against gay and transgender people, the president overstepped his authority attempting to end the program. the president responding by saying he would release a new list of supreme court justice picked by september 1st, i will only choose from this list. as in the past to become a servant of stopping court justices based on decisions being rendered now, this list is more important than ever before, second amendment, right to life, religious liberty etc.. chief justice john roberts said we do not decide whether daca or its decision are sound policies, the wisdom of those decisions is none of our concern. we discussed only whether the agency complied with procedural requirement that it provides an explanation for its action. conservatives including ted cruz slamming the chief justice for his recent ruling going as far as calling them a joke. gail trotter joined us earlier saying it makes it difficult for

the majority of the court was targeting donald trump and treating him differently than any other president. this will be a major factor because conservatives are tired of an activist court that is shaping policy decisions rather than calling balls and strikes. what this is about, this wasn't about whether or not it was good policy. it was about the supreme court using slate of hand by moving the goalpost for executive order, what a president can or can't do with regard to executive orders and correcting a prior administration's mistakes but saying you have to jump through all of our hoops and decide when you have given a good enough fresh now that fits our narrative that we allow you to use your executive powers. if chief justice roberts and others want to make policy they should step off the bench and run for congress and the american people understand

donald trump is trying to do the most he can to protect separation of powers and that will play a factor in november. todd: let's get to executive action. here's what president obama tweeted minutes after donald trump's tweet, eight years ago this week we protected young people raised as part of our american family from deportation. we have to move forward and elect joe biden and a democrat congress that does its job, protect dreamers and create a system that is truly worthy of this nation of immigrants once and for all. daca was an executive action and to the obama administration. the trump administration takes executive action to do away with that and they are rebuffed at the supreme court. what does this mean for executive action in the future? >> this is dangerous for executive action in the future because under the constitutionally congress can

make law. president obama violated separation of powers when he legislated with his pen to put daca in place in the first place, donald trump has been clear he is wearing work congress on immigration reform in article 1 section 8 gives immigration as a subject matter entirely to congress. donald trump was right in correcting this mistake in the supreme court cannot acknowledge that and put further barriers in place is only violating separation of powers and allowing the justices to say we have authority to determine which executive action can be rescinded in the future when future presidents want to correct those prior actions that may be illegal. this is on its head in terms of the constitution here, that is the dangerous precedent that donald trump was frustrated with and so are any conservatives that are concerned with separation of powers and making sure the remedy remains in congress and for president obama

to say this belongs to congress is an acknowledgment that he violated the law and agrees with the decision and that is really important come november that everyone recognizes we need to elect republicans and conservatives all the way down ticket to make sure we get people in place who care about the rule of law, not activism and thought violating separation of powers because listen, the liberals aren't concerned about playing by the rules. they are only concerned about moving -- forcing through their agenda and do it whatever means are possible. during the obama administration they push that through executive order, now they are doing it through the courts. they will do it any way, only conservatives, only donald trump really cares about maintaining separation of powers so that we make sure the american people get a voice through their elected representatives and have a constitutional republic, not just eerily from the liberal

inclusive holiday rather than an exclusive holiday. it is a holiday that commemorates the fact that whites died in this country, whites died so that blacks could be freed even though slavery was an institution in america it was never unanimously adopted by all-americans. we wanted to be an inclusive holiday that is not divisive, a holiday simply for black people only. it commemorates the unity of the country. it is the greatest significance today carried in the past. jillian: a good message. they designated juneteenth as a holiday. john cornyn introduced a bill to make it a federal holiday. what if it does become a federal holiday? >> we can go outside and barbecue. it was about unity in this

for what we are discussing. in the intelligence committee our obligation is to work in private. we are more often to be seen rarely and even more rare to be heard from and you just heard a clip rate there. although it may not be classified material it is also a chance for our adversaries to understand the steps we are taking to stop them from foreign influence. on the intelligence committee we deal with sensitive secrets. we should be operating in a secure facility and we should not be in an environment where we are online. these types of things that we are using today to communicate are often hacked and in a situation like this especially intelligence committee and staff gives someone the opportunity to harbor all our ip addresses etc.. it is an appropriate and the feeling is this is just one more

lighthizer was present in the room. i was present in the room and that is not in intelligence committee. it is always in those situations in open hearings. we can go back and do it safely, it can be done, we don't have to do all this virtual thing, we put ourselves at risk for being out there, online and the internet and subject to being hacked. it is not the appropriate thing, not appropriate in the intelligence community to communicate in this way to hold hearings in this way. adam schiff should be called out for that. what we put up was adam schiff the last several years, all three republican signed a letter on the intelligence committee to ask him to step down. we endured how many years of him saying he had evidence of collusion, when we go through the interviews, they all said no

one said they had any evidence of that happening. if he continues to say that he has been misleading and abusing his office. jillian: i don't mean to be rude but another question before we run out of time and it is important because there are a lot of people in the public interested in this and want to make sure they are secure online because we have an election coming up. it is an important time to make sure big tech companies do what is appropriate and what is out there. is enough being done right now? >> we are not holding hearings in the appropriate manner. this is not a new topic for the intelligence committee. this is something we are dealing with but we have done in the appropriate fashion and you don't want to take one situation of immediate concern in the american people have concern rightfully so, we don't want to
