>> the countdown is now on in nevada. democratic presidential hopefuls making their final push in the state today. now just hours before the caucuses begin. the candidates, they're fighting for 36 delegates today and the big question on everyone's minds now, is this process going to go smoothly or is it going to be an iowa 2.0? we'll find out as the day progresses. welcome to america's news headquarters, great to be with you leland. and with everyone at home, i'm gillian turner. leland: seems like you would have to try to get it to go

worse. gillian: try hard. leland: and moment of the candidates hoping to gain a momentum. one big name who is not bothering to compete in the silver state, not on the ballot until super tuesday. peter doocy is on the ground in las vegas tracking it all. just 9 a.m. in las vegas there, peter. >> leland, las vegas is all about hospitality so the candidates want support from the members of the culinary union and they don't want support from russia. that's what bernie sanders has been getting in some way based on being briefed from the u.s. government. sanders says i don't care frankly who putin wants to be president. stay out of american elections and as president i'll make sure you do and this is something that elizabeth warren is weighing in on as well. >> so, no, we have not received such a briefing. i believe that we need as much

transparency as possible and this is about disinformation and the way to fight disinformation is to call it out and show what it is and give everyone full information as quickly as possib possible. >> vegas and clark county is where a huge chunk ever the vote will be cast, but amy klobuchar is working a few hours away in elko. >> why is she going to this down with a small population today? what i'm doing is not leaving stones unturned. i'm not helping half of america, but representing all of america, not just where it's easy to get to, but not where it's always comfortable, but where it's uncomfortable. >> michael bloomberg is not on the ballot here, but some of his ads have been running on television, like one tying him to barack obama and joe biden

weighed in on that last night. >> and by the way, it's amazing we found out how everybody is barack's best friend now? man, i look at all of these ads, it's amazing. i wonder where the heck they were when i was vice-president with him? >> so tonight, democrats will crown a third winner, the entire crop of candidates is trying to join pete buttigieg and bernie sanders as victors in february. leland and gillian. leland: and peter, we'll start where you began, with-- you said hospitality, a big part of the hospitality union out there, the culinary workers were not exactly pleased with bernie sanders and his health care proposals earlier in the week. is that rift gotten ironed out or they're expected to play a big part in the caucuses? >> they'll play a big role because a lot of the caucus belongs to the culinary union. it's about health care with that

endorsement. they've carefully negotiated benefits. we went to their hospital here in las vegas, members of that union have their own hospital. it's a very nice facility. and there is concern among leadership that medicare for all could gut all of that or strip some of those benefits and so they will play a big role, but in terms of officially backing a candidate at the last minute, we don't expect that to happen. leland: all right, peter doocy on the strip in las vegas as the town is waking up. back to you later in the show. thanks, peter. gillian. gillian: from the vegas strip to the white house. president trump is weighing in on the democratic race to the top, sounding off yesterday evening against several of the candidates in his las vegas rally. david spunt is there at 1600 pennsylvania and he has the latest on what the president is thinking. david. >> good afternoon to you, gillian. president trump at the white house today where we're told he will spend the day tomorrow. tomorrow he'd head to india to meet with the indian president

modi. he has an interesting back in the united states, he spent several days out west in colorado, in nevada and also held a rally in phoenix visiting some of the very states where democrats are having primaries and caucuses. now, president trump is visiting those places, it's not a coincidence and he spent time in nevada before today's caucus and a rally yesterday in las vegas the president took time to bash democrats and tout his own agenda, listen. >> with your help this november, we're going to defeat the radical socialist democrats and we are going to win nevada in a big beautiful landslide. >> president trump also taking aim on twitter at the caucus system in nevada. remember a few weeks ago, the caucus in iowa as leland was talking about, did not go as planned after the app used to count votes went essentially bust. and the president hinting the same may happen and the democratic party in nevada may

make it clear. they're use ago completely different technology so things should go smooth today. i'm told to expect president trump and an administration official said to visit some of the states where the democrats are going. it's not a coincidence. he was in iowa before the iowa caucuses and he was in new hampshire. will he be in south carolina, some of the other super tuesday states? you could probably expect so, though we don't have the official schedule yet. and something else that president trump said, gillian, he plans to old rallies, after, if he gets reelected and he's expect today get reelected. if he gets reelected he wants to hold rallies and he says he enjoys them so much. back to you. >> david there are no coincidences in politics. >> none. >> making sure our viewers are clear on that. david, we'll check back with you next hour, thanks. leland. >> president trump tweeted a message to democrats in nevada today warning about the possibility of russian election interference. this as bernie sanders tells russia to quote, stay out of the

ambassador to germany has been appointed. we'll see if mr. grinnell addresses the press on this. gillian. gillian: joining us for more on this former deputy secretary of state for strategic, and you may have heard of him because he was hillary clinton's senior advisor for the last general election. so, philippe ryan, it's the day of the caucuses and the leading story or most recently developed here is the russians interfering to help bernie sanders in in democratic primary. does that surprise you? >> no because it's a little bit of a groundhog day. if you remember, our intelligence community at theened of 2016 when they announced it at the beginning of 2017, wasn't just that the russians were making an attempt to hurt hillary, but they were also making attempt to help donald trump, but they were making an attempt to hurt marco rubio, to hurt ted cruz and to help bernie sanders, meaning they were doing everything they

could in the primaries to help hillary, to hurt hillary and help trump. kristin: are you trying to make the argument. >> running the same play book. kristin: they're squarely anti-bernie, the russians. >> they are pro trump. first of all, they're pro chaos. kristin: they are pro chaos. we could argue whether they're pro trump. >> they're pro chaos, they love the fact that you and i are discussing right now to what extent they're trying to sew discord in our democracy. they saw what happened in 2016 worked so well, forget whether it helped donald trump or hurt donald trump, the fact that three, four years later we're talking about it and they did that on the cheap and didn't spend all that much money to really screw around with. gillian: to me we know-- the intelligence community has been telling for weeks now that the russians are trying to meddle in the 2020 presidential election. does it surprise you they're footing around in the primary?

in the democratic primary? >> it doesn't. gillian: more granular level in politics. >> it doesn't. what surprises me is that bernie has known for a month and decided know the to share it. that i find odd and somewhat irresponsible for a couple of reasons. first, this should be a team effort. this should be a bipartisan effort where today is the 40th anniversary of the miracle on ice. you weren't born, i thankfully was too young, but it was the do you believe in miracles when we beat the russians. somehow 40 years later we're talking about half the country not believing the russians won't do any harm to us. bernie should have told either his competitors or the dnc or someone to say being on the lookout and the real problem is if you remember, the last two weeks, we've been talking about bernie's online supporters and whether they have been too aggressive. those two things are connected and that's problematic. gillian: but this is much bigger than any one candidate, bigger than president trump, it's

bigger than bernie in this case. that story about meddling in the dnc process combineed with this iowa caucus app debacle, it's shaking a lot of voters faith in the democratic apparatus. >> don't forget bernie is someone who is very inclined to run around saying the process is rigged. gillian: right. >> and it sounds like the russians are trying to rig it, soap he should be more vocal about it, but, yes, it's very scary. look, our election system is pretty screwed up. even if iowa on its own just had a bad app, this shouldn't be happening. what happened in florida in 2000 with miswritten ballots, that shouldn't happen. we're hanging on by a thread. we don't need a foreign adversary who is like tipping us over to make this. and again, it would be great if everyone set aside the intent of the russians and just looked at the way you said it, they are trying to meddle in our

elections, and we should all be terribly concerned about that, and we should be fighting that. gillian: all right, you're not going to get off the set without answering a question about your former boss. >> i'm not going anywhere. gillian: listen, i'm going to read this tweet that you put out yesterday, you said, maybe the best person to beat bernie this time was the person who beat bernie last time, that being hillary clinton. are you-- i thought we put this issue to bed. is she getting back in the race? we had this conversation last week about maybe she was going to be the vice-presidential nominee. what's going on? >> well, you know, the window is closed. if someone were to jump into the race whether hillary clinton or gillian turner, you'd only have enough time to probably get your name on the ballot in guam and maybe a couple of other territories. so there's the crazy aspect of being drafted, but that's not going to happen. my point was over the last four years, people have been saying she was a terrible candidate, she shouldn't have been-- turns out campaigning is hard.

turns out debating is hard and raising money is hard. winning iowa is hard and winning the nomination is marred and she should-- maybe she did better than people think. gillian: speaking of raising money. tell me what you thought about bloomberg, our last question, on the debate stage, his performance has been widely panned. >> he shouldn't have been on the debate stage, i've been saying to for weeks. when you go back to november when bloomberg first jumped into the race as soon as he said he wasn't taking contributions this was an issue because you can't make the debate stage in the democratic primary without doing so. and he said look, if the rules let me debate, i will. if they don't, they don't. this is not a man who wants to debate, he could have written a letter in novi to the dnc, i want you to change the rules. if you're going to present yourself as the answer to donald trump, you have to be able to walk the walk, not just talk the talk. what happened the other night, and look, i know some. people who work on his team, he's got the smartest people in

leland: by tomorrow we'll already be looking ahead to super tuesday as voters get ready to get to the caucuses in nevada. and casey stegall is live in el paso where bernie is taking the stage. hi. >> good to see you. yeah, bernie sanders obviously wasting no time at all. he is really starting to shift his focus now on states like california and texas here because obviously there are a huge number of delegates up for grabs and he wants to try and work and build on this momentum that he's enjoying, but there's also something else really important going on here. trying to reach early voters, because early voting here in the lonestar state, got underway last week, and it will happen all next week up until super tuesday, about four days before super tuesday and about half of registered voters in the state of texas cast their ballots

early. so it's crucial for the campaigns to reach those people now. now, last night in nevada, sanders took a shot at president trump's economy and he's expected to deliver much of the same messages across texas. >> it's not just a rigged economy. the american people regardless of their political views understand that we have a corrupt political system. that's it. what our campaign tries to be is honest, to take the difficult issues and put them on the table and not hide them. >> now, bernie sanders will head to san antonio tonight after he visits el paso and this is a while wind tour. 's going to be holding a rally before the nevada caucuses actually close and tomorrow, then he's moving on to houston and austin, where he will be holding similar events again,

all aimed at trying to harness the energy for those oh, so precious texas delegates and texas, by the way isn't winner take all, they're awarding proportionately by district. and large districts, again, there's a lot of chance here for these democratic presidential hopefuls to swallow up some big delegate counts that night. back to you. leland: we will quick, casey, any sign of beto on the campaign trail for anybody in texas? >> not at this point. and it will be interesting to see if he may be makes an appearance here in el paso. we're, of course, in his hometown. we don't expect that he is going to throw his support behind bernie sanders, but stranger things have happened in the world of politics, i suppose. so anything is possible at this point, but rally now five hours or so from starting here and you've already gotten the people starting to line up. the barricades are going up and a lot of folks are excited to

>> developing now, greyhound bus services joining other major american bus companies in blocking border patrol agents from boarding buses to do immigration checks if they don't have a warrant. garrett tenney has been following the story since early this morning, what's the latest, garrett? >> this is important, it's something that border agents do on a regular basis. federal law gives them the right to board buses within 100 miles of the border and ask passenger about immigration status. and up until how greyhound says it had to let that happen and now border agents will no longer be able board without search warrants after a memo that says they couldn't board buses

without a warrant or permission. greyhound says our primary concern is the safety of our customers and team members and we're confident that these changes will lead to improved experience for all parties involved. the administration is seeing its first signs of success on another immigration enforcement front targeting sanctuary jurisdictions. ice's latest strategy is to issue administrative subpoenas to state and local agencies for information on individuals who were arrested. on friday, the san diego county sheriff's department announced it will respond to the subpoenas its received despite strict laws limiting cooperation and says in a statement while the sheriff's department does not enforce immigration laws, we are obligated to comply with lawfully issued subpoenas. the information requested by the subpoenas released to the providing of documents not honoring detainers and transferring individuals to ice. ice has now issued similar subpoenas to law enforcement agencies in colorado, connecticut, new york, oregon where five subpoenas were served

friday in the acting field office director said, ice will not be governed by dangerous sanctuary laws and community leaders who put politics over public safety to interfere with our mission to remove dangerous criminal aliens from the community. one thing about these subpoenas that's important to point out, they are administrative subpoenas, meaning they're signed by immigration officials not a judge and that's an argument we could see play out if this ends up going to court. gillian: the most surprising part to the story i didn't realize immigration officials did that in the first place. >> got on buses within 100 miles of the border. gillian: thank you, garrett, appreciate it. leland: more on this with the former acting deputy secretary and immigration services, ken cuccinell cuccinelli. do you take greyhound saying they're magnanimous about this or they're caving to pressure?

>> well, i don't know what brought it on. you referenced the long statutory jurisdiction of the border patrol to deal with the border. they don't just stand at the border on the international line to enforce the security of this country. they have to have the ability to do that in some depth and so, you know, it's a sad day to see something like this and hopefully #boycot greyhound will pick up and we'll see how it plays out. but we'll have some discussions with this. this is not something that they talk to us about before they made their public comments, so for us, it's ultimately about how we can all work together and the effectiveness of our law enforcement efforts. leland: noteworthy-- >> it isn't always about the rhetoric. leland: noteworthy they didn't talk to you guys first. if you broaden this out, is this an isolated incident? are you seeing other businesses

becoming more actively hostile towards ice and towards enforcement efforts that you have going on? >> this is more the political activist community, sanctuary cities effort is really more where it has been typically focused and you reported on some interaction with san diego sheriff's office and some the lawsuits that isis brought to gather the information that they need to do their law enforcement duties, imposed by congress, by the way, and you know, we hear a lot of congressmen who say they don't like them, but they don't do anything to change them. they also don't do much all the time to help us actually enforce that law. but ice has done a good job of plowing ahead. we have a lot of local and state partners across the country and it's just very sad to see this politicalization of law enforcement. the president commented on it in the state of the union and says he's not going to stand for it as the president and personal

ultimately responsible for enforcing federal law and we're implementing that vision of president trump's, again, with all of the folks who are cooperating with us. and where they won't, we go do our job anyway. leland: garrett tenney reported that you all are now seeing the first signs of success on targeting sanctuary jurisdictions, last weekend, sir, that we were talking about the border patrol sending in some of their special operations teams into cities like chicago, like boston, like los angeles to help round up dangerous illegal immigrants and fugitives from the law. have you started to see some real success with that, any numbers you can share with us? >> i don't of numbers to share with you at this point. we don't typically share operational information until any particular operation is over. and, but i will say while the customs border protection officers got a lot of press for joining ice in their efforts, the reality is that other

federal law enforcement agencies partner with ice as well and they don't necessarily make the new york times. and those are just healthy relationships in the law enforcement community that ice has been participating in for a long, long time. and there are very good reasons for it. in addition to removing people here illegally and the priority as you noted are criminals who are here illegally meaning they've committed other crimes, but that isn't all. anybody who is not here legally is and has a removal order has been through the due process that they get, which is very generous in this country, is also subject to removal and those are done with local partners, state and federal law enforcement partners and that will continue. where we don't have that or they're standing in the way. ice will double down and do their job. they're committed as professionals to do their job as best they can. >> and one might think the stepped up enforcement might

have people leeching on their own. -- leaving on their own. and talk about the travel ban. reasonable, the first couple of weeks of the travel ban the beginning of the administration have, shall we say, some problems. and now adding a few new countries, kazakhstan, burma, nigeria, tanzania. take us through sort of the general thought process hyped those countries and do you feel as though you all are on stable enough legal ground that we're not going to have the same problems in roll out of travel bohn 1.0? >> remember how that ended up? it ended up in hawaii v trump and the chief justice writing the opinion for the supreme court said the president could hardly be on stronger legal footing. he has natural article two authority and congress passed the law that he's using.

we're on strong ground and all of these are targeted additions to what you call the travel ban, i use nigeria as an example. the president of nigeria used a blue ribbon, he didn't call it that to fix the problems that led to the security concerns that got them on that list in the fairs pla-- first place and he's committed to getting off the list and that's exactly what we want. we want the cooperative security with the other countries. leland: thank you for coming in and the beautiful blue ridge mountains behind you. >> we love it here in virginia. leland: and two hours away from the start of the nevada caucuses and candidates like amy klobuchar are scrambling to get the vote out. and henderson, nevada looks a little rainy there, high, griff. >> it is, indeed. leland. they'll open the doors in about 30 minutes. they know the eyes of the nation

the backup. they'll do traditional phoning in to headquarters and a picture of it and back it up with paper forms. only time will tell how that will go. and an official didn't want to go on camera and i asked how confident are you this will work out well? no i'm not because young people get involved and they don't have the experience. candidates are making their final push and their closing arguments as to why they're best fit to take on donald trump. watch. >> i'm here one more time to look you in the eye and ask you to caucus for you. >> every time somebody tells you a woman can't beat donald trump, well, i don't know about a woman, but i can tell you elizabeth warren can beat donald trump. >> look, this campaign is just getting started and finally a place where there are folks that represent the country. >> i'm not leaving stone unturned and not about representing just half of america, but all of america. >> i've got news for the republican establishment and news for the democratic

establishment, they can't stop us. >> a few things to watch for, one is whether or not elizabeth warren can capitalize on a strong debate this past week. and whether biden will continue to fall like he did in iowa and new hampshire. and officials inside are worried about the rain. you can see a little rain coming down. they're afraid it may affect turnout and judging from the parking lot starting to fill up. it looks like so far it's not impacting it. gillian: i think the million dollar question on everybody's mind, is this whole operation going to go down smoothly or a repeat of iowa? a lot of people following that and we'll check with you and next hour you can keep us up to speed. thanks, griff. leland: meanwhile, president trump went after bernie sanders ahead of today's caucus and started off yesterday at a rally in vegas. >> bernie's too emotional, he's screaming, going crazy. >> all right, with that we bring in talk radio host, tony katz

voice of minuneapolis. and what do you think about the president's road show, before a caucus he's in the state with a rally. >> smart plan, smart way to do it. newt gingrich said if he got the nomination in 2012 he would go where barack obama was giving a speech not knowing what he would say and he would immediately explain why barack obama was wrong. this is standard operating procedure and it's a good one. feel the thunder-- steal the thunder and i was there when the president had the rally in new hampshire and there was a divide in excitement. the president's supporters versus kind of the begrudging of the democrats, who they were going to be voting for. it's politics 101 and it's a smart move. leland: the president likes to talk about the crowd sizes.

the only person comparing is bernie sanders 17,000. and you go to rallies the person that generates the most excitement next to president trump, sometimes comparebly to president trump is bernie sanders. >> i wouldn't go so far as comparebly. there's an interesting story, you watch the democratic apparatus, they're up in arms, we can't have a socialist candidate and we can't have the-- he is the democratic party, he's set the stage in 2016. his problem is that he was a much more formidable candidate in 2016 and now that people have seen results from trump not just talking points from trump they're more opt to go his direction and they realize bernie goes further and further into this socialist love fest. everybody complaining about bernie sanders and worried about bernie sanders, you let bernie sanders own the party. you all want medicare for all, that's bernie sanders. you all want to talk about the 99% versus the 1% in a much

stronger way than obama did, that's bernie sanders. don't get mad that he's having result. get mad that you didn't put him in the trunk four years ago. get mad that you didn't put him-- >> and you're looking at it from the democratic establishment point of view that seems to feel as though. at least for a good portion of them, bernie sanders being the nominee means the reelection of president trump. there are some republicans who do not necessarily agree with that. lisa booth last night on the ingram angle. >> bernie sanders is the toughest candidate for president trump to face in the general election. he will be the democratic nominee. he's got that message. i think that it could appeal to the forgotten man and woman that president trump was able to appeal to. i've heard a lot of republicans acting like somehow this is going to be an easy race against bernie sanders. it will not be. leland: thoughts? >> i'll give you a couple. first, i think that's an a--

comments against and that he had nda's out -- against him to release them from their nda's and that is because, you know, this is something that he thought about, he's an executive of a large company, i think over 20,000 employees but he's running for president and he's running to represent all women, all people, all across the country and the me too movement exposed that we have to be mindful of the accusations that are brought forward. leland: sabrina, the issue of nda isn't a new one, 48 hours before he was saying no i'm not going to do it, if he's going to be the decisive president and leader why not make this decision before coming out publicly, no, doesn't it undermine every statement going forward of what he's going to do if 48 hours later he comes out and changing mind? >> absolutely not. this is a decision that's been talked about on the campaign at the company, this was mike's decision and had nothing to do with what happened prior to 48 hours ago, this is something that he decided he we wanted to take the actions to allow the

women to be free and speak out, he believes that women should be able to, you know -- leland: 48 hours before he made the same decision except he made it on the other side of the coin saying no, i'm not going to let them speak out, what changed in those 48 hours, this wasn't a new issue, this was a new decision on the same issue? >> well, again, this is something that mike had been thinking about, this is something that, you know, mike has -- i can only speak from my work experience and my people around me and mike has so many women in senior positions on his campaign that have been with him for 20 or 30 years, this was something that he wanted to do, this was the right decision and frankly i really respect the fact that, you know, he recognized and took responsibility and said, you know, this is the right decision for the campaign and if i am president or if i remain president of my company, we will no longer have nda's that bound women from discussing any harassment or allegation against them. leland: as you rightly point out there were other changes in his statement that we didn't have

time to get to. today is the nevada caucus and while he's not really on the ballot in nevada, not competing there, he's competing there in terms of ad dollars, these are the billboards that have gone up on las vegas strip particularly targeting donald trump, donald trump has declared bankruptcy 6 times, donald trump cheats at golf, all sorts of different tag lines he has up there, this is what the las vegas sun had to say about this billboard that was on their front payment, the main story on the day of the caucuses, it also showed an ability by the former new york mayor to turn the tables on trump by subverting the president's ability to control messages and belittle opponents, all of bloomberg's messages attack elements of trump's boostful representations of himself, so should we read this as the bloomberg campaign running a two-part campaign, one is the primary and you are competing in super tuesday and the parallel, we are the nominee, we are running against the president?

>> the person we are running against is donald trump and i think that while we are still going through the democratic primary process mike is the only candidate in this race that has layed down roots and an entire infrastructure in the super tuesday states and beyond. i think we certainly are looking at bernie sanders as one of top competitors in the democratic primary but at the end of the day we feel confident that we will be if ones to take on donald trump in november and all the billboards of what they were saying is accurate, nice way for donald trump to be met on the -- on the vegas strip. >> what do you make of the polling post the debate that show your man's favorability ratings that were largely based off of bought advertising, not earned media, certainly not being on the ground in states, his favorability plummeting, how are you guys changing course for the next debate before south carolina and then before super tuesday? >> well, just to use mike's own words, he said yesterday or the day before, wasn't best debate performance but he delivered one

of the most memorable lines to have night, what a country to be in when a democratic socialist can be a millionaire and own 3 homes directly referring to bernie sanders, you know, i think there's always room for improvement but, you know, we have to remember for a minute here that mike has been on debate stage since 2009, we are talking over 10 years when he was on debate stage, he was going up against 5 other candidates and within 30 second, not even a full minute had gone by, he was being attacked. so, you know, i think we are to be expected for the next debate, we will expect more attacks but he's prepping and getting ready for the next one. leland: if nothing else attacks show that he's in the game, if ain't cheering or booing you aren't in the game. we had the one about him being the socialist with 3 homes, we had them saying that sanders was the one that wrote tax code when he was complaining about

could mean for the rest of weinstein's legal battle in new york and subsequent criminal trial in california, former federal prosecutor and partner law firm, jim, they reached verdict on 3, if you could read the tealeaves a little bit for us and tell us what this says, if anything, about where the jury will ultimately end up on weinstein. >> it's always very interesting to think there's perfect logic. gillian: we are trying to get a sense of where we are heading. >> quickly erase the tape if i'm wrong, the 3 counts are with 2 different victims, the charges with anabella, sentencing enhancement, potentially life because predatory pattern. in each of the counts anabella plus the other victims if they had acquitted there's no reason to be considering the most

serious with anabella. they are having hard time with age of her case, 90's, grappling with that but reached conviction on the other 3 counts. >> a lot of the case hinges on actress anabella, 50 year's old, her charges are past the statute of limitations, is it fair that she's getting kind of counted in as some people would say on the back end of this trial? >> well, i might remind you of bill cosby trial, it had so many victims, the judge said pick 5 that aren't part of this trial and you can use them but not the other 10, there's kind of a safety in numbers. the prosecution wants to have an opportunity -- gillian: these alleged victims are not part of this case, you can -- even counting in one of them sounds like it's a stretch, isn't it supposed to be one of the instances where everything is bound clearly? >> well, here is the thing, the predatory charge, the predatory pattern specifically warrants

inclusion of multiple victims, it's going to call by the nature of the charge for more than one victim, so that's really the hook they are using to get her testimony in there, it is -- it's controversial area because there's accumulation, critical mass where the defense looks at it one victim but there's -- gillian: let's say weinstein or anyone in the hypothetical case where these kinds of alleged victims is convicted, how is the jury expected to just now whitewash the fact that, you know, x number, in this case four other women have come forward and level the claims, you know all the details. >> a couple of things, federally it's absolutely fair game to consider anything that he or she can hear about a defendant, when there's multiple victims that

testify, even though they are not charged the judge is in a position to consider that, everything is linked to a charge even though anabella's event is outside of statute of limitations, linked to predatory charge a judge would be able to consider all 3 victims here quite easily in meeting out a sentence at the end to have day. gillian: i want to call for this line we pulled from the prosecution's closing argument, they wrote, they are creating a universe in which they are tripping women of common sense and hotel invitations, the plane tickets they accept, the jobs they hope to obtain. is that what this trial is about? >> well, the defense took a pretty controversial stand? >> all throughout the trial. basically say he's kind of predatory and he's pretty creepy, not in these words. gillian: but the women, they are not so innocent. it's gotten a lot of heat --

>> feels like 1950's, in the old days rape was a challenging case to prosecute because there was societal norms that didn't favor the victim. gillian: we have now societal norms today when women are not responsible of being raped, throwback to 1950's era sentiment here. >> it's a mixed bag, it's a difficult line to walk for that attorney to kind of make the comments but i think what he's getting at is a combination of consent and nullification and it's not pretty but suggesting that these are independent-minded folks that made a transactional decision to hook up with a guy who was all too really to take advantage of it, not particularly flattery to harvey but defense. >> we appreciate it. >> sure thing. gillian: leland. leland: indiana couple facing

up in terms of the weather, something to always watch when it comes for turnout, what is the general consensus there in terms of who the turnout helps and hurts considering the early vote? >> every person, every candidate, every staffer that you ask about who is helped by high turnout you will say it's them. [laughter] leland: perhaps low turnout theory guy -- the other guy who is hurt by that, peter doocy, excellent reporting. gillian. gillian: diverse population will play role in today's caucuses, we will bring the center for immigration studies executive director mark, mark, i want you to first set the scene for us on nevada and immigration, we know hugely, huge proportion of immigrant residents in the state both legal and illegal are undocumented, whatever you want to call them. >> it's immigration really has grown rapidly in nevada from a pretty low level, from 1980 to

today, 1,000% increase in the number of people who speak a foreign language at home, immigrants. gillian: a thousand%? >> a thousand% increase. 1 out of 6 babies born in nevada today is born to and illegal immigrant mother, some of them have legal immigrant fathers or american citizens, that gives you a sense for how big immigration in general and illegal immigration specifically is in nevada. gillian: and so all of these voters, all of these immigrants and foreigners who are in the state of nevada are now looking at a top-tier candidate that is exclusively white? >> well, yeah, hopefully the citizens are the looking at the candidates. exactly. but, you know, the fact is democrat fight isn't going on for a long time and there were hispanic candidate, there were black candidates and they just didn't cut it and so i'm not sure that hispanic american voters in nevada are saying, well, there has to be hispanic

and we will vote for him. in other words, they are americans, they are worried about the same things as everybody else, they are democrats, maybe they are focus is on health care or what have you, but it's not like they are saying, well, okay, where is the hispanic candidate, we will vote for him no matter what. gillian: fair, that's a great point. some to have democratic candidates in the state already being accused of pandering to black and latino voters in the state of nevada as well as in south carolina, we saw, you know, the candidates deploy mariachi bands and gospel choirs, a lot of people are saying, blacks and latinos are saying this isn't what matters to us, you to come up with really strategic policies that speak to the issues we care about. >> yeah, shocking with politicians pandering to voters. but it does show the narrow and silly way that a lot of politicians view hispanic americans, black americans, in other words, like i said, they are just american voters like

any others, some may care more about education, some may care more about health care or foreign policy, i don't know, but the point is they are voters, approach them as americans and see how it goes. gillian: hasn't president trump talked about this, take a listen to what he had to say at one of his rallies. >> the great state of nevada, washington democrats put the needs of illegal immigrants before the well-being of american citizens, you know that, you have been complaining about it for a long time. it's one of the reasons you voted for trump. >> well, i mean, he's right, i think, in 2 ways, first the president talks a lot about sanctuary cities and that's a very targeted thing, not because -- and the issue is not that illegal immigrants are more likely to be criminals, some of them are criminals, a lot of illegal immigrants, every democratic candidate supports the idea that only the most heinous criminals who are illegal immigrants get deported, all the rest of them, if you're

subpoenas for information on individual who is have been arrested starting with departments in colorado, connecticut, new york, oregon and california. on friday, the san diego county sheriff's department first to announce it will comply with the subpoenas its received despite california's strict law limiting cooperation explaining in a statement while the sheriff's department does not enforce immigration laws, we are obligated to comply with lawfully issued subpoenas, the information requested by the subpoenas relate to providing documents not honoring detainers and transferring individuals to ice as reported earlier, important to note the subpoenas are administrative subpoenas, meaning they are signed by immigration officials not a judge and that's a distinction critics would likely use if they decide to follow subpoenas. greyhound is not trending. leland: you get the idea from talking to dhs chief deputy
