>> i am answering your question. >> at least let him answer the question. >> under penalty of perjury, i will answer the damn question. >> firing back and forth between william barr and democrats a hearing that appears to have more questions than answers that were all-out but as he will be attorney general at a question of his own. how long will we let our cities burn. live in washington with the heated moments. >> almost ready to reveal his running mate but in a news tori already giving it away.
1:01 am
the reported front runner and what is expected to be the most progressive ticket in american history. >> if you thought new york city pizza was brilliant, wait until you meet the new jersey pizza scrawl. "fox and friends first" starts right now. >> as you wake up with us on wednesday morning, julie and i house you that we will allow each and every one of our guests to answer their questions, we promise, unlike yesterday. good morning.
1:02 am
it was something else. you are watching "fox and friends first" on wednesday morning. jillian: thank you for starting the day with us. let's get to the showdown on capitol hill, william barr's firing with democrats during the heated house hearing, interest by democrats several times, did not anything back. >> this is a hearing, i thought i was the one that was supposed to be heard. >> i control it. the time is mine. >> you didn't need to wait? >> you did answer the question. >> he said under penalty of perjury. i'm going to answer the damn question. >> griff jenkins reclaiming this time live in washington. that was the big take away, reclaim my time. >> reporter: i watched the
1:03 am
entire thing because i was stunned, the most contentious hearing we've seen on capitol hill in a long time. democrats grilling their most wanted to witness but it was clear from the get-go that they have little interest in the attorney general's answers, questions ranging from the president's bidding to the russia probe, his handling of the civil unrest in cities like portland. >> you did it in washington, you did it in lafayette square, you expanded to portland and now you are projecting year and violence nationwide in pursuit of obvious political objectives, shame on you. shame on you. my time is expired. >> reporter: at one deck of us have republican acknowledged chairman at the for being rude to try to give an opportunity to be fairly heard.
1:04 am
>> i don't want the time. i want the attorney general to have enough time to respond to accusations and questions asked him and you guys not cut him off. >> what you want is irrelevant to the's. mister stu be is recognized. >> when he had a chance to make his case william barr pushed back on this line of attack. >> federal courts are under attack. since when is it okay to try to burn down a federal court? of someone went down the street to that beautiful courthouse at the bottom of the hill and started breaking windows and firing industrial grade fireworks to start a fire, to throw kerosene balloons is that okay? is that okay now you >> he also challenged democrats suggesting he was punishing the president's enemies, little news, politics on full display but perhaps the lowest point,
1:05 am
partisan rancor of the day when the attorney general requested a 5 minute bathroom break chairman at the responded no. jillian: federal agents respond in portland. >> here to react senior legal fellow a judge foundation, so many places we could jump into our discussion, we will start with portland and listen to the attorney general, what he said about what he said. >> peaceful protests are being hijacked by a hard-core of instigators, violent instigators. they have become violent in their primary direction of violence is to injure police. todd: what do you make of the disconnect between what democrats are seeing and what we have seen with our own eyes in
1:06 am
portland each night in the last two months? >> democrats seem detached from reality at that hearing, kept referring to these violent rioters as peaceful protesters but as you say we have been seeing the video, they are not peaceful protesters, that was a sign of how what was supposed to be a hearing was more like a soviet style show trial because all they did was make inflammatory accusations all day and then wouldn't give the attorney general the ability to even response to their supposed questions. jillian: there are a lot of peaceful protesters but the problem is people are lumping everyone into one category because you have the peaceful protesters and then you have the rioters, the violence happening out there.
1:07 am
one of the things, how william barr said since when is it okay to burn down a federal court, is that okay? is this okay now? what did you make of what he had to say? >> the attorney general was distinguishing between peaceful protesters which he says he supports and violent agitators who attack federal courthouses and federal officers whereas democrats are failing to do that and the attorney general mentioned us marshals just trying to defend the courthouse in portland have been seriously injured, everything from being burned to being beaten to three who may be permanently blinded because they were attacked with lasers by these supposedly peaceful protesters. democrats seem to be detached from reality whereas william barr is doing what he is
1:08 am
supposed to be doing which is protecting the federal courthouses, federal property, federal law enforcement personnel, something democrats don't seem to want to recognize. todd: william barr defended his involvement in the stone and flynn cases multiple times and pushed back on the idea that he has politicized the justice department. listen to that exchange. >> i asked another us attorney and he determined based on documents that had not been provided to the court that in fact there was no basis to investigate flynn. >> i grew the president's friends don't deserve special brakes but they also don't deserve to be treated more harshly than other people. >> how do you think he handled this line of questioning?
1:09 am
>> he came across as cool and professional which is a contrast to democrats asking him about this. on the flynn case the lawyer that he assigned to look at that uncovered evidence to the prosecutors in that case had not turned over exculpatory evidence showing that the defendant was innocent of the charges against him and the fbi clearly engaged in wrongdoing. under those circumstances we wouldn't want the attorney general to recommend that a case dismissed. nobody wants them engaging in abuse of powers to target someone when they didn't break the law. jillian: is anyone's mind changed? >> the american public may see william barr in a better light given the frankly ranting and
1:10 am
inflammatory way the democrats conducted that hearing, it was the height of rudeness and instability. jillian: thank you for joining us. have a good day. the battle over the next covid-19 package ramping up as stated green milestones in virus related deaths. todd: republicans and democrats debate sticking points. >> reporter: lawmakers are battling it out on capitol hill for the next to me was package the death toll continues to rise. florida had its highest single day total with 186 in texas had 1600 deaths last week, a texan dying every six minutes and 16 seconds. republicans going to pass another multibillion-dollar relief bill. there is already pushback.
1:11 am
>> majority leader mcconnell, not much of a stimulus. i would call it a nonstarter. this plan literally provide 0 support for state and local governments that are fighting through this crisis. jillian: even some republicans are unhappy with the bill which provides $105 billion for schools, $70 billion k-12 it also adds non-abca24 related funding like $1.75 million for a new fbi headquarters in washington dc. >> i am opposed to non-germane amendments whether it is funding for the fbi building in the house bill whether it is a tax-cut for high income earners in blue states. i would hope all of the non-abca24 related measures out. >> criticism from the president as doctor anthony fauci defending himself. >> i will continue to do my job. it is important, we are in the middle of a crisis with regard
1:12 am
to an epidemic, a pandemic. i've not been misleading the public in any circumstances. jillian: donald trump wondering why he isn't getting any kudos. >> a man who works with us closely, anthony fauci and doctor birx, highly thought of, yet they are highly thought of but nobody likes me. it can only be my personality, that is all. jillian: the pandemic even affecting baseball, andrew cuomo offering to install easily baseball games in his state after the miami marlins -- duties players. >> the trump administration will no longer exit new dac applications while the conduct a review of the policy. the obama era program shields illegal immigrants across the uss children from deportation. the white house will renew existing protections for only one year instead of two. the supreme court recently shutdown efforts to end the program. in the next hour former florida

rob: a disturbing spike in violent crime plaguing american cities, homicides up 95% compared to this time last year. jillian: police department are being defunded. what does it mean for officers forced to do double the job with half the resources? retired nypd lieutenant joins us with his taken.
1:17 am
good to see you. let's look at these numbers, shootings up in major cities across the us, 69% increase in new york city compared to this time last year, 47% increase in chicago, 50% increase in philadelphia. my question, police are exhausted, some to permit expressing a high number of police officers retiring, putting in a position for that, you have departments being defunded resources strains, are crimes able to be solved at the pace they need to be? >> absolutely not. no way they can keep up this pace because they are asking them to do more with less, the bureau is stretched out when they start, protesters wrapped in and they have to get into uniform to back up the uniform for so it is like triage and
1:18 am
naturally violent crimes will come first. everything else is on the back burner, they don't have the manpower and they cut back the over time. this is a fickle effect but it will snowball from a month or two from now. todd: let's talk about back burner crimes. what so-called lesser crimes should we expect to see? >> lesser crimes, nonviolent ones of burglaries, larcenies, anything of violent nature would be a shooting or homicide, that would get priority. they are stretching them, let's take another thing into account. the sick calls will go up, they
1:19 am
are asking so much, it is not effective at all. the funding is going the way the political party wants it to go. our so-called mayor wants it to go. to investigate when he wants to, that is it. it is powerful because everything we worked for over the years to get the city to this point is gone and it will take decades to get it back. jillian: plans they are expressing support for defunding the police, you see the vastness of this conversation. all those cities and states. what does this mean to the mind of a criminal? >> it just emboldens them. they see the revolving door.
1:20 am
if they commit the crime, the other thing is there is a video out right now. the coalition telling the public they are doing their job, they want to do their job and how they do their job just to let the public know they are still there for them but not the capacity they were in the past and that is impossible at this point so criminals will have a field day. they will sit back and take advantage of it as you would expect because this is the city we live in, this is the world we live in, not just new york but across the united states, wake up, america because this is coming to a city near you when you least expect it. jillian: thank you for your insight, we appreciate it, 20 after the hour, should students pay tuition for virtual

to that beautiful courthouse and started breaking windows and firing industrial great fireworks and start a fire and start fires in court, is that okay? is that okay now? todd: william barr railing against the bogus russia probe. >> slim democrats over the -- how he defended himself. >> it wasn't a hearing. it was an attempted persecution. the american people saw that. the point my democratic colleagues seem to be trying to make is the attorney general was out of control. what they really mean is he is out of their control. william barr is guided by the rule of law and he doesn't do anyone's bidding.
1:33 am
he is tough as a pine not. >> one of the take aways that got lost in the fireworks, william barr confirming he appointed john - to investigate the unmasking of michael flynn. jillian: the democratic national convention is just 3 weeks away but looks like the party is becoming more divided. hundreds of bernie sanders delegates pledging to vote against the party platform unless it includes medicare for all. todd: independent women's forum senior policy analyst joins us to weigh in. let me read what the petition says. it reads as follows. senator sanders believes the democratic party platform should advocate strongly for medicare for all. the senator appreciates that a minute deadly pandemic creates the national health emergency,
1:34 am
his delegates understand now more than ever he must guarantee healthcare as a human right. how does biden respond to this petition? >> this is a divide that existed on the left for quite a long time now, since bernie sanders has been around for decades, aoc made it more prominent and we are seeing the bernie sanders aoc wing of the democrat party try to pull biden's policy position to the left. healthcare is just the latest example. i would expect this infighting to continue. the media will do its part to cover it up and act like it is not a big deal but these are serious policy differences between the two wings on the left, the biden team we know is working to bridge that divide.
1:35 am
if he has any hope of reaching his voters with a policy platform. he will not be able to go down the path of universal socialized healthcare like the bernie sanders we is advocating. >> what kind of president will he be. >> if i'm elected to the this, i will go down as one of the most progressive presidents in american history. consistent with a free market. not inconsistent with capitalism. >> that statement is impossible. of free market contradicts the types of policies that he has already released, issues like climate change and minimum wage and universal childcare.
1:36 am
taxpayers are paying for all of this, this is not the free market for providing these services but government provided services paid for by us the taxpayers. >> >> what joe biden is, how would you make of how biden handled this search so far. >> the violent riots raking out. the black lives matter. we are talking about. what vp candidate would appease
1:37 am
both factions of the left right now? i'm not sure there is an easy answer. we know the announcement is coming soon but there are very few individuals, besides, my, shall obama figure who we know is not in the running for this position who would make both sides of the left happy right now. jillian: thank you for joining us, appreciate it. 37 after the hour. carley shimkus for a check of the headlines. carley: two women under arrest for attacking a democratic wisconsin state senator who says he was recording a video of protesters outside the state capital when this happened.

making more money than they were making when they were working. university of chicago did a study that 2 thirds of those employees are in that situation. the republicans are trying to create incentives to get people back to work as opposed to stay on the catch if you will. jillian: a lot of people out of work but there are also a lot of jobs that need to be filled in that is affecting small business which is the next category, the gop, equal to what they did, along with liability protection. that is the sticking point. democrats want $10 billion in small business grants. which planning your opinion helps small business? >> bridging back to the first plan, a program to create incentives for people to get back to work, starting to scale
