specific individual saying you will pay the price of fuel in a certain way. not only should schumer be censured but this is borderline illegal. the standard, would a reasonable person in same or similar circumstances feel under threat of ali harm or intimidation? we can say you are from brooklyn but that was intimidating. >> very specific, including reasoning behind it and i thought about what donald trump said, the democrats went crazy that he should shoot someone in the middle of fifth avenue and get away with it, that clearly is a joke and a reasonable person can tell the difference between the two. >> that wasn't a specific threat against a specific person. everything has to do with context and whether the threat is particularized.

schumer isolated these two supreme court justices and said if you do a certain act, you will pay the price. this is something he is basically warning them if you do this on an abortion issue which is a very specific, you're going to pay a specific price. this could come across as a criminal threat and if this was anyone else besides a democrat in the senate they would be arrested. there would be an investigation that should happen here. heather: i was summarizing donald trump's statement a long time ago. let's look at holly's resolution, senator schumer has acknowledged threatening siemens can increase the danger of violence against government officials when he stated on june 15th, 2017, following the attempted murder of several it members of congress the level of nastiness, vitriol and hate that seeped into our politics must be

excised. let's look at the chief justice statements, threatening statements of this sort from the highest levels of government are not only inappropriate but dangerous. all members of the court will continue to do their job, both agreeing with you. >> i agree with both of those statements and was happy to see chief justice roberts weigh in. he needs to. this is someone, chuck schumer is a leader in this country. a lot of people look up to him. if he's making these statements, what is he encouraging the rest of these members to do and the rest of his party? these are statements, we can have the abortion debate all day long. i have the debate, stand firmly with donald trump on pro-life measures, we can talk about the constitutionality of that but can't threaten justices for an outcome based on our own opinion. that is inappropriate in this country and chuck schumer needs to do more than apologize.
