says they don't feel safe going in to put the wendy's out which as you can see is quite close to a bp gas station. police have been working to try to clear i-75 and i 85 which is a major highway in it lands him metropolitan area that's been shut down for hours with thousands of cars backed up. police have used flash bang grenades and tear gas as well but the crowd continues to grow tonight. the crowd is fired up and curious. there were continuing sound of breaking glass. they began to disperse out for a number of other businesses around the area. we bring in ted williams bp homicide detective attorney

formal federal agent time served as the attorney for police officers involved in businesses jeff: this. we appreciate you being with us this evening. looking at what's happening on the ground right now what is the tactical decision by the police in atlanta to let this wendy's burn and let these crowds continue to shut down highways? >> you know i don't think what is going on is they will have problems with law enforcement getting the fire department to get to that area where the wendy's is on fire. what is deeply concerning about the fire is you have reported there's a gas station right next to her. you have to be concerned that gas station could go up in flames so what has happened on the ground right now is the atlanta police department learned a few weeks ago when they were caught now deaf

emergency response units in place special operation units in place to try to put out any area that comes under fire or under protest that are out of control. that's what's going on now this immediate time. >> it's a we watched the wendy's burn bare their white people are angry about and you pointed out earlier much of atlanta was vandalized and there were violent protest over the death of george floyd and now they are fired up because of the death of rayshard brooks. they fought with officers and one angle of videotape and seen running with officers in the other videotape and turned towards one of the officers. this appears to be a much more complicated case in the george floyd case as the mayor did not

necessarily think so. >> she called for the two officers to be fired perhaps fearing a night like this would happen anyway. >> this is clearly a more comp a kitty case in the george floyd case. i can tell you in this instance they are are being designated by the georgia bureau of investigations. i wish the mayor would have put this officer and administrative leave and she would not spoken out to say the officer had been in a wrong manner. i wish he would have waited for a report because the question is did the officer acted reasonably and are the circumstances in which -- and that is the jury is out on that and an investigation clearly is to make that determination. how big is the role of the video we saw and we will get back to

the timeline. how unusual is it in your mind in less than 24 hours after an officer-involved shooting we have surveillance video released by the investigative agency. that's got to be a record. >> it is a record and is normally not done that fast but i think the mayor decided and city officials decided to release that video because they are trying to cool the crowd down out there and that is one of the things but that video cuts both ways. it shows that the gentleman mr. brooks was turning around and he had a taser or something in his hand that looked like a taser. that is one of the things that they are going to have to look at the georgia bureau of investigations. >> we all known a couple of seconds when it's dark and after fight with somebody in a taser can look an awful lot like a real weapon. we are why chang the flames continue. i don't know if you can see the picture but in the foreground at

least one gas station a bp gas station and it looks as a texaco as well claim shooting over both of those gas stations and police say it's too combustible of the situation and no pun intended for them to go and and try to help the firefighters feel safe enough to put the fire at the wendy's out. what do you make of the police standing back and watching this burn? >> well i would use the word standing down but what they are trying to do is to get control of certain areas so they can move. the fire department getting in there and a safe manner for the problem is you have other people that live in that community and one of the things that law enforcement is going to have to do with that combustible situation like they had with these gas stations in close proximity is to try to get the citizens out of that area and

get them out of there safely. the police department is stretched out. they are dealing with the highway situation and trying to deal with the wendy's situation and i'm sure they are dealing with putting out fires and i mean fires protesters and others that are probably demonstrating. >> wheel keep an eye on on the live signal their coming in from one of our affiliates in atlanta and at any moment we are expecting the reporters there for to get in front of the camera and we will take it as it comes in. what do police do to prevent going from one building on fire with angry protesters shutting down the highway, how do they prevent it from deteriorating into the night we saw in minneapolis where there was no law that became a free-for-all? >> what i think law enforcement is going to do is go into the area. anytime they go into an area where there's a lot of rioting

or looting going on they are going to swarm meaning they will send a cadre of law enforcement officers into the area to try to put out any kind of demonstration or put down any kind of the demonstration that's taking place but law enforcement have alerted atlanta what's happened about two weeks ago where the writing situation in atlanta saying it was truly inappropriate. my senses they are taking any chances now. the problem is leland is the morale. as you know the chief of police today have decided to step down. someone will take her place not on the hood that is but i assure you the men or women of the police department or cognizant of what is taking place and there is some question i'm sure in their minds as to why the chief of police step down. therefore you have the morale situation and its a dangerous

concoction when you have a morale situation in you've got rioters and probably protesters out there and you are without a leader. that is a very dangerous concoction. c certainly is a varied dangerous concoction when you have the mayor of the city calling for the firing of police chiefs if there was any type of investigation. it's the very early hours and we are beginning learn what happened. the mayor has taken taken a hard-line but the protesters we talked about earlier where there was violence in atlanta where she said they were disgracing the city of atlanta and was pretty vocal about the need for protesters to stay nonviolent. if that carry any weight in the community or are people who are going to burn buildings and loot going to use it as an excuse to do it? >> well i think it carries a lot of weight with the community and it also carries a lot of weight i believe with community leaders. i tend to believe even at this time of the night with all the

things that are going on there and the atlantic community community leaders are also trying to quell demonstrators in those areas. i supported the mayor when she came out and she spoke with some candor that these demonstrators should not get out of control. but tonight it's a different night. i am deeply truck pulled that the investigation has concluded the termination of this police officer. and the a city as big of atlanta i hope people would have waited until the georgia bureau of investigation who the citizens have a lot of confidence in would have completed their investigation. sierra ted williams you have been on all sides in cases like this quite literally. your expertise of the night like this is invaluable and we appreciate you staying up with

us. stay stay with the throughout the evening in our coverage going to bring in steve harrigan "fox news" correspondent based in atlanta. he's been in more protests than any network news correspondent that he brings his expertise and experience here to this. steve you pointed out earlier while we watch these flames shooting out of his wendy's it's impressive and scary picture to watch these flames. it is only one building. what are you hearing is being done to prevent this from deteriorating throughout the night i did let a police department? >> you are right, the atlanta fire fire department put out a statement saying they are standing by that they are unable to safely get to the fire and that fire as you mentioned is engaged with more than one gas station. you are right on one hand. the city of atlanta is not on fire. this building has been on fire for the last hour or so but the

basic fact is you have a fire and it's not safe for the fire department to get there. it's a basic failure. the other thing that's going on as they still have not been able to clear a major highway. 75 is not open yet. it's not clear so you have a building burning and the fire department did get to it. the other major highway that's being blocked so basic functions of the city in the wake of this action are not working. it calms on the heels of two weeks of protest, protest that were at times violent so there is a real mix here of anger and fear of what's coming next. c ted williams brought up an important point steve in terms of how law enforcement is feeling about this. it latta police department went through a couple of days of really getting it handed to them by these violent protest the were not able to respond and they were finally able to

respond and brought an overwhelming force but it took a while for them to corral the violence of this group. then i had an incident where a couple of officers pulled to college students out of a car. they were fired for use of excessive force within 24 to 48 hours, perhaps a record in charges filed against them. officers were african-american and the students in the car wreck to be american. 9090 of a shooting at a police chief has resigned the mayor has said she wants these officers fired before an investigation is complete. do you have a feeling in terms of how the rank-and-file of the atlanta police are feeling tonight? >> i think they feel under siege from all sides. i think you are getting a key point that we have seen throughout these protests from george floyd. that is the response by city leaders and how it has to be rapid and how we have not seen that, think there's an effort

here in atlanta right now to respond quickly. you have as you said the mayor getting the police chief to resign almost immediately and saying really making a verdict that deadly force was not justified in this case and you see a massive police presence on the highway. you have firetrucks also there that even though you have the police presence and even though you have the fire truck is ineffectual. the highway still closed, the building is still burning. the mayor is talking and the police cars out but they have not been able to open the highway or put out the flames. >> keisha bottoms has become a national figure for the past couple of weeks. in atlanta it's rumored to be on joe biden shortlist for possible vp pick so one can imagine so many of her decisions are being made through that lens or at least you have to take that

perspective into account the national perspective of why doing her city being looted or burned or police cars vandalized going out around the country. you have covered so many of these protests. what is the fine line between police exercising enough force to clear the highway, to keep people from burning buildings at not so much force that new use of force creates even more anger on the streets? >> you know i'm not an expert and i have seen these and i guess i've been stunned by the incompetence of the local city level. basic and competence in minneapolis where you have a police station abandoned and you have chunks of the city left a burn day after day. it's very hard to recover from that trader think there is an effort to defeat that here but so far it hasn't been a sexual. we have seen a few changes on the ground and we some are --

seen some armored vehicle's pull-up is not just police cars. lisa in riot gear and more vehicles as well. the real question is where does it go from here? it's not just at the wendy's and not just at the highway. reports now of protesters gathering at police station in different parts of atlanta. where is this going? could we see violence in other parts of the city if not in the early morning hours today and tomorrow night as well? >> one of the local reporters there from fox five our affiliate reported the people on the streets that she saw and talked to were fired up and furious. if you have spent time on the streets of atlanta talking to to folks is there still a real simmering anger over the death of george floyd and the death of ahmaud arbery. >> you mentioned it's not just

floyd dent arbery in this case as well 27 years old killed friday at 10:30 p.m. and i guess we heard from the family's attorney is earlier at the press conference. were the attorneys saying with the real sense of sadness. i don't know what we can achieve so it's very dispiriting to see if you live in atlanta as we do here plays on the screen in the dispiriting to hear people feel a lack of hope about the ability to make a change especially for advocates for attorneys who are fighting this fight day in and day out there is a real sense of despair that it's happened again here. >> certainly what has happened a black man killed by two white police officers one officer who fired the shot after fight in the scuffle and then one of the

have been put out at the wendy's restaurant where this all began overnight last night. rayshard brooks was unresponsive in the drive-thru police arrived. works took one of the officers tasers. you're watching the event in the upper right hand corner of your screen. he took 180 officers tasers and ran it turned around towards one of the officers with taser and handed him a shot by one of the officers three times. people have been protesting on my denault day in atlanta university avenue in i-75 and i-85. the sun went down in atlanta in the protest took on a decidedly more violent twist. they burned the wendy's to the ground and police were so afraid of what might happen if they win and they kept the fire department and the police outside of the area around where the per per testers were about the wendy's burned down. a local reporter on the scene reports when the flames began to shootout of the roof of the

wendy's and protesters could see the flames at applause broke out among the protesters that the protesters have shut down i-75 and i-85 meant a major north-south highway in united states. that's been shut down for hours. police brought in teargas and flash bang grenades to clear the highway to get traffic moving again and run successful so the highway still shut down. we understand the state police are also on the scene they are in atlanta with a growing law enforcement presence at 11:30. steve harrigan in atlanta reporting their protest have gone to other sites in atlanta particularly at police stations bringing out the awful thought that this could attentively turn into what happened in minneapolis a couple of weeks ago where rioters began to attack police stations, not just protest on the grandpa and we bring in steve rogers formerly

of the joint terrorism task force in new york. we appreciate you being with us and this brings up a very important balance we have seen police departments make decisions on the fly about which is how do you accuse enough force to clear protesters and to keep them from violent acts like rioting and looting in shutting down highways but not use so much force that it incites more protests and violent acts? >> well you are absolutely right that you don't want to use excessive force and the key word here is excessive or does ted williams said earlier the key element is the overwhelming numbers of police officers, overwhelming number of law enforcement officers and they do have strategic and tactical plans that they could put into effect. you separate groups in a look for leaders and it does a lot to minimize what can turn out to be a major confrontation between the police and the protesters. it's all about her of numbers so what the atlanta police and what i hope they are doing right now

is bringing in reinforcement and again not to use excessive force that the use of force necessary mainly by numbers in order to overcome many possible violence. >> those shows of force are incredibly important on the ground in terms of what he will see and also police are willing to put an end to certain violent acts that occurred. what do you make of the past 24 hours? i have never seen or heard of video footage being released by the investigative agency in less than 24 hours. the video was put out at the georgia bureau of investigation less than 12 hours from when the shooting took lay sent the police chief resigned in the mayor has said the two officers should be fired. it seems as though there's an attempt a rush to judgment or perhaps an attempt to in some way come the anger in the community that hasn't worked very well. >> no comment happened and i'm very troubled by that quickness to show the video because

normally you have an investigation, you have interviews and you get all the facts. you have to get the totality of facts before you release something like that. it backfired. i don't know why they did it but certainly it did back fire and we not rush to judgment whether a police officer is at fault or not. there's no reason to rush to judgment and so job of all of us to try to calm everyone and not add fuel to the fire. >> the video releases of very different video than the video we watched out of minneapolis with george floyd. there are there are many different questions and issues that are brought up by that video that were not wrought out by george floyd preview talk about a rush to johnson matt johnson one of the affiliates in atlanta georgia reporting arrests the cops being chanted

by protesters near the wendy's conceivably being harassed the cops that shot works. we don't have independent confirmation that the video from two different angles is running on the screen while the protest their on the left side of your screen. what do you make of these calls by protesters? judgment cannot be made by those on the street but as we have seen those on the street can have an awful lot to say about what happens. >> yes you are absolute right to those officers in minneapolis should have been immediately arrested and that was indeed a murder commit it by a police officer. in this case you have an individual fighting police offers is on the ground and took the taser which becomes a weapon. this is why this should not be a rush to judgment could my fear is so much political pressure is going to be put on some people in power and again they will rush to judgment and they could

>> blocking highways is certainly something that they can use force to deal with. people have to be able to get back home to their children. arson can be used with deadly force if necessary to prevent because it's dangerous to people in the building and dangers dangerous for the firefighters have to put it out. i'm sure the atlanta police are trying to get this situation to take down that fully in gulf restaurant which is close to a couple of gas station which could lead to a tragic tragic situation in special with all the cars backed up on the highway. >> a report out of atlanta the abc affiliate said it's about 10:00 when the flames began shooting out of the roof of the wendy's in the protesters were watching and broke out in applause. it took about an hour for the police to move in there with the

firetrucks and as we see from the pictures of the video on the lower part of your screen where we see the wendy's building burning earlier to life picture looking down towards the wendy's and flames were shooting up over the sides of the gas station which as you point out was a scary situation probably for all those around the gas station watching those flames and now thankfully it's been distinguished. the police chief and atlanta erika shields resigned this morning after the shooting, it's unclear why she was forced to resign and there was an immediate thought that the shooting was somehow an obvious excessive use of force in the videotape leaves a lot of questions and a lot of room for judgment and an investigation is the georgia bureau of investigation will have to sort through. if the police chief resigns who is in charge? >> i believe her deputy has

seen an african-american individual killed by police officers. this did not escalate, the demonstrations did not escalate until 8:00 when someone/police cruisers tires and we don't know what led up to that confrontation. what we do know is the number of people on the ground near the wendy's it's an unfortunate incident that took place continuing to grow. we so multiple people. if i guessed at the time the protest had doubled in size and it was at that point they got fired up. i've been speaking with the family throughout the day and they told me they were frustrated because they felt as though their loved one was running away from police at the time of the shooting. of course we know this is a polarizing situation. people look at that video and they say why are you tusseling with police?

of course things got violent and other people look at that and say this was a man who was pulled over after being out with friends and closed his eyes because he was intoxicated and unfortunately when police arrived he ended up tusseling with police and ran away from them. depending on who you are talking to the situation is a little murky. it depends on where you are standing. where i'm standing right now things are calm. just an hour ago it wasn't necessarily that the people were fired up and violence, it was more so that what took place at the wendy's was posing a threat to everyone's health. and what i mean by that is that -- . >> alex i want to zoom out here couple of weeks ago the violence in atlanta got out of hand and police got control of the situation. we saw the violence against police officers and vandalism of dozens of police cars.

protesters tried to break in and it took a line of riot or lease a long time to break that up and the mayor said the protesters were quote disgracing the city. do you think the police are taking a harder line to prevent that kind of out-of-control violence tonight let's. >> i have covered these protests for the past two weeks or so and i can tell you it's the most police presence i saw was maybe a week ago when the curfews were still in effect. we had a 9:00 p.m. curfew for the margarine at the time and the final night bathroom he saw long lines of police officers and even the national guard on the streets. tonight i have noticed that the lease are here in their presence is felt and moving as they speak on the phone with you but this is not a situation in which we have seen police officers with riot gear. that was something we saw really

last night overnight at 27 real man would shot and killed by police after he fought with them and grabbed one of their tasers and ran turned towards police with the taser and they shot him. people protested early in the protest turned violent starting at 8:00 with protesters slashing the tires of police cruisers and setting a wendy's on fire. the wendy's was destroyed. to give an idea of how violent we feared that situation could become the fire department was kept back for about an hour. it protesters are chanting to rest the officers referring to the police officers involved in the shooting or the mayor has said she wants those officers fired and the police chief has resigned in the wake of the protest. tonight we hear the protesters are heading to atlanta police briefings, possibly to protest or something else as we have seen these crowds turned violent. i-75, i-85 and major north-south
