1:15 am
effort to set up michael flynn to perjure himself. >> as flynn seeks to withhold his guilty plea does this new evidence will make his case? here with reaction is francey higgs. in your opinion how does this change the game? >> it changes a completely. context is really important in criminal cases and motives and bias of witnesses and agents in the investigation itself is always a critical component in here you now have the fbi, proof in writing that the fbi knew there was no criminal investigation, they were just going up to talk to michael flynn at the white house to find out whether or not he would lie, to see if he would lie or possibly to get him fired. getting someone fired is not a law enforcement motive.
1:16 am
i don't understand what anyone was thinking, it seems bill precept was worried about the fbi as worried about playing games which it is clear to me they are playing games. context is important when you talk about what was going on at the time. in january of 2017 the fbi had months of fisa tapes from the carter page fisa which resulted in nothing and critically you had the fbi already knew that the steel dossier that it was based on was discredited so there was no other way into the trump campaign and this was their last ditch effort. rob: the big point from those notes, what is our goal? truth admission? or to get him to live so we can prosecute flynn or get him fired? like you just said flynn was not the target. there was a bigger picture they wanted to get to.
1:17 am
is this the way it works? is the way it happens? because this is still the. >> this not the way it works when i was at the department of justice. this is incredibly dishonest, abuse of power. i don't understand what the heads of doj and the fbi were thinking other than they had a blind hatred for president elect and then president trump and they were trying for months to find a way into his campaign to prove he colluded with russia. there was no such proof forthcoming and then they had through this hail mary pass using discredited ideas from the steel dossier, the carter page fisa warrant and the whole russia collusion conspiracy. i don't understand it. i'm ashamed of the department of justice they took these actions. >> let's listen to the soundbites of james comey on the decision to send the fbi agents to question flynn from december 9th of 2018.
1:18 am
>> i probably wouldn't have gotten away with it in a more organized administration. the fbi wanted to send agents into the white house itself to interview a senior official. he would work through the white house counsel on discussions and approvals and i thought it is early enough, let's just send a couple guys over. >> a response? >> how sleazy is that? that is so slimy. they talk about corrupting and absolute power corrupting absolutely and i think that is what you have when you have the fbi that for 3 years has withheld written notes and 300 tos for the fbi in the mike flynn prosecution which meant he pled guilty without all the facts, without understanding the tactic the fbi was engaging in, without understanding the fbi's motivations and that is so contrary to our fundamental precepts and notions of justice and fair justice and blind
1:19 am
justice that it shocks. rob: is one of michael flynn's attorneys on hannity. >> devastating evidence of the length they were willing to go to to disregard all protocols, all prior, standard practice because they were determined to take him out. >> a lot of big familiar names are going to get wrapped up in this. what happens to them if this turns out to be true in this is as big as it looks right now? >> great question. people need to be investigated. we have to see if crimes were committed. obviously a violation of policy is not a crime, violation of the constitution may very well be, lying to the court is certainly a criminal offense and that needs to be investigated but mostly we need some sunlight and disinfectant. i really hope william barr, the attorney general, is going to
1:20 am
clean house. i don't think chris ray comes off looking very good when these notes have been hidden from michael flynn and his attorney for three years which i think there's an awful lot that needs to be done to clean out the department of justice and the fbi and get back where they are using the rulebook and using the constitution and not throwing them out the window as comey and bragged about. jillian: we will be following this. i hope you will too. rob: senators have been warning about extending unemployment benefits for weeks. >> for people to say i get paid more money for not working. jillian: how will this impact small businesses in their ability to reopen? peter morici says it will be difficult to hire workers back, he joined us next to explain.

>> mounting one from gop senators against and extending benefits. they have been, it can really backfire. >> >> an incentive for people to say i could pay more money for not working and -- >> never pass a bill that would give you a pay raise if you got unemployed, increase wages because you incentivize people to leave their job. jillian: the wall street journal reporting half of us workers can earn even more with jobless benefits and while working. chief economist for the international trade commission
1:25 am
peter morici. thank you for being here. 26.5 million people unemployment benefits over the past 5 weeks, a massive number. if you look at the unemployment benefits under the cares act, the last one allowing for an extra $600 a week. and thank goodness for the extra $60 a week. to get our economy moving, are they going to have a hard time? >> we saw this in the great recession following the financial crisis because we had unemployment benefits over 90 weeks, people didn't want to go back to work, now we have a situation where you are paid to sit at home and watch espn and that is what people are going to do. restaurant owners saying they won't be able to reopen until august. when these four months are done
1:26 am
we need to flip the switch and start giving money to employers for hiring people as opposed to giving money to people who don't have a job. rob: this big money you can get, do you think with all the haste to get this money out they missed some critical things they should have paid attention to? >> they were paying attention and they knew what they were doing. republican senators should not make believe they did not know what they were voting for but if we require the unemployment checks, combined benefit from the state and federal supplement did not exceed their 40 hour wage the process of calculating that with the antiquated systems the states have for unemployment insurance would have meant we would not have gotten checks out until june. this is one of those things we have to accept but if it becomes
1:27 am
strictly a short-term measure we have crocodile tears here. the real problem is this is an election year. i can see joe biden is democratic convention or before, in august if they have one, let's extend those benefits, putting donald trump on the dime. there will be a lot of pressure to extend those benefits, they should end at the end of july. jillian: the increase in the homebuying recovering from the coronavirus with strongest interest in a month and you, but this number, 12% increase in people filing on a seasonally adjusted basis. what does that number on your screen say to you? >> interest rates, 30 or mortgage with points and fees, something they have for 30 years. my feeling is this is a good time to buy if you have a stable

job and you're confident you will be in the home three years, at least three. it is a great time to refinance but you have got to have a good steady job to refinance. something about refinancing, banks can't assess whether or not your job is going to be gone tomorrow and whether it is or not a lower interest rate will serve your purposes. >> no rush because there's no indication those rates are going up anytime soon. we appreciate it. >> joe biden facing growing pressure to address sexual misconduct allegations. many women's groups are staying silent. rob: former bernie sanders staffer figaro says those groups have two options, joins us to reveal from coming up next.

1:36 am
what do you make of it? >> it is important a lot of folks say you never talk about trump, trump has been questioned on his allegations as well as brett cavanagh which means joe biden can be as well. there are only two options in the scenario we have, number one, going forward, we are going to believe all men and women are entitled to fair investigation and we are no longer going with the believe women no matter what. our option to admit the me too movement was a product is just whoever the me is that does not apply to all mes. if we're going with option one and all of a sudden we are going to believe men and what men have to say then joe biden should be the first one to say he made a mistake with a 94 crime bill that locked up millions and millions of black folks based on conspiracies was a lot of folks lots of under that crime bill were locked up based on a conspiracy, they were not caught with drugs, they were not can't

doing the crime but they had to do the time so because i dedicated myself to social justice for the last 20 years that is a real problem i have with this hypocrisy, we pick and choose when justice applies depending on who it is. >> why do different rules apply. it is so blatant when you look back at brett kavanaugh and how things were then and the reactions what was going on in and you look at the lack of reactions what is going on now with this, such different rules. >> i was pleased to see the me too founder yesterday saying joe biden can answer these questions and show his electability, almost like we're in a place of tribal politics where people do one or the other. it is possible for joe biden to still answer the questions and folks can still vote for them if they are fine with his answer but do not answer it at all and
1:38 am
just have campaign spokesman speak on his behalf is malpractice. if trump has to answer for his issues as well as brett kavanaugh did and so does joe biden and so for him to run from this is unacceptable. rob: a women's group try to send a letter but never did. a draft of a letter that never got delivered. vice president biden has the opportunity to model how to take serious allegations seriously. the weight a expectations matches the magnitude of the office he seeks, the owner reportedly said. i wanted to stacy abrams ran for governor, didn't get the office, here she is, she wants to be the vp. >> the new york times did a deep investigation and they found the accusation was not credible. i believe joe biden. >> this is the way a lot of people have been get away with supporting joe biden but here's the new york times on that excuse is being used, they say
1:39 am
it is inaccurate to claim reporting cleared biden of sexual assault, talking points being circulated by the biden campaign >> the new york times investigation found the allegations did not happen. our investigation made no conclusion either way. how are they going to continue to spin this based on that? >> i don't know when the new york times became the feds, they are not the fbi or investigation organization that is there to do an investigation to determine if it is credible or not. i appreciate that they did come forward and say we did not agree with the statement that stacy abrams made but secondly stacy abrams knows this, the new york times doesn't get to decide to do independent investigations, this is something, special investigator of actual law enforcement to determine if those allegations are credible or not. they -- the bottom line, let's be honest about it, they don't have an issue with what joe
1:40 am
biden has done in this is where we are but there are some folks that doing that will be a problem in the polls. >> you mentioned to me too movement, let's look at this tweet, the defense of joe biden shouldn't rest on whether or not he's a good guy or our only hope. he could demonstrate what it looks like to be both accountable and electable. a lot of people say i wanted to hear from joe biden about this. when do you think we will? do we hear from joe biden about this? >> the me too movement founder who is a black woman said let's go ahead and have them answer questions and see if they believe her. they also have believed black women but they pick and choose when they believe black women. she started this movement, she has spoken out to say we should answer these questions and i'm looking forward to see if they will but i don't like playing hypothetical theater. the bottom line is they will continue to spin around this because it is a question they

1:45 am
>> thanks for being here. it is really gutwrenching. >> we spent a lot of time and resources bringing awareness to veteran issues but not a lot of time to the solutions and the perspective is awareness without a solution is advertising a problem. we need to spend more time focusing on solutions and more time doing research and building programs to help these veterans. rob: one of 5 covid-19 fatalities in the us is a veteran over the age of 70 years old, a staggering number. does the federal government and state government need to put more money into this to better care for these people that have
1:46 am
fought for this country? >> absolutely. oftentimes i think veterans on certain days of the year we talk about veterans but most of the time i would say we put them on the back burner sort of like a foreign object so to speak. we really need to put them in the focus of all the efforts to come away with a cure for this pandemic and to treat the pandemic. >> more than 1500 nursing homes report covid-19 different infections to the cdc after april 19th as ordered from dms, this is been such a source of problems for so many people in this battle to fight covid-19, trying to protect the elderly, the nursing homes, the veterans stability's, what have you heard from people on the ground, what have you heard from our veterans? >> often here just about daily about the fear of lack of care,
1:47 am
lack of information on how to deal with the covid-19 if they were to come down with it or what is the protocol, what do we do. there is a lack of information put out and it causes mental health issues for veterans because the level of uncertainty and fear is a triggering thing for those who have experienced combat in different operations, brings back those memories and emotions so we go down a different rabbit hole. >> you even say of all the things to be concerned about even with a number one in 5, 70 plus veterans dying of this virus you still maintain that mental health during this pandemic is the thing you are worried about the most. explain why. >> absolutely. when the directive came out to social distance i immediately had a fear of that being misconstrued for social isolation. isolation in the veteran community as a whole is a killer.
1:48 am
that is where we get the 22 at a suicide rate so we need to make sure veterans know there is a difference. social distancing doesn't mean being cut off from society. is an opportunity to stay connected and there are different ways to do that. when the directive came out about covid-19 and was we need to do to stay healthy, i did a survey in the paul and i asked what is the biggest fear and it was mental health, light years ahead of the rest over child care and unemployment. it is a huge stressor but that wasn't on the radar in comparison to mental health. we need to change focus and be more flexible, not put them in a box. it is a different genre of

and this is what americans are about. >> all good intentions here, the governor showing off a mask mural made of masks, the office has received in the mail but some thought they should be put to better use so he is seeing some backlash on social media, some nurses and other people don't have masks and he makes artwork with them. scott said masks put a highest and best use, a quarto photo op and talk about tone deaf, cuomo's office did catch wind of the backlash and said these masks will also be distributed to people who need them so they will find a good home as well. >> okay, let's move on. mattel is honoring the heroes of today. carley: mattel has created a new
