story." my friends the broadway producer, what's going to happen to broadway? >> brian: good evening and welcome to "tucker carlson tonight," i'm brian kilmeade. tucker dubbed him the creepy lawyer and tonight cpl will be on. but first, major sacrifices during the coronavirus lock downs. maybe you still are, at the time we were told the sacrifice would flatten the curve and save lives. businesses was destroyed, u unemployment record high, and now after months of restrictions, the virus is back and politiciansol want to do the

9:02 pm
going to get it, the data is that most likely we aren't going to die, we have a 99.7% chance whether we contract it or not. >> let me jump in, neither of us are doctors and there are a lot of numbers being thrown around. ti've had it, it was not fun. >> brian: it's easy, one of them is still getting paid. we saw that interview and we invitedai him on to defend his position. >> the cops came in here today and gave us a cease and desist order from the city. >> are you going to abide by it? >> definitely i'm not. i'm going to continue to stay open, my barbers are going to continue to work and serve our community. do i expect that to come inside? they've said they're going to. there is no plan in place.
9:03 pm
>> brian: the second round of shutdowns, the menu just saw saw joins us now. the news, especially distressing for business owners like you, what are you going to do? >> we are going to stay open, we will continue to serve our community, we are not going to be bullied or live in fear, we aren't going to let this stopp us. >> brian: will your customers come? >> we are booked solid, we are the most busy shop in town. we have people coming from all over the statete and out of sta, we are booked and it's not slowing down. >> brian: since you went back online against the law and once they released you to do this, how many of your clients, customers tested positive for the coronavirus?
9:04 pm
>> as far as i know none. no one has ever come in and told us, none of my barbers have tested positive, none of our family members have tested positive. i think these tests are just going to confuse everyone, especially for the fact that the tests are proving that the death rate is going down at a great rate. there is absolutely no reason to keep shutting down our economy, shutting down the nation. >> brian: but they say in california, 8,211 new cases coming over the past week, what else do you want them to do? >> if you test more, there's going to be more positive cases. that's the statistical fact, no one is arguing that. it's not detrimental to our health, it hasn't been detrimental to the death rate, we've lived with td and whooping cough and flus for our entire lives and that's never shut down
9:05 pm
the nation before and there's no reason to shut it down now. the only reason that gavin newsom is doing this is because he enjoys the power and he's going to continue to flex it is much as he can. >> brian: how much does gavin newsom get paid if there's a shutdown? i believe the same amount. if they shut down, how much do you get paid? >> we get paid nothing, we are self-employed. there is no unemployment for us, no ppp in line for us, all these major corporations are getting paid and the little corporations, small businesses, they want us to break our backs and not get paid and step away from what we do and were noto. going to do that. unfortunately, there is no really good leadership in need thereof the parties, including the republican party. i feel like right now the only one who's using any type of common sense is president trump and his white house staff. unfortunately for us, he's not
9:06 pm
around here, so we are going to stay open. >> brian: over the last five months, i've had a chance to talk to a lot of small business people. between paying your rent anday paying utilities, paying your employees, taking care of insurance and worker's comp., you have your hands full everyan day. all you want is a chance to be successful, how does it feel somebody is robbing you of that chance and telling you you are selfish for fighting for taking a living? >> i'm not going to be believed by anyone, including governor newsom, including all of our senators and congressmen unwilling to make a stand on this. i'm not asking for a penny and i'm going to continue to charge on. i'm not going to be bullied, it's not th the american way. >> brian: iul hear you, best of luck. we are going to track you, weou want you to be safe, i know you're going to stay safe because if you are not and people start testing positive, they will come back.
9:07 pm
but you will be in control of ayour own fate and a so far you've done a pretty good job, best of luck. meanwhile california also making it very hard to wash up, first they banned a singing in church, now they are shutting down the churches altogetherr again. pastor hodges leads the san diego pentecostal church, there shutting you down. >> they are not shutting us down. we are continuing. the church is alive and well. >> brian: are you refusing to be shutdown? >> the church is never shut down, looking at all of our options right now. we do have a problem with this and i meet with a coalition of mega-church pastors and other organizational leaders like myself representing thousands of churches in california, there are over 10,000 churches in
9:08 pm
california. basically, we've gotten to the point where we are saying enough is enough. we have complied, we have accomplished a goal, we were told in the middle of march the goal was to flatten the curve and to not overwhelm hospitals. guess what? in san diego county we flattened the curve in three weeks and after four weeks, the curve is headed downward and hospitals are underwhelmed. churches are not part of the problem, they are part of the solution. while hospitals are treating people with thisf medical condition, the other parts of people's well-being is completely left out. their spiritual well-being, mental well-being, emotional well-being, the church will not be marginalized any longer. the church is here to help our societyy heal. >> brian: you are part of a lawsuit suing the state to stay open. >> we filed that on may the 8th against governor newsom, that
9:09 pm
lawsuit went to theto ninth circuit court with an injunction along with it, an emergency injunction request that was considered while the suit was held in advance and we narrowly lost that in a 2-1 decision. the judge had a scathing 18 page dissent, we took that appeal directly to the supreme court, it was fast tracked about 15 days in front of the supreme court and a decision came down within 21 days. unfortunately, we did not get the favor of that decision regarding granting our injunction but again, i narrowly divided court 5-4 and we are back before the ninth circuit. wewe are admitting some of our original filings and we are still in that lawsuit. >> brian: do you think these politicians are targeting, being very dismissive of church, of religion in particular specifically? >> i'm going to tell you come up until now, i've always said no.
9:10 pm
i'm always going to presume the best. that's how i'm wired to. but, it really does give us pause. because this recent spike in california is not being caused by churches. l.a. mayor garcetti finally came out and admitted that the coronavirus spike in los angeles is most likely caused by the protesters. he finally admitted that in a public press conference. if churches are not the problem, we are the solution. i would argue that the church i pastor in san diego is the safest place to be in town. one of my daughters is a nurse at one of our hospitals, she has worked at the covid ward as well and she said "dad, your intake procedures for church are stricter than ours at the hospital." and i said that's the way we wanted to be. said if you can go 1 mile, go two. we are looking at safety standards but we are saying we
9:11 pm
have constitutional guarantees. we cannot be shut down, you can't abridge our rights. >> brian: they're going to have to shut you down and physically lock your doors. thanks so much and best of luck in this fight. stay safe, stay healthy. we are done with this topic yet, california's largest school district will remain shut down this fall, they say it's about the coronavirus. in reality, the teachers unions are using the crisis to extort the government, what do i mean by that? the l.a. union says they will not return to work for the kids and so the government passes medicare for all to fund the police, bans charter schools, and gives them $116 billion. really? does not have anything to do with learning? victor davis hanson is a longtime californian and a fellow at the hoover institute, this is the bernie sanders agenda which has manifested
9:12 pm
itself with l.a. teachers, why did they think they can get away with this? >> they have over $100 billion in unfunded pensions for california teachers and they'vee been bailed out. they have among the most dismal test scores in the nation among the most highly compensated. it's a good thing they keep doing it. and all of these stories, there's about two or three things that summarize all of them. we have a class divided between a self employed and the middle class and those who work for government and wealthy that have guaranteed income. that's one divide. the other is this isan antiscience. it's ironic because teachers are supposed to be pro-science and teach science but california has a lower death rate for any population of european countries including germany, it's well under 200. it's only a fifth of new york and we have twice the population and we are doing very well. we know why we had a spike, all
9:13 pm
of these people who told us to be locked down for 90 days suddenly said politics trumps science and everybody can go out and protest if it's a correct protest along p the antifa line. then they came back and they infected people. third and i think this is important, if you take the equationout of or 2020 isn't an election year, we wouldn't have a lot of the grandstanding. a lot of this is predicated on the idea that the economy would never recover, the fifth largest economy in the world i'm a california's is not fully operative. if your kids are not in school and you have to have to provide day care at home, you're not going to be able to work or work efficiently. a lot of this has been weaponized and it's been pretty obvious now. it's a rejection of science and politics. of >> brian: you just mentioned kids for the first time, you've been talking this whole segment about kids and the school. lisa kreger is the writer for
9:14 pm
the san jose news, kids aren't the germ bags, a growing body of research suggests young children are extremely unlikely to transmit the virus. they get it from us. so you take the teachers with underlying conditions, you pay them and say you can't work until we get this vaccine, you let the kids go back to school andun you find a way. that's if you put kids first, final thought? >> that's what my colleague has pointed out. the children are the cooling rods of this reaction and they don't get the virus at all very often and they tend to be not very infectious and they don't transmit it. in some weird way, it's good that they are around. the people who are vulnerable. that would mean the economy would be fully operated and they wouldn't have a political agenda. they are getting paid not to
9:15 pm
teach and everybody knows it and the people who have to pay their salaries from the taxpayers don't have that luxury. it's very selfish what they are doing. again, it's ironic because the progressive teachers are alwayse lecturing us on let's follow the science, the science is clear from scandinavia, switzerland, china, the children are not the problem. it's who you talk about, people my age over 60. we can treat them without shutting down the entire school system. e >> brian: we can do it for target but we can't actually do it for grammar school. it's unbelievable and unacceptable. when you have 4.8 million jobs in june, got to make sure it doesn't happen in july, how do you do that? shut it down. it's always great to talk to y you. big story just came out of washington about theig washingtn redskins, our lab report is next. also, the creepy lawyer returns

9:22 pm
commented about their appearance, and left the women feeling helpless about their complaints. the story did point out that the nfl team did not have the proper structure in place to handle these complaints. one full-time staffer for about 220 full-time employees. some women were told by other veteran employees which males to avoid in the hallways, which stairwells to avoid, because it could lead to men looking up their skirts. as for daniel snyder, he was not accused of sexual harassment but more as a boss who belittles senior employees, one former employee went on to tell a story where they alleged that snyder after a meeting would prorate one of the senior management members would make fun of thehe fact that he was a cheerleader in college and made him to cartwheels down the hall. they now have two law firms working on this to handle the situation and the other the name change.
9:23 pm
>> brian: what kind of reputation does daniel snyder have beside underachieving on the field and firing coaches? >> you know, there's been a lot of stories over the years. sometimes these things catch up with you, that's all i can say. >> brian: three employees accused of improper behavior, larry michael the club's longtime radio voice, alex santos, and this could get really bad. this reads like i animal house, it's no john belushi and it's not a comedy, it's deadly serious. thanks so much, appreciate it. meanwhile, another big story straight ahead, will college football return this fall to the gridiron? lsu coach coach o is ready to return right now. >> we need to play football for many reasons. first of all, i think the country needs it, i think the state of louisiana needs it, th economy needs it. i think our children need to get back in school and we need to
