training, abuse, obviously. you can see the crowd, the people are reacting. anyway, we are going to get the back in a second. we have hard breaking news from the department of justice. reportal investigative just breaking good but first, mike tobin on the ground with j the very latest on this situation unfolding tonight in minneapolis. what's going on? >> let me give you a look around,e, sean. right next to me is a makeshift barricade the demonstrators erected. from local target stacked up in the streets, checking down my chanting a lot of different things. george floyd, the man who was killed here. now we are at the third precinct, and this is the precinct from which those police officers were dispatched. that's arsene as we go on. looking back at the police headquarters now, some of the

glass has broken out in the third precinct. you've got a lot of police officers at the ready right now. some of what they have are from the rubber bullets, some of the taser is at their side, there has been the lot of pepper spray deployed tonight. there have been some of the flash bangs deployed tonight. the way it starts, there is a bit of a back-and-forth. you'll see a lot of the crowd here, the usual chanting, and you'll see something flying over the crowd. plastic bottles, in case rocks. the police respond. usually in that area where the flash bang hits or what not, you'll thehe demonstrators scatter. that area will be vacant for a little while until they fill it in again. you hearhi some of the demonstrators saying right now, they have guns, we have signs bearing art situation here. angry demonstrators. you saw that the four police officer is connected to the incident where were fired swift.

you saw the president, here is one of the guys saying, they ought to be up arrested. that's not enough for these protesters bear they are saying, no justice, no peace, they wants with justice. one of the people impatient about it has been the mayor of minneapolis himself. >> tucker>> sean: have you spoko the protesters specifically with you? i want to hear what they have to say. >>r let make me bring them in. >> from what i understand them andd you get arrested for it. >> right, you get arrested. you heard the mayord saying he wants the county prosecutor move up -- >> on one of them. i'm talking all four. at least accessories to the crime. >> you said all the way up from the president, the doj and fbi in this investigation for it why is not enough?

of a man suspected of forgery. president trump has ordered both the fbi and department of justice to investigate the death of george floyd. the minnesota african-american who died in police custody earlier this week, whose death has now sparked a national outrage. let me go back and re-rack this video. my understanding is the total time on this is about 8 minutes where the officer -- again, we are talking about potentially they suspected forgery in this case. not a violent crime. but if you look in particular a, this video, this is what i don't like as somebody -- again, i've been training in martial arts for seven straight years. for example, somebody's carotid artery, you hit it hard enough right here, they will stumble and fall to the ground. it's a targeted area appear there's a phrase markel there is a in martialif arts,

choked out. for that length of time it's impossible for somebody to survives that as that's the most sensitive area of somebody's neck. white went on for that long period of time, we don't know. we've got new video will bee, getting to in a minute. at my request, the president said the fbi and department of justice are already well into an investigation to this very sad, very tragic death in minnesota of george floyd. the president has tweeted, the four minneapolis o officers involved in the arrest were fired on tuesday hours after a bystander's video showed an officer kneeling on the handcuffed man's neck even after he pleaded that he could not breathe and stop moving. new video has just been released we are going to get to. as a matter of fact, we have it? let's go to this new video that was just released. put it up full screen. obviously no talking here but you can see more from a

different angle. this is... what this video is showing is mr. floyd is not resisting arrest. we will follow this through, or watch it, market, see where exactly it's going to. what's happening here is i'm a big supporter of law enforcement. i am. everybody knows that. i say 99.9% of officers, they are good people.er they protect and serve their communities bear the officer has his hands on his pocket with the knee on the nectar the lack of training here is breathtaking. there is no evidence in this part of the tape prior to theen next incidents neck incident.this is not a vioe are talking about. this is some suspected forgery of some kind. the other officer if you look at him next to him was standing up and just looking around and, you

know, this new video has audio if we can get that up and play this because this has audio on it as well. we will pull it up any second. let's go to the other video and i wanted to take a look again. this went on for eight straight minutes. again, what is the most serious sensitive area of a person in terms of an arrest. from a martial arts standpoint, it is a targeted strike were one strike on the carotid artery can literally bring somebody right down to their knees, one shot. if you put somebody in a choke hold,, it will -- that's what they mean by the term choking out. we heard the more drastic term, we've seen it in the movies, it's called flockin shlocking sy out. you move it into oracle directions and you break their neck. it's one of the most sensitive areas of the human i body. this period of time, nobody saw

it, also according to reports, i can't breathe, i can breathe, and it's critical we got to be asking, i don't see any movement, i don't see anyem resistance, i don't see why the person is not cuffed, why the knee stays on the neck. i'm trying to be as fair and objective, i don't rush to judgment in this program but i don't think anybody should. we believe in the presumption of innocence but i can also say looking at the videotape, the videotape doesn't lie. putting somebody's knee on somebody's neck is extraordinarily hurtful and dangerous from somebody's neck cramped point. the guy has black gloves on so they are not in his pocket and you can hear some of the video in the background there, some of the bleeping out of things. when he touches the car, you can see he has his gloves on. so the question is once you get some money in handcuffs, why would this go on for any

extended period of time? these are the facts as we know them. george floyd, a 46-year-old african-american man as you can see there, this is not an edited tape. this is one long extended video. on monday after being handcuffed, pinned to the ground, this is what we have. let's bring in dan bongino with us. dan, you love law enforcement like i do. you served in the secret service. you trained in martial arts, as i do. tell us your s experience in tes of the neck, how sensitive the neck is and how this can go on for a period of time. makes no sense. no resistance that i see at all. >> yeah, sean. i've been tweeting about it the past couple of days in conjunction with a couple of other people i work with here at fox as well. it's a tough video to watch. a couple of things about this. as you said before, there are two different type of jokes. one is specifically banned in

law enforcement, that'll be a tracheal choke when you cut off someone's trach, the windpipe, that's universally banned in law enforcement, everywhere i know. what appears here is a carotid choked, a blood show, which blocks off the carotid arteries which restricts blood to the brain. it is very dangerous. obviously restricting blood flow to the brainvi is going to resut in potentially permanent damage, in this case death. the problem i have here, sean, obviously the full story matters, but the video tells a story that you just can't run away from. when i was in the 75 precinct, a new york city police department officer, the golden rule was when the cops are on, the subject controlled, the fight is over. that's it. what i don't understand about this, and believe me, a lot of my law-enforcement brothers i've been communicating with feel the same way, his eye get it, maybe it's a stressful job, we all understand that, after a minute,

30 seconds or a minute, when the subject is contained and other officers on the scene even though they are engaging in crowd control, it's clear this can turn into a potentially deadly situation with a blood to choke lasting that long and in this case sadly it did. this was really tough to watch. >> let me go back and give the details of this. i think the total time, dan can correct me if i'm wrong, 8 minutes this c knee was on the guy's next?es >> it may be six. but either way... the bottom >> sean: the bottom line is if you get on somebody's carotid, you and i have talked for hours and hours about martial arts together in your training as a secret service officer, i mean one shot, a quick chop or shot at somebody's carotid, it'll drop them to the needs if you have the right spot.

bernie kerik who knows a lot about tough situations. played football, moved to minnesota, he worked there, driving trucks. according to a friend of his, the difference between me is i had more opportunity than he did. a good friend of his who won a championship with the san antonio spurs. again, bernie kerik, we are dealing with, you know, in this case, a guy suspected of forgery for crying out loud. i'm looking at this. you are trained in the use of martial arts. you know how sensitive a neck area is. why, he's not resisting as we can see in the new video we are going to right now, why would they keep the foot on the neck for 6 minutes orou more? >> you know what, sean? i don't think anybody has the answer because it defies logic, defies common sense, it defies

training. it defies policies and procedures. there was no resistance. i'm curious... they took him out of the car, they sat him down, all of a sudden he winds up in this position with this guy's foot on his neck, the knee on the neck. why? how did he get there, why didn't he keep his leg on his neck as long as he did? the guy crying out he can't breathe. i am one, as you are, to give the men and women in law enforcement the benefit of the doubt. in this case, this is atrocious. this was an abuse of force, it was a killing of someone who should not have died. >> sean: you are also trained in martial arts too and you know it'str my passion so i talk abot it with everybody about this. one of the things that we learn about the neck and the neck area, but again -- i want to go

that. your reaction to that? >> sean muslim video may emerge. before anybody rushes to judgment, hear me out. we don't have the full story, we aren't trying this case by gvideotape. he may have resisted, we don't know that. the point is -- that's not the point x make the point is once he's in handcuffs, once we are seeing there, it's over. whatever videotape shows the precursor to this event, will be interested in telling the story and will be necessary. but this has nothing to do, as bernie just said, the golden rule of policing, that when handcuffs are on, when the subject is under a degree of control, the fight is over. i want you to pay close attention to the tape. they say -- if he was turned over, it'd be called neon belly position. unfortunately he hasn't turned over prone on his back. it's very critical. the left leg of the officer

that's on mr. floyd's neck. o i want you to look at his right foot. his other foot is light. i know it's light because he's moving his right foot. what does that mean? that's means all of his weight is in his knee into the guy's neck. when you're in the knee on belly position, if you want to put all your weight on the neck, your oufoot is flexible to move arou. that's the first thing i noticed being involved in the stuffov fr the last 20 years of my life is that he has all of his weight on this guy's neck. again, i just... what could you possibly be thinking here? >> sean: again, this goes back to what i keep going back to. 15 seconds, somebody can be choked out. literally on the ground collapsed, health, passed out there is a term we use, we tapped out when we get to the point, where i get to the point where i'm feeling that.

we bring in former new jersey governor chrisik christie. governor, i don't see any resistance in this video at all. the officer is not involved in this case have been fired. this went on from anywhere from 6-8 minutes according to different reports. you see the foot on m the neck, watching the video as we all are. you were in charge of a lot of police officers. i always want to give them the benefit of the doubt. but there's nothing in this video that tells me anything was done right here. >> no, sean, there isn't. i also remember, i was united states attorney for seven years and oversaw federal law enforcement as well. everything you see in this video tells you it was done not only wrong, but done fatally wrong. there is no excuse for it. as you said, when you look at this, i'm waiting to see the resistance and why they had to continue to do this while he was already cuffed. there was no resistance at all. in fact, he was begging to breathe.

going on in this video. they put themselves in harm's way to make sure that we are not. this is not an example of that. it's not only the person who is actually involved in the physical action that we see in choking this perpetrator. but worse. it's the people standing around him just reach out and grabbed the guy off the ground themselves to be able to put him in the car. especially when you hear so clearly on the video, if you hear it clearly on the video you know how clearly you can hear it -- >> sean: "i can't breathe." he's got handcuffs on at that point! >> s there's just no excuse i cn see, sean. i am like you. having been a part of law enforcement, i want to give the law enforcement the benefit of the doubt. this is not a benefit of the doubt situation i can see. this is a clear wrong and somebody lost their life because of it. >> sean: let's go to mike tobin, he's on the ground>> with the protest are breaking.

breaking news in minneapolis. let's get an update, talking a lot to the people on the ground there. t there is a lot of anger. >> sean, i'm a little tangled up in all the gear going on here. ga little bit of an ad in the action at the moment and that's kind of how it goes as they go back and forth with each other. you can see some of the demonstrators who are out on the street here on minnehaha avenue, i believe this is lake street. they are going back and forth with the police. the police would shoot them back shoo them back, and the shore leave but you hear some of the chanting, taunting, they are in riot gear but you can say they are relaxed. you can see how the building is broken up, you can see the officer standing on top of the third precinct, some of the nonlethal weaponry at the ready. i can describe some of the different weapons. some of the teargas lawn chairs

some of the flash bang launchers, the fumble at launchers this gentleman over here has a pepper spray canister at the ready. if someone gets up a little too aggressively, that's when the pepper spray comes out. mostly we see a lot of this. people holding signs, taunting the police officers. slowly but surely, you'll see something coming over the crowd. a most of it are some of this garbage you see here. every once of a while you'll see a rock come over the crowd, obviously something that could harm the police officers.ob you see the response, you'll see the flash bangs come out, you see the pepper spray come out, and it just goes back and forth throughout the night. you heard some of those demonstrators we talked to earlier. nobody is disputing what is seen on that videotape. no one including the mayor who move rather swiftly along with the police chief, i should say

that police chief did come at the fire four of the officers connected to that incident, call for criminal prosecution. but what you get from you demonstrators is it's not fast enough, they don't trust the people in the system. sean? >> sean: stay on the ground. when we get back to you, you'll talk to some of the people in the crowd with you in just aro moment. first, w our own investigative reporter lawrence jones is with us.ne lawrence, you are seeing what we are all seeing. it breaks my heart. the only thing i would say to the protesters is the officers have been fired, we have a justice system, the president has ordered two investigations. i don't think cops go to work every day wanting tokn kill people. as bad as everything we see on video here is, we don't need confrontations with police, the police don't want the confrontations. as hard as it is sometimes, we've got to for the sake of the community, think of every body.

and safety. >> yes,er sean. it's tough to watch. as someone that majored in criminal justice, they grew up their entire life wanting to be a cop and change the dynamic within the community, but i am someone who knows what it feels to be in the position, that knows that a badge with a gun to his head to go after the police department.ic i believe the majority of cops go every single day trying to keep the community safe, but there is that small portion that abuse their power and i think when you look at conservatives and republicans today, they havl seen that abuse of power during this pandemic. there are people that are part of the state that abuse their power. and that's what we witnessed in this incident. and whether it's people like me or the first black republican senator tim scott that experienced it even in the capital, these stories are real,

they deserve due process and to be r tried in the court of law. there should not be anarchy. there should not be writing. but it should be swift justice as well. i understand the pain. but i would encourage people, if you are going to protest, do it peacefully. and don't cause more issues. your mom and dad at home, they want you to come home alive.th you have a whole life ahead of you. let the system do its job. if the system does not do its job, we need to have a conversation. at least allow the investigation to takebu place. >> sean: nothing that we see here, lawrence, that seems justifiable. it's not going to be a trial by tv cameras. we have to believe in the system of justice. >> thank god. >> sean: i want to remind everybody the president has now ordered both the fbi and the department of justice to investigate the death of mr. floyd. he is the person that died in

custody. we didn't see any of the evidence off resisting arrest. lawrence, stay right there. let's go back to mike tobin, he's on the ground and he's been talking with the protesters. mike, what are they putting on? >what are they saying? >> what i've seen from the demonstrators again and again is a mistrust with the system and the belief it's not moving fast. they believe if it doesn't move quickly, justice is not going to move at all appeared frankly, sean, what i'm seeing here is a lot of palpable anger. a lot of demonstrations where it seems like the whole thing is a street party or a big raucous demonstration, a chance for kids to get out and have some fun. this is different. people are angry. everybody who is seen that video can't come up with a reason to justify what they've seen in the video. they are out here demonstrating. the police are responding with the nonlethal weaponry. let me show you an example of some of that nonlethal weaponry.

gaetz of florida. had been booked on the program for another reason tonight.d you've seen on this video, your thoughts? >> i was criminal justice legislator in the florida legislator, we are filling the air with a dynamic that can animate people to protest. the call from lawrence jones to ensure the protest is peaceful is important but i think what people are upset about is the lack of speed at the local level and that's why it's so important that president trump has been responsive. president trump understands the need for fairness in this case, injustice. involved the department of justice to ensure that if civil liberties were deprived and certainly in this case there seems to be strong initial evidence that was the case, that we elevate this to a national concern, and hopefully that will give us comfort. lllike you said, the folks in law enforcement are in fact here to protect us, but just like there ares good and bad tv hosts and good and bad tv down my

congressman, you've got folks in law enforcement that falls short to the high standard the rest of thee profession sets, and when that seems to be precisely what the president is focused on. >> sean: one of the things we followed so closely are the 1% that abuse power in the fbi that don't represent the premier law enforcement agency in the entire world for that's what i've been saying, director wray, clean up your occasionally -- what i cannot comprehend in this is the most rudimentary training. i'll go back toy bernie kerik on this. bernie, 101, the neck is the most sensitive area. when somebody is not resisting, when you have handcuffs on them, when they are screaming, they can't breathe. how do you not listen to that? >> you aren't even supposed to not listen to it, sean. it should be over.

led the call for the investigations. we have the fbi civil rights investigation ongoing. we also have the justice department investigation. the full force of the u.s. government investigation, possibilities are now in play here. >> yeah. from the federal perspective, there's not much more the president can do other than call attention to it and demand an investigation which is exactly what he did. but just watching, it's interesting. i just saw the split screen here. while we can i think all agree and everyone has so far that this could've not been handled more poorly and this was an obvious tragedy, what happened to mr. floyd, investigation, a full throated full blown investigation must happen immediately to reestablish trust, what's happening with this rioting is disgraceful as well. i don't understand how this in any way helps to solve the problem for these are two --

there are protests, four officers involved in the case are fired. i want to read the full suite of president trump, and this came i believe tuesday of this week. my request, already well into an investigation of the very sad and tragic death in minnesota of george floyd. i have asked for this investigation to be expedited and greatly appreciate all the work done by local b law enforcement. my heart goes out to george's family and friends, and justice will be served. that's from the president of the united states. speaking of the department of justice, kerri kupec joins us. we had the book for another issue. can you tell us the status, kerri, this particular investigation and what the role of the fbi civil rights department will be involved in and the department of justice? >> certainly, our hearts go out to the victim's family here and

the fbi is investigating.ea the attorney general is monitoring the situation closely and we are waiting for the results of the fbi's investigation, which they will present tohe our u.s. attorney they are in minneapolis, and we'll take it from there. but certainly a very troubling and upsetting video to watch. >> sean: i want to ask you as long as i have you on becauseou the attorney general has now appointed u.s. attorney john basch. there is a new probe, irs understand? what's going on. >> john durham is part of an investigation, has been looking at the issue of unmasking, and the attorney general determined that certain aspects of unmasking need to be reviewedne separately as a support to john durham'ss investigation. so he tapped john basch, one of our u.s. attorneys out of texas to do just that. sean, obviously we know that unmasking inherently isn't wrong. but certainly the frequency, the motivation, and the reason

officers themselves, the mayor may not permit the interviews, they may have lawyers, which i suspect theyct have. look at all the forensics evidence and immediately go to the u.s. attorney in minnesota who has already assigned u.s. assistant attorneys to work with the fbi on this case and to get it in front of a grand jury as quickly as possible. that's what they are going to be doing right now and the way it happens quickly is that there are a lot of resources at it. i'm sure attorney general barr has instructed the attorneys, what director wray has done when it applies to agents. >> sean: this is important to note too. you have worked in varying forms of law enforcement. i think it's important to understand that i've talked a lot in the last three years that the 1% of people who abuse their power and corrupt, we see the damage of 1%. this is not been my experience in law enforcement. the 99% who do their job and
