about unmasking, leaking raw intelligence and surveillance. take a look. >> general flynn is a wonderful man. i think he's been treated very, very unfairly by the media. as i call it, the fake media. and i think it is really a sad thing he was treated so badly. i think in addition to that from intelligence, papers are being leaked, things are being leaked, criminal action has been going on for a long time before me. but now it is really going on. and people are trying to cover up for a terrible loss under hillary clinton. i think it is very, very unfair what is happening to general flynn the way he was treated in the documents and papers that were illegally and i stress illegally leaked. very, very unfair.

>> sean: all right, thursday at the white house talking about mike flynn's resignation and the leaks from intelligence agencies. prior to the press conference early this morning, trump tweeted "the real scandal is the classified information is illegally given out by intelligence, like candy, very un-american." joining us from house intelligence chairman devin nunes is with us. congressman, good to see you again. isn't it a crime, in fact to leak this information? isn't it a violation of the espionage act among other things? >> there could have been multiple crimes committed, sean, for sure leaking classified information is punishable by law. this needs to be looked into by the appropriate agencies. in fact, our committee will request agencies look into this to try to bring these perpetrators accountable and hold them accountable under the law. >> sean: i want to go back and

this was a little notice piece in "the new york times." the waning days of the administration. and actually said the obama administration expanded the power of the national security agency to share globally intercepted personal communications with the government 16 other intelligence agencies before applying privacy protections. does that mean the list of potential leakers is that much bigger or not? >> well, if that is the case, we were never notified of that the house intelligence committee. what i will say, sean, it is not just about what leaked, the transcripts that leaked on general flynn. it is also about the transcripts donald trump talking to the mexican president, talking to the australian prime minister, those also leaked. so this is a state here falling apart and totally unacceptable for anyone within government to be doing this. malcolm i think most of this is probably for people in the

administration, but there still could be some people that have burrowed in and providing classified information to the media. >> sean: it is clearly a violation of law, is that not congressman? isn't this the type of thing where if you have robed intelligence people, and they are intercepting from illegally intercepting phone calls of americans, that is illegal. in other words, if, in fact, they wanted to get the intel or for example hack into the phone in this particular case, general flynn, wouldn't they have to get a court subpoena to do so? >> that is correct. i'm not aware that they did that. so my guess is the intelligence agencies did not do this. when i'm assuming is that this was picked up as they were tracking and if that is the case, that would have to go to the highest levels of the obama administration to get approval to unmask who that person is,

and in this case that was general flynn. and if you look at these leaks, sean, it looks like these original leaks, leaks that the media had at the beginning of january. >> sean: that would mean -- the attorney general, would you recommend the attorney general convene a grand jury to get to the bottom of this? >> well, look, the first thing that would have to happen is the fbi needs to do a full investigation of this and try to track down the leaker. >> sean: former cia director john brennan testified on public till today as part of the investigation into whether russia interfered in the 2016 presidential election. this comes as a new, explosive report by circuit news, john solomon and sara carter details how obama intelligence agency violated americans privacy for years and then secretly disclosed this at a closed-door hearing just days before

president donald trump was elected. and today during his congressional testimony, brennan had this to say about whether or not he personally requested to have americans names unmasked. watch this. >> we are talking about prohibitions that you place on yourself with respect to identifying u.s. persons as part of the surveillance programs, right? >> that's correct. >> and you just cited some of the very important reasons that we do that. and i would assume that there is a process. a protocol under which the intelligence community goes through if they seek to unmask a use u.s. persons. >> that is correct. >> have you ever requested a u.s. persons to be unmasked? >> sean: the breaking news from circa, let's start with you sarah, this breaking news report and a lot more to come tomorrow as i understand it. >> yes, sean. what we know is this.

we just broke the story yesterday with the cia, the largest consumer of unmasking americans of any agency that we know right now. we can't give you exact numbers because those are classified, but we know the majority of unmasking of americans occurred with the cia. what is even more interesting about that is that under the cia's own purview, since 1947, they were charter is not to spy on americans. so the question is, why are they doing this? what are they looking at and what purposes? what john and i are also breaking is that we know that the nsa under obama violated the privacy protection when they were searching actually the databases at the nsa. so nobody knew this until we were able to get our hands on these documents, john and i. these are from the fisa courts.

what happened is obama last fall, his administration actually admitted to the court that they had been in violation of these rules. and they were actually chastised by the courts. severely chastised, saying they were, you know, violating the fourth amendment rights of americans. and i think these are two very serious issues. >> sean: all right, i want you to propose this, john, if you may come if you can for the audience, the increase in surveillance that you saw in the this election cycle, this is march 2015, the presidential cycle, the recent one started. what you saw in terms of surveillance, unmasking the prince will make the percentage of increase and i think i got it wrong, 600 by over 350%. and connected to what sarah explained to the audience. >> you said a couple of weeks ago that it felt like we were peeling back and onion. that is exactly what we done. obama loosened the rules to

allow espionage community to look at american data. then we reported they look at donald trump's associates and unmask intelligence report. they reported they unmasked members of congress. then we reported that a number of unmasking tripled, 300% increase under barack obama after he change the rules. tonight for the first time, we can say confidently there has been a finding that some of the espionage, spying on americans, actually violated the law appear the court concluded it violated the fourth amendment protection against illegal search and seizure appearance will be gone from something at the beginning susan rice defended herself that all of this is a legal and governed by tight rules to now yes, we violated those rules. and they disclose that days before trump was elected president. there is a reason to go to the court that late in the election season and we will have to find out why they did it. >> sean: i want to ask you both because this is so important. a dramatic increase in surveillance, unmasking and intelligence leaking has occurred.

we have john brennan today admitting a unmasking occurred. i guess with the american people really need to know and sara i will throw this to you. we need to know with this government under the guise they have been using national security, use the weaponry of our intelligence agencies to spy, unmask, political opponents in an election cycle. political opposition and a political cycle and how deep does it go? in other words, how high up does it go? does that make sense? >> yeah, it does make sense, sean. there is enough evidence that we've been able to present through our numerous stories and our investigation to suggest that somebody needs to look into this. now, remember all of these documents are highly classified. so if anybody was to leak to us, let's say a report collected like a tax cut or fisa report that they actually saw her, then we don't know what they were looking at. we don't know.

useless. they had debunked it and they knew it wasn't true. they knew the sub source after three interviews had said, steel, that is not accurate. august 2nd, 2017 acting ag rod rosenstein providing robert mueller with a letter detailing the scope of the investigation. that scope consisted of a few dozen faceless charges and a few allegations totally unrelated to collusion! the accusations against general flynn had previously been debunked by the fbi in early january. premeditated fraud on a fisa court. they were warned before october 2016 fisa application. we have in these papers, andrew mccabe admitting, i don't know -- he actually said i don't know if any of it is true. then he also said, without it, they would have never gotten this piece fisa application approved. guys like adam schiff had been hiding from we the people this time we found out today.
