zone vibe to it. they are certainly thinking outside the box here. jillian: i want to talk to the restaurant owners about this. carley: i think it's funny though. jillian: i have got to go. carley: i will shut up. rob: we will see you later. steve: good morning, everybody. it is 6:00 in the east on this thursday, may 14th, 2020. and we start with a fox news alert. the flynn unmaskers have been unmasked. we now know the names of the obama administration officials who requested the unmasking of general michael flynn. ainsley: i like the unmaskers have been unmasked. among them former vice president joe biden, brian. steve: oops. brian: absolutely. griff jenkins is live in washington. griff, he is knot the only high ranking obama official on the list. i think we even go to italy the ambassador to italy why shouldn't he ask for michael flynn's identity?

griff: good question. there is 39 names in all. some are redacted but biden's name making the biggest waves. the unmasking chuck grassley yesterday after ric grenell unclassified it. former katrina james breaking new than, james clapper, will will will will will jim comey, lou, mcdon mcmcdonough and stephanie power. >> pretty curious that the vice president of the united states would be requesting unmasking, in this case of general flynn 8 days before he left office. griff: the biden campaign firing back blasting the release of this statement saying these documents have absolutely nothing to do with any fbi investigation and they confirm that all normal procedures were followed. any suggestion otherwise is a flat out lie. what's more, it's telling that these documents were selectively

leaked by republicans abusing their congressional powers to act as arms of the trump campaign after having them provided by a partisan official for this very purpose. so we will see. meanwhile northerly twist in the flynn case, judge emit sullivan reporting john gleason a brooklyn prosecutor to argue against the pending motion to dismiss and explore the possibility of new perjury charges because flynn pleaded guilty under oath before seeking to withdraw it. this shall address whether the court shall issue an order to show cause why mr. flynn should not be held in criminal contempt for perjury. unclear what steps will come next from judge sullivan. meanwhile fox news is told that the grenell we can expect more intelligence from him by way of congressional releases in the coming days. brian, ainsley, steve? steve: there is so much going on down in our nation's capital. griff, thank you very much. folks, keep in mind it is not illegal that ask that a name be

unmasked because a lot of people do that in fact, on the list there were a dozen names redacted. it is presumed that those people are in the intel community and they need their identities protected. but it's not illegal to ask for it. it is, however, illegal to leak intel. and so it's going to be pretty tough to figure out who exactly leaked to the "the washington post." of the list that we just heard griff go through, joe biden requested that the name be unmasked on january 12th, the day that the "the washington post" actually ran the story. chief of staff to the white house mcdonough unmasked the name on january 5th. that's the day they had that meeting in the oval office that sally yates said i was going to tell president obama about the phone call but he already knew about the phone call. so there is a lot of connecting of the dots and apparently mr. durham is doing it devin nunes says what we have seen so

far is just the tip of the iceberg. >> what the hell were they doing unmasking like this. so the only logical conclusion is and it goes back to what i said in the early part of 2017 when i came out and made all of this public. i had seen a number of trump transition officials that were appearing in reports and were being unmasked. so general flynn is really just the tip of the iceberg. what it appears to me like what they were doing is a lot of them went wild after trump won. they got poisoned with this russia hoax. the fact that they would be taking that information and unmasking whoever that was and leaking it to the press it's a big problem. steve: ainsley, he is right. went wild is an understatement. a stunning 39 separate officials made 49 requests to figure out whose name was behind the redaction and it was michael film's and to so many it looks political. ainsley: exactly. you are right.

it's not unlegal to unmask if you are in the position to be able to ask that request and so many people did ask for this to be unmasked. what is illegal is someone leaked this to the press. you are not allowed to leak someone's name who works for the government who is an american to the press. that is what is illegal. we are trying to find out who leaked that will we ever be able to know that? the press doesn't have to release their sources. we might not ever know who actually leaked that unless there is some documentation of that what happens is the government intel can eavesdrop on conversations that americans have with foreign leaders in other countries or people in other countries. that is not illegal. what is illegal is to release that name of the american to the press. and that's what we are trying to figure out here. there are so many questions. but, when you take a flashback of what happened in 2017 of what these top officials in our government, in our intel community, what they knew back in january of 2017. this is what they said.

capacity. that's encouraging. ainsley: it is. in nearby washington, d.c. the stay-at-home order is extended now through june 8th. bookstores will be allowed to reopen but only for cush side ct porch pickup. stay-at-home order. and that's a big deal. meantime hand it over to jillian. brian: i want to just add to that think about wisconsin stood up and said you are being unreason, governor. that might give other lawmakers in pennsylvania where they're directly taking on their governor and maybe in new jersey and in michigan where they are says this is unreasonable you are allowing my business to wither on the vine. i understand this. so i think that court is going to inspire a lot of people today especially as the president goes to pennsylvania today to meet with one of these manufacturers. so, look out for that case.

steve: this is a fox news alert. we now know which obama era officials requested the unmasking of lieutenant general michael flynn during the transition following the 2016 election. joe biden is on the list. and president trump had this to say about his 2020 presumed opponent. >> and he said he knew nothing about anything. he has no idea. he knows nothing about anything nothing at all. it gets released today that he was a big unmasker. how do you know nothing if you are one of the unmaskers.

steve: all right. that was the president yesterday. here now live, fox news legal analyst gregg jarrett. gregg, good morning to you. >> good morning, steve. steve: okay. so it was after the election. you know, the obama people would already be putting their things into boxes to leave their jobs and, yet, 39 separate officials made 49 different requests to unmask the name. why would they be doing that? >> well, i asked that very question of a top intelligence official last night. he said this is not only outrageously excessive, it is punitive, a concerted effort to target michael flynn during a transition period, a conspiracy, if you will. and, you know, it's amazing the number of officials here who were involved. and so the question is why? and i think it's because, you

know, flynn had a bulls eye on his back. people like comey, mccabe, brennan and clapper all knew that once flynn took the hymn of the -- as national security advisor, he would expose the russia hoax. and so they went after him with a vengeance. they targeted him, and they got rid of him. steve: at the same time, have you got to figure, gregg, that you know, maybe they were unhappy that the trump administration was going to go in a different direction foreign policy wise and undo everything they had been doing for the last 8 years. so here's the chance, let's go get flynn hot obama administration had already fired once. >> gregg: you are right, steve. there were multiple motives. they knew trump would unravel the iran deal constructed by barack obama. michael flynn was the key to

that. so, yeah, they tried to take him out. i think the next step here is that senators are going to be holding hearings and these 39 people who are unmasking flynn are going to be put under oath and say why did you do this? did you have a legitimate national security reason. are you the one who leaked this to the media. the answers may turn out to be different than the previous one some of these people gave under oath which will be a serious legal problem for many of them. steve: right. so as we are learning more about what happened to michael flynn long ago in the transition between the elections and new orleans in january of 2017, now, of course, last week we heard that the department of justice was saying to the judge it's time to dropped case. but the judge, emit sullivan yesterday in washington, d.c. appointed a former federal judge john glee sen to present the arguments why the department of

justice request to dismiss -- she should not go for it. they should figure out whether or not flynn should be held in criminal contempt for perjury. now we know that judge gleason does not like flynn because he and some others were in an op-ed in the "the washington post" in the last couple of days. and the headline was the flynn case isn't over in the judge says it's over. and now, gregg jarrett the judge has appointed that guy to essentially prosecute flynn again. >> yeah, what a coincidence, steve. both sullivan and gleason are clinton appointees, look, sullivan has proven time again that he has a feeble grasp of the facts in the flynn case answered seems to be utterly ignorant of the law. the law is very clear at the trial court level only the prosecution and the defense can be heard. we don't let people walk in off the street and say hey, that

defendant, he should be convicted. so it's wrong to allow these watergate prosecutors, their hay day 45 years ago. hyper partisans to insert themselves in the case. it makes a mockery of fairness and justice. even worse to appoint a retired judge to come in as a quote let's invent a new crime. flynn was innocent. his plea was coerced so let's charge him with perjury for trying to withdraw his coerced plea? i got news for you a writed of mandamus by flynn's attorneys and emit sullivan who frankly has no business being on the bench will get roundly spanked by a higher court. steve: okay. some developments. gregg jarrett. thank you for joining us on this thursday. >> sure. steve: all right.

the fall. we have different situations happening in different states based on different cases and different circumstances. ainsley: how do we do that safely? >> well, it would be a very good plan if everyone was working in harmony and we have a, perhaps, white house task force that could funnel information down to the states that is received in the district and we move forward with assurance. ainsley: that's not a bad idea. we had the task force we are focusing on beds and focusing on medicine and then it moved to vaccines and reopening that would be an excellent idea to have a task force on education. as parents we are all concerned. what do you make of this outbreak especially in new york city. more than 80 children in new york city have gotten this coronavirus inflammatory syndrome. knowing that information, we just don't know a lot about that disease. and i think one child has died as a result of this. in new york according to an

article i was reading yesterday. so how do we safely send our kids back to school when we're worried about this now? >> yes. it's definitely a hyper concern for parents and for our country, the world. as we come into fall, that is certain consideration as is summertime if we are going to implement summer school. young children in addition to our older population, we must be vigilant. we must be careful. ainsley: i know you mentioned the task force on education and i was saying that's a great idea. how would we go about doing that? who would you want to see on that task force? >> on that task force it would be important to have all stakeholders. certainly we want to have our education professionals. we want to have parents at the table. we want to have unions at the table. and we want to have white house department of education. we want to have our public health commissioners and we want to have everyone having a seat

pretty curious that the vice president of the united states would be requesting unmasking, in this case, of general flynn 8 days before he left office. attorney general barr and acting director of national intelligence ric grenell they are heroes. they are patriots. they are being unfairly attacked right now, mercilessly attacked. brian: it was somewhat expected that was senator ron johnson who got that information about the unmasking and released it along with senator grassley. on the surface is there anything illegal there? let's bring in judge andrew napolitano host of liberty file on fox nation. according to reports he went to law school. so, judge, we will deal with your background in a second. let's deal with the background of what happened in 2016. i'm looking at this list and the list of people who requesting the unmasking who is on the other side of that kislyak call, the russian ambassador. what questions do you have knowing on the surface there is nothing illegal here?

>> well, there is nothing illegal about the conversation that general flynn had with ambassador kislyak. we know that. and there is nothing illegal about the request for the unmasking. so when america's spies are spying on a foreign person, here ambassador kislyak and stumble on information about an american, and they report the existence of that information to their superiors but not the identity of the american, people with the national security clearance can ask for the unmasking of the american. and that's what happened with respect to general flynn. the problem is that one of those unmaskers, all of them had national security clears. all of them, including joe biden, i mean, it's a political question. it's not a legal issue. all of them had the right to ask for it. one of them went to the "the washington post" with this information. and that is arguably the crime

of espionage. what strikes me as bizarre, brian, steve, and ainsley, is that there are 39 requests for information by members of the obama administration and some career doj and intel officials about conversations involving general flynn. not one of those requests is about the december 29th conversation with ambassador kislyak which formed the bailiffs of his prosecution and his guilty plea. now, that's odd. why isn't the person who asked for that mentioned there? maybe that's the person that went to the "the washington post" and maybe the intelligence community has kept that information even from their boss ric grenell so that that name doesn't get out. steve: that's really something, of course last week we heard the department of justice was saying we need to dismiss all these charges against michael flynn and at the 11th hour yesterday

judge elm mid sullivan said hold everything, i'm in charge of this. and he appointed a former federal judge john gleason who really does not like michael phlegm. in fact, weighs part of an op-ed in the "the washington post" the film case isn't over naacp until. mr. gleason you look into whether mr. flynn should be released and did he commit perjury? this seems crazy. i have never heard anything like this. >> it's unusual that somebody would be charged for perjury for making a misstatement in a guilty plea; however, when you plead guilty in federal court not necessarily so in all state courts, the government insists you be under oath. that of course locks you into a version of events from which you can't deviate. so the general flynn lied to the fbi or did general flynn lie to judge sullivan? in my view, that's a legitimate

inquiry. it's a box that general flynn and his first team of lawyers, not the terrific lawyer sidney powell that he has now. it's a box that general flynn's first team of lawyers let him get put into and now it's nearly impossible for him to get out of it. so why is judge sullivan doing this? well, you have two litigants before you, the federal government, the department of justice, and general flynn. they're each taking positions opposite from those they took for three years. flynn now says he did lie t dide to the fbi. they are each saying the opposite. the judge is a little curious why they changed their minds and entitled to find out what happened. no one in the courtroom is going to defend the prosecution until in comes former judge gleason whom i have known for 40 years and for whom i have the utmost respect for his intellectual honesty and his understanding of the law. he will make that argument and judge sullivan will make the call should i, judge sullivan,

grant the government's motion and end this or is this all part of some scheme to dupe me because general flynn testified twice in front of me under oath. ainsley: the governor in wisconsin the stay-at-home order and the supreme court of wisconsin just struck that down saying the administration overstepped authority. what do you think? >> i think this is the first time we have actually seen, ainsley, a state supreme court dedicated to the basic democratic principles in america. and that is that governors don't make laws, they enforce laws. legislatures make laws. so this 4 to 3 opinion. very hotly contested with very serious bitter its dissent says you want to close things down, only the legislature can close things down. the tyrant governor evers you have to follow the law like everybody else. i applaud the decision. the supreme court of

of emit sullivan in d.c. and even though the department of justice said last week they should dismiss the charges for a variety of reasons. the he appointed john gleason to essentially take a look at the charges regarding flynn and figure out whether or not he committed perjury and to argue against the department of justice's decision to try to dismiss the case. is it just me or do you think this is a little crazy? >> it's more than crazy. i mean, it's unconstitutional. the executive branch has the constitutional authority to prosecute. not the judicial branch. not the legislative branch. the executive branch. so for them to have friends of the court briefs to aid a prosecution that the prosecutor wants to drop that's

camps under certain guidelines. it comes as 10 more states and d.c. loosen lockdown orders tomorrow including outbreak epicenter new york. brian: yup and in virginia stores and restaurants with outdoor seating and churches are set to reopen. across the border in maryland stores will open at 50% capacity. but there are restrictions. steve: meanwhile in nearby washington, d.c., the stay-at-home order is extended through june the 8th. bookstores will be allowed to reopen for pick-up only. meanwhile overnight in wisconsin, the state supreme court rules its stay-at-home order unlawful. and in the state of florida, the state is welcoming pro-sports to train at empty stadiums. major league baseball and nba are reportedly considering florida to start their season. ainsley: that is wonderful. everyone is ready for sports again.

let's bring in ron desantis. good morning, governor. >> good morning. and just so everyone knows i have already spoken with some our colleges like the university of florida. they have a great football stadium, the swamp, that's not used on sunday. so nfl team needs a place to land we could work that out, too. ainsley: what about where i went my freshman and sophomore year, florida state? >> look, i haven't spoken to them yet but it's a great -- it's an iconic stadium and i think we would want to be very helpful if we could. so i think that things like that, getting sports back, getting some of the things back that we're used to is really important from a psychological perspective, a confidence perspective. and so i'm a big proponent of that. i think it's great that these leagues want to move forward and i think there is no question we can do this safely. brian: so, governor, you know the stats. you haven't full credit yesterday strategy like south carolina and georgia the numbers are pretty strong. especially when it comes to

helping seniors stay safe and stay alive. give me the five -- the four principles of successfully opening in this pandemic environment. >> well, the first is you still are in the fight against the virus in terms of safety. and you are focusing those efforts where the threat really exists, which is in our senior population. so, we did very early with the nursing homes. we restricted visitation and we prevented hospitals from discharging covid positive patients like into nursing homes. that's like a tinderbox if you let that happen. we districted 10 million masks and other types of ppe just long-term care facilities. we have national guard going in and test test test testing 50 different teams and i got a mobile lab that goes around to different communities and tests at long-term care facilities. and then, of course, we are continuing to message to our senior citizens who aren't in those facilities if you are 65 and over you are at increased risk. avoid crowds and make sure you are being careful about your

contacts but in florid i througe country we are seeing 80, 58 percent of the fatalities are ages 65 and over. as we reopen business, as we do things safely, we need to stay in the fight and protect those who are the most vulnerable to this virus. steve: which is advice we have heard from the experts. isolate the vulnerable and then social distance and things can happen like down there in florida. i saw in axios new cases are down 14% from the previous week. and, governor, i don't have to tell you, it's already hot in florida. and you know, over the last couple of months we wonder if it's seasonal like the warmer it gets the more likely the virus is to get tamped down. we know that the sunlight kills it almost immediately. have you found or do your experts talk a little bit about how florida's unique, almost subtropical climate has helped you in this?

>> well, i think what we know is that this is a virus that is highly transmiivel and when you are in close repeated contact inside in close environments. the flip side of florida we get a lot of airconditioning. if you are in those types of environments that's more risky. i certainly always believed that the open air is just simply less transmiss cybil environment. i think the studies have born that out across the country there aren't massive outbreaks linked to a lot of outdoor activity. that's why i got a lot of flack from the media because i didn't want to close every beach in florida communities that kept beaches open they did the social distancing as they were required. to say they have the lowest rates places like brevard county very low death rate. people should be doing it. we kept golf courses opening. we had fishing going on the whole time. people could boat. we really wanted to have people

be able to do activities in ways that were safe clearly for you to be out in an open field that is safe and less risky for the virus. i think it's less about necessarily the weather per se but just when you have the opportunity to be in good weather you are less likely to be in those enclosed environments where is where we have seen this virus spread like wildfire. ainsley: governor in wisconsin, the governor there decided to do stay-at-home orders and a lot of people were complaining and protesting there the supreme court of wisconsin just struck that down. do you think some of these governors that are just doing one size fits all for the entire state, do you think they are being too strict and going too far? >> i don't think the governor has the authority to direct anyone unless there is a direct troip combating this virus. if you look around the country clearly examples of draconian

arbitrary restrictions that have nothing to do with public health. like you can't plant a seed in your front yard in your garden? you can't walk around the neighborhood with your daughter or something like that? so some of this stuff has devolved into social control. i think absolutely it's gotten out of hand. here's the thing it's less effective to do that. in florida we did not do that. we were reasonable. we trusted the people to act appropriately and we have had a better results than some of the states that you have seen. i think that yes, there have absolutely been oversteps and i think the legislature should look at this as we go forward. you need to be able to act. there are certain things that need to be done, but you are not a dictator. you don't have unlimited authority and people do have rights. brian: i was shocked at the call state system made an announcement in may for september. going to be almost no in classroom learning all going to be remote. in may, not even trying to open up in the fall.

governor desantis have you committed to opening up universities where you can which you are in control of and schools in the fall? >> yes. so i have spoken so some of our universities already. why would you give up now? why would you do that? of course have you got a plan to come back. i think we will have people on campus. i think that's the way it should be. we have an opportunity, too, because those folks those students are low risk and there is a way to do this so they are safe. our universities will be able to do it. to have more distance learning is not the same at a university level and we need to get the kids back on campus for sure. steve: governor, florida is one of america's number one tourist destinations. a lot of people have destination weddings. my daughter was going to have one on may 1st. it obviously didn't happen. now she is thinking about august. what do big events in families' lives that might involve 50,

100, 150 people look like in august in the state of florida? >> well, steve, i can't give any guarantees but we obviously want to get there where people are able to live life. that's the goal here. i think the first mission for the country including in florida has been accomplished of flattening the curve. our hospitals weren't overwhelmed. we know we are able to handle this with our medical capacity. so now we want to go to the next stage, start having more economic activity. i would like to get there. the president's guidelines, i think, for phase 3, you are able to have some of those group activities again. so we absolutely want to get there we are going doing a very safe step-by-step approach. based on the data and what we are seeing. i think that's what folks want to see. i do want to get there because when you think about what's happened with this mitigation, all these little things in life that we don't necessarily talk about in terms of infections or not, weddings, graduations, all these things that are really important moments in people's

lives that have had to be put aside. and you live life to be able to do things like that. so we need to get that back. ainsley: that's so true. i know a young girl that's out here in my neighborhood and she -- they announced that no graduation. she said her mom says she hasn't come out of her room all day she is so upset. the parents are affected too. we raise our kids. we want to experience those events with our kids as well. it's affecting a big group of people. and, steve, i do hope she gets to have that wedding in august. we would all love to go to florida, too. brian: i know. ainsley: governor, let me play this soundbite for you. the president was on with maria talking about vaccines. listen to this. >> i think we are going to have a vaccine by the end of the year. we are doing very well with the vaccine. we are mobilizing our military on the basis that we do have a vaccine, you know, it's a massive job to give this vaccine our military is being mobilized at the end of the year we will be able to give it to the people

rapidly. focus on nursing home and senior citizen centers because that's really, if you look at it, that is so -- that is a very vulnerable group. it's a terrible thing. but, so we are going to be focused on that. ainsley: she recorded it yesterday, governor, and the full thing will run today this morning. what's your reaction to that? >> well, look, i think they are putting all hands on deck for it. i applaud the president for the right approach. i obviously hope we get a vaccine soon. i don't know that that's 100 percent. let's hope we do it. they are putting the pieces in place so that they do have an effective one, it can be distributed. so they are putting their money where their mouth is and i think that's really good and potentially could benefit a lot of americans. brian: keep your eye on shanghai china. and universal that would bring a lot of people back, affordable vacation for some americans. governor desantis, congratulations. you took a risk, out on a limb

ainsley: america together a chaplain and therapy dog caring for front line workers during this pandemic and for this duo it's nothing new. they have been on nearly 5,000 visits over the past seven years. canines for christ chaplain ron leonard and he joins us now with his dog mollie and one of those frobility line workers that they visited laverne tennessee police chief mike walker. good morning to everyone. >> good morning. >> good morning. ainsley: good morning. ron, tell us what you are doing. what is canines for christ and tell us your mission is. >> i would absolutely love. to say canines for christ is what we call a ministry of presence. we have over 900 faithful volunteers and 1,000 plus therapy dogs in 36 states. and four foreign countries. that just go out and just ministry of presence. since covid-19 has hit, a lot of our volunteers are visiting a

were redacted the list was made public by gop senators ron johnson and chuck grassley after requesting it from rick grinell who declassified it on wednesday. johnson had this to say. >> from my standpoint pretty curious that the vice president of the united states be request ing unmasking in this case of general flynn eight days before he left office. griff: the biden came pain firing back in a statement saying these documents have absolutely nothing to do with any fbi investigation and they confirm all normal procedures were followed. any suggestion otherwise is a flatted-out lie and what's more is telling these documents were selectively leaked by republican s abusing their congressional powers to act as arms of the trump campaign after having them provided by a partisan official installed for this very purpose. this as sources tell fox news, that the durham investigation will be taking a hard look at this now-public list as a pool of individuals who knew flynn's name and the press around the

time of the unmasking. to be clear requesting it and receiving the name is not illegal, leaking it to the media is, the office of dni tells fox news more than 9,000 unmasking requests were fulfilled in 2016. meanwhile, in another twist in the flynn case, judge sullivan appointing retired judge john gleason to argue against the pending motion to dismiss and explore the possibility of new purdy jury charges against flynn, and he plead guilty under oath before seeking to withdraw it and the doj is not commenting nor has flynn's attorney unclear what comes next from judge sullivan. brian, ainsley, steve? ainsley: all right, thank you so much, griff let's bring in kentucky gop senator rand paul member of the senate homeland security committee. good morning to you. >> good morning thanks for having me. ainsley: you're welcome. what do you make of all this new information? >> well to me i think it amounts to illegal eavesdropping on someone for political

purposes. people always say it's not against the law to unmask someone but actually for political purposes it is so that's what needs to be investigated. what i want to know is what possible national security reason would there be to unmask flynn? this is a conversation they obviously know who it is because they probably recognize his voice where he introduces himself and he talks to the russian ambassador and so they probably talk about a wide range of issues between russia and the united states. i haven't seen the transcript of this but the question is what could they possibly think, was flynn saying oh, we're going to do something that was illegal? or that would threaten our national security and why was everybody finding out and knowing it was general flynn. the fact what joe biden did was very important judgment but also an abuse of power and precisely what they were accusing trump of during the impeachment. they said oh, you use the power of government to go after a political opponent and that's exactly what biden did here in a partisan way he went after a

political opponent a high ranking official of a new administration of the opposite party, so i think it's a devastating abuse of a power. brian: senator i just don't know how it works maybe you could tell me. if i want to unmask somebody and i'm in the obama white house and the trump white house, do i have to give you a reason in that paperwork to formally get it or because of my rank, or because of my position do i just get that? >> i believe that all you have to do is sign, but also i believe that the instructions on how it's supposed to be used say that it needs to be for a national security reason. it's supposed to be there to protect americans, because realize there was no warrant. they did not go to a judge and say we want to listen to general flynn. they went to a secret probably the foreign intelligence to say we want to listen to the russian ambassador. i'm fine with that but a lot of ordinary people talk to the russian ambassador, i've talked to him and half of the senate has talked to him.

that doesn't mean just because someone is spying maybe that's fine, doesn't mean you can listen and then take parts of the phone call that are private and reveal them and do something with them and that's what they did to flynn so i think it was an illegal eavesdropping, and i think it was done for political purposes which makes it even worse. brian: sure, well if you've talked to the russian ambassador i'm sure you thought i wonder whose got my name under a redaction somewhere. steve: senator, you know, you mentioned joe biden and you're talking about what could have happened back then. couple of days ago he was over on abc, and he was asked about flynn and the former vice president gave two answers in less than one minute. watch this. >> so what did you know about those moves to investigate michael flynn and was there anything improper done? >> i know nothing about those moves to investigate michael flynn. >> i do want to press that you say you didn't know anything about it but you were reported

to be in a january 5, 2017 meeting where you and the president were briefed on the fbi's plan to question michael flynn. >> i thought you asked me whether or not i had anything to do with him being prosecuted i'm sorry. i was aware that there was, that they had asked for an investigation but that's all i know about it. steve: well, that's all he knew on tuesday, senator. what's interesting is now that you look at things, on that particular day, when he was in the oval office that was the same day the chief of staff had requested the apparently got the unmasking of mr. flynn, that's also the same day that sally yates was going to tell the president about the phone call but the president said hey, i've got to tell you about a phone call. he already knew, are we starting to connect some of these dots? >> well you know, steve, i think when joe biden comes on fox & friends the next time and you ask him about the unmasking he will probably explain why this was all appropriate. that is a good question.

he should have asked did you un mask him before this came out and then we would have known whether he was going to lie or not about the unmasking because i have a feeling he would have nice way of saying lied about the unmasking too until he was caught but this is a big thing. the entire inner circle was listening to this phone call not for national security reasons. they were listening to it because they wanted to do anything they could do to damage the incoming administration. they were also doing it because they were desperate because they did not have any evidence of russian collusion, so they were trying so hard to find something because they had gotten the ball rolling on this , and i think if we were to declassify any meetings about crossfire hurricane you'd find that president obama was in those and leading those and i think if you were to ask any of these people under oath was president obama aware of the cuppertino did he approve of the unmasking of general flynn i think you'll find this goes to the very top and this is really scary that they were using the entire enormously powerful apparatus of our intelligence

community to use it against a political opponent that's why i'm fighting in the fisa court or in the fisa reform today to say that americans and political campaigns should not get caught up in this. we should exempt americans and not use the secret court on americans or political campaign s. ainsley: so the acting, go ahead , so the acting dni rick grinell has declined the invitation to testify about the unmasking in front of congress and he does say he's going to continue to be transparent. why did he decline that invitation? >> well i think what's most important is to actually complement, had he not declassified it we would never know it and i think the big thing about classification is it's not about secrets. was any secret revealed that would hurt our enemies? no the secret revealed was there was a kabal of appointees abusing their power but this is what happens is classification

used to cover your tracks not necessarily to protect secrets and i think there's a way to declassify a lot of stuff but we never had a president came in who had people around him because that president had been abused by the intelligence community so this is a real chance for reform so if you ask most of your viewers should we let the secret court investigate political campaigns again, the only way we would prevent this from ever happening again is say no american political campaign should be investigated by a secret court. if you want to investigate trump campaign or the biden campaign you go to a real judge in a constitutional court and you get a real constitutional warrant but you shouldn't be able to do it in secret. brian: we haven't put the piece s together yet as you know and as senator grassley even said right now all we have is the names. we don't have the reason why they wanted the unmasking. we can't fathom why the u.s. ambassador to the united nations would need seven requests. we don't understand why the u.s. ambassador to italy needs to be on this and has

separate requests, except for george papadopoulos does. george papadopoulos says the guy that questioned me was joseph fy sfid, who was in italy so was this maybe the beginning of a international cia effort but we just don't know yet but what's interesting senator listen to this. let's go back to 2017, and i'm going to get you to answer that but let's go back to 2017 with me and listen to these officials being questioned. >> you didn't say one way or another whether even there's an investigation underway. >> correct i don't, especially in a public forum we never confirm or deny a pending investigation. >> but these ever request the unmasking of mr. trump, his associates or any member of congress? >> yes, and in one case i did. i can specifically recall but i can't discuss it any further than that. >> do you recall any u.s. ambassadors asking that names be unmasked? >> i don't. i don't know.

maybe it's ringing a vague bell but i'm not, i could not answer with any confidence. brian: senator having heard what you heard and now what you know, what do you think now? >> well you know, we know james clapper has a history of lying to congress. i don't trust him first of all, but i would think that as you were talking about the reforms or the way we've tried to fix this , what we could do is not only you have to sign your name to do an unmasking, maybe you should have to have a stated reason interest there's x information in the phone call and we think by knowing this person's name it'll help with this national security problem. a paragraph will explain your reasoning and if we instituted that it's such a great idea it is my idea but what i think we should do is maybe i will send a letter to the dni this morning and suggest that we reform the process by making people not only sign when they're unmasking but also they should have to have a stated national security

maria: they're saying you're putting money, business, ahead of lives. president trump: no, no, i think the people that want to see the right thing happen, they agree with me. we have to get our country open. you know, it was up to some people let's keep it closed for a long time, okay? a long time and watch the united states go under. it's not going to happen. never going to happen on my watch. steve: of course it is a public safety issue, but is it also political, senator? >> well i'll give you an example in my state. we have a democratic governor who said and this week, that he's not planning on allowing child care to open until there's a vaccine or a cure. well, really? that would mean we might not have daycare ever again, and working parents couldn't go back to work. that is a ridiculous statement. i think what we've learned so far from looking at this is one-size-fits-all, response by government is wrong. new york was and did have a significant pandemic and in

kentucky we had very little and we've been very lucky. many of the rural states have had very little of this. they shouldn't be treated the same as new york, but we also need to learn that this flu , this virus effects ages quite differently. we've known this almost since the beginning. children have a virtually zero mortality rate. above 80 has a significant mortality rate, particularly in nursing homes. we shouldn't treat them all the same and say everybody needs to stay locked up forever. in fact i think sweden is actually doing the right thing in the sense they kept their kids in school. now we kept our kids out for a half a semester. we be foolish not to get them in in the fall. it's devastating to the community, to the economy, because parents can't work, but it's also devastating to those kids particularly the poor kids who don't have a great ability to be taught at home. ainsley: thank you so much for being with us, senator. >> thank you. ainsley: you're welcome. a big win for the gop republican s flipping a house

lowering taxes was resonating with folks, so we did a fantastic job of evolving despite the stay-at-home orders and every registered voter had a self-addressed stamped envelope sent to them with a ballot so accessibility was very high, and this is a referendum on the message and there's an awakening here in california brian: is the referendum on mail-in voting since it seemed to work in your favor? >> you know, i think that's still yet to be seen. the results were favorable. i think as long as you're running hard as long as you have a good message and a good candidate and a great team you can win any election. having in-person voting centers is extremely valuable still. i think we can do it while mitigating the risk with the covid virus still at play. i don't like the fact that there's not a chain of custody of the mail-in ballots but at least now we have the means to track them electronically online

, and you can at least see when your vote is counted so that's a little different than in the past. brian: obviously you're a strong candidate a decorated navy veteran, there's a lot of strengths you had. i'm just wondering from your experience, do you think california's opening up fast enough or just right or too slow? >> it's a little too slow for my liking especially in our district we have one of the highest unemployment rates in the nation in our district with the large amusement park, a lot of hollywood production and princess cruises is headquartered in our district, so i think we have the guidelines and the policies and i believe that the small business owners, the large corporations and the employees frankly are responsible enough now to start implementing those guidelines and get back to work and you know, we have the means to mitigate the risk of the spread of the virus but we also need to start looking after our economy and get people back to work and do it in a safe manner. brian: you know if republicans take back the house they have to

you're a pro-stock car driver and also report on this on nascar for us. that's so exciting. are you a little nervous knowing you're going to be the only reporter? >> i'm not nervous at all. that's part of my job is to be at the racetrack and is to bring that to the fans and what's happening at the racetrack to the fans. it's been 10 weeks and we're all kind of, we've been at home and wanting to get back out, get back to the racetracks so to finally get there i'm excited about that, i'm excited to see at least see some people walking around the track, true guys drivers getting into the race cars, and you know, it's time. i think we've all been wanting this. we've had our racing for a while and now we got the real thing back. ainsley: i'm so excited that it's nascar, and it's in south carolina which is my home state. you're going to have a lot of extra viewers what can we expect >> well you can expect a very exciting race, so i think the most unique part of this weekend for our sport, there will be no practice. there will be no qualifying the first time these drivers hit

the racetrack is when they drive into turn one and for anybody that's ever heard of darlington it's one of the most difficult tracks on the circuit it's one of the oldest racetracks on the circuit it was designed for cars to go 80 miles an hour they are going 180 miles an hour around this racetrack so it's nerve racking the first 5, 10, 15 laps for these drivers who haven't been in a race car in 10 weeks as you mentioned earlier that's longer than our off season just about so a lot of things go into these guys preparing for this race and i can't wait to see turn one. it's going to be exciting. ainsley: how are you going to interview the drivers and stay safe? >> well we've got a plan to basically keep our social distancing to do all of the things that we need to do, boom mics will be a big part of that so nobody has to use any of the same microphones and things like that so that's something that's been thought out by everybody. i feel like all the right protocols are being taken to keep everybody safe. that's the biggest goal is to keep everybody safe. we're excited to be back on the racetrack, but we got to do it in a safe way. ainsley: what about the driver

ainsley: we're back with a fox news alert the weekly jobless claims just released 2.98 million americans filing for unemployment last week, as the economy reels over the coronavirus, brian. brian: right, this is higher than the economists predicted but down from over 3 million claims the previous week. we're at 36 million americans who filed for unemployment since the start of the pandemic, eight weeks ago, and they say already, 100,000 small businesses are down for the count. that is just before they even try to reopen and maybe realize they can't. let's bring in south carolina senator lindsey graham, chairman of the senate judiciary committee. we have a lot to discuss but first i want you to comment on this. they expect unemployment to go

up as high as 25%, senator what's your reaction to this number? >> well i think it's just unfortunately what was required to save a couple million people from dying. there's no worse news than i've lost my job, my businesses had to close because of mitigation, i can't get work, it's a terrible blow to that family. the only thing worse is to be told your loved one just died of the coronavirus. this is the world that president trump lives in. he had to shut the economy down, to keep a couple million people from dying. the economy will come back, but those who have passed away won't come back and these are the choices we have. ainsley: okay let's talk about the unmasking because i list of names was made public yesterday, and let's pull up some of the people that were requesting unmasking. you have joe biden, james comey, john brennan, james clapper, samantha powers she requested

seven times and dennis mcdonough , who is the chief of staff. i have so many questions for you why were there so many people requesting this unmasking? why wouldn't one person request it and tell us about the process and your reaction to this? >> well number one why are they asking to unmask the incoming national security advisor of the trump adminitration? why do you have the outgoing administration trying to follow conversations of the incoming administration? that is outrageous. general flynn had every right to be talking with the russians about policy differences they have with the obama administration. he could talk to anybody he wanted to talk to about his new job. i guarantee you that every incoming administration during transition reaches out to foreign governments. i doubt that most outgoing administrations spy on them, so this is an outrage, it's at least unethical and we're going to get to the bottom of it. they had no business listening

to anything general flynn was saying about trump policy. brian: right i imagine michael flynn might have had a different kerr with israel than maybe susan rice did because they seem to be putting heads with israel. keep your powder dry it's going to be a lot different when you take over, maybe michael flynn didn't realize there's nothing wrong with that but senator you know the law. there was nothing wrong with them unmasking for so for people to say unmasking means up to something diabolical, you can't put those two together, senator grassley didn't. >> well see here is what i would say. you can request an unmasking of an american citizen whose on the other end of a conversation with a foreign agent, but you have to have a national security reason. here is the concern, that if you don't have a national security reason, you're basically spying or eavesdropping on a political opponent. they hated flynn. they wanted him to be fired before he ever got the job, was

this an effort to undermine flynn or was it really about our national security? i talked to foreign leaders all the time about my differences with obama foreign policy. when president trump wanted to withdraw from syria, i got on the phone and talked to about everybody in the mid east. if i find out they're listening to my conversation and reporting back to the white house, what i'm saying to foreign leaders, that violates separation of powers. this is a big deal. what is the national security reason to unmask general flynn in transition? i can't think of one but i do leave given their behavior they're looking to get rid of flynn and if they used our intelligence apparatus to basically act on a political vendetta that's chilling to every american and be very wrong ainsley: well let's go steve always calls it the "way-back" machine and show you this montage of testimony from comey, clapper and brennan back

i have no recollection of making a request related to general flynn. i have never leaked classified information. i have never leaked names that have come back to me in this highly compartmented process. i have in fact never leaked even unclassified information. what do you think when you hear those sound bites from 2017 and you hear what she said? >> well somebody leaked to the washington post the conversation between general flynn and the russian ambassador during transition. she says it wasn't her but even more chilling, trey gowdy asked samantha powers he showed her a cart where she made over 200 unmasking requests and her answer is i didn't make nearly that many. i didn't make that many unmasking requests so here is the question. if she didn't make those requests, who did under her name? this stinks to high heaven and again you have to have a national security reason to un mask an american citizen whose involved in a conversation with

a foreign entity. it can't be for political curiosity or for political revenge. this stinks to high heaven and what they're about to do to general flynn in federal court is the most disturbing thing i've seen as a lawyer in decades i'll be glad to tell you why. brian: yeah, in a second first i want to go back to 2017 when you had a chance to ask james clapper and sally yates about these unmasking issues, let's watch. >> did anybody ever make a request to unmask the conversation between the russian ambassador and mr. flynn? >> again, senator, i can't answer a question like that. >> i don't. >> is there a way to find that out? >> well in another setting. it could be discussed. >> but there is a record somewhere of who would make a request to unmask the conversation with general flynn and the russian? if one was made there be a record of it?

>> i can't speak to this specific case but i can generally comment that in the case of 702 requests, yes. brian: so what is he not saying and what is he saying in that now that you know? >> well this is a very important exchange because i read in the washington post that on january 12, david ignacious wrote about a conversation between general flynn and former russian ambassador in december. they were talking apparently about a different attitude towards sanctions. obama imposed some sanctions on russia as it was going out the door they were pretty light to be honest with you for interfering in our election and i think the line of attack was that flynn was going to tell the russians we're going to have a new start here, don't retaliate. he had every right to talk to the russians about the trump view of how to engage the russians. the obama administration had no right to unmask that conversation because there's no

legitimate national security purpose here. the logan act does not apply to me as a senator. if i want to call some foreign government and register my disapproval with the administrations foreign policy i'm not committing a crime. i'm not undercutting foreign policy of the administration. i'm able to speak for myself as the united states senator. so, the incoming administration has to be able to conduct business without being spied on by the outgoing administration. ainsley: you're right. real quickly, we wanted to ask you about judge sullivan. what's your response to what he's doing? >> i am very concerned about what i see here. this judge gleason is being appointed for the court. here is the theory of the case. they're going to argue apparently that when judge, when general flynn plead guilty, and changed his plea, they're going to hold him in indiana contempt of cord because when he plead guilty now he's saying he wants to withdraw his plea. he must have lied to the court. here is the one thing we can never tolerate. if the government is withholding

evidence in your case that's exc ulpatory, the court needs to allow you to change your plea based on advice of new counsel so to deny general flynn the ability to change his plea because the government withheld evidence is rewarding bad behavior by the government and to punish him for following advice of a new lawyer, this happens in america all the time. some kid is charged with robbing a store or stealing a car and they find out the cops were a little bit shady, they allow the kid to withdraw his plea and get a fair shake here, so i hope and pray that they're not going down the road of trying to punish general flynn for changing that plea because the government withheld evidence in this case. that be so wrong. brian: it be , but i think that's if you look at this other judge it looks like the road they're heading. senator graham we'll talk to you again. >> they need to prove beyond belief if that happened. thank you. brian: i agree.
