to use the football analogy, mcconnell in the open field with no democrats left to impeach. yesterday the senate said they heard enough, republicans did not fall for chuck schumer's witness tricks and president trump will be acquitted next week. big win for the american people. you did it. even cnn admitted it. >> trump won, he is going to win this trial. he won on the issue of witnesses, he will get acquitted and that is how history will remember what went on here. jesse: nancy pelosi still cannot face the fact. >> he will not be acquitted, he cannot be acquitted if you don't have a trial, if you don't have a trial if you don't have witnesses and documentation and that. jesse: actually, nancy you can have a fair trial without a crime either, here is ted cruz with his/her castaic clap right back at her.

>> i never knew that. we will let ted cruz slide since he's been forced to watch adam schiff to week. the democrats, two articles decimated. and never should've been brought, no abuse of power, no construction just like mueller investigated the crime that did not occur. no collusion, no obstruction. in three short years trump beat hillary, mueller and impeachment. the democrats keep whining accusing him of cheating and saying it does not count. do you think it's the chiefs will do that if the niners win tomorrow. of course not they will do it again next year. something tells me the democrats won't. >> do you believe as john said on our air because of that they have now essentially made donald trump into a team? >> yes now what we have is a

constitutional monarchy, our constitutional hypocrisy where donald trump is the supreme element of the state like north korea. [laughter] jesse: msnbc is not taking this well. that is the new talking point on the left, he is a dictator. sorry liberals he is your president, the house voted, he went to court, hire lawyers, both sides made arguments, the senate voted, we the people state-by-state but the senators there. the republic is strong, the system worked. trump is not above the law, but he is not below either. thanks to the framers of the constitution. the democrats say they care about that document. but this democrat does not. >> i don't care what nice little legal constitutional thing they came up with. jesse: nice little legal constitutional defenses

pre-choose a u.s. senator. the u.s. senator on camera says she does not care about the law. she does not care about the constitution. not a good look hawaii. that is on you. chuck schumer needs to get her off the screen but he already has his hands full over there. here is the minority leader scolding, harris. [inaudible] jesse: senate democrats get it together guys. i will just warn you it is never over with the left. i cannot wait to see what they try next, wiretaps, impeachment shutdowns and fake news, meanwhile president trump's undefeated. here he is hitting a little exercise this morning, still not tired from all the winning. his reaction.

>> alan dershowitz a member of president trump's impeachment defense and the author of guilt by association. professor dershowitz before i talk to about abuse of power article which i think you decimated very effective. you take this down to the senate chamber, you are there, the chief justice right above you and you are face-to-face with adam schiff and the democrat managers. what was the color down there, were there a lot of dirty looks between each sides? >> there were were there. >> the name of my book is guilt by accusation you can get on kindle for $1.98 per thank you fermenting it. this is the second time i was on the senate floor. the first time i was there i was representing the democrats print in the democrats love me and that's not the case now because

i was defending the constitution and the person i was defending on behalf of was donald trump. there were dark under dirty looks but after i made my main speech which was one hour and five minutes senators walked in including democrats one of the managers lawyers and praise me for my speech that i had educated them and one said i swept them away. it's all inspiring, they all paid attention. some of them were giving me scowls as they replace the constitutional argument. jesse: who is giving you scowls can you name names. >> yeah i would say bernie sanders gave me a scowl. [laughter] >> hypothetical, a democrat gets elected president in a democrat says to the israelis quid pro

quo you're not getting a nickel of the allocated funds unless you stop the settlement. i made that point looking at sanders and he looked at me giving me a scowl it wouldn't be illegal would be foreign policy even though it was a quid pro quo. >> that is interesting. even though you are totally on the other side some of the democratic senators and lawyers for the house team came up to you and said you did a very nice job. that is good to hear because it's respectful. because of you, the entire left-wing media and a lot of people on the democratic side of the house and the senate are saying you are responsible for making the argument that president trump is king, a monarch all because of your argument, what do you say about that. >> they deliberately and willfully misinterpreted my argument because they thought i was effective with senators. i said a president can be in

impeached to treason or bribery, that was my argument and then i said just because he committed noncriminal conduct and may have been motivated in part by politicians by looking at his reelection, that mixed motive cannot make it into crimes so they misinterpreted that saying the president is king and he can do anything. i never said and i don't believe in its ally to say i said the president can commit crimes because he thinks it's in the public interest rate that is nonsense. the former press secretary to bill clinton said my arguments were like hitler, stalin and mola lenghi because i said a mixed motive which every politician has is not enough to put 70 in jail or the duly elected the president. others who do look under deliberately misinterpreted.

jesse: i don't know if they misinterpreted or not smart enough to understand. i'm sure the president called you and thank you for the service that you did. thank you very much. >> as i said he thanked me and said i did a lot of good for the country and as i said in my speech i was on the floor, i love america in the constitution, this transcends any individual and it could impact any future president. jesse: professor dershowitz thank you very much. let's break down the winners and the losers of the impeachment trial. we will begin with the winners from that we go to former arkansas governor mike huckabee, judiciary committee member in florida congressman member and acting attorney general matt whitaker. let's start where we left off, the white house defense team

with a lot of legal firepower and any fair-minded person looking at the presentation has to say they made very effective constitutional arguments and the democrats did not stand a chance. the president should be very grateful. >> he absolutely should be grateful but i think we are all grateful. i hear people talking about the winners, losers, the winners are the american people in th the rl winner is the constitution and our system. it worked. these guys in the house, adam schiff to jerry nadler in particular are not going to be able to railroad a president out of office when he is on the ballot about to be reelected and what now i believe will be a landslide. so the winner is ultimately our system. jesse: the democrats did not handle a loss very well. imagine how they will handle a landslide. congressman gates, i said that at the top of the show, the

constitution was protected and the american people are all winners. but i believe mcconnell is given a lot of credit here. he had senators up for reelection and he really guided this thing. sure very, very effectively and i think he deserves a lot of credit. >> there is natural tension between the house and the senate and often has house members pulling their own hair out about the tedious nature of mcconnell. but in this case he was masterful and mat managing throh the process. this began with a bipartisan vote against impeachment in the house and because of the work of mcconnell and dershowitz and others issued in with a bipartisan vote. but in question would be the milk, it's only a thing you can drink besides water. they would never work again but they should've had orange juice available because then the

president could a secured wisconsin and florida of the electoral college if he had milk and orange juice. >> freshly squeezed only the best for "watters world". whitaker, the president has defeated hillary, mueller and now impeachment and has the wind at his back, what do you think the white house, the trump administration has learned after three years of the very intense complex. >> having served for this president and seen him on thursday and i will, what i know about this president he is working as hard as he can to accomplish the agenda and ignoring the distractions. everyone has said he is obsessed with the mueller investigation, obsessed with the impeachment but at the same time the economy is going well he passed agreement that will bring billions of dollars to my home state of iowa and really billions of dollars of money to

our economy. he will continue to soldier forward and accomplishes agenda but he ran on and once an opponent is identified he will be contrasting himself to an opponent whether it's sleepy joe biden or any of the other ones. jesse: governor huckabee, the state of the union address next week, what items do you want to see the president define for a second term? >> i think he just goes there and kicks off all the things he has done. when he kicks off the accomplishment, the economy, trade agreements, standing up to iran, standing with israel, standing up for life, the things were most proud of as a president when he kicks those off he will kick off all the people on the left. it'll be a delightful evening and i cannot wait to see it. jesse: i am sure. how should he engage the ford guy not here in miami. where are you.

>> it's deeply tragic that you're here in miami and i'm here in washington, d.c. where it's winter. i have no idea how the universe allowed this to happen. jesse: finally you drew the short end of the straw. thank you very much. coming up to a footballs biggest legends preview the big game and later is a city of miami down with impeachment? >> what's going on with the impeachment? weak. >> i get it i'm totally with it and that's because were in miami. in his huddle is senator feinstein where he supposed to be as attorney general for hillary clinton, i get it. can you put together a speech, yes, but what he did if you listen to what murkowski said he caused his own demise. murkowski said how would it help for this to continue, for this to continue and all he had to do was sure there would be an end in sight instead he showed us another 40 weeks of them staring at their heads and looking straight ahead and wondering when bernie was going to comb his hair. and the answer was he never will. and he was scowling the whole time he was making the argument. jesse: when he does not scowl -- that's his resting phase.

the media had suicide attacks of the democratic party leading them over a cliff, everything they want fails and this is another example. let's talk about the left wing of the democratic party, we are going to show you divisive ugliness. watch hillary clinton get booted and watch michael moore let it rip. >> i watched the debate in iowa two weeks ago, the all-white state and the fact that the democratic, the dnc will not allow cory booker on that stage and will not allow julian castro in the allow mike bloomberg because he has billions. >> someone by the name of hillary clinton said that nobodo boo -- >> no i will boo, boo. [cheering] as you know i cannot be quiet,

no we are going to boo. >> the haters will shut up on monday when we win. jesse: hillary, the dnc and you feel bad for them don't you. >> no i don't. this is exactly what we've always said, the republican party really is the party of tolerance. this is what president trump has absolutely eliminated like nobody else before has. we are showing it truly is. jesse: he is the most tolerant president ever. >> he really is and he has shown that. >> it's his best quality. >> not many. >> and he has a long history of showing that. jesse: i would say on the democratic party in particular, cory booker is not on the stage because nobody wanted him on the stage. if he had earned it, if there
