james comey, sally eights and none other than susan rice, the woman who lied to us about benghazi and who 15 minutes after trump became president emailed a memo to herself about how obama wanted the flynn case handled "by the books." she's on the short-list by the way, naturally, to be biden's running mate and even if she doesn't get that job, she will certainly get a top post in his administration. covering for corruption seems to really have its perks. rest assured, a biden win won't just unleash chaos and misery on the streets, it will mean bringing unsavory characters like rice back into power. it's retribution time, my friends. and just as this played out, the federal appeals court ordered district judge emmet sullivan to allow the doj to finally drop its case against flynn. sullivan will now have to end his despicable anti-trump

crusade, and obviously this is outstanding news for all americans who believe in the rule of law. and of course for a general flynn and his family. >> the justice system prevailed in the decision today, and that's good for all of us. and it hopefully renewed some sense of confidence in the american public paying close attention to what's going on in our elections and it's really another one of those marks in our history where you can truly say voting matters and elections count. >> laura: i'll say. joining me now, former deputyng independent counsel, sol wisenberg. we've been talking about this flynn case for so long now, wass justice finally served today? >> justice was served. we will see whether or not it's final because judge sullivan does have the right to ask a full panel, the full appellate court to re-hear the case.

and the judges themselves, if they get enough of them, can ask for it to be re-heard. i don't think that's going to happen, i hope this is the end and it's an outstanding opinion. >> laura: one thing we noticed in the court filing from flynn's legal team is that they say peter strzok's notes were written on january 4, but that was a day before the white house meetingme where obama brought up the flynn case and the doj says strzok's notes were taken between january 3 and fifth of 2017 so you noticed this confusion in the dates as well, what's going on here? >> i think she just got it wrong, this has to be notes of the january for the meeting because it is so similar in some respects and -- to the susan rice memo and the interview of sally yates so it's got the exact same number of people this has got to be the january 5 meeting we've all talked about so often. what's interesting is that

strzok wasn't at that meeting so unless he was hiding behind the curtain somebody had to have dictated this to him, somebody who was there and presumably that would be james comey or maybe he dictated it to mccabe. what's interesting is what it does and doesn't corroborate about what we know, it corroborates very important stuff. number one, that the president and vice president are talking about the logan act, which is just ridiculous. it corroborates the president is saying to comey, should we maybe not share national security information with the incoming team? that's very important. but something striking that it doesn't say, nowhere in the notes does it say that the president wanted it done by the book, which as you know is mentioned four or five times in the susan rice email you talked about so very, very interesting. >> laura: three times, four times. t if it was something that was

mentioned three or four times especially a line like that or a phrase like that, you'd think someone, with the attention to detail, strzok would've written that down. also comey saying that this seems to have been legit, what flynn did seems to have been legit, how significant is that? >> i think it's very significant because he says it but even after he says it, the president still says, you know, is there any reason that i shouldn't be sharing it? in these notes which obviously are not as detailed as the susan rice email, the notes just have comey saying, it appears to say yes, there are calls but it appears to be legit and it's not clear that comey has even raised this issue. in the susan ricesi version, it makes it appear like comey is the one raising the possibility rthat maybe information shouldt

be shared and after the president says it, comey says, well, they appear to be legitimate. this is in the susan rice version and the president inquires about whether it maybe shouldn't be shared, the information and comey says, he's talking about the whole crossfire hurricane and comey says potentially, we will have to monitor it.t. the whole tone of susan rice's it's really a concern of jim comey whereas these notes indicate it's more president obama.ll >> laura: thank you so much this is fascinating and we will see if susan rice gets the nod from biden after all this. we have final thoughts after this. nobody likes a tight squeeze.
