their own directives and i am grateful to them both. rob: listen to the back-and-forth between the state and baer county which is where san antonio is. here's the letter from the attorney general to that county, baer county has issued a local public health order that exceeds the county's lawful authority, act quickly to avoid further confusion and litigation challenging the county's unconstitutional and unlawful restrictions was the mayor of san antonio saying on the merits we are not concerned but it doesn't stop the ag from seeking a cheap political headline. what exactly are san antonio and baer county doing? >> i can't speak to that county but i can speak to austin which is similar to san antonio. osten saying a few a restaurant and are opened up, keep tabs, keep a log, ask for contact

information and if you don't do that we could shame you with the health commission. those are things the city leaders were saying are in compliance but failed to mention direct compliance. i don't know the situation in baer county but i suspect it is a, this is not just confusion, telling citizens to wear masks but it is not required and you can't walk anyone up or fine them for it, we are talking underhanded tactics like forcing restaurants to keep tabs on patrons was no one will go to a restaurant and say here's my address, i will have a hamburger and then shaming these restaurants and scaring them with threats such as we will put your name up and make sure the city knows you are not following, the people in the city know you're not following protocol and stuff like that, the attorney general says this has to stop and we have large cities, not every city is acting this way. go to the city of dallas, not dallas county but the city of dallas which mayor johnson is a

democrat, made a point that this is not a partisan exercise for him. he is following the law, doing what he should be doing keeping citizens safe but not going to war with the governor. you have other cities around the state that love to play politics. they want to enforce whatever they feel is necessary, they do it in the name of science and the governor and attorney general just looking out for the state and restaurants and people who want to go to those restaurants to make decisions for themselves. jillian: have you heard from restaurant owners? >> i have. i have friends in austin. i haven't been there for several weeks but i have talked to people who gone to these restaurants, none are complying with the directive to keep a journal of who goes and eats their with contact information. that is not happening. there are some who have chosen not to open. some are doing it and they are keeping a 25% occupancy. in rural areas in my district it

gotten a loan in the first place to return that money to the government and the fda issues more lenient guidance the president is not letting up on this. >> any companies that got loans they were entitled to we will go after them. big problems. rob: another deadline is approaching for deserving businesses and it could mean a major problem for those that are still shutdown. here to explain both these issues and solutions, founder of the marx group jean marx, we appreciate it. the first issue is these companies that have this deadline that they took the money that they shouldn't have taken. >> the treasury department issued this rule. in the first round of funding paycheck protection program a bunch of companies that were eligible for the fda loan program but didn't need it

because they had credit elsewhere, they took loans to $10 million and by doing that they took the money out of the hands a lot of deserving small businesses that needed the money more. on the second round of funding, treasury had to step in and say you shouldn't be doing that, you need to return the money by may 14th and a bunch of companies discuss that in returning money even today, the deadline which is what they should be doing. rob: we are looking at 52% of businesses expect be closed in 6 months if we don't get this restarted. you see a problem for businesses that have gotten some of that money coming. >> if you're a small business owner and received the paycheck protection loan you have to be wary that it is just a loan. you can get forgiveness of the loan but that forgiveness starts eight weeks when you get the

money so the clock starts ticking and you apply for this loan. the problem is as you have been reporting for so long, a lot of jurisdictions are closed down so a lot of businesses getting the money and can't use it. how we rehire your employees if your business is shut. a lot of them are making more money on unemployment and the clock continues to tick for these businesses and if they can't pay it back they will owe it back in the form of alone. rob: the interest rate is pretty low. one more topic, the new guidance that will make this money last longer and let's bring it up. any borrower that receives ppp loans of $2 million will be deemed to have made the loan request in good faith. tell us about this new guidance from the small business association.

>> it gives a free pass to any business, the reason for getting the loan is you have to be affected by covid-19 and represent that you've been affected by it. so many loans have been given up and so many larger companies of not done the right thing. we will focus on loans of $2 million, make sure they got it in good faith and if you got less than $2 million we will not bother or assume you took it in good faith and won't go after you. it is a relief for small businesses who are unsure whether they really needed the money now or later, the government will give them a problem. rob: the other problem if you got the ppp initially it is eight weeks and you need another round. thank you for your time, we appreciate it. jillian: it is 26 after the hour.

up dual cases that could completely overhaul the electoral college. rob: joining us to explain what this is, president of the judicial crisis network and former clerk, supreme court justice clarence thomas, carry, latest out for people who are confused. >> we normally think of the electoral college happening automatically, my state goes for this candidate or the other in the electoral votes automatically go in their column. however these are people. we elect individuals to cast those votes and normally they do what they are expected to do because those are names given by those candidates that when those votes. however in a few dozen times in american history, what we call safe list electors, the states went for hillary clinton in the case of some of these things and they said i will vote for colin

powell instead and that is what is happening here, state laws that say you have to vote for who you are pledged to. the question is does the constitution make these electors true free agents and say you can choose how you vote for is it something states can force them to vote the way they pledged to initially? jillian: what is the big picture concern? >> reporter: it is good the court is hearing it because you don't want them to be listening to these cases in the context of an election where those shifted electors could change the outcome of the entire election and have a situation like bush versus gore with the election waiting on the supreme court for a decision. there have been movements to try to shift who these electors vote for. in 2016, some people involved in this were part of a group called south hamilton electors, finding third candidate they could at
