>> all of the stemming from the death of george floyd. all four officers involved were charged yesterday. >> in minneapolis. protests continuing coast-to-coast overnight. let's update you. from portland, oregon thousands marched to the justice center, some pleading with police to take any with them. to the nation's capital where hundreds gathered near the white house chanting george floyd mattered repeatedly. >> we begin with lauren green in new york city with the latest on the attack on nypd officers. what is the latest? >> reporter: the attack happened late last night against those police officers, they were wounded in what is being called a completely cowardly despicable unprovoked attack. two officers patrolling the streets of brooklyn trying to protect local businesses from living when a man approached them with a knife stabbing one of the officers in the neck.

fellow officers responded immediately, exchanging gunfire with the perpetrator, two officers were shot in the hand come all three wanted officers are in stable condition and expected to recover. the suspect was also shot and is in critical condition. in this incident follows other attacks on cops in recent days. a sergeant was struck by a black sedan in the bronx and another officer was beaten up on the street. the police benevolent association president pat lynch responding to the violence. >> the only thing that comes to mind is questions. are we surprised we are here in the hospital again, did we doubt because of the rhetoric we are hearing, the anti-police rhetoric, all levels have to say it is going to end today and allow us to do it. >> more protests are expected today, more peaceful protests are expected today, the brother of george floyd is expected to attend a memorial service for

john's church, still protesters, it has been peaceful all night but they are confronting and sharing their opinions with the national guard you see deployed. one of the gentlemen out here protesting all night long saying he is a former army veteran who wants to connect with these guards out here, some of them trying to share their opinions, the national guard cannot respond or say anything to them. there are no violent clashes as we look at this in the early morning hours. the war of words between the former secretary mattis, mad dog mattis has been left angry and appalled at what he has seen and disapproves of the president's leadership writing this, donald trump is the first president in my lifetime who does not try to unite the american people, does

not even we tended to try, instead he divides us, also denouncing the use of military force you see in the nation's capital, criticizing the visit to st. john's church saying it violated the constitutional rights of protesters like the ones you see here, the president tweeting back, the president not taking it without offering his opinion. he calls him the world most overrated general but then says mattis's primary strength was not personal relations, i gave him a new life, things to do in battles to win but he seldom brought home the bacon. i didn't like his leadership style or much else about it and many others agree, glad he is gone. if there is another feud brewing, that is with the current secretary of defense,

mark esper breaking with the president over possible use of the insurrection act which would entail deploying active-duty troops in the streets. here is a little bit of what secretary esper had to say, take a listen. >> the option to use active-duty forces in the law enforcement role should only be used as a matter of last resort and only the most urgent and dire situations. we are not in one of those situations now. >> to give a little context, it has been all night long, the national guard and the police kept things peaceful as these protesters, many of them young african-americans sharing their views and venting but not clashing. when i talked to that a little bit older african-american veteran protesting saying he understands all sides of this and is glad to see the destruction gone, in hopes the

safety of these guard troops as well as the safety of the police will be a priority as protesters continue to try and make a change but we are certainly at an inflection point in the nation's capital where it seems order is mostly restored but the protests in the thousands growing, looking at twitter the dc police, not seeing any arrests that have taken place. >> we should add regarding the president versus mattis the president said the only thing he has in common with donald trump with barack obama is they both had the honor of firing james mattis. you have it as it is. what happened with our current defense secretary? he said the active-duty people should only be used as a last resort and then went to the white house and came out and said i changed my mind.

what happened? >> he reversed course and the reporting from jim, pretty anxious to get the 80 second airborne troops back to fort bragg but decided to reverse course and leave those troops in the dc area on military bases. however, there is a sense that many in the administration would not favor the actual invoking the insurrection act including active-duty troops on the ground here. one of the big take aways. many people will focus on mattis's criticism of the president but he's drawing a line in some of the timing of his comments with regards to getting in front of the deployment of active troops in the streets, that certainly would take things to a different

level than having the national guard which we see not just in the nation's capital but in several states at the request of the governors to make sure first and foremost the distraction and violence ends and order is restored but there will be more chapters to this as we watch what is happening this morning. >> the insurrection act last used in 1992 in los angeles when it was brought to its knees, fires everywhere, one city, now we have these multiple cities, multiple times, multiple intensity with huge insurgency destroying things like fifth avenue, not the boroughs, this is destroying the heart of the financial district in areas we've never even seen attacks before, the president tried to do what george bush 41 did in the former secretary of defense comes out, people calling him a dictator. i don't understand, didn't they get brief, didn't they very the president to a safe location. if that's not a reason to possibly use the insurrection

service for george floyd will be held in minneapolis for those officers involved in his death are now charged. garrett tenney has the new autopsy report. >> reporter: in terms of the protests, this last might was another called peaceful later that has been the case for several nights but it didn't -- it didn't help that in the last couple hours, not a lot of development in this case. you mentioned a new autopsy report. last night the county medical examiner's office released a full autopsy report internet we learned george floyd was a survivor of covid-19. he tested positive but didn't have symptoms and did not have any lung damage as a result. the officers involved in his death were facing new charges as well. derek chavn has been charged with third-degree murder is now

facing a charge of second-degree murder as well. the other three officers were charged with aiding and abetting second-degree murder. demonstrators have been demanding the three officers be charged but they want to see all four face first-degree murder charges so there is mixed reaction from folks we talked to yesterday. >> it is not enough until they are all behind bars for the rest of their life for what they did. >> i can't say when the right time is. this is a situation where they are expressing themselves, feeling united with the community, you can't put a time limit on that. >> not sure how many officers will be arrested but today right now we are celebrating but it isn't enough for us. >> reporter: in terms of timing in this case going forward keith ellison said it will likely be months before they are ready to go to trial.

today the memorial service for george floyd will be held in minneapolis at north-central university, an invitation-only event and that is largely due to coronavirus restrictions, crowd sizes. river now sharpton will deliver the eulogy and the funeral will be tuesday in houston. back to you. >> thank you very much. because out on the streets the protests continue to be deifying the curfews, a number of local law authorities say they won't arrest anybody if it is peaceful. tucker last night on his program at 8:00 pm eastern took a look at the numbers because so many people are frustrated. what do the numbers think about what is going on? >> last year, their 1004 killings. of the 802 shootings in which the race of the police officer and suspect was noted, 371 were white, 236 were black, the vast

majority were armed, there were a total for safely ten cases in the united states last year according to the washington post in which unarmed african-americans were fatally shot by the police. in two of those cases, fully have, the officer was commonly charged. is it possible more of these officers should have been charged, of course it is possible. justice is not always served, that is for sure. but either way, this is a very small number in a country of 325 million people. this is not genocide. it is not even close to genocide. it is laughable to suggest that it is. in fact the number of police killings is dropping. in 2015 during barack obama's presidency 38 unarmed black americans and 32 whites were slain by police, totals have fallen since then and they have fallen more dramatically for african-american men. last year was the safest year for unarmed suspects since the

washington post began tracking police shootings, safest year for white and black suspects. at the same time the country remained a dangerous place for police officers, 48 of them were murdered in 2018 according to fbi data, or than the number of unarmed suspects killed of all races. >> pure numbers and keep sentiment out of it. i think you look at something where sometimes you say to yourself i don't agree, we are at the edge of total chaos, celebrities calling not only for reform police, to defund police, the mayor of los angeles saying we are cutting back funding. we have movement by black lives matter to form their own peace force where they feel they should be armed to take things in their own hands and part of the problem in minneapolis and minnesota overall they can't get cops to do the job. who is signing up to be a cop

right now when you are being vilified for taking brick and icewater in the head while being vilified or stepped in the neck and people are saying cops are the bad ones instead of looking at these individual incidents. if you want to talk about ways to make it better, sure but if you want to defund and get rid of it while allowing criminals to run free in new york and st. louis because of these ridiculous bail laws but not the judges out of it and 90% of cases brought in front of these judges you go free the next day so you commit a crime, you are the funding police and form your own peace force while smashing windows and taking whatever you want. tell me how america is better for this, widespread condemnation of this. >> look at these images, this is what it would look like on all

>> fox news alert, the four officers involved in a different george floyd all charged in clearing upgraded charges, put the neon the neck and second-degree murder now longer for knowing a third. here to weigh in his brett tillman. is this a good move going from third to second degree? >> nobody likes what happened to george floyd. it is her in december whole country is behind the prosecution of these officers especially the one who held down his neck but it is risky when you elevate the charges. you hope it is not out of emotion in response to the crowd because what we don't want to see is losing your case because you've overcharged the case. >> i looked at the attorney

general yesterday and he said trying this case will not be easy in winning conviction will be hard. that is not what people thought when you saw the video from every angle and hear the audio. what is he saying? i is he ratcheting down expectations? >> it is concerning. second-degree require specific intent to kill, there is no question he has his knee on his neck for an extended period of time, perhaps past the point he's warned and told to take his knee off. that does indicate at the least third-degree murder. the question is did he have a specific intent to kill george floyd when he was addressing the situation and that is going to depend on the fact of this case. what factors could there be to suggest he had that intention to

kill? that is why the attorney general is downplaying expectations, because he has ratcheted up or upgraded that charge. it the response the crowd and the emotion of the moment. >> yesterday at 10 am rod rosenstein took his seat in front of the senate judiciary committee at which time the deputy attorney general who is in control of the russia probe the told robert mueller i got a job for you and for 2 and a half years and cost of $30 million they probe the president's campaign and how it colluded with didn't collude with russia, turns out they didn't and it turns out rod rosenstein wouldn't have done it in retrospect. listen. >> if you knew then what you know now what you have signed the warrant application? >> now. >> the reason you wouldn't have is because exculpatory

information was withheld from the court, is that correct? >> among other reasons. >> do you consider it to be an early basis corrupt investigation? >> i do not consider the investigation to be corrupt. i understand the president's frustration given the outcome. >> what did we learn yesterday? >> first we learned is he acknowledges a couple things that are significant. he acknowledges he would not have signed the carter page fisa warrant if he knew then what he knows today. the other bombshell that came out of this was by august of 2017 when he authorizes the mueller investigation he conceded yesterday there was no evidence that the time of colluding. he had not been presented evidence of a conspiracy that justified opening the mueller investigation. that's the most aggravating deck of the country, the president and any of them that have been subjected to this including general flynn.

images, blue canisters of rocks and bricks at locations where the worry is the protesters would pick them up and hurt cops. >> this reminds me of guerrilla warfare tactics that we see committed against israeli soldiers in the west bank. unfortunately nypd officers are accustomed to being attacked during riotous behaviors. this is not the first rodeo so to speak but speaks to the organized blacktop to hurt police officers in the wake of the riots behavior. we need to do what is necessary in the nypd to keep safe and protect the public, the 8 and a half million people that are new yorkers. steve: everybody has an opinion of what is going on.

but again, speaking to my director yesterday, police director, our county of north decided to drop their interview. i didn't want to do that so, said that it was fine. he was fine with moving it altogether because just hasn't had the same level of violence or protests here and he didn't think it was necessary to continue with the curfew but i would rather be safe than sorry so i left it midnight to 6 and kept our beaches close, supposed to open the backup on monday but as long as we have the curfew in place we keep the beaches closed. >> speaking of opening back up yesterday florida governor ron desantis announced apparently florida is about to enter phase 2 starting tomorrow for 64

counties in florida except york county, broward county and palm beach county. why are those counties still lagging behind the balance of the state. >> because we haven't by far the most cases in the state of florida and i -- the governor and i speak about every day. we are in sync. the situation in miami-dade, miami-dade has the highest number of cases, we are an international city, we have 600 tests, 17, 18,000 cases, the largest in the state of florida, it is very correct what the governor is doing the rest of the state. we follow a week to ten days later after he opens portions of the economy. we are working on that right now to get to the same place with the rest of the data. >> i was reading a social workers can still go to work during the curfew and if you need to walk your dog, 250 feet from your residence.

social distancing guidelines that are in place. our next guest wants to know if protesters can march why can't businesses open? new york post columnist carol markowitz joins us to explain. >> thank you. >> your op-ed started with remember covid-19, owners of small businesses are you to reopen but are in danger of being smashed by rioters, they remember, small business owners, what is your plea to the leaders? >> i spoke to a number of small business owners all over new york and they are baffled that their openings remain in doubt and far away, new york doesn't go into phase i until monday which is only a limited number of things opening but they are watching giant crowds on tv and wondering if they can be safe why can't we? why can't our business open with proper guidelines and proper sanitizing of the rest of it and continue to proceed forward and

they don't understand why they are not able to do that. >> all these rules for small businesses but when you look at the protesters most of them are not wearing masks, not social distancing. >> we've been told for months wheeling killing grandma if we don't take these precautions and now these precautions are out the window because the cause is just. it has exposed the fact that this is either a public health emergency or it is not and if it is not we need to reopen and move forward and if politicians need to let us do that. ainsley: you say leaders are fearful and have no answers. what makes you believe that? >> they are afraid to say to the protesters we can't do this because they are protected by the first amendment. i'm in support of the protesters in the streets doing what they need to do. it is not about that. it is about the was no longer make sense.

the beaches in new york you can't go swimming as in california you can go to the beach, you can go swimming but you can't go to the beach and the mayor of miami was on before me said there beaches are closed completely. miami is in the mid 80s, open the beaches, let's have a pressure release of all the people who have been home for all these months and told what to do and following directions and have now released from their leadership to be outside and have a normal life. at least follow the guidelines for everybody, make everybody stay home or let them out. ainsley: you are a new yorker, i heard different stories, people making plans for the fall, if i can't reopen in the fall should i move to florida? should i moved one of the states where i can reopen my business? what about kids in school? we are trying to make plans. >> that is it. governor cuomo of new york only opened camps two days ago but most of the camps decided to close for the summer. they can't survive like this.
