after testing positive for covid-19. where do we draw the line on civil liberties. joining me live is jenna ellis. people who test positive and then head out to the public be arrested? >> this is an example of something that needs to be contemplated by state legislatures, the police power of states is very broad and we are learning americans are we contemplating civics and constitutional authority under the ninth and tenth amendment through the covid-19 process. what is interesting about this statute is the legislature or even municipal code hasn't been put in place it had public input but the attorney there is referring to the texas penal code which states a person -- if he recklessly engages in conduct that places another in imminent danger of serious bodily harm and they are interpreting that statute and applying it to covid-19, those are legal terms with the precise meaning in the law.

serious bodily injury can't be established for something like covid-19 so i don't think these are charges that carry water at all and it is more of a tactic that is designed to scare people and try to keep them in their homes if they test positive but it will discourage people from getting tested. >> the word reckless means something significant, not just a word for their for fun. let's go to this topic. a lot of schools, colleges, universities, joining harvard and mit to sue immigration authorities over a new policy from the trump administration for students to return home if the courses they are enrolled in are entirely online. here are the schools that are top of the list, a number of schools joining harvard and mit and in an amicus brief you see the others on screen, critics say this is an attempt by the

hospital beds were developed such as opening a large stadium in houston and making it to hospital bed, that was shut down because we didn't need it after all. now that we have so many cases coming up, a lot of the patients now are younger and not quite as sick but because of the volume we have a lot of very sick people too. we may have to go to the next phase of opening up something like a stadium. >> of you been able to nail down why there is such a significant spike? do you chalk it up to people just getting complacent and not wearing masks anymore? >> texans were really good in march and april about socially distancing, staying at home, wearing masks and then once things opened up a lot more beginning may 1st, especially once memorial day hit people did get out more and more, you would see pictures of crowds, people
