one-day death toll last week. the governors across the country are greenlighting more and more businesses to open doors despite some concerns that enough people will not wear masks or take the proper precautions to stop what is expected to be growing infections nationwide. colorado governor jared was interviewed about all of this this morning on fox news sunday. jared: we are proud to be getting our economy going in a reasonably safe way and a couple of stores have been opened and we are doing this thoughtfully and carefully. we value our partnership with the federal government. there's a time for elections, there's a time for politics, this isn't it. it's a time for managing the crisis together and i'm doing my best to get it done. eric: for more on the economy and what's being done to protect us steve harrigan, in atlanta with more. steve: 7-day death toll stands

over 1400, significant improvement from just 3 weeks ago, down by about 30% and as more states continue to reopen, the former director of the cdc warrants that some parts of the country may be going too quickly >> tragically this is a really bad virus and we are just at the beginning. we are in different places in different parts of the country. in new york city where i am today and where i live we are at the end of the beginning. in some other places of the country it hasn't yet hit in full force. >> so far among states that have reopened there's a real mixed bag of results. in texas as you mentioned, they had highest single-day total of new cases, 1801 but officials in texas say that's largely because of increased testing. in georgia which has also been aggressive in reopening its economy, so far there has not been a spike in new cases, some other things to note, a north

carolina judge has allowed religious organizations to hold services indoors in north carolina and the tsa says air flights, passengers are increasing up almost 50% in the number of passengers since may 1 but the total number of people flying still down by about just a fraction of what it was several weeks ago. and as far as the temperature goes, researchers at harvard and mit say 77-degrees is the magic number. when it gets above that temperature, it's harder for the virus to be transmitted but officials also warn that high temperatures, warmer weather, no substitution for social distancing. eric, back to you. eric: yeah, reopening with no new spike, that is encouraging. steve, thank you. arthel. arthel: eric, thank you, new york goner cuomo giving response to coronavirus pandemic. in fact, let's listen. >> we will be talking to the

regional heads today to find those additional personnel and get them trained and get them ready but that's the only function that has to be performed for those regions to open and, again, that's something that we anticipated and that's just administrative and working together with the regions so we can get that done. so that's good news. today is day 78, day 78, 78 days, a long time or a short time. you can argue both. when you shut down everything and you've gone through the trauma that we've gone through, 78 days is a long time and people are feeling it and they are feeling it in a number of ways. we've talked about it but i don't know that any of us have really explored the depths of the mental health issues that have been created inadvertently

in the 78 days. we have been so anxious about the day-to-day and operationally oriented and we have been talking about hospitalizations, talking about deaths, talking about infection rates, but there's also a more subtle but very present mental health crisis that has been going on. don't underestimate the trauma that this has created for people. out of the blue comes this virus, something we've never seen before, you're living a science fiction movie. it's been incredibly anxiety-producing, traumatic, disturbing and we felt and seen all along evidence that this is creating a significant mental health challenge for people. some of these numbers now that people are reporting, the number

of americans who are reporting serious mental distress, up to 38%, doesn't discriminate by age, right? 18 to 44. it's a multiple of what it's ever been and -- ainsley: that is new york governor andrew cuomo mentioning on this day, 78 of the new york state shutdown, he's highlighting inadvertent mental health crisis created by the covid pandemic and the very seriousness of that angle of this health crisis that the country is dealing with. we will stream this live on foxnews.com if you wish to continue the governor's remarks. meanwhile there's this, president barack obama taking thinly veiled swipe in online commencement speech to graduates of historically black colleges and universities. mr. obama telling the class of 2020 the pandemic has exposed the lack of leadership from

those who are, quote, pretending to be in charge. david spunt is live on the north lawn in the white house with more. hi, david. david: president trump to land in the north lawn after meeting with advisers. the president has repeatedly taken swipes at predecessor barack obama and president obama as you mentioned spoke in front of a class that was -- it was a virtual speech last night, here is what president trump had to say. >> the pandemic is fully finally torn back the curtain on the idea that so many of the folks in charge know what they are doing. a lot of them aren't even pretending to be in charge. if the world is going to get better it's going to be up to you. david: obama supporters say they

did leave a playbook which was part of national security council. senate majority leader mitch mcconnell he echoed the obama criticism last week, listen. >> the obama administration did not leave to this administration any kind of game plan for something like this. david: the week on special report with bret baier, bret spoke to majority leader who then changed his type, listen to this, arthel. >> what the critics fail today note, however, the thin packet of paper was replaced by two detailed robust pandemic response reports, commissioned by the trump administration, exchange this one which i will hand over to my assistant windy for these two pandemic response plans.

democratic campaign for joe biden? >> well, i think it's worth noting that these are former barack obama's first public comments since the coronavirus outbreak began, but he did have remark that is he made on a phone call earlier this month with former members of his administration. i do think that it's something that we will see more of from both barack obama as well as former vice president joe biden in the lead-up to the election in november. obama has very much taken a kind of mode profile while president trump has been in office but we are starting to see really now ramp up mys public appearances and you should expect that given that his former vice president is now the democratic front runner and we should see a lot more of him and significant that he didn't use the president's name but clear that he was criticizing his leadership in the time of crisis.

eric: yeah, he just mentioned the phone call that was leaked, purposely leaked, of course, in which he says partisan, quote, during divided, seeing others as the enemy that's become stronger impulse in american life. playing on the divisions and, of course, the position would be that this is the president's fault. >> alayna: barack obama has been criticizing both the administration but president trump specifically and the theme that we have seen in both of these in the commencement address yesterday but as well on the call earlier this month is attacks on his leadership especially during this coronavirus pandemic. he's newsing the virus to really shed a light on what he sees as the administration's failure of leadership here and i think that will continue to be a key point in his remarks regarding the virus and the administration,

but also in the biden campaign which we have seen use the virus as attack on president trump. eric: the president meanwhile tweet with one word obamagate and tweeted out saying that they are being successful against coronavirus. here is something else that the former president said during the graduation speech last night referring to likening adults to kids, here it is. >> doing what feels good, what's convenient, what's easy, that's how little kids thing. unfortunately a lot of so-called grown-ups with important jobs still think that way and this is why things are so screwed up. eric: what do we take from that in terms of potential criticism of the president? >> alayna: so i think that he's saying that president trump

essentially again without using his name is being like a little kid, not showing leadership and not stepping up to the plate in this time of crisis and though they are similar to those attacks that he used on phone call earlier this month and i think that if you look ahead to what we should expect in the next few months you will continue to see him likening the president not being proper leader and need to vote out of office in november and continue to say that, look, we need to look back what america needs right now and he's going to say that's former vice president biden. eric: and the president, current president expect today land in the lawn within the next half hour. he could speak. perhaps he certainly won't want to muzzle himself. what do you think he will say in response to president obama, will he discuss the previous virus situations, the record of the economy, the russia

investigation, how will he attack him, will he? >> alayna: i think all of those are probably lines of attack or lines of response that you can expect from the president. i think obamagate, the tweet that you mentioned earlier, is exactly the type of response that we will be seeing from several of his administration officials and i think that, again, the president is not afraid to lay into the former vice president. we have seen attacks ramp up on twitter in the last few days about obamagate and his administration's surveillance officials including his former national security michael flynn, so that i'm sure will be brought up and, of course, they'll try to correct the record in saying that his response has been great and they are looking at helping the economy and being tough on china, all of the things we heard the president and his administration officials say in the past few weeks with regard to any attacks on their response to the pandemic. eric: seems like a preview of

what we can expect in the next few months into november, alayna treene of axios, thank you so much for joining us today. >> alayna: take care. arthel: this is a fox news alert, an explosion at a hash oil manufacturer in downtown los angeles last night after crews responded to reports of a fire at a commercial building. firefighters running for their lives as a ball of flames shout-out of the building. 3 of them reported in critical condition. christina coleman live in los angeles with more. christina: arthel, the firefighters are recovering from burned injuries, 3 of them suffered critical but nonlife threatening injuries. take a look at intense video of the moment fire expanded into what officials are calling a significant explosion or a flashover, the fire happened at

6:30 yesterday evening, warehouse distributor with tanks to honey oil. firefighters were inside the building and on the roof to try to find the source of the fire when the huge explosion took place. they tried to get the crews right out before the explosion because things didn't look right to them but some still got hurt. take a look at the intense may day call for help. [inaudible] >> i need you to go and assist engines for two down firefighters. christina: firefighters had to run through ball of flames and some scrambled down in ladder engulfed in flames to get to safety. the explosion was so powerful that damaged several nearby store fronts, blackened a fire engine and melted some of the

firefighters' helmets and significantly damaged firefighter equipment, huge ball of flames, crews were able to extinguish the flames last night. the mayor showing appreciation. >> the good news is everybody will make it. we heard the news and raced here as quickly as possible. firefighters are shaken up. >> when one of your own is injured and at the time i was talking to them we didn't know the extent of the injuries. you can imagine the amount of emotional stress. >> kris kris cause of the fire is unknown right now, the fire chief says the on-scene investigation could take several days. arthel. arthel: boy, kristina, what a strong reminder of how dangerous the jobs of firefighters, they go into danger every day, it could happen at any moment, boy

arthel: tropical storm arthur forming in the atlantic off the florida coast, weeks before the official start of hurricane season. it's expected to brush the outer banks of north carolina by monday. meteorologist adam klotz live with the forecast, so adam, this is early, does this signal an active hurricane season? adam: it is going to be active hurricane season, arthel. arthur still a couple of weeks early, typically we would be getting the season on june 1st, instead we already have the tropical storm, maybe impact the coast by tomorrow morning.

currently 45-miles-per-hour but this is the potential path as we track tropical storm arthur into monday morning and into tuesday, very close pass there by the north carolina outer banks. the timeline of this, well, here is your tropical models. several models are move ago long. the majority of them keep just off the coast on early monday morning, several tracks, do run over the outer banks, that's still a possibility at this point. it's something that we will be watching, definitely close enough that they'll be impacts across the entire area, north carolina, everything you're looking at there in the yellow box, those are tropical storm warnings at this point. we will be talking about surf, high winds and then, of course, whenever you get a system like this also some potentially very heavy rains. so, again, the system lifting up by early monday morning making the path, this potential model, particular model keeps most of the heavy rain off the coast. you see 6 to 8-inch rain sitting

just off the coastline and you can be talking about flooding in some areas. yes, above average activity is expected this season. as far as the storms before june 1st, this is actually happened in the last 4, 25 years, becoming the new normal where we get a storm in may and we are getting it right now. arthel: okay, we will be prepared, adam klotz, thank you. eric. eric: look at that. nascar is back, that's what it says, big day for sports fans who have been starving for action. now finally ramping up engines after shutting down because of two months because of the pandemic. the first race today in south carolina and restrictions, no fans in the stands, limited pit crews and health checks for all of those who are being or leaving the track.

mark meredith live at darlington with the very latest on the race and the preparations, hey, mark. mark: hey, eric, good afternoon, as you mentioned it is race day but you would never know anywhere i am because there are no fans here to witness what will be happening this afternoon. instead nascar says it's doing all it can to protect both the drivers and the crew and we are seeing some of the new normal and one of the photos taken showing 23-year-old driver getting temperature check as coming into facility. a sign of new era for nascar. this is one of the many things that nascar is working onto make sure that the race is safe, screening for drivers, teams are being limited to 16 people maximum. the schedule for there week was consolidated. even most of the journalists who cover nascar won't be here, fox sports will call announcers call the race in studios in charlotte

studios and not darlington. we talked to one race team who says they don't believe things will seem that much different. >> all you hear is race engines and will sound exactly the same from home. the stands will be empty but you will hear it and feel it. i think other sports may feel more different because when there's a good play and you don't hear cheers that will sound on but in our sport you don't normally hear that anyway. mark: if you're watching the race, frontline workers, people are trying to help the country battle the coronavirus, this race being dedicated in honor of them, but as i mentioned back out here live, it is surreal to see the stadium empty. the race tack -- track and no fans tailgating, this year certainly has a different feel,

open beaches this friday, limiting the crowd size and on the beach with face mask. new york governor andrew cuomo encouraging new yorkers to get tested for coronavirus, he was tested himself during daily briefing just a few moments ago. aishah hasine live on the governor's test and what to expect this weekend. aishah: governors in the northeast reminding everyone that you are in control of what happens here next and as you said, memorial day weekend will be a big test for what happens. now, new jersey dipping its toes so to speak in the water this weekend, large crowds descending on the few beaches that reopened on friday. one beach supervisor at momouth county saying they were behaving and social distancing and also outdoor theaters like warwick,

drive-in opened up in new york for the first time this season, new york governor cuomo said he is expecting the numbers to fluctuate up and down as the state reopens. he's among several governors asking people to take individual responsibility over their actions so there isn't a second spike. >> again, we write about where we were when we started. we just don't -- we want to make sure we don't go back to the hell that we've gone through. aishah: new yorkers travel to new albany saturday to protest governor cuomo. the rally organizer told fox people believe the governor is stepping on their civil liberties and setting a terrible precedence for the future and protestors rallying at the illinois state capitol and congressman says his district is mostly rural where people are able to social distance more easily. here he is on "fox & friends"

this morning. >> they're being treated as if they're in a hot spot like chicago and the governor when he comes out and threatens things like i'm going to withhold federal funding from the local communities, that makes people even angrier. aishah: by the way, that drive-in theater reopened in warwick, new jersey, by the end of this weekend, eric, 48 states will have reopened across the nation in some capacity. eric. eric: all right, if they have in the northeast mandatory masks at the beach that means tan lines for masks will be the new vogue at least in the northeast. all right, aishah, thank you, arthel. arthel: all right, eric, well, lawmakers and the trump administration officials expected to make major revisions to the payment protection program to give small businesses more leeway on how they can spend government pandemic relief

fund. let's bring in cpa at the marks group joining us via skype. let's start with the news about the ppp there and with more spending leeway but also restrictions specifically pertaining for loan forgiveness which is what most small businesses rely on, so what stands out to you. >> good to see you. the treasury department released new guidelines on friday for businesses to follow because, arthel, the big issue that we have among small business that receive the loans and even the ones that are waiting to get the loans, how will the loans will be forgiven, so there are a lot of questions about the types of expenses that are allowed and the types of payroll cost that is could be forgiven as well, the period that it can be forgiven and without getting into the details here my recommendation is go to sba's

website, sba.gov and new guidelines are there and as you're tracking expenses and want to get forgiveness, the guidelines, you can follow them. unfortunately there's a big issues that are still open, arthel, one one of the biggest t owners are concerned of 8-week period of expenses that can be forgiven and a lot of businesses aren't open yet or starting to open. they don't have those kind of payroll expenses to be forgiven. big changes could be on the way. the treasury department and congress in another stimulus bill could be making more changes that will extend the 8-week period and also hopefully the mix of expenses that you can use whether it's payroll and some other operating expenses. so fingers crossed that the changes come sooner rather than later. arthel: perhaps that's in the leeway, more leeway for these --

for the ppp, maybe that's part of it. >> gene: it is, the only leeway given is certain specifics of what exists right now. so, for example, some people are asking if they pay their payroll right now, can they get forgiven if they've incurred but haven't paid it yet and there are new guidelines that give you some guidance on doing that. other people were saying, gee, can i get forgiveness for rent expense that i pay. it's just my office or how about if i'm renting piece of equipment, something like that, again, the -- >> arthel: hair salon. >> gene: if you're running hair salon, you have equipment, forgiveness so that's good news. arthel: okay that is good news. let's move onto this, millions of americans are relying on stimulus checks and

unemployment, so are stimulus checks tax free, are unemployment checks tax free, in other words, do you have to pay taxes on either? >> the stimulus checks are tax free. so the people getting stimulus checks now would not have to pay taxes on that, but unemployment is not tax free, so whatever compensation you're getting under unemployment from your state including the additional federal, $600 a week through the end of july, all of that is still taxable. that's very important that you bring up, arthel, because a lot of people like hair salons, for example, hair stylist might be independent contractor and they are trying to figure out should i get unemployment or should i apply for payment protection program. you can do both but you can only choose one. your unemployment may be less than you think because it is taxable. arthel: okay, so let me jump in right there. so here is a scenario, you apply for sba loan, okay, the small

business loan, you -- you give your ein and your social security number, if you employ yourself through your business, okay, are you also eligible to receive a stimulus check? >> so, yeah, a stimulus check you are still eligible to receive personally assuming that you meet the income criteria, but you are still eligible to receive a stimulus check. if you apply for the sba loan, the paycheck protection program loan, and you apply for unemployment, which you can apply for both but you can only take one or the other. in other words, no double dipping and the reason, arthel, say you're getting money forgiven for your payroll through the paycheck protection program, you can't also be receiving unemployment income as well for that 8-week period of forgiveness. again, just to recap, you can get a stimulus check if you're also supplying for sba loan but you cannot get both unemployment and the paycheck protection loan

money at the same time. it's an overlap, it's like double dipping, hope that makes sense. arthel: thank you, that makes sense, thank you. finally you have female-owned, african-american owned businesses they are at the end to have line of ppe payout, how can they move closer to the front of the line to get assistance that they desperately need? >> gene: that's such a great question. unfortunately a lot of minority-own businesses have not been receiving loans to the same extent as others. some in a lot of cases is just education, they are not aware of the loans that are available to them or maybe they're not used to getting loans because they haven't seen that kind of funding out. my advice if you're a minority-owned business, you should be aggressively calling up your local bankers. i recommend a good-local community bank and making sure they're aware of you and asking for help to apply for the loans. some people i talked that are

minority-owned businesses weren't aware that they were eligible or had never had a banking relationship before. now is the time, arthel, of any time to start a good banking relationship, so talk to your community banker, good independent banker, introduce yourself and aggressive i will say i want to apply for the sba-backed loans, please help me. you will find a lot of great bankers that are there to help you do that. arthel: gene marks at gene marks, thank you. eric. eric: arthel, new details are coming to light about the former police officer who is charged with shooting death of unarmed robber ahmaud arbery and the how the text messages could impact the case. we are taking a look next

jogger ahmaud arbery in georgia, newly obtained text messages showed glenn county police officer talking to the home owner of home under construction about potential trespassing incident and can contact former investigator gregory mcmichael himself. mcmichael himself leaked video to local atlanta radio station. mcmichael and son travis are both charged in the deadly shooting. former georgia u.s. attorney michael jay moore joins us now via skype. so let's walk-through this. glenn county police officer told long-distance owner to have home that's under construction that he could contact gregory mcmichael for help with potential trespassing seen in surveillance video from the property. what does this reveal and does it suggest that gregory mcmichael was on heightened extra sensitive alert as local

guard over the property? >> well, i really think, arthel, that it reveals probably poor judgment on the part of the police officer. i mean, if they look into mr. mcmichael's record he lost certification at the time and so that's an issue when you think about assigning somebody or pointing them out as potential law enforcement type in the neighborhood. but it really doesn't change the analysis because what we know is that the -- the key state of mind or the knowledge goes back to mcmichael, what did hi know on the day on the day he was shot. the only thing he saw a black guy and talked about -- a black guy running his blank off down the road and nothing about the video and, again, that's backed up now by the homeowners lawyer who said in fact, the home owner had not seen the video of arbery looking around the house until after mr. arbery was killed.

arthel: okay, so meanwhile you have the attorneys for gregory mcmichaels issuing a statement friday saying in part that their client, quote, did not commit murder. ahmaud arbery is did, how did they come up with that? >> well, i think they may be talking about a technical issue in the law and change, i know the lawyers, they are good lawyers and friends of mine. really what they are saying is that his son, the younger mr. mcmichael, travis mcmichael is the one who fired the gun, if you aid or abet, solicit or encourage someone else to do the crime that in fact, makes you party to the crime and let me give you an example. let's say somebody holds up the liquor store and they kill the clerk of the store, well, the guy who is driving the car can also be culpable in the murder of the -- of the store clerk. so while it may be that mr. greg

mcmichael didn't pull the trigger, the question is whether or not there's evidence that he was a party to that by aiding and abetting and encouraging soliciting, procuring somebody else to do it and when in fact, he ran into the house -- arthel: which would be his son. >> correct. arthel: which would be his son. >> maybe a closer pattern of -- of encouragement or solicitation to participate in the chase of mr. arbery. arthel: and then so travis mcmichael's attorneys commenting that travis had been vilified before his voice could even be heard adding that the truth in the case will exonerate travis. again, i'm not sure what i am missing there, you've already touched on that and i want to go on and ask you if there's any pursuit of charges against all officials involved of what could appear to have been cover-up, quickly. >> you know, the state attorney
