believe so, republicans disagree at clip of 84 to 16, now what we have seen in the past, most of this is, of

course, split along party lines, no surprise there, but i also think i should tell you this, independents on the latest survey about 19-point margin, 53 to 34 feel like the president should be removed from office, as for the white house, conversation there with leland, they are working here at the white house getting ready for day 2 of testimony over on capitol hill, a chance for the president to have his side of the story discussed. the white house for the record isn't buying the argument that career government appointees get a chance to set the direction for u.s. policy. >> these people who it was their job to deal with ukraine have said they did not like the policy, they did not like the president's policy and that's a real problem, career officials are not, when you work for an administration you need to carry out the policies of a president, a couple of them have said they are not sure and have real concerns about the policy here, that's not an impeachable offense. >> stephanie grisham on fox's

media buzz, democrats meanwhile argue the president has to be stopped because he's not only abusing his power, he violated the oath of office by encouraging ukraine to attempt to influence a 2020 election. >> they basically acknowledged the scheme, they don't really contest the president's scheme, they don't say, no, he didn't try to get foreign help in the election, they don't say that there was no evidence that he was conditioning the aid, they just tried to make the case that you don't need a fair trial here. >> adam schiff earlier today, of course, the white house has long said that that was not the case, meanwhile that assertion comes as a newly-revealed video from 2018 appears to show the president in a donor event including a few minutes talking about removal of the u.s. ambassador to ukraine marie yovanovi, of course, that's his prerogative. for now back to you kristin.

>> all right, kevin corke live in the north lawn, kevin, thanks. leland. leland: little bit more on how the defense team will be presenting in congress, yesterday they called it a movie trailer, if you will, of their case, mark meredith on capitol hill with both how we expect the white house's team to go about things and also the response on the hill as well, hi, mark. >> hi, leland, good afternoon, we expect monday's session to be longer than what we saw on saturday because we only saw roughly 2 hours, the movie trailer version of what will be coming down the line for the president's defense, but we did hear from the president's lawyers as they argued that democrats have been using impeachment as a political weapon up against the president, of course, this is exactly what we have been expecting the president's legal team to lay out the last couple of days, counsel told lawmakers that they are omitting key and he says

he's looking beyond these opening arguments and remains committed to compelling the senate to call additional witnesses. >> if they're successful in depriving the country of a fair trial, there's no exoneration, there's no exoneration, markets will recognize that the country did not get what the founders intended because they put the word try in the constitution for a reason. >> now, it's unclear when the defense is going to be wrapping up their opening arguments and when a vote on witnesses may happen, democrats need 4 gop senators to join them if they want to have a majority, new testimony, new subpoenas, so far most republican senators appeared to be united against that effort. >> i'm not going to vote to approve witnesses because the house democrats have had lots of witnesses, we heard from them over and over and over again this week. we don't need to prolong what's already taken 5 months of the american people's time, the house democrats have not proven their case against donald trump.

>> that's one thing we have heard over and over again as the senators have left the senate chamber at least from the republicans who have been there as jurors, now last week's session went late into the night, early into the morning; it's unclear if we will see the exact same thing, we tried to get a better idea yesterday from the president's legal team about how long their opening arguments will go, would it last the entire time like what we saw from democrats, although, right now nobody is saying how long it would last, the action kicks off at 1:00 o'clock tomorrow afternoon, leland. >> especially yesterday it was striking how part of the team, we will do this in a lot less time than the house managers did and perhaps get extra credit for that, mark meredith there on capitol hill, check back with him as he talks to folks that are roaming the halls sunday, mark, thanks, kristin. >> for more on this let's torn florida congressman, he also

served as trial during bill clinton, how do you think the president's legal team did yesterday and what are you looking for tomorrow? >> well, i think the president's team did fine yesterday, they didn't speak too long, they were doing what they said, summary of what they're going to do, i think it's important for them to be concise but i also think it's important, i think they will tomorrow lay out the case for the president, lay out the facts that are there and it's very clear what my former colleagues 21 former -- 21 state attorney generals wrote to the president, look, there are no crimes here, there's only a question of an allegation of corrupt motives about being political in foreign policy matter and that would mean that you -- remove the president for that, you could remove and have impeachment of almost every president all of the time, it's not a good case and they need to show why it's not and i believe they will.

>> one thing that was really interesting about yesterday was that the president's defense attorneys did not mention really or really go into the bidens, the former vice president joe biden or his son hunter biden, do you think we are going to hear more about them tomorrow? >> i think you probably will hear some about them in the background of why this was important to the president in the first place, corruption is the issue in ukraine, his interest in holding back that aid i personally think was broader than simply the bidens, he talked about us rather than himself and asking for the so-called favor from the president of ukraine, the arms the weapons and so on were there and just timely manner they would have been no matter the fact he had a holdup, the ukrainian government did not appear to be aware of the hold at all until maybe 3 or 2 days before they received those arms and it was released so i think that the president was looking at a broader issue of corruption in ukraine which is historically has been there, barism was the

heart of that and still does, was one of the worst of all back in a previous administration in ukraine and all of that was taking place in the background of the 2016 election, so while the russians may have interfered in the elections, ukrainians were not hands off, they were supportive of mrs. clinton and i think it's a very, something that's very important that will be brought out in contest but not dwelled on by the defense team tomorrow. >> democrats continue to want new witnesses, pushback on some of those points and, you know, that really has been the big question last week and continues to be this week as will witnesses will be allowed, quoted in florida paper saying that i think republicans are making a mistake if they don't allow witnesses because of the fairness, do you still standby that, do you think the republicans should allow new witnesses? >> well, first of all, i want to say i don't think the president

have committed an offense that's impeachable, i wouldn't need to hear for witnesses to make my decision to acquit him, but do i think politically from a standpoint of just appearances, most of the people aren't watching this, they are not paying attention, like you and i are, we don't have to have them and it may be because of the difficulty of bringing witnesses in this case, the ones they particularly want to bring like mick mulvaney and john bolton, they have executive privilege issues, those two spots around the president who would be protected probable by the courts. difficult to come up with witnesses that would be appropriate but i have said and i will say again, i think it would be best if there could be two witnesses or so aside just from the standpoint of the politics of this. >> all right, well, we will have to wait and see, will certainly

warns the u.s. not to cross any, quote, red lines, what does all that mean, we bring in former israeli ambassador from the united states michael ernst, i appreciate your time, sir, 50% of this deal would be palestinians, they've already said no, thanks, we are not bother showing up at the negotiating table or in washington, what's the point? >> good to be with you, leland. you know, the palestinians hold the world record for people who have been offered peace, have been offered a two-state solution throughout history and every time they've said no, in fact, they don't have yes in their vocabulary. i think that the administration has internalized this, it's a new day and this peace plan is aimed at really two customers, if you will, the israeli public and the moderate arab sunni world and particularly the gulf states and so far the reactions are very good. in israel we have two major

parties, blue and white are engaged and coming, the heads of the parties are coming to washington and in the arab world, this president, this administration has a tremendous amount of street credit for strong stance against iran, pulling out of the iran nuclear deal. leland: we saw jared kushner, among others making the sale when they looked to sunni-arab states, i believe latest conference in behrain, into a new possible palestinian state, how much of this as you point out is about the israeli politics from an internal sense? you have prime minister netanyahu accused of serious crimes, bribery and corruption in his administration, he's now lost 2 elections to be able to put together a comprehensive government and i can't remember in all my time covering the middle east you ever had essentially the opposition and the current prime minister showing up in the united states weeks ahead of an israeli election?

>> we've never had a situation like this period, so everything here is quite new, it's unprecedented, but i think we can't lose track and lose sight of the big picture, what's the big picture? you have a huge chunk of israeli party, even radical right are supportive of this peace initiative, that's unprecedented. back in the 90's, during the clinton years, this country was divided bitterly over the peace process. now we are united around this peace process and historic moment. leland: interesting point considering that benjamin netanyahu road to power campaigning against the peace process that was in place, just so we give equal time to everybody, we want to hear from bennie, ahead of blue and white, former leader of israeli military who is also running for prime minister, take a listen. >> will go down in history as

meaningful landmark mapping the way for the different in the middle east to finally move forward towards historic and regional agreement. leland: what do you make playing homage, if you will, to president trump? >> well, first of all, this is the friendliest administration we have known since israel's founding in 1948, this administration ha has recognized jerusalem as our capital and israeli sovereignty over the golan heights, which has most recently taken out the arch terrorist qassem soleimani, the president has tremendous amount of credibility in israel and beyond israel in the broader middle east and i would very much hope that that -- that street credit can perform the basis of viable and ultimately

leland: check out this video, the californian couple being air-lifted to safety after a hiking accident, evidently the couple fell off the trail and you can see her holding on and then sliding down to a paramedic who was then able to grab the

have about this new rule and that is, how do you enforce this >> well, i mean, the counselor officers are the front line of granting visas in the department of state and when it's appropriate and sometimes it'll be rather obvious they are going to be asking questions related to this subject, realize that when people overseas apply for a temporary visa, one of the things they promise is that they are truly only coming here for temporary purposes whether to be a tourist or to do business or what have you and obviously people gaming the system with birth tourism which means they plan to come here to give birth are lying about their temporary intentions, so this is a way to try to stop that gaming of the system. >> but sometimes it is not obvious if a woman is present -- or pregnant. >> true. >> women carry more weight in that area or sometimes, you know, women are only 4 months

into their pregnancy and still not knowing it, i mean, what can these officers realistically do to enforce the new rule, are they going ask women to take pregnancy tests in order to get a visa? >> well, obviously this isn't going to be applied except in those situations where as you read, kristin, the counselor officers have some reason to believe, some reason for concern, so something will have to stand out to them that is unique from all the other cases, so it won't be applied in every case because it won't be appropriate in every case, but it is a new -- it is a new regulation in place for the counselor officers and we fully expect them to implement it fully and if the department of homeland security we expect to back them up with own regulations. >> i want to share a little bit of the other side, you have some critics say that this is because of how difficult it is to enforce it, this rule is more

symbolic than anything else and you have congresswoman alexandria ocasio-cortez saying that the trump administration is now targeting pregnant women and the cruelty is the point of this and she's also using that to renew her call to abolish ice, listen to what she said just last night at a rally for senator bernie sanders in iowa. >> i hear -- i'm here because we need true immigration justice in the united states of america. [cheers and applause] >> and i'm not here to reform some of the systems when we talk about immigration, i'm here because senator sanders has actually committed to breaking up ice and cbp. >> your response? >> well, of course, policy wise that's stupid, i mean, something is going to remove people who are here illegally, even senator

sanders as a senator, as a policy matter when speaking of universal health care has noted you can't just have open borders if you're going to have a universal health care system, so there are all sorts of complications on a policy level that the quotes you just played don't account for, they're just not realistic, not to mention we are not a nation of laws and we intend to remain that way, president trump has certainly commit today that and exercised exactly that in the tradition of this country in his leadership. >> ken, i only have 3 seconds left and i want to ask you one more question about a separate topic, about ukraine in the news lately given impeachment trial, as the acting deputy secretary of the department of homeland security, it's department that's responsible for securing the 2020 election, it was responsible for securing the 2016 election. >> yeah. >> i'm curious, have you seen any hard evidence that ukraine

interfered in the 2016 election or if possibly trying to interfere in the 2020 election, it's something that's been put forward by the president's allies but chairman adam schiff said yesterday he called it or earlier this week a conspiracy theory brought to you by the kremlin, have you seen any hard evidence that ukraine interfered? >> so i wouldn't say that, i would say that we've been focused on securing the 2020 election, of course, and we are in a position that is night and day with 2016, so i think that we will be better positioned not just to block interference in this year's election but to spot attempts to do so, so i'm not prepared to -- to, you know, share what we have seen at the intelligence level with respect to this year's election but i will tell you and the american people should know that we've never been, we've never been better prepared than we are today. >> okay, but 2016, any hard evidence that ukraine interfered

kristin. >> kristina coleman, thank you. leland. leland: the california case comes after 2 others reported in seattle and chicago last week, the cdc says t currently monitoring 63 potential cases, there's not a vaccine but the nih tells fox news they are in the early stages of developing one, let's turn to infectious disease, center for health and security dr. amish adal, appreciate your time, as you look at the numbers in china in terms of infections versus deaths, it seems to be about 2,000 infected and 50-some people who have passed away which undoubtedly is tragic but at the same time is this any worse than the flu? >> no; it's not worse than the flu but the concern is trying to keep this at bay so it doesn't become like the flu, we know the flu kills thousands of people every year and we don't want this new coronavirus to be something like the flu that

becomes something seasonal, we want to contain it so we can end outbreak and as the number of cases go up it's important to watch the rate as deaths go up because we will uncover more mild cases and that may be an important thing to find out because show how severe it is, where it fits on the skill with sars on one end -- leland: when we say the coronavirus, something as simple as common cold is a coronavirus, right? >> one-third is cause bid coronavirus, 6 coronavirus, this is the 7, four of them are common cold viruses and only two are severe. leland: as we are watching video from china, quarantining people, the military is coming in, et cetera, does it jive with you that they're doing all of this for a virus that is -- we just talked about, may not be any worse than the flu or is there a

chance the chinese know more than they're telling about how bad this is because of their response? >> i think it's hard to really gauge the response because we don't know a lot about the virus and they are really d they have been chasing by the experience of sars in 2000 where we had 8,000, 800 dead and worldwide and that's what's driving this. i think when you this draconian measure going on in the region of china, i think that's going to end up having negative consequences because it's going to distress and make things worse and shortage of medical supplies which we are hearing about and no-go zone and you may see increase intensity in transmission based on what they do there. leland: just now coming across the wires, the virginia department of health investigating 3 residents in central and northern regions of virginia here near washington, d.c. related to the coronavirus, but i keep going back to this, you say sar serving, 8,000

people infected, 800 dead, tragedy no doubt, could have been a lot worse had measures that you and fellow doctors had put in place, there are more people that die from the flu and i'm wondering if the amount of coverage and intensity that this is getting, oh, my god, one new case of this gets so much attention in the united states and the cure is worse than the disease. >> this happens any time we have emerging infectious outbreak, they simmer along and the media explosion with coverage of this and sometimes it's hard to keep perspective, people forget about things that are common like influenza, i don't want to minimize what's happened, coronavirus that's killing people that has some characteristics of sars which when you look at it compare today influenza doesn't look that bad. it's something really important that we need to contain, flu is something in its own category,

has been charged with estranged wife's murder, the judge blasted him for breaking house arrest rules and also waived his right to a probable cause hearing which his lawyers said should get him to trial faster, the most significant of the 3 developments unfolded as dulos appeared on thursday with legal team to address issue of quarter order house arrest and gps monitoring, dulos admonished in court by the judge after state prosecutors learned he had made an unauthorized shop and dismantling make-shift memorial that people built at the end of his street while he was out running a work errand, made bond and placed under house arrest which allowed him to go to court, work and church, the judge allowed him on strict house arrest for the memorial misstep which the judge called dumb and says if he does it again he will double the bond,

dulos' attorneys are focused on getting him to trial and clearing his fame. >> yeah, i'm worried about the public perception but there are 12 good people who don't we yet know and that would be the juror in the case, the jurors in the case, when we have the jury and orderly courtroom proceeding my people commit to go decide by the rule of law we are extremely confident in our eyes. >> dulos former girlfriend and civil attorney cent who were arrested on conspiracy to commit murder charges in this case are also working through their legal defense, currently out on bond but melani hasn't been able to post his, remains in custody, ex-wife has been granted full custody of their twin sons after telling judge her children are embarrassed and afraid of her husband. dulos will be back in court on the 28th and not allowed to have contact with 5 children or caretakers or missing wife's family members.
