familiar with bail. is the concept of bail and the requirement someone stay in jail if they don't make bail is unconstitutional and unfair, and as a result people are being freed to reoffend. some of them aren't even coming back. what do you think should be done about this? was this something you had to deal with when you were attorney general? >> when i was a career prosecutor, thank goodness we had great judges like you who would look at the facts you are supposed to look at. if someone is arrested, you have to look at what you said. if they are a flight risk. someone with 138 prior arrests? they are a flight risk. you have to look at if there is a victim involved, if they could harm the victim. the number one thing is if they

are a danger to our community. this isn't political. it should be about whether we can keep our citizens safe. our police officers safe on the streets, and whether someone will come back to court. judge jeanine: the purpose of bail is to reassure the return of the offender. dangerousness is not one of the criteria. should bail be readjusted? they are loosening it up. instead of saying if you are likely to kill someone as the opposed to giving them an order of protection like we witnessed in new york, ms-13 gang members. and the prosecutor had to testify against the defendants, he ends up dead. so it's all going against the

judge jeanine: you know, i know you are a special advisor to the president within the office of white house counsel and you can't comment on prosecutorial decisions. but there was something that got a lot of people frustrated and that's the decision by the department of justice to not prosecute andrew mccabe who was found by the inspector general to have falsely testified or sworn under oath, and on the other side, and a decision made to not prosecute him. and on the other side, roger stone, that same department of justice made a decision to recommend the sensing of 7- -- the sentencing of 7-9 years. i know you can't comment on the prosecution side of it. but is there any question in your mind that 7-9 years for

the department homeland security to having access to their dmv data bases which are critical to conducting law enforcement and national security work for the department of homeland security. it's amazing that one of the three states like mine, virginia, that was hit on 9/11 is walking backwards on this critical information sharing. but that's what they are doing with their political virtue signaling. judge jeanine: what is the information the federal government could access from those records that would help you decide whether someone is a danger to the rest of us? >> there are a number of things in that data base. first of all, simply confirming if you have a driver's license whether this is real and this is actually the identification, the identify of the person in front of you if you are a law enforcement officer. or look up witnesses in an

investigation. if you couple on a vehicle, knowing who owns that vehicle, or are there any warrants or are there any warrants. the most dangerous thing law enforcement does is couple on a vehicle they that have pulled over. it's a very dangerous moment for a law enforcement officer. finally, all the updated criminal information, warrants, temporary restraining orders, people who committed domestic violence. all sorts of things are contained in that date today base. and they tell us whether that person can be a trusted traveler, and b whether if they are who they say they are. and whether they are dangerous to that law enforcement officer. there is an awful lot that comes through that data base. judge jeanine: the consent of this when it comes top sanctuary

cities. you have the liberals on the left not allowing law enforcement to access information so you can protect the safety of innocent americans is absolutely stunning to me. i understand that the president has just recently decided to take some of the border patrol off the border and start sending them into the cities to assist in some investigations. >> so a number of different law enforcement officers you will see supporting i.c.e. and their efforts to do removals and enforce immigration laws of various kinds. cbp partners with ice and many other areas is the ones you read about most recently. it's not that unusual. but we are looking for any way we can because it is a priority for the president and this white house to expand our ability to enforce immigration law.

judge jeanine: i was looking at the cost. it says fair study in 2017 found illegal immigrants are a net consumer of taxpayer benefits worth $100 million a year not including the cost of enforcing the border. the american medical association found the immigration insurance program $200 billion a year in emergency treatment and $1.2 billion in infant delivery expenses. we can't afford it. >> it defeats their goal of letting them all in and he raising our border and our sovereignty. there are real costs. you talked about some dollars. there are human costs. there are all of these crimes in

coming out of iowa and new hampshire, joe biden is sinking fast. >> before he even announced he was running, i was never nervous about joe biden. he doesn't connect with. he the way donald trump does. what does it mean for the polls that are apparently so accurate. joe biden has obviously had a lot of gaffes and ground he has to make up. but i don't think he connects with people. it felt almost to me like somebody said to him, you have to be more donald trump than donald trump. yelling at people and getting angry up there. but it didn't work for joe biden. third type is not a charm for him and it won't work out.

judge jeanine: when you talk about bernie sanders, you know socialism is part of the fight. with buttigieg, what is his message in what are you fighting? >> we don't really know because he hasn't made himself clear on' of anything other than i can beat donald trump. their only mess and and only platform is i can beat president trump. if that's all you are running on, i don't think you will get the american people behind you. i don't think the american people would rally behind a socialist. but they are running to beat donald trump but that is their problem. they have nothing to run on but look at what donald trump has actually done. judge jeanine: then you get into michael bloomberg. he has endless amounts of money.

he's willing to sing it into his own campaign or anyone else's campaign because he doesn't want donald trump to be president. who is willing to put hundreds of millions of dollars into defeating donald trump? >> i think he could take a page from 016 and ache a look back that it doesn't ultimately matter. you are not a good candidate, it doesn't matter. in 2016, hillary clinton had so many more money that donald trump. the base of that party that is anti-capitalism and doesn't like millionaires. this an old rich guy buying his way into the democratic nomination. that won't sit well with the
