these senators that have grappling with whether or not to call witnesses, this might be the tip of the iceberg for them. they might say look we have got to ask him about that. and maybe they are feeling pressure from constituents to ask him. what happens next? does john bolton if he says he will speakened he a already says he would, but does the president get to call executive privilege and then john bolton is not allowed to talk? or does john bolton make that decision? brian: he could call a press conference today and he could say i will take any question you want because he is a free man. he is not under lock and key. ainsley: is he with executive privilege? steve: has to be under oath. brian: very good, steve. you have to say is john bolton lying in his book? is he lying at the press conference? is he only going to tell the truth if brought in front of everyone? you are allowed to speak publicly. ainsley: we will get into this later being criticized by some people on his own team about writing this book. saying if you have conversations with the president that should be private. brian: i will add this to it

general mattis said i'm not writing a book about the president until he is out of office and general kelly said the same thing. if condoleezza rice came out and wrote a book about george bush while he is still in office i don't care if it's good or bad that's inappropriate. to put a book out while the president is still in office is incredible. steve: you know, a lot of people say it's still speculation. nobody has actually seen the book other than the "new york times." that's why the rnc put out a mass email. his name is steve guess. he put this out yesterday this is the 2.0 version of the failed kavanaugh playbook. it cited no other fact witnesses. trump himself have said that he cooperated with the investigation. rather, no direct quotes does not cite any named source. and that's why they are saying we don't quite understand what's going on

here. brian: so, here's the thing. if john bolton is saying i'm being miss portrayed. he hasn't. they only say we had nothing to do with the leak. alan dershowitz who said i'm a democrat as ainsley mentioned. i didn't vote for president trump, but this is not impeachment-worthy. also said when it comes to bolton, it doesn't even matter what's in his book. listen. >> if a president, any president were to have done what the times reported about the context of the bolton manuscript that would not constitute an impeachable offense. let me repeat, nothing in the bolton revelations even if true, would rise to the level of an abuse of power or an impeachable offense. that is clear from the history. that is clear from the language of the constitution. you cannot turn conduct that is not impeachable into

headed back to court today three years after it was first imposed. a federal appeals court in the commonwealth of virginia will hear arguments in three cases challenging the controversial rule. even though the supreme court already upheld the legality of the ban back in 2018. the rule suspends immigration to the united states from several muslim countries, also, north korea and venezuela as you can see right there. and the high court allows the trump administration to enforce new rules that would deny green cards for illegal migrants. under the new public charge policy migrants applying for permanent residency must show that they won't become a burden on taxpayers by using public benefits like food stamps and medicaid. that's a big difference ainsley. ainsley: thank you, steve. the cdc monitoring 10 potential cases of the krohn

recognized the president has the authority to exert privilege over testimony from his closest aid. >> if john came here as he used to, and started spilling the beans, that would violate the privilege. but it would be perfectly lawful and he would be able to do it. if he did it in the. brian: a press conference. >> a press conference he it would be lawful and he could do it. the question is can he do it under oath in the well of the senate? that's where the authority is divided. senator cornyn told you he thinks the president would challenge it and it would go to a district court. i have a different view. i think the chief justice would order it and if the senate didn't overrule that ordering, john would have to testify. no judge would take jurisdiction of the case after the chief justice had ordered it. ainsley: what if they had a conversation he with the president and they had a conversation with the quid pro quo. what if the president was talking about 2016. john bolton thought he was talking about 2020 and there was that confusion? >> that's why you have cross-examination to

examine. but, remember, executive privilege doesn't apply every conversation the president has. in this context, it applies interestingly, right in john bolton's wheel house, military, diplomatic, sensitive national security. that's what united states vs. nixon, the unanimous supreme court opinion said in a criminal context where the government was subpoenaing documents on the president to see if he should be prosecuted. not in an impeachment context. remember, the house of representatives -- the branches of the government are equal. but in certain areas, one is superior to the other. so the president is superior to the congress in terms of running the military. the congress is superior to the president in terms of appropriating funds. brian: pat toomey seems to be wavering. that's unusual one. expect romney, collins, murkowski but he seems to be wavering. he proposed yesterday in a closed door session what about a one for one. you bring bolton and i don't

popular vote. people think you would have to amend the constitution to get rid of the electoral college. but this basically does the same thing with only action in states. and there are almost 75% of the way to doing this. to hijacking the electoral college for a direct election. steve: they just need to find states with 74 more electoral votes and then they essentially would be able to work around the electoral college. >> that's right. it's an end run around the electoral college around the constitutional amendment process. it's an idea james madison never worried about it. nobody thought states would give away their power based on sort of leftist direct democratic ideology. but that's exactly what we see today. steve: ultimately, if this goes through, and there is 74 electoral votes away from having it happen, what happens to people in the middle? you work in oklahoma. i'm from kansas. i was born in iowa. what would happen to those states in the middle? >> they would become

the administration was taking a specific position. you would see the next day an opinion or an article in the "new york times" leaks that would occur. this is a consistent pattern. it's tragic that it's happening with john bolton at the helm so to speak because let's face it, the "new york times" would be the first to argue that john bolton was someone they did not trust and did not believe. look at what they said about his opinion on iraq. he was a liar, someone you couldn't trust. but now all of a sudden he is very trustworthy. steve: let's say, brett, that what john bolton, his book, reportedly talks about, let's say it's true. what does that mean? >> well, let's stop thinking that this lightning bolt so to speak or this, you know, incredible gotcha moment. you don't have john bolton indicating that the president told him to do

something in relation to the ukraine and to president zelensky. you don't have him overhearing the president telling ukraine of his demands or conditioning it. what have you is bolton indicating that this was a conversation that the president stated that he wanted corruption, looked into that he would withhold aid. it still does not articulate a crime and then the facts don't bear out what the assertion seems to allege. you don't have the president of a foreign country who says yeah, i kind of understood. this was what was happening. i was being told i had to do this in order to get this aid. and then you have a president and those around him that are saying that is not what happened. there was not condition placed on this mulvaney even sondland in you take his

steve: what did you make of the way they presented things because we heard the house managers for 3 jam-packed days present the information and yesterday we actually heard some sound bites from the democrats and then the trump team would turn around and say, now, why didn't the house managers present this exculpatory testimony that exonerates the president? >> well, first of all, that was long, long testimony with the house managers, that was pretty painful. but in any event, the point here is, if we care about our republic, if we care about our constitution it is so clear, so many times in so many ways whether it was ben franklin when he said i give you a republic if you can keep it, this would begin the demise of the republic, you cannot use impeachment as a tool that is political, impeachment is a very

serious issue and we know that it was so serious that the founding fathers really debated and discussed how and what they should put in there because they never wanted to use it as a political tool, now we are getting to set up a precedent where each time we don't like a president or a president does something that we don't care for, we are going to use impeachment, that will destroy the republic, it's not good and their points were well made, we have to move on, my god, this has gone on for years now, it's cost millions of dollars, it's cost so much time, so much good work we could have gotten done that we haven't gotten done, i feel like there's a lot of americans that just feel like saying, stop. brian: congressman, i understand that chris christie as well as the president talked to you and helped you make the move but you also have a voting record which is a lot -- you opposed to the president a lot. are you going to stop opposing the president or switch on all the views? >> no, i'm going to still be

myself and when they say you oppose the president a lot, when it was really most of the important and significant issues, whether it was, in fact, the first vote i took was to vote no on nancy pelosi to not vote for her as speaker, the most important vote that we've had, i think, has been impeachment and i made it very clear, both on the inquiry and also on the impeachment itself that i was a no vote, i'm going represent my people, i'm going to represent my state, but when it comes to the really important and significant issues i think i'm going to be in a good spot. you know, the president knows my voting record, he knows me and, you know, and we met in the white house and spoke for well over an hour, i think he understood me, i certainly understand him and i'm proud that he's our president, i thought he's done a good job and i've spoken very clearly on that often and i will continue to do so. steve: speaking of your home

york and new jersey lynn patent counted the number of people living on the street, good morning. >> good morning. >> good morning. ainsley: something you that's you do every year? >> yes, there's annual homeless assessment report that comes out each year and this is called the point in time count, it's done on one night, usually a cold night and it's across the country so tens of thousands of volunteers who actually go out interview people and find out what their status is. ainsley: lynn, what did you find out? >> unfortunately we found out that there are a lot of people in the streets of new york on the coldest night of the year and it was very humbling and we know that over 78,000 new yorkers live on the streets over, 20,000 of those are children, but new york is trying our best to put them into shelters to give them the services they deserve and this administration is investing record funding to do that. >> last year unsheltered

homelessness in new york city, there were 3,622, homeless people in new york city shelters each night, more than 63,000, that's unbelievable. what do you recommend we do as a public because i will see them on the streets, give them money, some people say no, other people say have a heart, it can be an angel or jesus, you think about that, i saw your post on instagram, how it reminds you -- homeless man was on the street -- >> i used to be you. >> i used to be you. what do we do? >> the key thing we do is ask ourselves why is this a problem in our country, you know, you look at japan, you look at tokyo, they have virtually no homelessness there and what is the difference? they don't have stacks and stacks of regulations that keep you from being able to use technology, we have some very innovative people in our country who have come up with -- with

modular homes, tremendous advances in manufactured housing, tinny homes, there are a whole host of things that could be used, you know, think of yourself as a millennial or a young person maybe coming out of college and, you know, getting your first job for $50,000 a year, you can't afford anything here, forget about it. but if we had those other alternatives you'd be able to get into it, built some equity, move to something else, that's one of the things that we have to do, the other thing we have to remember is it's not just a matter of throwing money at this, more and more vouchers and more and more services, also a matter of getting people out of the system, giving them the tools, hope to go retool them so they can function in a more sophisticated society that we have now before all you need it was before a strong back and willingness to work, that's not going to necessarily get it for you right now so we need to retool people because this is
