"fox news at night" will be there live from des moines as a result's role and throughout the night. and what about the senators who were tracking the impeachment trial here? instead of hitting the trail we will react to their campaign. chad pergram is standing by. looks like we finally get to this vote on whether or not we quit on wednesday so, why the delay and what will the weight of that moment the like? >> this will be a moment of history as they move from 4:00 in the afternoon. two separate votes on both articles of impeachment, abuse of power and obstruction of congress, they need two-thirds 67 votes and no one thinks they are anywhere close to that. the senators vote from their desk. they called her names alphabetically on the rise, according to the senate impeachment rules they are supposed to declare guilty or not guilty. now in 1999, the late senator from absorbing out arlen specter said not approved, not

guilty. but we will see how this vote will go on wednesday afternoon. i would start to look at some potential crossover vote. on the democratic side of the aisle i would look at kristen cinema. you remember joe manchin from west virginia, he carried his state by 42 points and doug jones has a very competitive reelection this fall. on the republican side certainly look at lisa murkowski of alaska and mitt romney and susan collins of maine. susan collins of course a facing us tough reelect as well. >> shannon: what will it be like having the state of the union now? it will have to go off in the middle of this with the vote not taken. >> this happened before, same thing happened at january 19th, 1999. democrats thought this might be a good way, what's good for the goose is good for the gander. and that said it, some republicans were upset that they

weren't able to get an agreement to finish the impeachment trial tonight or over the weekend. and this is a couple of comments from republican sources. it's the best deal mitch mcconnell could get and finally it will be over. it's a terrible thing. republican senators should have stayed in on saturday and they got rolled. the white house director of legislative affairs eric ewell and is putting a different spin on this indicating it's to the advantage of the president to have state of the union one night and then go to the verdict on wednesday afternoon. he says it's a strong one-two punch, both help bring the focus to the present successes. >> shannon: there has been a question. we have talked about many times during the trial, if it got to a tie, with the chief justice have to weigh in? >> we have an answer to this. in 1868 the chief justice, he voted twice on three tie votes. a lot of people said, could you

do this? technically the vice president is supposed to be able to break the tie but that's not the case in the senate impeachment trial. listen to what john roberts said from the day is tonight. >> i think it would be inappropriate for me to assert the power to change that result so that the motion would succe succeed. >> the the sun it works on precedent. with this ruling by john roberts they have a new president and if there is another senate trial at some point involving the impeachment of a president, we know the answer. can the chief justice vote or not? he can't. >> shannon: chad pergram, another historic day. get some rest. the president was called tonight, pleased that the impeachment trial would wrap up with no more witnesses or evidence. now the commander in chief is turning his attention to the tuesday state of the union address. kevin is here with his latest reaction.

>> white house sources telling fox news that they expect the president to strike an optimistic tune, cottone. in his final state of the union address they say expect a heavy emphasis on america's economic successes and an incredibly bright future a lead of course by the 25th president of the united states. they are saying the speech will be positive and unifying. that's what aides are telling us describing the upcoming remarks. tuesday's address on the nation is meant to shine a spotlight on administration's recent successes with particular emphasis on the blue-collar boom, supporting working families. lowering the cost of health care, safe and legal immigration system and protecting national security. but with a cloud of impeachment still hovering overhead, it's less clear what, if anything, the president might say about the democrat led impeachment which, as you just heard chad point out will be dismissed by an acquittal likely in the senate on wednesday. while white house officials were measured in the reaction to the senate's vote today on more

witnesses, the president was still fired up. let me take it to twitter. he said no matter what you get the democrats in the end, it will never be satisfied. he went on to add in the house, they gave us nothing. mike pompeo today vowed that the trump administration would not waver in its support of the ukraine despite intensive a bit of politicals strain in the alliance and impeachment saga all began. everything should be wrapped up we are told by wednesday. and i can't come soon enough say white house officials. steve linick kevin corke, a rainy night at the white house. three major breaking news events happening over the course of the next few days. the iowa caucuses, president trump state of the union it address and then the final trial impeachment vote on wednesday. joining us now to talk about that, michael lee who also sits on the senate judiciary committee. both sides sound a little dissatisfied tonight. i'm hearing from democrats who

say this whole thing is been a sham, we never got any of the witnesses or evidence that we thought we needed to complete this. on the other side a lot of people on the right are asking, what the heck happened, why wasn't this resolved before the state of the union? >> we all wish it could have been and perhaps it should have been. we were told we couldn't get it done between now and then end in the meantime this is the victo victory. it's a huge victory that we got this evidentiary behind us. i know the democrats have presented this kabuki theater and saying we need to have new witnesses. we have reviewed hundreds of pages of briefing and thousands of pages of evidence. we've had the proceedings that we need to have. we have satisfied our duty as the trial court of impeachment. >> shannon: i want to give you a chance to respond to one of your colleagues who does not clearly feel the same way. senator liz warren who is also running for the presidency tweets this. senate republicans just failed the american people and broke their oath to the united states constitution. we talked about how much you love the constitution.

tonight she says you trashed it. >> she couldn't be more mistaken. it's very important to honor the rights of the accused, as she knows of all people. a former law professor. she should respect the fact that we are looking out for the rights of the accused. donald trump was incorrectly accused of a lot of things and we honored his procedural rights in a way that the house of representatives always refused to do. tonight, we made good on that promise to do right by him, to do impartial justice. we concluded appropriately that we don't need to have any more witnesses. after all the witnesses and all the evidence we've received, there's no need to do that. >> shannon: is what senator blumenthal had to say about what the trial really means. >> i was so deeply disappointed and dismayed, there is no vindication here, no victory for the president. there is a court of appeals which is the court of public opinion. we have to take our case to the voters in november. >> shannon: a couple things there. you know the left is saying

there's always going to be an asterisk on this. and secondly how worried are you about the fact that -- there will be campaign ads made out of this and they will be used to run against you guys this fall? >> there are and they will lose. i think the american people see what we see. the american people especially america's hard working poor middle-class americans are doing more for the economy. they are also saying the president has been unfairly accused. one thing americans don't put up with is bullying. they are tired of bullying and tired of seeing president trump being bullied. we will not let that happen. >> shannon: it's of the issue of this not being a real trial because it were not real witnesses and documents? >> let's take every trial court in the federal do judiciary. and yet most proceedings whether they are civil or criminal come before the trial court don't

culminate in a full-blown trial because the courts don't have the power or material dispute in the facts in front of them. there is no need for any additional evidence because it wouldn't change any material fact before us. >> shannon: what we've been hearing the last couple of weeks, it is the senators on trial. "the washington post," their editorial board under the headline "the cringing evocation of senate republicans" writes s. mr. trump's relentless stonewalling end of complicity can take some comfort in the prospect that most or all of the evidence the white house is hiding will eventually come out. they talk about john bolton's book and the fact that we will know more in a few weeks. they say, we can only hope that voters who wanted to have evidence in the trial will respond by showing incumbent senators that they are a force to be reckoned with. how do you respond, you are the one that is on trial here and at least part of the mainstream

media doesn't like the way that you performed? >> i know the journalist wing of the democratic party, and it's not my place to presume. i get it. but the american people aren't aligned with them. that statement reflects a real arrogance and simultaneous arrogance. ignorance. if there is evidence they want out, adam schiff can still go get it on his committee. i think it's foolishness but they can bring other impeachment proceedings if they want to. it's only going to secure their own political detriment. but they are wrong to say that somehow this is the senate's fault and the senate is on trial. adam schiff and jerry nadler were on trial and they didn't fare well. >> shannon: thanks for popping in. u.s. officials believe the leader of al qaeda in yemen is dead killed by an american air strike. officials are reportedly waiting for confirmation before making a

democrats who are looking at the party and saying, wait a second here. what are our options? a socialist, a socialist and a socialist. there is major concern about the fact that the democrat party is filled with weak front runners. there's really no one front runner right now if you are looking at the individual states. so this is very problematic. i think for the republicans, when we have seen the fact that they have made these weak articles of impeachment something that doesn't pass or fly in the senate, i think the american people are saying, this was clearly a political sham. this is what we wanted to do, and the president gets to the next election in 2020 and wins.

>> shannon: how worried were you about the party nominating somebody who is openly a socialist by his own self-description and also, the fact that there are those trump supporters who who are more frustrated and angry, angry than ever about the way he has been treated by the media and the democrats? >> i think there's no question about that. the proud republican base looks more energized at the moment. and, we look at "the new york times" report, john bolton's book indicated he is in the room not only with the president but with the president's lawyer being told to have the president of the ukraine meet with rudolph giuliani. then we have the former chief of staff john calley saying this will be half a trial. 75% of the american people

including -- not a majority but a large segment of republicans want witnesses. >> shannon: but they may want hunter biden. >> we are talking here about bolton, mulvaney, people with direct knowledge of these even events. so when you hear senators like murkowski who said today that she could not vote to have witnesses because it's not a fair trial but you also hear rubio and others say, they behave inappropriately. it looks like they are -- >> shannon: a listen. there is plenty -- there are plenty of people given across the political spectrum, and that wrongful behavior is not becoming of the president. but to the issue of the dripping

of information, it starts to look suspicious. how many more things are they going to read in "the new york times"? >> it's not about "the new york times" at this point. and we talked about overwhelming evidence that they had it, they had a very weak case. these house managers wanted the senate to basically expand their impeachment role, meaning they wanted them to listen to additional witnesses. it's the job of the house of representatives to basically move forward on this impeachment inquiry. it's not the job of the senate, that would set up a very dangerous precedent for the senate and so the house instead rushed to process. it was a partisan process and, now all of a sudden they are trying to throw it over to the senate to say, we all have to

listen to additional witnesses. even those moderate republicans, they basically said no way. but for the president -- this has been away in the end we need to turn the page and move on. the american people are tired of the democrats continual abuse of power in terms of what they have done with this impeachment and how they tried to lower the standards of impeachment. >> shannon: all right, one? close us out. >> i think the real tragedy here is that we have allowed the president to obstruct justice. i think it's a case that not only has the president did not testify to himself and said here, i didn't do anything wrong -- >> the house didn't even give him his due process rights. if that's the b.s. >> but as a

going to go for witnesses, for acquittal, we are still not there yet. especially with the newest senator. did you feel that? >> i certainly did. i fell up a notebook and a half taking notes making sure the president got a fair trial that he deserved that he did not get in the house. i think at the end of the day both articles fell woefully short of proving any kind of crime, and also raise a lot of questions about the conduct of the house managers. what happened with hunter biden. it just opened up more questions for them. >> shannon: we have a debate with one of our legal panels later t two. congressman doug collins from georgia who has been a huge support of the president has decided he wants to run for the senate seat as well. it's not a traditional primary for the seat, it's one of these jungle primaries. he's taking some hits and criticism but what do you make of this now that you will have

two strong republican voices, but a very vocal congressman hereto, jumping in? >> certainly on the president's biggest defender and supporter and i will be working hard to advance his agenda. in fact, i came into politics only a month ago like you said and eight weeks ago i was running a company in the private sector. i saw the work that president trump was doing and we have this blue-collar boom, setting all kinds of employment records and fighting for national security, taking out terrorists and securing the border. there's so much good work going on that i was so inspired to come into this role, i'm going to fight for georgia and i'm going to run to win in 2020. >> shannon: so you know you have skeptics. the president was in favor of congressman collins and the president chose you. there are questions about some of the thought you were too moderate for some of the republican party. chris so lisa riding this, about

your critiquing mitt romney and his decision this week saying, leffler shows to tag and the tweet to do everything he could to ensure that he saw it which raises the question, why? leffler needs to prove to conservatives that she can be just as as collins. >> i'm a strong conservative woman and i think that may be something that intimidated people that wanted to challenge me on that narrative is completely false. i take issue with it. in fact all my votes have demonstrated so far exactly, i'm doing what i said i would do. i signed on to three pro-life bills on the first two weeks so my actions will quickly prove out that that narrative is wro wrong. >> shannon: senator, it's great to have you with us. the final countdown for the first in the nation iowa caucuses on intimate new polls show that bernie sanders and

joe biden are virtually neck and neck. marcus live in des moines. good evening. >> only a few hours left for the candidates to really build up the momentum ahead of monday's caucus and a lot of these candidates are eager to shake up the leaderboard. this is the latest poll we are seeing from nbc "wall street journal" giving us an idea nationally about how democrats feel about the 2020 race. bernie sanders is ahead, but only slowly and followed behind by vice president joe biden. we are watching to see those other front runners including elizabeth warren, pete buttigieg and amy klobuchar. we will see if the results in the caucus mirror what this poll is showing nationally. because of the impeachment trial happening in washington come bernie sanders the front runner hasn't been able to be on the campaign trail here in iowa the last couple days. today we saw his wife out on the trail teaming up with documentary filmmaker michael moore. the two spoke to a crowd earlier today and they said that sanders is ready to be there.
