betty crossing a very happy birthday. her story is featured in my bo book, "unknown valor. happy birthday betty, look at her on her front lawn. we will see you back here tomorrow, i have good night. ♪ >> tucker: good evening and welcome to "tucker carlson tonight." it looks like a crime was in fact committed involving the russia investigation but no, it was not a crime committed by michael flynn. today the department of justice filed paperwork to end its prosecution of flynn and would end all criminal charges against him. we will have more on why this happened and what it means but first, tonight, another breaking story. the house intelligence committee just released 57 transcripts from its investigation into russia collusion. america's newsroom cohost ed henry has gone through these documents and goes through with

the latest. >> we are getting even more information today. foxnews.com added that adam schiff was in "panic mode. if they are from the probe of alleged russian collusion. but breaking tonight, adam schiff may be even more panicked because i am hearing from two sources familiar with this. as early as tomorrow, you could reveal even more documents shedding light on the russia probe, and how they knew for a long time there was no collusion even though they kept saying they had direct evidence otherwise. two sets of documents. adam schiff late today releasing transcripts, and they conducted over 50 of them to try to prove there was collusion. the first set of documents embarrassing, because james clapper testified under oath long ago, we never learned of it until tonight. he testified "i never saw any direct empirical evidence of the trump campaign or someone in it

was plotting and conspiring with the russians to meddle with the election. he testified as i tried, and mccabe testified that's correct. tonight fox's learning there is a second set of documents that ric grenell who now has a job that clapper had brought to the attorney general william barr today in a satchel. i was tipped off to this by someone outside of the government, and jacobson was able to say -- this after the case against general flynn was dropped.

he said the way the the fbi handled the case was improper. going through another set of documents, this is very interesting. it talks about how sally gates learned about michael flynn talking to the ambassador. he said after the briefing during the presidential transmission, he asked yates and james comey to stay behind. obama started by saying he had learned of the information and his conversation, he was seeking information about how he was treating flynn differently. you have to wonder, how did yates learn about michael flynn because the document says that yates "was so surprised by the

information she was hearing that she was having a hard time processing it and listening to the conversation at the same time. remember, she was at the obama justice department at the end and she's having a hard time processing this. why did he know that information about flynn? remember you have john durham looking at all this. james comey, all these people who were probing russian collusion and what was going on with michael flynn and others. chuck grassley talked to bret baier tonight and he said he thinks he's hearing in the next two or three months that john durham will have some information coming out. we will see whether that will be. there's a whole lot of information coming out and watch what ric grenell does in the next few days. >> that satchel. great reporting ed henry, thanks so much. we will be watching, 9-noon eastern. now back to the latest elements.

if you've been paying attention this afternoon, there is a passionate debate underway right now. but there shouldn't be a debate because there isn't actually a debate about why the case was dropped. doj officials explained it in detail today. read the filings, it's worth it, they are online. clearly almost no one commenting on the case has read them, and they should. the documents are shocking not for republicans or democrats but for americans. we have outlined much of what we knew about the flynn case, and how an fbi director decided to derail him. at one point, peter strzok decided to charge flynn under something called the logan act. in the entire span of american history has never been used to convict and single person. in fact no one has been indicted under the logan act since before the civil war. in fact is probably

unconstitutional. but peter strzok didn't care, his goal was to keep the investigation going. by january 4th 2017 the fbi had completed its investigation of flynn which was thorough. they found "no derogatory information of any kind linking flynn to russia. that would have ended right there. according to the doj today, it should have ended. there was for communicating the foreign investigator. that's the essence of it right there. people cannot commit a crime and they knew it. itself is a shocking outrage and completely unacceptable in a

free country. for some reason nobody in washington seems to notice or care about, but they should. because they already knew what flynn had said in the call, no justification or need to ask him about his own personal recollections of what had been said because they knew. we know this for certain because we have peter strzok's text messages to his creepy girlfriend. the fbi claimed they had been lost due to some technical glitch so we almost did find out what exactly happened. michael flynn almost went to prison. and that gets to the nub of all of this. how often does the fbi set people up? how many other lives have they destroyed without the public knowing about it? this isn't about michael flynn, it's about you. it's scary to think about that.

they suggested their goal was to "get him to lie so we can prosecute him or get him fired. it's not speculation, the fbi wrote that down on paper. flynn faced a maximum of five years in prison. our people really arguing that his prosecution was a legitimate? are they really arguing they should be behind bars? would happen to their commitment to civil rights and fairness? there's nothing liberal about the arguments they are making, this is the most brutal kind of power politics disguised with allies. this moment represents the full collapse of an apolitical justice department, wrote cnn's legal analyst. justice matthew miller agreed with that "bar is giving treatments that are not -- they were coordinated, the world's

plucking a bunch of political arguments out. these are -- it's a well supported argument with him and citation to a lot of supporting evidence that shows something that we already know, which is, against protocol and under circumstances where we had no case, the fbi set up a perjury trap interview for mike flynn, discouraged him from getting counsel and from notifying the white house authorities who should have been alerted if the fbi wanted to interview somebody on the white house staff, and one of the things that bill barr doesn't get into today but is very alarming is the monkeying that they did with the report of the interview. i think when you look at all the things that are brought together in the memo, you come away with exactly what the justice department said which is, they did not have a case that they

could prove beyond a reasonable doubt that flynn was guilty. you have an ethical obligation not to go forward. >> tucker: and just to be totally clear, that's universally understood among prosecutors, that seems like a fair standard. >> it's not only universally understood, it's if you don't want to be embarrassed and look like a in court, you don't want to go in with a case that you can't win. the case now, tucker, against flynn consists of a report that they can't justify which is the interview summary which has multiple versions, that they have made misrepresentations about who did what. in the testimony of two agents, peter strzok and joe p enke who is the case agent on the trump russia case and would be

♪ >> tucker: so even if you're skeptical of social distancing and masks, even if you believe the masked quarantines were we e living under our insane and counterproductive, it should be pretty obvious that you want to keep sick people away from places where there are a lot of elderly people, nursing home specifically. in the state of new york though, governor andrew cuomo did the opposite. nursing homes were required under the cuomo administration. now 5,000 or more nursing home residents have died of the virus. 5,000. that's more deaths than any other states except new jersey and that's just in nursing hom homes. she joins us to consider what is

a growing scandal in new york. thanks so much for coming on. why would they do this? >> thank you tucker for exposing this because it's truly an outrage. on march 24th governor cuomo said my mother is not expendable, your mother is not expendable and yet the very next day he signed an executive order mandating nursing homes where our most vulnerable mothers and fathers reside to accept covid positive patients. right now there are 5,000 residents of nursing homes or prep patients that have been put into nursing homes that have died which accounts for 25% of the deaths in new york and 30% of the deaths in the community that i represent. i believe that we need to have an independent investigation and we cannot trust of the state of new york. this is the attorney general

that he handpicked in a special election to be the candidate. so we have to have a federal investigation and that would be the only way we get an actual true independent investigation to take a look at what exactly occurred here. and i could tell you something else because i've been on the ground with the nursing homes. they did not have the proper ppe, the proper protective equipment to care for these individuals so not only did the governor mandate that they accept covid positive but then he didn't even provide the proper protective equipment to keep them safe and stop the spread from within the nursing homes and we had push them on this. we said at least mandate the municipalities to provide the protective equipment. >> tucker: so i knew andrew cuomo when he was hud secretary, and he is an extremely political person. really quickly, what was the political calculation in this

decision? there must have been one. >> sandra: to be honest i don't know what the calculation was at that time. it doesn't make any sense, my colleagues and i were scrambling for protective equipment to get to the nurses at these nursing homes because the city and the state were not providing an adequate supply. but what i can tell you is two days later, 1100 parolees, people had broke parole. what that shows you as his priorities, that he cared more about the interest of these and that's apsley outrageous. >> they are just american citizen taxpayers. great to see you tonight. good luck.

tracing. that's when government bureaucrats find people who are infected and then track everyone they've ever interacted with. we are hearing that contact tracing might be a way to reopen society sooner and is of course on a massive expansion of intrusion into your life. this week the california health director from ventura county appeared to suggest that beating the virus might require removing people from their homes. >> arresting harris law and owners who open their business have certainly given lockdown authority as a black eye but when the director of the ventura county health department dr. robert levin said children who test positive for coronavirus could be forcibly removed from their homes, it struck a national nerve. now, he said he might have been misinterpreted or gave the wrong impression except there was no misinterpretation. when the health director was talking about hiring new contacts trace investigators, as you said the people who

investigate the transmission of covid-19 he said they would "find people who have covid-19 and immediately isolate them find every one of the contacts, make sure they stay in quarantine and check in with them every day. then he added this. >> every person who is isolated for instance needs to have their own bathroom. and so we will be moving people like this into other kinds of housing that we have available. >> that's for the kids were pulled out. but when the tweets hit the fan, dr. levin pulled it way back. >> i gave people the impression that if you were isolated he would be taken out of your home and put into a hotel room or motel room were sequestered in some other way. if i did do that, i'm very sor sorry. >> and yet california is actively promoting what it hopes will become an army of 20,000

but as a judge, when you are impacting people's lives you have to have some humility and this judge had none. he demanded that she apologized to him. she really wasn't put in jail because she violated an order, although she did. but as i've said many times the governor and i don't want to put anyone in jail, that's not the point. it could have been a $50 fine, but no. he had to punish her. we saw the worst site of what a judge can be and that's really what it's about. and this has been a great american story. it's called the imagination of the people and i think it's because it was a woman who stood alone and was looking out for her 18 employees. she was willing to stand alone and pay the price, and she would not yield to this judge. she stood her ground. and then you saw of course what

happened with the sentence, and people responded to it. when i offered to take her place with home arrests, i wasn't trying to grandstand, i just thought maybe he made a mistake and it would give him a chance to save face. but no, he didn't want to save face. in fact i'm sure he was grinding on him today that he learned, don't mess with texas. >> tucker: it's so cool and awful, and to think that someone like that would be sitting in judgment of americans day in and day out, i know guards judges are elected so hopefully voters will correct this. but what is he doing to other people? >> he's i in the ballot in november. >> tucker: he is, but what are others doing in the courtroom? >> he has a reputation of being a judge that's pretty cold. i would call him a radical leftist on the court. but what has happened is we have seen the human cost over the last two months now and it's

been terrible. nearly 70,000 americans have died and the most heartbreaking thing about that is, they die alone. it's a terrible price of these people have paid up but, there's also been another price that people have paid. when you have dreamed of the dream of owning her own business and you put everything you have into it, and it's taken away from you, everything you have ever had, maybe your life savings to build up to this moment, your dream, then it's taken away and a judge treats you like this. this is not the way america should be. this is not the way the judicial system should work. and if i had been on the bench i would have said, i going to have to find you $50, shelley, but i salute you for standing up and come it go and go back to work. but he couldn't do that. between the republicans and

governor doug ducey's draconian stay-at-home order. sheriff, thanks so much for coming on. he will not enforce this, why? thank you for having me. i want to be very clear, this is not the country that i grew up in. i never thought i would see a day were hardworking americans are criminalized for trying to make a living for supporting their family. we look through the constitution which is very clear and it's obvious to me that we have a lot of overreach which is very damaging. according to the constitution last time i checked, the law of the land, they must fairly apply to all of our citizens equally. and that's not the case out he here. and, does governor doug ducey believe she, he has a right to supersede the constitution?

>> i haven't spoken with governer ducey and i'm sure the man is doing what he feels is best. we are talking about guidelines which are now being brought into law. we are literally making it a crime to try to want to earn a living and that's not something i'm going to stand for. >> tucker: why should rules that applied in maricopa county which is the most densely populated county in arizona apply to mohave county which it certainly does not? >> that's a question that's been asked repeatedly. every area is different based on geographical basis. mohave county is a very rural county and very widespread and a lot of our county borders up to utah and nevada. we continue to see a large influx of people coming in, enjoying the summer and the activities that arizona has to offer, specifically mohave county. yet we are telling our locals to stay in lockdown and yet we
