"the five" starts now. >> jesse: hello. i'm jesse waters with greg butt felled, dana perino. this is "the five." >> live pictures right now where peaceful protests are currently underway in honor of george floyd. it comes though after a weekend of mayhem in america where violence and looting erupted across several major cities. tonight dozens of cities bracing again for more violence as they set curfews. thousands of national guard troops will be deployed. the white house also saying that there will be additional federal assets deployed to restore

order. the brother of george floyd calling for an end to the looting during a powerful speech earlier. and president trump calling out governors during a conference call for what he's calling a weak response to the riots. take a listen to this audio of the president. >> a situation going on, shouldn't be hard to take care of. we're going to take care of it. we've got a number of people here that you'll seeing a lot of. general milley is here. the joint chief of staffs a fighter, a warrior. a lot of victories, no losses. he hates to see the way it's being handled in various states. we have all the men and women you need. people are not calling him. you have to dominate. if you don't, they're going to run over you and look like a bunch of jerks. you have to dominate. >> jesse: we have some reporters out in the field. mark meredith is in washington

where protesters are gathering. mark, what's going on? >> good afternoon. we just got our mobile alert here throughout the d.c. phone system with the mayor letting us know the curfew will be going into effect at 7:00 p.m., roughly two hours from now, lasting until 6:00 a.m. that's after the violence that we saw last night where we saw rioters and looters where we are outside the white house in lafayette park. i'm going to show you what it's like in the daylight. there's protesters gathered outside of lafayette park. secret service continues to have the area shut down. the protesters are not able to get into the park or get too slows to the white house fence. over the weekend, we saw 60 secret service agents get injured. if not more. they had bottles, rocks, bricks thrown at them. some of the other things we've seen is people starting fires in the middle of the street as well as in st. john's church, a church that really is close to lafayette park near the white

house. a small fire was started in the nursery. the good news, the main sanctuary is still standing. the church is still standing. i spoke to the pastor. he said considering what could have happened, things are okay for him. the businesses that are around here, you have the hay adams hotel, chamber of commerce. they've had graffiti spray painted all over them, terrible language. we've seen that on the national monuments here in washington d.c., the lincoln memorial, the national park service working to get that off as quickly as possible. d.c. police announcing they had 80 arrests. 40 were tied to looting. with have heard from the white house all day long that they believe antifa, these anti-fascists are responsible for what istifa is not an easy organization to identify. there's no one leader. so how will the white house

target this group specifically? as i mentioned where we are live outside of lafayette park, things are calm. plenty of protesters. more throughout the night. the big question is the curfew going to make a difference. jesse? >> thanks, mark. laura ingle standing by in new york city with the latest. laura? >> we had a huge crowd here a short while against with protesters gathered behind me. it was peaceful. in the middle of this protest, we saw in unison, the crowd laying down at once saying "i can't breathe" repeating the rally cry over and over again. as we know, those were the last words of george floyd. after that wrapped up and there was a huge police presence here today, in the middle of all of this, that is when we found out that the governor of new york, andrew cuomo and the mayor of new york city, bill de blasio,

unificationly -- that's not a word. i'm sorry. they both decided and gave us an announcement there would be a curfew. originally bill de blasio said there wouldn't be one. he didn't think the city needed one. now we'll have one. so at 11:00 p.m. tonight, we're going to have the new york city curfew go into effect. that will last until 5:00 a.m. also in today's announcement, we heard there will be more officers, up to 4,000 more officers put on city streets tonight starting right away with all of those areas that saw the looting last night. we saw incredible damage to new york city. we will see more officers tonight and we will bring you more as we have it here on the streets of new york city. back to you, jesse. >> jesse: thanks a lot. so horrible weekend across the cities, across the country. greg, your thoughts on what transpired in the last 48 hours. >> greg: well, first of all, i have to say, i have great

respect for the news. but you can see why conventional news isn't working in a story like this. what they're doing is they're summarizing what is going on behind them. but they're not talking about what is behind the violence. because all you had to do for days was get on twitter, you could tell there was a coordinated plan of attacks. it was obvious to everybody. i saw what was going to happen to my neighborhood four days before the conventional news got there and were shifting from talking about protests to violence. we knew -- anybody -- everybody following in this closely knew there was a separation between the protests and the instigators. remember, we were all in agreement at the beginning that this was a brutal crime against mr. floyd. yet the fact that we're all in agreement meant nothing to the violence which tells you that this was used as an opportunity

for insurrection by a specific group of fascists. i'm not talking about black lives matter. i'm talking and antifa. we decided to be worried about the public perception of what we say than the actual reality. i have to hand it to the radical groups that understand that liberal governance is more worried about how the media looks at them than protecting citizens. they can take advantage of the cowardess of the politicians knowing that they won't show up to protect the citizens. then they hang us out to dry. my neighborhood got destroyed last night. right? it got destroyed. it's hard for me to think about it, how to think about this straight when your neighborhood gets gutted and the mayor and the governor did nothing. the media just keeps talking

about it as a protest. hey, it's peaceful today. you know, everything is peaceful in the day. the protests were invaded by a group of people that planned this out very well. we have to decide as a country are we going to let this continue or are we going to let them destroy our country under the guise of a protest. i'm not talking about the protesters. i'm talking about the insidious feigns that used it to destroy our cities. >> jesse: we're looking at live shots from a helicopter above philadelphia where it looks like there's some tension scenes unfolding just past 5:00. judge jeanine pirro, philadelphia, a perfect example. they can call in the national guard. the liberal mayor can talk to the police chief and they can set the boundaries of what is acceptable and what is not acceptable.

that seems not to be happening. >> what it appears is that the left and the mayors of a lot of these cities and the governors as well are looking to have chaos and anarchy. i'm 30 years in law enforcement. my response to this, once we have a protest, it's a wonderful thing. if america came together -- we all agreed, every prosecutor i know, every cop i know said what happened to george floyd was a crime and it was murder, which we'll talk about later in the show, i'm sure. we all agree that it was a nightmare. protests are appropriate. but this is part of the anarchy to destroy america. we cannot go into a further

economic downturn here. we have to have leaders. we have to make arrests. the president has designated antifa as a terrorist organization. what does that mean? what does that mean in terms of prosecuting? we've got the ability to take them down. greg is right. you have this mayor of new york city who today said well, i don't know if i should have a curfew. we don't i don't know if it would work. are you stupid? so then they decide at 11:00, 8:00. now they're coming to the suburbs, going to all kinds of places to destroy america. they must be stopped. not only can we activate the national guard, they have to be deployed, be prosecuted, put in jail and leave them there. >> jesse: yeah, juan, it's all over the place. you know as well as anybody in washington d.c., you're seeing a terrible amount of destruction

and vandalism and violence taking place very close to some valuable monuments and even to the white house. how do you feel? >> well, i must say, when i look on social media, they make it out to be like, you know, the city of washington d.c. has been wiped out. it's not true. i think that's being advanced with people with their own agenda. we've had violence. we've had even the violent spread in some cases. so it's a real thing. i think it's important to underline the idea that while protests are legitimate, rioting and violence is counter productive. not only does it damage our city and our nation, but i think it's not an effective way to send a message about the real issue here, which is police brutality. i don't want to play into people that are looking to become indifferent and focus on the violence as opposed to the reality, which was the violence that led to the death of

mr. floyd in minneapolis. it's just a terrible situation that right now you have so many people in our country, including me, on edge, just feeling like boy, things are unraveling. it's not only the virus, it's not only the economy, now it's this. then you have -- i think you have provocation coming from both sides. i don't like it at all, jesse. i just don't want us to get distracted. i mean, i remember when colin kaepernick was taking a knee against police brutality and people are oh, what is the nfl going to do? i think someone called him a son of a gun, you know. we look back now. maybe people would have a different opinion about that kind of protest and what it meant and maybe that was an early signal that people should be serious in dealing with the reality that so many black people deal with daily, which is being treated like a suspect by

police and brutalized in some cases. remember stop and frisk and people says why are you stigmatizing these young men? 99% have nothing on them. you're stopping them. a high percentage of crime in those neighborhoods. well, it's damaging to human beings that don't want to be treated as if they are criminals simply on the basis of their skin color. and yet you see -- >> greg: but juan, nobody is disagreeing with you. >> juan: hang on. >> greg: you've been talking for a while. i know you've been off. but we all agree -- >> juan: i want to make a quick point. >> greg: the riots -- if we all agree, if we all agree, who -- what is the violence against, juan? come on, tell me. who is it against? we all agree. >> juan: i'll give you an example right now. >> greg: tell me. >> juan: if you give me a chance to speak. you don't want me to speak. allow me to speak and i'll tell

you. you have the national security adviser saying there's no systemic racism in the criminal justice system in this country and people are like what? that's the national security adviser? that's just wrong-headed. >> greg: nobody is disagreeing -- >> juan: if you talk to anybody black in this country about the police and the criminal justice system. >> jesse: let's move this along. this is not about robert o'brien. unfortunately it's not about floyd anymore. as much as we want it to be, now it's about death and destruction and people terrorizing most cities in this country. dana, you've seen this thing move from the beginning to a legit protest now to complete anarchy. what are your thoughts? >> dana: i'll be quick. i know we have an hour to talk about this. so i think to greg's point, you have to ask yourselves, was law enforcement across the country not communicating with each

other about what was happening? what was the intel? you don't just get intel on foreign sources. you have intel and you should share that amongst yourselves. so when it comes to accountability, we have to look back at that. i also have more confidence in the restoration of law and order. i believe that even today in washington d.c. you've heard there will be more of a presence tonight. i agree with judge piro why would you start a curfew at 11:00 p.m.? we watch the news. that's when it's happening. why not earlier? we had stay-at-home orders for three months. those can't -- stay-at-home orders for coronavirus cannot be more enforced than a curfew when it comes to violence. the other thing i'd say is that it takes a second to loot a building or to light one on fire. that destruction can take

is. >> greg: judge, take that question and answer it. >> jeanine: dana is absolutely right. rico is something that can be used. when the president said he was designated antifa as a terrorist organization, the question that everybody had is what significance does that have. the united states does not have a domestic terrorism law. we have a foreign terrorism law. so prosecutors are going to be left to try to handle cases under rico and inciting to riot. what we now know is that bill barr and the justice department through the joint terrorist task forces throughout the country, local d.a.s are engaged in in westchester will be engaged in sharing of intelligence and information so we can identify who the organizers are and share the information that dana was talking about in the earlier segment. there are crimes to which they can be prosecutored.

it's usually a secretary of state that designated someone as a foreign terrorist organization and then you get the secretary of treasury that withholds the monies and seizes the assets. there will be parallel situations with these domestic terrorists. right now we don't need additional laws. but we can use the rico statues where we go to the organizers, take them apart and use whatever resources we have to take the money and put them in jail. >> greg: juan, you have to agree that antifa has marred what could have been a really great thing. they have taken something that could potentially be healing between -- people are all in agreement about this crime. they turned it into something else. >> juan: yeah, the violent protest is to be condemned. i don't know that -- who is behind it.

and i'll go to you, dana, at this point. when we heard about a father being arrested for playing catch outside with his son or we hear about gretchen whitmire in michigan. these are serious governors. there has to be consequences. now this happened, there should be no consequences? greg makes a good point. it's over. a lot of the mayors and governors could care less except for this. >> dana: we have to remember that the government aspect helped to flatten the curve. we did that. all of the states are in some phase of reopening, some are fully reopened. some in different stages. there's many hundreds of arrests across the country. in minneapolis, they had 638 the other night. they're trying to do those things. a lot of the peaceful protesters

were wearing masks. sometimes the masks were askew or hanging down. but their intention was there. >> jeanine: you know, health officials are saying, jesse, there's going -- there's going to be a second wave of the coronavirus because of these protesters, because they're not wearing masks. they're even saying the tear gas that is being disbursed is causing people to choke and to cough and even that is going to increase. >> jesse: well, health experts have been wrong before. we'll have to wait and see what happens here. maybe the protesters are wearing the masks to mask their identity to burn a building. you can cut someone's hair and get then in jail or maybe throw

demonstrators have walked through. they have splintered off to several different areas of the city. the police line here, you can see a lot of demonstrators here, face-to-face, inches away, talking to police. you also see behind here, pennsylvania national guard brought in, activated earlier today after two nights of violence and rioting and looting here in the city of philadelphia. i've been here, native son of this area for 50 years. i've never seen anything like this. right now national guard police are just trying to get a handle on the violence right now. i can tell you, three hours of marching was peaceful. they shut down a major interstate here in philadelphia. right now much of those demonstrators have splintered off to other part of center city right now. i can speak for most of the people here in the philadelphia area, just hoping for a night of
