being mugged that the cops would be the enemy. you have the speaker of the house referring to federal agents, by the way the same designations of federal agents that protect nancy pelosi, those capitol hill police, don't know if she told you, as storm troopers. jillian: donald from pulling leadership from the national association of police organizations at the white house after the group endorsed him earlier this month. todd: felony charges for displaying guns during a protest says police had a video of armed protesters outside his home. >> the police were aware of people in the crowd, that just got revealed. as i told you once before, one in particular pulled out two loaded magazines, you are next.

procedures, will 48 a, judge sullivan took the opportunity to do his own investigation, appointed advocates, to look at this, william barr's attorney general, what happened was, a petition under the risk act, 1651 and the dc circuit court, 3-judge panel said this is inadequate and judge sullivan on separation of powers taken that dismissal. because of that the 3-judge panel dismissed the charges. it is up to the appeals court, 11 judges fail because there is

a majority, they agreed to reevaluate this, the entire circuit to make this determination, dismissed in front of sullivan's investigation. shannon: michael flynn's attorney was on with hannity. let's get reaction on the back end. >> judge sullivan's petition should not -- there was no standing to file it. taken on the role of the advocate. jillian: what do you make of that? >> district court judge taking that petition, very does favorable for the entire circuit

this bill is long overdue. like so many others, my heart is torn, to communicate frustration with the system and as i learned about vanessa and the matter she died it is horrific, should never happened. i spent ten years in the military and credit who i am today as a result of my time in the military, i had an opportunity to work alongside great men and women. we heard of stories like vanessa so many times, gregory morale us, this deep situation, a better pathway for that.

todd: this bill allows active-duty service members for assault claims instead of their chain of command. you mentioned that this was long overdue. why haven't a bill like this been put into law? >> there are a number of reasons. there are bad apples in every walk of life and when they raise their ugly head we need to take swift action and make sure victims, those who have been harassed in any form have the ability to make their concerns known. in any corporation the military is no different, those who want to protect the system more so than the individual and we are not just seeing that in the military but a congressional

oregon state police moving to portland is the city transitions federal agent outside the city. rob: they did not stop protesters from gathering overnight, more on the city's new tone as the present without a crackdown on rioters. >> reporter: troopers moved into portland to replace federal agents. oregon state, and officer friendly look at a more peaceful tone as portland hit into at 60 fourth day of protest with 400 arrests made at that time, the president blasting the violence, vowing to bring back federal prisons if necessary. >> these are professional agitators, professional anarchists. they are working today and probably tomorrow to cleanout a beehive of terrorists. if they do i will be very happy.

if they don't we will send in the national guard. jillian: a conservative journalist is speaking out after he was stabbed during the unrest. >> a message to tell everybody they need to wake up and people need to expose them for who they truly are, domestic terrorist organization. jillian: we won't know the officer's point of view for now, a judge blocked them from reporting and live streaming protests. todd: thank you. jillian: tropical storm isaias strengthening to a category one hurricane as it approaches the bahamas. heavy rain and strong wind gathering parts of puerto rico and the dominican republic.

todd: florida bracing for the storm expected to hit this weekend. janice dean joins us with the latest track. >> janice: the latest information from the national hurricane center as of 5 am, still a category one hurricane, it is going to battle some dry air and upper-level sheer which could inhibit it from strengthening but we also have warm water in the bahamas that could help it strengthen so it is battling are few things we have to watch and fine tune the forecast. look like a brush with florida and direct impact on the north carolina coast line. moving through the bahamas it will continue its northward turn. when it actually makes the turn is going to determine what our track is going to be into the weekend but right now looks like the center, the core of the strongest winds remaining offshore from florida and the computer models are in good

agreement of that. as we get to the latter part of the weekend, monday into tuesday it starts to accelerate and perhaps direct impact on the outer banks. cape cod, the island have to watch this. the official forecast track has it remaining a hurricane for the duration of its lifespan. you see the tropical model in pretty good agreement. we have to find tune a lot of things. the intensity, exact track and if it makes landfall yet to be determined. if you live from south florida to maine you need to watch the track of this system. we will keep you up to date. jillian: the good news is a couple days people have time to prepare. todd: donald trump sending shockwaves from capitol hill after floating the idea of delaying the november election. >> i want to have the election but i don't have to wait three

americans to think about. we had prosecutions of republicans in west virginia, mail in voting issues, we have had elections in new jersey on the democrat side in local elections and for months now since last november i had a problem and don't get my mail from the post office, i get an image and haven't seen that mail from fox news networks. there are problems between lost mail, potential for fraud, mail in voting opening the door to problems and that is what the president is addressing. todd: half the country is somewhat interested in this problem, the other half not focused on it and we are a few months from this election. switching gears, 100,000 criminals released because of this pandemic.

those are the stats spread across 39 states, dc, the federal system. is that the right move, releasing his individuals due to covid-19? >> now. are there people who need to go into protective care or isolate? in extreme circumstances we can do that but removing someone from prison who is there because they have been adjudicated and convicted, the majority of them didn't stop being criminals because of coronavirus. catching coronavirus is not an automatic death sentence. can it happen? yes. but as they friends but americans in jail for not wearing a mask, criminals we don't want out on the streets back on the streets and ask people whether it has been a murder or bank robbery or other

crimes committed by these criminals why are we letting them back out into society? >> five times likely to get sick in the non-prison population. herman cain passing away. it is sad. tea party movement is successful. and we miss him. i don't know what contributed to it. as the media has done, all i can say is we lost a really good family man, someone who cared about this country and lived his life on principles of freedom
