eric: health officials in washington are warning that we are not out of the woods yet despite some of the encouraging news. florida, this is been new cases reported in tampa and the st. petersburg areas. more in texas, south carolina, arizona, oklahoma, michigan, wisconsin among other spots, this as testing is ramping up, live at the white house on the north lawn with the very latest from their. reporter: good afternoon, the presidents coronavirus task force said they cannot let their guard down even as governors nation begin to ease the health restrictions. the president tweeted that he sees the number of cases are dropping and the number of deaths going down, the white house remains focused on major cities like chicago, los angeles and d.c. they are still struggling to contain the virus. we heard from deborah birx on "fox news sunday" who encouraged americans who may be venturing out for the first time to take every precaution they can.

the science and research conducted at the cdc as well as what guidelines are listed on the website. >> cdc remains the best public health agency in the world and they have definitely made some mistakes here the americans are going for information advice and recommendation and they've had more than 1.3 billion clicks on their website, it's where i go for the most up-to-date information. they had a new subsite that looked at test data and that is not been collected before, was collected from state and local government and there were some airs and how that was collected. but the best place to go if you want the most recent information on covid is covid veal, it's a weekly report from cdc and it shows really well analyze data of what is happening. and it's once a week people want something quicker when they try to get something quicker there were imperfections of the data.

display. what is more concerning to you? >> when we look around the world and the united states, we see the places that are doing best are the places that are guided by and support public health. that is how we can get out of this. this is about science, fax, it's a bad virus, there's only one enemy, it's a virus. it will not kill us all, it is undermining our economy. they said if people don't want to come out to the ballpark, how will you stop them. as we open and less people of confidence, our economy is not going to bounce back. that is why we need to do contact tracing, test, isolate, pointing, that's why we need to wear masks when word near other people outside, that protects all of us. that's what we have to protect the vulnerable and recognize that the virus is here to stay for a while and if we want to get our economy and our lives

back, as soon and as safely as possible, we have to work together. arthel: i have to tell you, conversations i am having, it seems like some of the sheen is off of the cdc as it appears that politics seem to take over what they're putting on the website, how their positioning their data et cetera. please correct the record if that is in fact wrong, people need to know that the cdc is not compromised by politics. can you assure us that that is the case, that the cdc is not compromised by politics? >> the cdc has 20000 health professionals, they work around the clock to keep people safe. what you want to go to on the cdc website are the recommendations, their standard data, fundamentally i will feel safer when we have regulated directly from the cdc. they have not had a press conference about this virus since ten weeks ago. that is unheard of. they belong to the american people, there is a national

institution, there's a global resource. the more we hear from them, the more we can understand what is happening, what they're doing and what the answers are. i know they're working to help and dozens and dozens of outbreak situations around the country, they have thousands of people working on this but i wish they were allowed to speak directly to the american people to answer questions that people have and to explain what were learning about the virus. we would all be safer. arthel: i understood, i'll read between the lines for that. my interpretation, more of the scientist and less of the politicians at the microphone because the scientist have the facts, not the politicians. doctor tom frieden, thank you very much. thank you for your expertise. thank you. eric: yogi bear, said it ain't over until it's over. and it is not yet over. meanwhile president trump on friday, he declared houses of worship as essential in the

order the nation's governors to let churches reopen. some governors are pushing back saying the president does not have jurisdiction over state laws and pointed out that some pastors and parishioners have been infected. as it turns out, not everybody in their religious community is ready to return to normal. >> we are wanting our governor and our state to no longer discriminate against churches in their phase-in plans, maybe all of us in the south side of milwaukee have faced this virus very closely by having to deal with the sick parishioners, so then people understand. >> chief religion correspondent lauren greene is live outside the church on the west side of manhattan. >> many churches felt like president trump's announcement declaring all churches, houses of worship are long overdue,

salon will get tested. all this is the city moves to ease coronavirus restrictions on the public. >> president obama, jim comey agree that any investigation conducted into general flynn would be buy the book, i don't know what book they were reading. this is the justice manual and jim comey did not follow the justice manual pursuing the prosecution and interview of general flynn. i think there are very curious issues including what susan rice said in an interview that she denied she had any awareness of this. >> that is former acting attorney, questioning the motives of the obama administration in terms of the investigation of former general michael flynn. this is the federal judge was overseeing the case, justice emmett sullivan, justice sullivan has retained a new lawyer to advise him on whether to drop the charges against the president's former national

security advisor as both the justice department and flynn's lawyer have requested. he already brought on another former judge to argue against the move to throughout the case, this could get complicated. former chief counsel and senior advisor to the senate former relations committee. what happens when the judge lawyer is up, you have the appeals court reviewing judge and sullivan's decision not to dismiss the case. they want an answer by a week from tomorrow. why is he pushing back? >> it is an interesting situation, flynn's lawyers have an order from the court of appeals directing the judge sullivan to not appoint any additional friends of the court to give a briefing in the justice department's request to submit the underlying cases

against flynn. the justice department wants to get rid of the case where flynn led guilty and the judge is saying they will get all the decisions that i early entered a guilty plea so i fight between the judge itself, the justice department and the court of appeals involved to see what's going to happen here in the next week and half or so. eric: is it your sense that he's doing this as a legitimate legal matter, questioning everything and dotting every i so he would not be overruled or is there something else going on? >> obviously judge sullivan's were concerned about what general flynn played guilty to, he made that clear when he was determining and assessing the sentence for general flynn. at the same time, it is important to do the right thing to make sure all the teaser cross in the ayes are dotted in this case, in a case like this which is very unusual where the defendant has played guilty in the justice department says they want to withdraw the underlying information which he pled guilty

and admitted guilt of in the entered a judgment, it's an odd scenario. the judge probably tried to do the right thing and flynn's lawyers are doing the right thing by saying this is not the right approach and we should something just accept the justice department's prosecuting or not prosecuting general flynn as it were. eric: sidney powell, the lawyer in the defense saying he was forced to plead guilty and we will try to son and they played dirty pool according to them. and then you have the fbi memos are, from an interview in which the investigators themselves during this did not think that he lied or was lying to them. >> the fbi memos are very troubling that they will go and try to get a sitting government official to lie intentionally without going to the normal process of the justice department including the deputy attorney general was shocked that this actually happen, deep

concerns about the fbi handling this. at the same time there were underlying issues about his son and him doing work on behalf of the government of turkey. the plea related to the underlying question about the conversation with the russian ambassador and they mentioned the plea agreement and the foreign agent with mistakes and errors and untruths, that is also played here, it's unclear how this plays out in everything we've played out to date relates what they didn't do appropriately there or had problems with their and not issues with the turkey issues, that's a separate matter that has to be dealt with. eric: there's a lot here, it will come out during the senate hearings. lindsey graham saying he's having a crossfire hurricane hearing, here is senator graham saying what he expects. >> i want the american people to know about crossfire hurricane, allowed supporting buller to do his investigation without interference to think crossfire

phase two as accounting reopening plan. christina coleman is live in los angeles with more plans on slowly getting back to normal if and when that is possible. reporter: we have different counties in california that are in different stages of the government for phase plan to ease restrictions, it did not stop 2000 people from protesting at california's capital, this is one of at least 12 reopen protests that happen across the country yesterday, this rally was reportedly the largest anti-lockdown protest yet in sacramento, many demonstrators fired up over california state home order which had been in place since mid-march, many who do not support the lockdown protest fear of flareup in the virus, as of today there's more than 1.6 million cases of covid-19 in the u.s. and more than 97000 deaths. were approaching the grim marker of 100,000 deaths in just a matter of days.

as the fight against the virus continues, more states continue to reopen businesses gradually. in arkansas, they have been lifting restrictions, even though the state has had an increase in cases over the past 30 days. here is the governor on that. >> we are following and tracing where those are coming from and they're not coming from the fact that we lifted the restrictions. you have to manage the risk and we believe comfortable in terms of meeting the criteria during phase one. reporter: there has been 5775 cases of coronavirus in arkansas so far. in 115 deaths. eric: meanwhile the nursing home tragedies, especially here in new york state. it is become an increasing scandal and thousands of other residents in nursing homes and long-term care facilities and some staff across the country died from the outbreak, what are

they doing to try to get to the bottom of this and protect nursing homes and a better way? >> nursing homes hit hard by this deadly virus, two weeks ago the white house urged governors to test every staff member and resident at nursing homes for the virus within 14 days but many states are not going to meet the deadline saying they do not have the manpower to do it. here is mark, the president of the health association on "fox news sunday". >> the country was too concerned with hospitals being overrun and there were consequences to that, one of the consequences as nursing homes were left out, residents were not high-purity or testing, we were not given the equipment we needed, there needs to be some accountability for all these people making these fantastic estimates of the entire hospital system across the country was going to be overrun. it wasn't and there are consequences. reporter: he says nursing homes and lawn care facilities are in recovery mode right now and pointed out the trump administration allocated

cheering crowds coming of the sounds of engines, when you're there, how does that change the dynamic of the atmosphere? >> absolutely, it is not like other sports like basketball or football, when you hear the crowd, obviously with cars you hear the noise of the engine. we will still have that and still have the energy. but instead of walking around the infield going and see in the cars in the garage is where it is usually packed with fans, people get up close and personal, that is what is part of the sport to get the access, we don't have any of that, you walk out there and it's easy to go anywhere in its easy as a reporter to get my work done but it's weird, we missed the fans tremendously and they will be back when it is safe but right now we get to race and we still get to put on a show for everyone watching at home. eric: we were just seeing video of the names of falling service members who are being honored on this memorial day weekend with

the names on the windshield, that is a really special tribute and the drivers will be pulling the pit for a moment to honor those who are falling, tell me about that. >> nascar always honors our military, our fallen and especially today, that's what it's all about, we remember those that we have lost in every car as you mentioned, at the halfway point after the second stage, all cars will come down pit lane, they will turn off the engine for a moment of remembrance. that's what we started doing a couple of years ago in her ability has been lost and that's one big thing that we are missing, usually we see all the military families that keep coming out and forget about the heavy hardship in the media attention that they deserve,

arthel: even during a time of crisis, one chicago restaurant is finding a way to give back to some of the most vulnerable among us including our vets, matt has that story. reporter: as chicago family-owned restaurant was forced to stop seeding customers. >> this is for two senior meals, and started feeding hungry veterans outside of its stores. >> good morning, how are you. >> we went out of our way to take care of me, my wife has alzheimer's. she does not cook anything anymore. >> country house restaurant has cooked up 1503 meals a day for veterans in the pandemic. >> it is out of honor to them, they earned it, we did not. >> the family says it became clear they might be forced to shut down. we said if that happens.

reporter: they have given away 100,000 meals to anyone who needs it. $240,000 of their own money and hundred $30000 in donations. including a veteran who donated half of the stimulus check and support from of dfw. >> veterans are looked at a lot different than they were 20 years ago. it is very important, there is a lot of veterans that are up against it. >> the restaurant partner with volunteers of america delivering meals to housing complex with 67 veteran families. >> it's not just their bringing in food but they are reminding them that we are also connected and there's people out there that see them and hear them and are still caring for them. reporter: cooking all the delicious meals has kept the restaurant busy. he has received federal relief and has not had to lay off any of the 215 employees. they are raising to the occasion to feed the hungry. >> are you a senior, are you a
