recovered, the windows were rolled up in the vehicle when they were shot up, not usually the case in a drive-by shooting so it raises more questions than answers. jillian: let's look at the fact as we haven't, the violence in the chop zone, four shootings, four people injured and as you heard todd in the sheriff and chief of police say, two people have died. what do you see happening in the serializer when you think about the people who live there, the people who have businesses there who haven't been able to open their businesses for months because of covid-19 and now this, what is the vision long-term? >> right now we saw two lawsuits pending, one is a class-action lawsuit by businesses and residents in the area and the other is by single individuals in these lawsuits, the second one named the mayor and the governor the city attorney for not doing anything about the situation, the mayor's original plan was to allow certain sections remain closed which had

president that is as anti-gun as joe biden. he is the guy who said he would i'm going to take away your ar 15s, ak-47s away from you and appointed a gun's are in charge of gun policy. he wants to be seen as a moderate but he is a radical particularly on gun policies. interesting to see if people even see that as a point they can overlook, people in virginia who are already ousting anti-gun democrats from city council in putting republicans in who are pro-gun because they are sick and tired of democrats are not going to respect their second amendment. >> is what the nra is saying, the nra believes voters who recently purchased guns for self-defense will join other
1:26 am
second amendment voters into a more formidable voting block of anti-gun politicians are the biggest threat to their fundamental right to self defense but what specifically are the nra and other groups like it doing to get out the vote, search their message come november? >> we have always been focused on are no compromise policy, not only is the second amendment available for self-defense but in doing, it is not only those two important things, but being able to preserve our right to go against a tyrannical government and that is what we are seeing amid the covid-19 time. we are seeing that we want to push the gunboat like we've always done before like earlier in january where we had hundreds of thousands of people in virginia's state capital ready

to push for their second amendment rights and we are to push that in senate races in montana and colorado where it's very important we get the gun vote out so we will see that as we approach november. todd: it will be fascinating to see if the gun buyer block grows over the next couple months. will check back in with you to see what the situation is. we appreciate your time. >> chief justice john roberts signed with liberal justices to strike the louisiana's abortion law but what impact will his decision have long-term. jenna ellis as it undermines our constitution, she joined us next to explain. todd: a new push for protests at donald trump's visit to mount rushmore, south dakota governor says those demonstrators need a history lesson when "fox and friends first" on tuesday morning returns.

lieutenant governor spencer cox for the republican nomination. todd: a ruling from the supreme court, john roberts joining as liberals rule against the louisiana abortion law. >> the chief justice joined with the four liberals on the court to strike down louisiana app statute, four years ago, same statute, same issue the chief justice voted with the conservatives, he flip-flopped like a catfish. >> jenna ellis says robert is acting as an activist, good to see you. >> reporter: good to see you. jillian: this is what chief justice roberts said on the decision, louisiana law imposes a burden on access to abortion just as severe as that imposed by the texas law for the same
1:33 am
reason, therefore it cannot stand under our president. can you make a case for his decision based on precedent? >> this is a bizarre decision for roberts who did flip-flopped. he joined the dissent in the heller scott case four years ago. why did he joined the majority now? justice thomas was correct when he said the constitution does not constrain the state's ability to regulate or prohibit abortion. if we look just at the constitution in context it doesn't provide a right to abortion. that was a legal fiction fabricated by a prior supreme court in 1973 and all the way through the abortion law progeny, it was a legal fiction and simply wanted to advance policy and legislation through an activist court, look at the constitution in context our declaration of independence
1:34 am
provides our rights are fundamental, inalienable and god-given and the constitution is required to preserve and protect those rights, chief among them life so where roberts is switching his decision based on precedent the supreme court can overturn itself and has over the course of the supreme court's history so one of the things that is interesting and needs to be raised here is this is the same case minority leader and democrat chuck schumer was making threats against the court outside the oral arguments in this case and threatening the justices and whether or not that had a political impact on justice roberts is a question that should be raised because it is really bizarre that roberts would simply flip-flopped this soon after a very clear opinion four years ago. >> that is where my confusion lies. the supreme court, law school was a few years ago for me but i thought the supreme court set
1:35 am
precedent. what are the implications for somebody like the chief justice, john roberts saying i got to go with what they said in 2016, we can't start sitting president when that is kind of the role of the supreme court. >> really bizarre and completely antithetical not only to his own position in other cases where he has joined the majority in overturning precedent but manifestly obvious to a first year law student so it raises the question what was the motivation behind chief justice roberts for joining the liberal majority and i think the political implications are that the pro-life community and anyone who cares about our constitution, our rule apply in the role of the judiciary has to be concerned about the composition of the court and this is going to put the supreme court and new appointments front and center in the 2020 november election, donald trump has
1:36 am
already promised to put out a new list of his supreme court nominees before september 1st, joe biden has made no such promise, why hasn't joe biden been willing to put out his own list? i think that will be a very important decision for voters in 2020 because we understand the supreme court's role and responsibility is to call balls and strikes and fairly and appropriately apply the constitution and for conservatives that means conserving rule of law and making sure the supreme court stays in its lane and we haven't seen that in the past 50 and 60 years of its history especially now with chief justice roberts siding with the liberal majority. >> the other of the bill says when a woman is -- has complications from an abortion, hemorrhage as an example, response time is very important, she says when the supreme court says is no health benefit, tons of women saying it would be beneficial if a doctor could have provided them healthcare at the time of abortion so that was her opinion on that and she was on the shannon bream last night
1:37 am
to share that information. todd: protests in hong kong. the law bans bursts of activities in the territory but many fear will be used to silence criticism of beijing, demonstrators demanded independence from china calling for revolution. us bold the exports in response, china is threatening retaliation. >> four police officers who were shot during violent protests in st. louis have been invited to spend independence day at the white house, the officers were wounded on june 1st during unrest over george floyd's death. they are all okay. the police union has raised money to cover the cost of is my fourth trip, calls are growing for protests nationwide on the same day.
1:38 am
several native american groups are also planning to protest donald trump's visit to mount rushmore on july 3rd where he plans to kick off independence day with the first fireworks show since 2009. >> south dakota governor christie nelson's message to protesters. >> our history is important to this country and what we stand for, it is what makes america special. our leaders have flaws but when we focus on the flaws we miss the virtues and the lessons they can teach us. i think possibly this is a wonderful opportunity to celebrate america's birthday, to join together and have unity, focus on opportunity in america and that's what they don't want to talk about. >> one native american activist says around mount rushmore is a symbol of white supremacy because, quote, it is an

1:44 am
spike, in texas and houston, in miami-dade, florida counties there are huge outbreaks so it's important to know where you are traveling to, now your risk and if you're in a high-risk group, take these factors into consideration before you travel and if you are at high risk you shouldn't be traveling in the first place because of the risk of complications and if you come back in new jersey -- new york, new jersey and connecticut if you have to quarantine after visiting one of the hotspots. let's get into emails from folks at home, should people avoid states that recently had spikes and coronavirus cases? my family want to head to florida for a family vacation, what would you say to that? >> absolutely. it is so important to make sure there aren't any outbreaks we are going, a huge outbreak in florida, record number of cases, 9500 cases in a single day over the weekend, that is probably not safe right now.
1:45 am
look for an alternative. an area where there is no major outbreak because you may be putting yourself at risk and putting your family at risk and picking up the virus and bringing it home and spreading to other family members and your neighbors. it is not a good idea to go to florida, look for an alternative. it depends on what part of florida. the entire state is not having a surge but this virus is highly transmissible, highly contagious so it can spread from one person in one area of the state to another very quickly. >> kenny emails and with the following question. with cases spiking in some states is it safe to fly? are masks and gloves 100% effective in preventing coronavirus? >> it is recommended essential travel only and it depends on what group you are in. if you are over the age of 65 it's not a good idea to be flying right now because you are in close contact with other people for a prolonged period and even if you're wearing a mask the mask and significant protect yourself and others but
1:46 am
it is not 100%. we do not recommend wearing gloves unless your doctor or nurse or healthcare provider inside the hospital, gloves are not recommended by the cdc, masks are. we have data that shows masks can reduce the transmission of the virus, it is important to keep that in mind. shannon: an email from adrian. is it safe to travel with infants if they cannot wear masks? interesting question. >> depends on the mode of transportation. are you going via private car where it is you in your close bubble and family members only or are you going to be flying? if you're flying or using public transportation i would think twice about that. the reason children under 2 should not wear masks his concern for difficulty with breathing but kids can still get sick. we have pediatric inflammatory syndrome, kids are still at risk
1:47 am
of complications from coronavirus. it depends on mode of transportation. we are going on a road trip that is fine if you're not going to an area of outbreak but it's not safe to travel -- able to protect themselves with mask right now. jillian: i am amazed how many people i see with masks not covering their nose, that defeats the purpose of it, correct? >> sure. that is a very good question and good point. the virus can enter eyes, nose or mouth so you should cover your nose as well. at least of your mouth is, you are getting a lot of protection if you're coughing or sneezing, where a mask that covers your nose, can prevent the virus from entering the mucous membranes of your nostrils, make sure it is having your nose in your mouth. todd: another last-minute ad from a guy named todd in connecticut, he needs a haircut. does he kill this thing or not?
1:48 am
what is the answer? >> what do you mean does he kill this thing? todd: the heat. >> the latest study that just came out shows 34 minutes of sunlight can inactivate the virus outdoors on surfaces. that's very reassuring but that takes 34 minutes. within that 34 minutes if someone is in close contact with another person within 6 to 10 feet spending 10 or 15 minutes with that person you can transmit the virus from one person to another and when you're outdoors and on the beach you probably want to go inside into a bar or restaurant and you could still pick up the virus that way. that is why governors of states like florida, texas and california are shutting down beaches for the upcoming fourth of july holiday to protect against that transmission. that is reassuring we can inactivate the virus, we do every 2 we can to get rid of it
