>> he is in the process of being exonerated. you look at those notes from yesterday, that was total exoneration. these were dirty filthy cops at the top of the fbi, and you know their names better than i do and they were dishonest people. now we have to see what's going to happen. but general flynn was treated like a nobody should -- and i'm not talking about generals, but no one in this country should be treated. >> bill: also today, the former vice president facing a new pressure to respond to an accusation of sexual assault. biden's campaign has denied it, but he has not yet made comment about it. all this coming as biden announces a team to help take his running mate. we have team fox coverage analysis with bret baier in a moment on all of this but first, peter doocy reporting live in arlington, virginia. let's begin there with joe biden. good afternoon. >> good afternoon, bill. right this minute, joe biden and his wife are on an instagram live q&a with the world cup

if there's news coming back. thank you. want to bring i in a bret baier, anchor of the special report. we are told that more documents will be made public. don't know when, but just got 1. what have you heard today, what does this matter mean? >> at significant. you have these documents that show what the fbi was doing with these agents going to interview the national security advisor michael flynn, and what jim comey talked about about setting all of that up. in these new documents, cross fire razor is what this investigation into michael flynn is called, crossfire hurricane you may remember was the broader investigation into the trump campaign and the trump white house and the administration and in these documents, it essentially says that they're going to set up this questioning not telling him what it's really about in the hopes that either you get the truth or you get him to lie and

get him fired. and jonathan who we know very well, law professor says i've been a criminal defense attorney for decades. i've seen abusive tactics. however, this one is one of the most sluggish records i have ever seen. most concerning as they were trying to create a crime, not investigative crime. the use of the logan act which we talked about before only highlights that bias. i think it significant. >> bill: i know you interviewed james comey and we've seen quite a bit of that. i want you to reflect on that in a moment. but i want you to listen to this sound bite from december of 2018. this is sound bite number two, nicole wallace from msnbc asking how did you get two guys in the white house? and this is the way he answered that here in new york. >> i sent them, something i probably wouldn't have done and gotten away with in a more organized investigation, a more organized administration. the fbi wanted to send agents into the white house itself to

interview a senior official he would work through the white house counsel and be discussions and approvals and who would be there and i thought it's early enough the militia send a couple of guys over. >> bill: you listen to that now when you hear it with a different ear. >> you really do, and i've asked a similar question when i asked for your james comey on a set of special report on the early efforts with michael flynn and it was a similar answer. i think it does take a different tone as you listen back to that. can be characterized as a set up. some analysts are saying this is what happens, but it's not really what happens in the big scheme of things if you look at what happened to michael flynn and all the coverage after that moment and all he's dealt with sense. >> bill: before he answers that, he says under the bush administration and obama administration, maybe it would've been different but he seemed to suggest he was seizing

the opportunity of an administration that had just come into the white house. quickly on the joe biden matter, something from him directly, yesterday "the washington post" editorial said this, biden should address the terra reade allegations. you are seeing more of the media come around. what does joe biden do here, do you believe? >> you got to address it. it's like a snowball going down a hill gaining more and more snow as it gets bigger and being covered by mainstream media. i think the disparity is so huge if you watch nancy pelosi and what she said in the brett kavanaugh allegations and how that was handled and what she's saying today. she didn't really answer those questions today, had a briefing on capitol hill. i think that is really what it's dark if you look at some of the people who spoke out before as far as the details emma we are

time as they're getting infected with coronavirus and in many cases, when they do get infected, their immune systems are weaker than younger people. in less than an hour's time is going to be similar to tuesday's event with small business people. the president will have some folks in who are in this risk category and talk about the steps the administration has taken to protect seniors such as raising infectious disease standards in nursing homes across america, requiring nursing homes to alert residents and families when they arrive, inspection throughout the health care system to ensure vulnerable populations are protected, hhs has designated $1 billion for at home assistance grants for things like homecare services, home delivered meals, and new information is going to come out this afternoon about critical supplies. even as parts of america begin to reopen, the white house guidelines recommend seniors continue to self isolate. as things really begin to change for them.

but we need to know what will happen if you give it earlier in the game. to him i going to be able to keep people out of the hospital with it if i give it intravenously at home? is it going to shorten hospital courses? is going to save lives? we don't know yet, but preliminary studies like it may save some lives, and that's key. >> bill: so it stops the virus from replicating in the body which stuns the growth which is what you want to do. but they were using this drug on ebola a few years ago. you remember that. >> yes. ebola is a far different type of virus. ebola is an incredibly deadly virus. this virus for some reason makes a lot of inflammation and blood clots in your body. that's when it gets deadly. with this virus, i think you can stop it in its tracks a lot easier than ebola. once a bullock gets in there, it's almost impossible to defeat it. >> bill: if this is the answer, and i still note some hesitation in the analysis here

from medical experts like yourself, gilead is going to have to produce how much of this? hundreds of millions of doses and how difficult could that be to get it produced and get it out all over the world? >> first of all, i don't know that's the answer. what i think is it's a weapon. it's definitely an arrow in our quiver. it's a tool we have now. it's going to save lives i believe. gilead is going to start by ramping up 100,000 treatment courses over the next month and by the end of the year, millions of courses. so they are on the way to making millions of doses of this. that's what's going to be needed. but even 100,000 doses to be used treatment courses is going to make a big difference. i think it's something positive here. >> bill: are you giving it a a, b, what are you giving it right now? looking for help, be honest. >> it is preliminary. i'm giving it an a-. i am very excited -- here's the

30 million have lost their jobs in the past six weeks. a tough stuff here, good afternoon. >> out, huge numbers. these are jobs, these are people that are trying to pay rent, trying to put food on the table here. the administration saying that would be worse without the payroll protection program, but if you look at this over the past six weeks, that's 30 million jobs. we are talking about all sectors of the economy, not just one hit more than the other and if you do the math here, 151 million people are in the workforce according to the labor department. that's 20% of the people now without a job. this is pointing to a very bad unemployment number coming up next week. white house advisor saying the highest unemployment number we've seen since the second world war. and the good news if you want to call it that, the jobless claims seem to be decreasing from the peak of march 28th. that's when to fix all of this,

the white house is hopeful for a phase opening up of the economy. listen. >> of the economy gets going relatively quickly because the viruses contained, than we expect most of those people to go right back to work, but if the virus continues to be a problem throughout the suburban, then it's going to be a very, very heavy lift for a top use of the economy going at that rate. >> the federal reserve chairman jerome powell saying he believes the program meant to keep people in their jobs are critical to a big bounce back in the economy. the administration saying 60 million people will be helped by the payroll protection program at the end of the day when it's finished and in its second round of funding, they've burned through about a third of that funding, but the demand is increasing for this program, but the treasury secretary steven mnuchin says they will be no more money for this program after this round. in fact, house speaker nancy pelosi confirmed

back up and interact with our guests, that's part of what that barbecue experiences, and it's a real touch tone for the community. we've been here a long time. have a lot of our regulars that come in and this is a third space, and meeting space and we look forward to it cautiously going very well. >> bill: well stated. any reservations here as you get ready for this? >> i think there should always be hesitation and reservation. i think that's how you stay sharp. i think the most important thing is most of what you mentioned, we are in an industry where we are professional food handlers. all of our folks are food safe certified so i think more than most sectors we are prepared for this but you should see that we are prepared. you should see hand sanitizers stations by the doors, you should see that tables are set, but again, only to 25% here in texas. other places are creeping up to 50, but we are at 25.

>> bill: back now to one of our top stories, documents to be released about what is known as cross fire razor. last hour, got a few more documents and now some are more forthcoming. the investigation into former national security advisor michael flynn and learning new details by the minute. so former deputy independent counsel of the whitewater counsel, let's begin with what you believe was the set up. go ahead and make your case.

>> i don't know if there's any question. we've known for a long time it was a set up. jim comey on his book tour admitted it was a set up and the interview by michelle wallace said the crowd got a big laugh at it. did i call her michelle? sorry. he's admitted it. what's new about this is there are notes showing that they were using it as a justification of the logan act. that is just ridiculous. the logan act is a complete dead letter and everybody and federal law enforcement knew it was a dead letter. it's never been in force. let me repeat that. and it's over 200 year history, it has never been enforced. there's never been a successful prosecution under it. so to use that is a pretext. >> bill: never been enforced, it was mentioned when john kerry was meeting with some of the

iranian leadership but again as you mentioned, with regard to these documents we are seeing the department of justice apparently another just being released right now, we don't know what's in it. appears to be quite lengthy so we wait on that for the time being. as a federal employee, general flynn is working in the west wing in 2017. should federal officials have warned him or notified him to some level of degree as to what they were pursuing? >> i think so. there is a long-standing federal case, supreme court case and a follow-up and what they basically stand for is if you're a federal employee and you are being questioned in a criminal investigation, you have to be warned as to how your questions will be used. they cannot be used in a critical case.

and no one has really talked about this other than one commentator i'm aware of, and "the federalist" in december. i feel as a federal employee, they certainly did need to be warned. >> bill: professor wrote this piece in the hill a bit earlier today, one quote here. "i've been a criminal defense attorney for decades. i've seen abusive tactics but this is one of the most thuggish records i have seen. most concerning is they were trying to create a crime, not investigating a crime. the use of logan only highlights that bias. that was a tweet he sent out earlier. i am told the department of justice there is more to come on this. what is your understanding about what happens next? >> keep in mind that ag barr

appointed the attorney for missouri, the eastern district of missouri to look into it. he has been -- to look into the flynn prosecution. he has been over the last couple of weeks releasing documents initially under seal both for the government and the defense in this case and we don't know how serious these are. we know there's at least 100 pages and a number of attachments. so if you had asked me ten days ago is there a chance that judge emmet sullivan is going to dismiss this case, i would've said absolutely not. he appears to be hostile to general flynn and two general flynn flynn's new attorney. but now we don't know exactly what is in these documents. we don't know how serious these violations might be. that's the violation of the government to divulge exculpatory evidence, so i think we need to wait and see.

i will tell you, however, it's extremely rare for defendants to be allowed to withdraw a guilty plea. it's a very difficult climb. >> bill: so we will see as it goes along. thank you for coming back today, nice to see you. a moment ago right now, watch this. >> a few cities, a few coastal cities off and around orange county area, those are the point of particular concern. so today, we want to make some clarifications. we are going to do a hard close in that part of the state just in orange county area. >> bill: so that just happen, orange county and california governor gavin newsom shutting down beaches in that county after a crowded weekend during a heat wave. at 80 packed the newport beach which the governor said as an example of what not to do. police say the overwhelming majority of people were practicing social distancing, so

a bit of a reversal, but also the clarification. meanwhile, other part of the country in the panhandle of florida, local leaders getting ready to reopen more beaches there. that includes pensacola. the board of commissioners voted unanimously to reopen the beaches tomorrow with social distancing guidelines in place as well. vice chair of the county board of commissioners, how are you doing? tell us how did you arrive at this decision? why don't we begin there. >> thank you for having me. the decision was not taken lightly. we consulted with medical professionals, we of course track the numbers, the hospital ceos that had sent us a letter requesting us to close almost six weeks ago sent a letter saying it was time that we could scale back our restrictions and reopen the beaches for the county. we've actually had very good enforcement and the people here have been following what to do and staying off the beaches, so we hope they continue that as we move into this new phase of

reopening our beach. but we have about 8 miles of beach on pensacola that is all open to the public and so they can easily spread out. we put in our ordinance that groups no more than ten and 6 feet apart which also follows governor desantis' order that starts on monday, so right now we do have that that he's extended through monday and we think we can still come out and face that. >> bill: what happens if they don't obey the restrictions? how do you get involved there? >> we have our lifeguards that are out here. but we also have our public works, animal control and ultimately the sheriff's department to help enforce that, so we are just going to be encouraging people. we know we have a hot spot, a trouble spot in the peer that's behind me that people usually congregate and that's where we were congregating before we have the beaches so we close that area off. also public restrooms, a lot of

people going and so we had some porta-potties for the first few days, a week or so to see how that goes so that a reduces the congregation and those smaller confined areas. >> bill: it sounds like you are ready. you have ten new cases today, 11 deaths throughout the county. looks good for you. what if the trends reverse themselves? what's the plan there? >> as a board, we are meeting each week over the next three weeks and we will monitor that. typically what we have is a big memorial day crowd here, the organizers of those events already canceled those. we are starting to focus our attention on our big blue angel airshow here in pensacola, and they do a beach show here in mid-july, so i know they're probably in your area earlier this week and what they are doing flying across the country. so we are starting to focus on that. >> bill: thank you for your time, good luck.

still the statement is the worst is behind us and we are now at a place where you we are considering how we will reopen our businesses, we have some news on the vaccination, so it's very positive for this and hopefully. >> bill: some people put a target on models because they change so much and we are just learning about this as we go, but 2,000 deaths reduction in a matter of 48 hours is significant. how does that happen? >> that's very true. what we are realizing as i said before, we don't just increase mobility. we are tracking mobility from cell phone data. we notice an increase in mobility and suspected that would increase mortality. the expected deaths wasn't as big as we expected, so it seems as they are going out, they are practicing social distancing, so we are counting how many people are moving about but not counting how well they are moving about while keeping a social distance. >> bill: so one of the key

models you were trying to develop was how it varies from state to state and as we begin to reopen. have you been able to make a key finding on that yet? >> yes. so we now have specific dates where they can move from a strategy of containment or we can trace cases and test them and isolate them and we have different data from different states. some can start much earlier which is sometimes in may, and that is a function of the cases at that time when you say you can move to a containment phase, we are looking at one case per million new cases that people can detect and try to send isolation. >> bill: tough question here, what does winning look like in your model? how do we know when america has one >> sandra: >> how america has won in my opinion when we
