[♪] congress' approval rating was just 20% proving how little

americans think of their elected representatives in washington and how broken the system is. at a time when we need them most, they are not working. but they are getting their paycheck. using any reason to not work is nothing new for them which i suspect is one of the reasons congress' approval rating hasn't gone above 30% in a decade. they talk a good game, but rarely deliver on their promises. their goal is to be part of the winning team and folks that ain't us. they've vow to fight for us at all costs. but it makes little difference in our lives. while most mayor cans were told to shelter in place, essential workers were out work. healthcare, first responders, truckers, delivery workers.

public workers. fastst food workers. journalists, radio, television. but congress? no, sheltered in place like the prima donnas they are and getting paid. they would prefer to be working. americans want to work to take care of their families. to eliminate the financial and emotional toll of being without a paycheck. so what does congress do? they pass one funding bill after another which is good, including yesterday's fourth $484 billion stimulus bill which wouldn't be so terrible if it went to americans who cannot work because of the virus. no, they have to play their games to buttress their positions and pet projects.

take the april 7 $.2 trillion -- -- $2.2 trillion cares act held up by nancy pelosi for seven days after there was already agreement. she wanted money for planned parenthood, the green new deal. election law changes. she got $35 million to the kennedy center where she is a board member and $150 million to the kennedy center and endowment for the tarpts. which had nothing to do with the virus. 1.6 million businesses got money to save 30 million jobs. but republicans knew they would

need to replenish the money and wanted to do so by consent. 4.4 million americans filed for unemployment because of the delay. so why? house majority whip james clyburn said it all in a phone call with his democrat colleagues. quote, this is a tremendous opportunity to restructure things to fit our vision. that was a reported quote. covid is being used as a cover to fund liberal progressive programs. it gave nancy time to show her freezer ice cream, and she goes from the late late show with james corden to the late show with stephen colbert to bill maher who puts the ultimate question to her last night. >> i know we can bail out certain sectors as we have done in the past. i don't know how you can just

keep indefinitely writing checks. we were $20 trillion in the hole to begin with. how can the whole world be writing this funny money? >> because it's a matter of life and death. judge jeanine: funding the kennedy center is a matter of life and death for you, nancy. the left is not in tune with america. last year when 800,000 americans were not receiving pay during the shutdown, pelosi and schiff were off to afghanistan and brussels after nancy prevented the president from delivering his state of the union, suggesting he send it in writing. after this year's state of the union, we know what she does with her state of the union speeches. congress goes from one thing to another. each side high fiving each other.

lindsey graham. does congress have the wherewithal to take the drastic actions necessary against the chinese communist government? >> shame on us if we don't. after 9/11 when al qaeda attacked america we came together to push back to go after them. we should have the same attitude about china. china is responsible for 26 million unemployed americans. 53,000 dead americans. we came together to spend $2.7 trillion because of the damage done to our economy due to china. so i have got two goals. that is to get china to change their behavior and the second goal is to make them pay. judge jeanine: if there is the

ability to sanction them and that happens, you know, they still want to be the head of the world order. they have a sense, the chinese communist party, that they should be in charge of the globe. >> that's true. they do aspire to be sad world leader and dominate the world. but here is the question for the world. do you want this country running the world? this chinese dictatorship that puts people of faith in jail for faith? do you want people to run the world to lie to their own citizens and hide from the world this virus. to my democratic colleagues, i'm going to give you a chance to work with me and other republicans to push back. i want china to do three things or be sanctioned. fully cooperate with investigation regarding the

wuhan lab and how this started in china. two, i want them to close the wet markets where they serve bats and monkeys and exotic animals. and third i want china to stop this. i want china to change its behavior. they needng to let the democracy advocates out they put in jail in hongai kong. they need to close the wet market and cooperate with investigations. if they don't we should sanction the hell out of them. judge jeanine: if we are able to go there and we have gone there, they haven't let us anywhere near the lab as i understand it. that's number one. number two, they ended up storing all the ppe so they could sell it back to other countries. this is not a government that has an incentive to work to be

better and be part of the world order. what about all the other countries in the world that have been affected by them? what is it going to take? >> when it comes to china the european union looks pathetically weak. they dialed back their statement about china. but congress has a chance to be tough working withes the president. i want to say stop travel from china, limit visas in the united states. allni these chinese students who come to our universities, stop them from coming. stop chinese officials from traveling to the united states. stop businesses from partnering with the united states. stop direct investment in the united states by chinese companies until they change their behavior. until they let the democracy advocates go who have been put in jail while everybody is

focused on the environment and closing down wet markets. if they don't do nieco -- don'to these three a things we should t china off from the united states. judge l jeanine: when you look t these sports figures and hollywood, they are not a pariah. a lot of people are making money over there. 80% of our antibiotics come from over there. will congress work to bring the source back? if you believe as some do, that some of this was, you know, at least they lied what it after the fact. let's assume it was an accidental release from a lab. they said there was no human-to-human transmission.gh what makes people think they are not going to do the next thing which is being in charge our antibiotics.

judge jeanine: breaking tonight. rumors and reports circulating about kim jong-un's health. some sources say he's in grave condition and near death. thee' white house monitoring ths closely. joining me to talk about that as well as some of the democrats' shenanigans on capitol hill is counsel to the president, kellyanne conway. thanks for being here tonight. first thingsng first. what is the white house hearing about kim jong-un and has the president reached out to anyone? >> i will not comment on that. the presidentot will make any announcement about a head of

state. all of us will get our credible information off line, not online. and echoing what senator graham said, the offer president trump made to north korea stands. there can be great economic liberation and opportunity for the people of north korea. and we t would be willing to hep with that. but so many conditions would have to be met first. the verifiable complete denuclearization of the korean peninsula. the president is firm on that as he's trying to broker a deal on that. as to the health condition of a foreign leader, i'm going to leave that to the national security council or the presidenton himself to make any announcements. judge jeanine: i understand that. it's highly unusual for him to

be absent as he has been. and something that came out in the "wall street journal" and that is that the white house is planning on replacing health and human services secretary alex azar. what say you to that. >> what i would say to that is secretary azar has served for two years. he was in the information room yesterday at the task force briefing. he oversees a huge budget with over 60,000 employees. the cdc and nih all report at some level to the hhs secretary. he time i read a story about a personnel change, they say it has to do with somebody who has oversight over the pandemic.

[♪] ashley: live from "america's news headquarters" i'm ashley strohmier. the guidelines require states to have sufficient tracing to track people who have been near someone with the coronavirus. the cdc on contact tracing is forthcoming. governor cuomo said new york will begin testing healthcare workers for coronavirus antibodies. followed by transit workers. according to the world health organization there is no evidence that people with antibodies are protected from the coronavirus.

america healthy, nancy pelosi sacrificed small businesses. she held it some when there were 700,000 small businesses with applications but they were out of money. nancy pelosi owes the americans an apology. she'd held up every single bill when it came to coronavirus. the second time she held it up for the entire week to get more funding for the endowment of the arts, the kennedy center. then she came back this time, we asked two weeks in advance. we saved 30 million jobs. 4.4 million last week was nancy pelosi's unemployment she added to america. judge jeanine: that's absolutely stunning to me. but i want to move on. there is so much going on with respect to the money that is now

being allocated. but mostly for americans who are out of work and small of businesses obviously. bill maher as i said earlier in the show asked the question, what do you dow do just keep printing money? she says this is life and death. but we are at the point where some of the states are saying look, in order for to us get back on our feet, we need the federal government to give us a clean slate. so if we are indebted because of the medicare system that we don't monitor properly, i would say, as well as states that have promised pension benefits to government employees, then you are going to have states that are flush paying for states that haven't been able to manage very well like new york, new jersey, illinois, michigan. and andrew cuomo really went after mitch mcconnell.

>> what i see is the governors when they didn't planning their own states, they look at the opportunity to grab more money. if they would look at what we already passed. we passed $2.7 trillion, and added on with what the fed is doing. that's $7 trillion into the economy. we should allow that to get up amendmented. the liberal democrats want more. in the last month we provided more than 500 billion dollars to the states. we spent roughly $600 billion for an entire year when it comes to medicare. we have $150 billion going out to the states by the end of this week. we increase wad we pay when it comes to medicaid. cities bigger that 500,000 got

direct money input. remember what governor cuomo got. he got hospital beds, navy ships, ventilators. here is president trump trying to protect us from this crisis while nancy pelosi is trying to politicize it. instead of focusing on what we need to accomplish here. judge jeanine: the real problem, congressman, is the fact that you know, you see cuomo digging his heels in and saying we mismanaged this state and we are in the hole, politicians promising everything but the kitchen sink to get re-elected and the rest of the country should pay for it. i'm a new yorker and i don't think it's fair. >> it's not fair. the federal government spent $500 billion. what when made to do now is find a way that we not only open up

judge jeanine: u.s. attorney general bill barr raised some eyebrows when he compared the coronavirus shutdown to house arrest and suggested possible legal actions against the states. joining me, barr's predecessor in the justice department, matt whitaker. the on general suggesting he might join legal actions against the states for infringement of their liberties is a rather stunning statement. when do you think that kind of thing might happen? >> i think if we re-open and look at how some of the states are trying to balance individual liberties with emergency police powers, i think the justice department is well placed to make sure that our first amendment and all constitutional

rights aren't infringed unnecessarily. the supreme court said any infringement on those fundamental rights must be narrowly tailored. so lockdown orders what we equate to martial law is not tolerated. i think the department of justice is looking at it with keenize right now. judge jeanine: when you say that the first thing that comes to mind is michigan where the attorney general not only has the bizarre restrictions on the people of michigan. you can buy weed, but you can't buy plant seed. you can go in a canoe but you can't go in a motor boat. eboat. and i don't have time to go through all of it. when people go out to express

and protest, she doubles down and says it may now go longer. i suspect that's the kind of thing where you might say there is no correlation between her trying to deal with the pandemic and the extent to which you saw to restrict civil liberties. >> i think michigan will be the first defendant in a lawsuit from the department of justice enforcing these civil liberties. these liberties were given to us by god and written down in the constitution have been handed down from the forefathers of our country. while this pandemic is serious, it can't be used for government overreach or to anything that, you know, ronald reagan says it the best, as government expands, liberty contracts. i think the citizens of michigan felt some of that in the rhetoric from the governor.

jean rsh for all of us -- judge jeanine: for all of us, whether you are a prosecutor or studying american history. we are so far beyond what people would have expected in terms of a lockdown. some people are being arrested for playing catch outside with their son. do these people not understand the bill of rights? the governor in new jersey saying the bill of rights is above his pay grade. do you laugh at that or does it make you sad. >> i see moms sat playgrounds -- i see moms at playgrounds getting arrested for letting their kids play. the guidelines say keep six feet apart. wash your hands often. the fundamental stuff we have been doing consistently.

some of these places made people like barr said, under house arrest. it's an infringement on our civil liberties protected by the constitution. judge jeanine: we'll see whether the attorney general cometh as a friend of the court and it will be interesting to watch. matt whitaker, thanks for being with us on "justice." now, you can go to the gym in georgia. but is it worth it? we'll discuss the governor's controversial decision next.

a lot of these businesses i mentioned and more including bowling alleys where everyone wears the same shoes are starting to open up in your state. should they? >> i don't think so. everybody wants it to be open. but the president just said it. you just heard him. this is not inside the phase one guidelines. this is not what most would deem essential. leadership is more than saying we are going to open something up and getting it started. it's about communicating so the people of georgia and the business know what to expect so they can prepare for it and have the proper protection. do they have the equipment to do so if they wanted to open up? and what does it mean for folks to come back in. we are opening restaurants monday. so it's not a matter of opening of the business. we have to make sure people feel comfortable going back to those

businesses. and for the president it's not part of phase one. judge jeanine: they had to show a reduction. the nail salon. the tattoo parlor. the bowling alleys where you wear other people's shoes. plus the risk of something happening where the numbers go up would be devastating for your state. >> it could be. that's the interesting thing. another thing that was concerning about this. there was no cut out of local input. in my area where i live we are seeing an increase in positive cases. but we are seeing an increase and we are not sure what would happen if more infections were to come. a blanket assessment sometimes is not the best. you need input from your locals.

but you don't want to start it too quickly because it could have a devastating effect. judge jeanine: there is a psychological peace to it, too, congressman. are some people afraid? they have been sheltered in place for so long, they are thinking, i don't know. >> the media, especially the liberal media, would love to have everything doom and gloom. and giving more in2002 than we have seen any president give. the problem is they hear all the things and they have gotten scared. we need to be able to open this up. people need these paychecks. they need to get back into our economy but we need to do it the right way. having input so people feel comfortable is something we cannot afford to lose.

judge jeanine: ways so stunning here, it is nuanced. you know the president believes in americans going back to work and getting out of the house. but he's been critical of this because he recognizes science and medicine have a lot to do with it. but the senator there, kelly loeffler who is accused of selling stock after and i even til tell jones community is standing right up there. supporting this re-opening. do you think she can appreciate what ordinary georgians are going through? >> she was appointed by brian kemp. most people in georgia don't work off stock evenings. that's not something they are familiar with. while this was going on their
