department of justice request to drop charges against michael flynn. this is all theater. there are two parties in every criminal case. the government and the defendant. here the united states and michael flynn. criminal prosecutions are no longer conducted in the village square where everyone holding their pitchforks gets involved and delivers justice usually from the closest tree. judge sullivan you have been a judge for 30 years and you need another judge to co-pilot your way through the simple decision where you collect box on a file and allow for dismissal of the charges. especially where neither the defendant nor the government disagree? this is difficult for you? it's done all the time. don't you have law clerks to help you make decisions? why don't you just at this point

michael flynn. sullivan wants to charge flynn with person are you or lying for pleading guilty. really? should we comarnl every defendant -- should we charge every defendant who pleads not guilty of person are you when they are convicted and found guilty? consider this. what about a defendant who pleads guilty because his lawyers pressure him as was clearly con in this case, telling flynn if he doesn't plead his son will be prosecuted. what about the defendant who pleads because he gets a lesser sentence if he goes to trial and he doesn't want to risk being found guilty. consider where there is new dna evidence, exculpatory evidence

up their telephones again for the first time in 10 or 15 years. we made millions of contacts because people want to break from their lives of every day being stuck with this coronavirus business and being stuck at home. we are getting more and more contact and more and more people are engaged in our campaign while joe biden struggles in the basement to come up with a complete and coherent sentence. judge jeanine: going forward, do you expect the president to be able to start going to rallies and will those rallies depend upon the state and whether the governors of those states are giving it okay? how long does the president wait to get on the road again? >> we saw the president doing an official event in scranton, pennsylvania that joe biden claims as home even though he

hasn't lived there for six decades. the statute of eliminations calling scranton your home expired 60 years ago. but i think you are starting to seat transition. more and more states are opening. some states never closed. but we know the president loves a rally. i think we'll see a reassessment right after the 4th of july. is it safer for the people to come together again. and what precautions are necessary. part of those precautions have to be personal responsibility as well. judge jeanine: with the effort on the part of the left and nancy pelosi to actually fund write-in ballots. how do you think that will play out and what can the campaign do with respect to pretty much shutting down polling places and

requiring people to do write-in ballots. >> what we know is last week in the state of nebraska there was a primary. it was held in person. city worked out fine. in my home state of new hampshire we have an issue who can vote in the election. we are allowing people who weren't residents of the state to vote in our elections. these mail-in ballots are dangerous. it takes a driver's license and stated case to do just about everything. but one of the most important things our country has is this democracy, the integrity of the ballot process. and asking people to show up in person when they are permitted to do so should not be a difficult thing to do. we can keep social distancing but we can't allow mail-in

economy with the federal government. you saw what the house wants to do. it's a wish list similar to what they tried to do when we did 3.0. it's a non-starter. business liability is a concern as we start to restart this economy. many small, medium and large businesses are worried about that. i think more than anything, you hear a lot about testing and all that stuff. businesses are willing to pay attention to the rules. let them have the chance to get going. here in indiana i know that's a key concern. judge jeanine: certainly, senator it's about individual responsibility and understanding what the issues are. i want to talk about this $3.3 trillion relief bill that's called pelosi got out of the house. there are those who call it an

income redistribution bill. even thought it's supposed to be for the pan dem i can, there is no payroll protection plan. there is no liability protection for businesses. those two would seem to be non-starters if this is supposed to be considered a re-opening and protecting the economy and businesses. >> there is no doubt about that. of course, a large portion of it is for state government. and that's a ticklish issue in the sense a lot of state governments don't operate like indiana where we have a balanced budget and have a rainy day fund. so that's going to be a big point of discussion. and again i think they look at this as a way to try and inherently change government to put into affect a lot of their agenda that's not going to work, and i think it american public
