points in the polls over george bush senior peer they were already calling me president dukakis. what happened to that? michael dukakis tomorrow. and now "the five." ♪ >> jesse: hello, everybody i'm jesse watters, greg gutfeld, one williams, 5:00 in new york city and this is "the five." president trump ripping into democrats and calling out the supreme court after a pair of decision on taxes, the high court ruling, the president does not have absolute immunity from prosecution and that a new york district attorney can subpoena his tax returns. and then a separate case the supreme court blocking house democrats from getting their hands on trumps financial records hear it for now.

both of those cases are being thrown back to the lower courts. here is the president's reaction. >> this is a political witch hunt, the likes that nobody has seen before. it is a pure witch hunt, the hoax just like a mueller investigation is a hoax that i won. this is another hoax from a purely political. i win at the federal level and we won decisively as they said in new york. you know what's going on in new york. everybody is leaving and it has turned out to be a. people are leaving new york. it is a political witch hunt to just continue. >> jesse: nancy pelosi responding to the rulings to keep investigating the president. >> we have a path the supreme court has laid out that we certainly will not ignore. and we will never stop our oversight. this isn't so much about the president's rhetoric, although we would like to know how russia funded his operation although years. that's not what is at stake.

it is the president of the things he's above the law. >> jesse: kennedy, here is what i don't like about this. they are going to get their hands in the day and then they will leak them. and you are back to mysterious people leaking things. you don't know if it's true or not and then it spends up a lot of fake news and speculation. pretty unfair. >> kennedy: it is interesting because i think more information is there. i would like to see everyone's tax returns with the most powerful person in the world. i don't have a problem with that but i do with the politicalization. that is what the supreme court blocked today. they made note that this is what the framers wanted to make sure didn't overtake the branches of government. and they didn't want the congress to be able to the president with request. and so they did block that, but also what you have to see here, this was not a slim majority.

this was 7-2 ruling in two cases lumped together here. and or search and cavanaugh although they agreed with the majority opinion, they also made note the president should have some claim to block certain request in the lower court. and to your point about leaking the process through the lower courts may take so much time that if the president is worried about being known before the november election, because it is going back and restart, that may be politically against him. >> jesse: one williams why do you have to pester the president with superb list request? >> juan: [laughter] well, you know, at first i want to say i thought kennedy was on target overall. the key thing here for the president in the short term is that his taxes will not likely be out in public before the november election.

so the short term my think although we saw him with his hands across his chanc chest log defensively and talking about obama and i witch hunt my think politically, jesse, he came out on top in terms of the congress not having immediate access to the records. in the long term, the big ticket is you have a conservative supreme court stating very clearly that in terms of prosecution and in terms of investigation, that the president is not above the law. that everybody, every american, including the president has to respond to legal subpoenas and actions in that regard. and that is something that goes beyond the political moment, goes beyond. the president said he could not be investigated, couldn't be prosecuted to shoot a man on fifth avenue. he even said he could pardon himself. here is a supreme court saying that is not the case,

mr. president. no kings around here. >> jesse: i don't know if that is exactly what the ruling stated, but that is neither here nor there. dana how do you see the scotus ruling? >> dana: it is hard for me to see anything because you are not wearing a tie and i don't understand why. >> jesse: it is a long story. [laughter] i don't have enough time to get into all of that. >> dana: i'm so thrown off that i'm flabbergasted. okay, so this decision might have been a huge thing to the end of the supreme court session and a little bit of a whimper. and that is because of all of the things that have already been set up your the white house press secretary today in her briefing, she describes the decisions as a win for the president. and i thought that was skillful the way that she handled those questions. and also, she is a lawyer, so it helps. i think that is the best way to do it. i would not talk about this much more because this is not going to happen before the election.

but this did insure there will be a lot more litigation going forward. what andy mccarthy and john you, intellectual legal scholars that we listen to, one of the things they said to commit might be a political win for the president today, but it was a drastic, terrible decision for the presidency to the presidency because going forwar, this basically means any u.s. attorney that wants to basically drag any sitting president into court is going to be allowed to do so. so there is some caution there. but i think overall for the president, not a bad day. >> jesse: i mean, greg, you have told me in the greenroom many times that is the reason you're not running for the presidency because you don't want to have your taxes exposed to the american people. it is a very complex tax return. and you just don't want americans to see that. this is a very smart strategy to say, let's just see what happens. now, it also pays to point out what energizes the media. they are always consumed by any potential avenue of muck regarding people who don't share their assumptions. so everybody becomes a woodward and bernstein around the people they hate. imagine if the media had been energized about harvey weinstein ten years ago or jeffrey epstein ten years ago where the decay of democratic cities 20, 30 years ago were just recently, the scandalous debts were baby hunter biden writ enriching himself off of the data. or who push the steele dossier? we haven't heard about the steele dossier, the clinton author and order to pay damage on the dossier lies. so the bottom line here is, media bias isn't always about the story that the media chases. it is the story they pretend don't exist. >> jesse: that is a good

and saying no. and if you would like joe biden, joe biden says, he, in fact will make on those failed promises that came from donald trump. that is the big difference to offer a positive vision. and i think it may build back better. and i think, hey, i can deliver on the economy where the incumbent is not doing it. it is a positive agenda, and i think, you know, you think back to the tax cuts and the whole thing led to the buybacks for the big corporations that enrich the very rich in our country. didn't bring back wages or jobs and i think he is saying that is a failed economic package and here is an opportunity to actually bring to life with the president trump have been talking about. so it's not plagiarism. it's saying, let's do it and get it done. >> greg: you know, dana, who knew joe biden is a white

nationalist? >> dana: think about where he gave his speech today, pennsylvania. pennsylvania will be the main battleground state, i think coming up in this 3.5 months on election day. so joe biden has some work to do, especially in the counties or he was today. i understand that voter registration for democrats is down 20%. so if he wants to try to find voters who went from obama to trump, and he wants to get them back to his corner, he has work to do. that is one of the reasons you saw him go out there and do this today. the other thing, bernie sanders invited the working staff and working committees to try to figure out where might they be able to agree. instead of moving to the center has general election candidates usually do, joe biden continues to move more to the left. maybe not on the economic issue in particular, but i think that

bernie sanders would be very comfortable with buy american, higher american, that is his whole world. the other thing is that biden come as soon as the trump campaign starts to focus on pushing him to where he is and saying he so far left, and he will go further left, he likes what bernie likes. he wants to give health care to illegal immigrants. he's going to do the green new deal all the way. we will eliminate jobs in pennsylvania. just relentlessly focusing on how biden will actually be beholden to the left seems to me to be where the trump campaign should try to focus on the next few weeks. >> greg: what did you think, kennedy? >> kennedy: i'm not a big fan of populism on either side, but it is especially dangerous when it comes to the left because it breeds authoritarianism. and the economy is really going to go down. what they are going to do is have these federal mandates on

what you can buy and who you can buy it from. it's not just a sense of goodwill that i want to help out manufacturers and workers and workers who have great ideas and buy their products and services. it is going to be done by force. so when you increase spending, they will also increase taxes. there is no greater certain way to tank the economy than to marry those two devils. that is what joe biden is doing with us. when working in concert with bernie sanders, who is about a socialist commit is horrible news for the economy. and i think as he moves up in the polls, the worst it will be for the market. and they will really start reacting to that. also, dana can tell you this, it is always a good idea to steal whatever is working from your opponent. if the president were to steal something from joe biden comeaux what is his phrase or his ideas? the foundation of ideology that is so populist and working so

to ask us to accept one quarter, 25% of the world's covid cases, one quarter, 25% of the world's covid deaths. those we represent only 4% of globes population. >> juan: and attorney general bill barr, he is saying all black lives should matter after an increase. >> obviously black lives matter, all human life is sacred. i also think that it is being used now as sort of distorting the debate to some extent because it is used relate to refer exclusively to black lives lost to police misconduct, which have been going down statistically. five years ago, there were 40 such incidents. this last year, ten. so at least it is a positive trajectory there. but then you compare to 8,000 homicides in the african-american community. those are black lives that

mattered too. >> juan: greg, can you agree with beto o'rourke that even after the big shootings in newtown, vegas and promises from president trump, little has been done to deal with gun violence and easy access to guns in america? >> greg: you know, this is a really, this violence explosion is an incredibly serious topic. beto o'rourke is not a serious person. he is a poster child for petulant stupidity. he has the actual opposite of wisdom. so he should not be taken seriously at all. so here is a serious explanation for this problem. we have it all backwards, right? it's not about cops. it is about crime, okay? crime requires -- crimes in inner cities black on black crime requires police involvement. police involvement means more stops, right? more stops. they end up becoming more

engaged with young, black men and more stops creates more opportunity for incidents, especially in high crime areas where compliance is a big challenge. so the media pushes this idea that it is police misconduct and police brutality when the real issue was the crime and the police dealing with the crime. the number, the sheer number of the police stops which then makes the incident, the incident percentage drop. it is not as big as the media says. it is because it is such a vast number of police stops. it is about the crime. it's not about the cops. i know you look confused right now, juan, but you can play the show back later really slow, and it will all make sense to you. then you will smile for once when i'm talking. >> juan: okay. kennedy, the attorney general, the attorney general was sagging in that interview in kansas city where they seen a surge in

violence, especially homicides, mostly gun related over the last half year or so. they will work with the mayor and the governor to put in more callouts for a ten-day period. do you think more cops would stop that? >> kennedy: stop a surge of violence that seems momentary? it certainly can both assess what i was saying for weeks and weeks. there will be no consequences for your actions. you have a bunch of people out of work, frustrated, and they are bored. and now they are angry. now they are on a mission. they think the cops aren't going to do anything? yes. they were going to go out and cause some problems. so there has to be a shift in perception. that means more cops, not less. so the whole defund the police movement, it is so incredibly shaky that it will fall apart and bring about the exact opposite of what it reports to

want to. as far as beto o'rourke, he does this snap-on policy. he's not a senator. he will not be president. he probably won't be near the biden administration if the former vice president wins, but he still can't put two points together to make a logical argument about anything. so he is saying the democratically run city are somehow subject to a republican death toll mentality that is thin reversely tied to covid cases. none of that make sense. he needs to stop talking. [laughter] >> juan: dana, in new york city, they say there is a surge in police seeking to retire. do you think there would be any trouble replacing them in the economy? >> dana: sure, the other thing i believe, that the d fund the police movement did was it froze the recruitment for a year. so yes, that will be a problem. you need really good cops to be

training the dash what do you call them, not freshman but rookie cops. cadets. i don't know. unlike that other candidate that we have been talking about all day. now, i've got it in my ear as well. the other thing i was going to say, don't forget that joe biden said he would lean on beto o'rourke for his gun policy. again from another issue we have been talking about, showing the left is going really far to the left. that is what you would end up with. the other thing i wanted to mention about this and it's been on my mind and it is a distressing editorial in "the wall street journal" yesterday about a lot of the business owners, all minorities, that are in minneapolis whose businesses were ruined and destroyed. their merchandise set on fire, things absolutely destroyed, they have had zero help. and that fund with all the celebrities poured in -- it's like $30 million, the bailout

people that were arrested during the rioting and looting. there is still $30 million in that account, but nobody is thinking about going to help the business owners. and i think attorney general bill barr is saying, yes, all "black lives matter." but all black lives matter and those people deserve our help as well. >> jesse: chessie come i wanted to pick up on dana's language there because bill barr the attorney general that black lives matter about all lives matter. i wonder if he understands how that strikes lots of years as weakening the focus on racial justice at this moment in terms of trying to repair damage being done to black lives. >> jesse: i don't think he cares about slogans. and juan, you should go back and watch the show with greg. i have started doing that myself and it really does sings in a second time. so i highly terms of beto o'roui

in terms of canceling their schedules? >> greg: the bad news is the ivy league canceled all of their's words but no one knew they had sports. i didn't know. other people at home very upset that i say this. why don't they switch to plain things you comply online like poker or compete in grand theft auto or call of duty. that is what everybody else is doing. >> dana: that is where it may be, dana. and there are schools that have cut out entire programs permanently, stanford just eliminated 11 sports at that school. what does that say about where we are? >> dana: i feel bad for the students and also i'm a little worried about the economy. there's a lot of money that goes into sports. you know, the big ten also just announced a reduction in their schedule. i think that is because they won't do anything to get a leg

up on the ncc and the national titles, the big ten can't handle anything. that is why you are seeing people take advantage of the situation to try to improve their position reputational lay. >> kennedy: i would not be surprised to see the pac-12 do the same thing, juan, that is the sleeper. but that is something, such purity in college sports. this is what we've been looking forward to. a lot of programs they will not decide until late july. should we just call off all of 2020? >> juan: wow come i would be disappointed because i'm a big sports fan. i must say sports as a part of life. when you look at people trying to get sports going right now, major league soccer is back in gear. already we have seen the dallas team, the nashville team, and the women's orlando team had to pull back because there was too much spread of the virus. dr. fauci said the nfl might not even be able to make it happen this fall. to me, it is kind of

[laughter] that's it for us, "special report" up next. >> thank you so much, a colleague of mine said any wine is better than no wind at all. good evening, welcome to washington, john roberts and for bret baier, raking tonight, mixed verdict from the supreme court on whether president trump's financial records including his tax returns can be made public. the bottom line for now is that they cannot do. the justices rejected the argument that the president is immune from state to grand jury subpoenas while in office. they punted on whether congressional committees can have access to the records, throwing both issues back to the lower courts.
