1:01 am
we are on the ground in north carolina, one of the hardest hit areas. good morning. >> breaking overnight some good news, children who were thought missing during this tornado that touched down in poverty the trailer park behind me have been found, that makes two adult who died. the clean up in north carolina is going to take a while especially in this trailer park where the tornadoes pulverized so many of the homes that are there. a number of houses caught fire is flooding and gas mains combined for a very combustible situation. all the harder for firetrucks to move around in 8 foot storm surge and 80 mile an hour winds. one thing made the storm so unusual is how quickly it moved south to north bringing flash

flooding in philadelphia where one person was killed, a woman was swept away in her car in rising waters. all told, 3.7 million people from south carolina all the way to northern new york state are out of power. >> you could hear everything splintering, glass breaking. may be two or three days before we get power. >> 2 or 3 days for her and longer for those in rural areas as there are so many power lines that were brought down by the wind and so many trees that were uprooted because of how wet and soggy the ground got. something to keep in mind, this is now august 5th, just the beginning of what is supposed to be a very active major heart of the hurricane season. >> let's go to janice dean.
1:03 am
the water, the flooding is always such a disaster and the wind was really wild. >> janice: this was worse and sandy in 2012 for a lot of folks. there were trees down everywhere, power outages, some say it will take a week to get the power back on. it will be a trying time in a reminder it doesn't take a big hurricane or strong hurricane to causing credible amounts of damage. the storm is cleveland mentioned, fast-moving, now in canada. in its wake a lot of distraction, over 2 dozen reports of tornadoes yesterday. here are the peak wind gusts as it made landfall across north carolina, 100 mile-per-hour windss, new york city, jfk, 70 mile-per-hour winds, bridgeport,

connecticut, 60 miles per hour. the storm is done with the us but this is a recap of what we saw the last 24 hours, 2 dozen reports of tornadoes in highly populated areas. even those we were week tornadoes relatively speaking causing a lot of damage and unfortunately deaths, here is the radar estimated precipitation. in some cases a wide swath of 3 to 6 inches but when the storm made landfall we saw the higher totals, 8 to 10 inches of rainfall. incredible storm, the worst of it now moving into canada but the distraction it left is in some cases historic for many people. back to you. >> breaking overnight donald trump's campaign and the rnc suing nevada over mail in ballots one day after the nevada governor signed a new law to
1:05 am
expand mail in voting for the november election. >> the suit claims the law is illegal and voter fraud will be inevitable. the governor says people shouldn't have to choose between voting or their health. and now to this, in a few hours former deputy attorney general sally yates will be in the hot seat on capitol hill over her role in the fbi's trump russia probe. >> the questions senators want answered. >> sally yates will face a firestorm of questions from senate republicans who are investigating the origins of the russia probe. she is expected to be grilled about an oval office meeting she attended in 2017 when president obama and james comey discussed sharing national security information with michael flynn, flynn's attorney says gates has a lot of questions to answer.
1:06 am
>> we know now from the record, they believed general flynn, showed no indications of deception and yet the next day she runs to the white house not once the two times to get general flynn fired. >> the investigation includes reviewing the probe the former trump campaign advisor carter page, the fisa warrants. lindsey graham says that will definitely come up at today's hearing. >> he signed a warrant application in january of 2017 to seek a fisa warrant against carter page. we know there was no there there. i will ask her if she knew then what she knows now which is signed a warrant. >> reporter: donald trump telling lou dobbs he is stunned about what has been uncovered about his campaign so far. >> we caught them spy using the intelligence apparatus of our country to spy on opponents or

the opposing party's campaign before and after the election. it is up to our attorney general. i hear it is breathtaking what they found. that is all i can say. >> a grand plan to call in comey and andrew mccabe to testify before the november election. or testimony to come just ahead of the 2020 election. we will have more on this later. todd: hundreds of protesters set a dumpster on fire in portland, oregon outside the police union. >> the city's 10 straight week of unrest, senator ted cruz call the democrats refusing to condemn violent radical hijacking protests. marianne rafferty joins us. >> senator ted cruz not holding back during the hearing. >> protests against a vile act
1:08 am
of abuse. sadly, soon hijacked by opportunists and violent radicals. shannon: also calling out democrats for refusing to denounce extremist violence. when exchange became heated between ted cruz and hawaii democratic senator maisie hirono when she got up and walked out. >> i hope this is the end of this hearing and we don't have to listen to anymore of your rhetorical speeches, thank you, i am leaving. >> appreciate as always kind and uplifting words of senator hirono and i would also note that throughout her remarks she still did not say a negative word about antifa nor has any democrat here. shannon: before her abrupt exit she said it is the protesters who needs protecting. >> we seem peaceful protesters in need of protection from federal officers.
1:09 am
no one is condoning violence. >> testimony by secretary ken cuccinelli painted a picture, 140 officers sustained injuries during violent demonstrations outside the federal courthouse in portland and 97 arrest of protesters during the last two month. >> you're welcome to say something negative about antifa right now. she declined to speak so that is the position of the democratic party. >> someone who does have something to say, journalists and the know who was attacked by antifa last year. >> i was beaten so badly i was hospitalized.

race. we have to when a couple of them on november 3rd but congratulations to everybody, a big night. shannon: a big night in kansas where congressman roger marshall leaves chris kobach. beating lacy clay. what do these results signal now that we're 3 months from the presidential election? ron meyer joins me, thanks for being here. the president had previously backed roger marshall, seemed rather excited about it. would you think the results? >> conventional wisdom is ron d marchal was the next, mitch mcconnell got involved in the primary which is rare but wanted to make sure kansas stayed a
1:16 am
republican seat. by all means there should be a relatively safe republican hold. roger marshall only beating the democrat by 10% so it is a race to watch, definitely one that people should pay attention to. >> let's look at the results. roger marshall, 40%, chris koc a kocbach 50%. it is the one to watch but it has been a long time. >> democrats have routinely won the governor's mention so kansas has become more competitive over the years. with trump on the ballot it is less likely democrats have a play, they are hoping kobach would win because he was defeated in the 2018 election but nationally a little different, people care more about partisan leanings during a
1:17 am
presidential year. >> let's talk about the misery democratic results. you see this one a bit closer, corey bush coming in with 48.6% over lacy clay with 45.5%. what does that say to you? >> democrats are lurching to the left. this is the third major incumbent to the aoc wing of the party. whatever you call justice democrats, when they ought to appeal to moderate voters to defeat the president they are going further to the left and it is making it easier for donald trump and other republicans to say democrats are trying to go to a place where they are out of touch with middle america and this is another sign of that and it is pretty amazing, lacy clay was in the house for 20 years and before that served in the
1:18 am
missouri house, since 1983 and so his family has been an institution there. the social justice wing of the party led by aoc and rashida tlaib and that up winning her primary last week shows the democratic party is going to the left in a year they are to be trying to appeal to the middle. shannon: that is interesting because joe biden was on yesterday saying joe is a moderate but you have bernie sanders saying joe biden will be the most progressive president in history. i don't know where the democrat party will be between now and november. >> you have jill biden on fox news saying joe biden is a moderate and bernie sanders telling is supporters joe biden is progressive. that is a lot about politics, doesn't it.
1:19 am
that is the interesting thing, that joe biden can appeal for middle america and the progressive left. a lot of politicians are in that conundrum where they have to appeal to the middle and their base but at some point joe biden is going to have to come out of the basement and the interview with jill biden, joe biden announced there would be three presidential debates, a big opportunity for the president to shakeup this race. a lot of prognosticators think donald trump doesn't have much chance to win but with three debates, the president has 3 chances to shakeup this race and that's going to be, those 3 debates will be spectacular events to watch and could be historic changes in the race so will be exciting to watch. shannon: thank you for joining us, appreciate your intel. also just a note, roger marshall will be on "fox and friends" at 7:00.

that is why i created giving people like you the opportunity to learn the basics so you can see the reality of police work. >> this morning markland joins me with more on that offer that is now going viral. why did you do this? >> there's a lot of uneasiness in this world. everyone sees what is going on, people don't know what to do and i saw this as an opportunity to help people deal with these emotions they are feeling. we all see this going on in the news, the insurrection, the riots and people want to feel like part of the solution is not the problem. >> let's go over the requirements applicants can see, including a background check, signing a waiver and for our training course. once an applicant complete these requirements what are they allowed to do.
1:25 am
>> we have control policy that assists are deputies on a daily basis. this will be a citizens policy where we can train them, give them more knowledge how they can protect themselves, their homes, their communities and their county in the case of an emergency so this policy will be more for me if there is an emergency. if the sky falls, floods, fires, riots, anything like that i can call on these. the sheriff's responsibilities to prevent breaches of the peace, riots, insurrection and i can command inhabitants of the county to help me to do that. >> what is the reaction from the community to this? >> it has been great. we've had over 2000 emails already, people want, they are yearning for something like this, to feel involved.
1:26 am
i have my critic too but they will be the same people saying we are not doing enough as law enforcement to bridge the gap between community and law enforcement. i would ask is where critics to wait and see. they will see this will be a good thing and it will be a recruiting tool for our other volunteer programs, our patrol party, citizens on patrol and paid positions like deputies. it will be a great thing all around. >> this is certainly an interesting idea. interesting to see if it catches on throughout the country as other counties do we have clay county doing it. it will be interesting to see if others do it as well. we appreciate your time.
1:27 am
shannon: the trump campaign sues nevada over mail in ballots as the president points to one city showing what can go wrong with mail in voting. >> you see patterson, new jersey, where i believe it was 20% of the vote was fraudulent. you have tremendous fraud if you do these mail in ballots. >> the new jersey gop chairman joins us with what he's doing to stop future fraud. doesn't compare to zerowater's 5-stage. this meter shows how much stuff, or dissolved solids, gets left behind. our tap water is 220. brita? 110... seriously? but zerowater- let me guess. zero? yup, that's how i know it is the purest-tasting water. i need to find the receipt for that. oh yeah, you do.

1:31 am
>> the lebanese people are waking up to survey the damage from this massive explosion the red cross says killed 100 people leaving thousands injured. overnight rescue crews picked through the rubble looking for survivors, there was twisted metal, broken glass and splintered wood everywhere, lebanon's president has released $66 million in emergency funds as a is pouring in from around the world, beirut into the 2-week state of emergency of the government has pledged to hold someone accountable for the blast was the official explanation is a stockpile of ammonium nitrate that was on fire leading to two blasts in the city, hospitals remain overrun at this hour. you saw story after story of people losing everything. when interview with the governor stands out he compared the devastation to that of hiroshima and the nuclear blast as he choked back tears. in washington donald trump said this. >> i met with some of our great
1:32 am
generals and they seem to feel this was not some kind of manufacturing explosion type of event. >> pentagon official speaking to fox news say there is no evidence to support that statement by the president. all evidence points to this being in accident. basically claiming otherwise puts us allies like israel at risk. shannon: thank you. donald trump's campaign and the rnc sued nevada for allowing voters to use mail in ballots in the november election. >> the breaking developments, good morning. >> reporter: if you have any doubts this is an election like none before, look what we are
1:33 am
seeing in nevada, the trump campaign is asking a judge to intervene after the governor signed a bill providing mail in ballots. the lawsuit alleges several issues estate encountered during the primary including ballots mailed to deceased individuals the wrong addresses, the latest state joining several others including washington dc who will mail ballots to voters. the president made known his concerns for fraud but the presidents took a different tone yesterday when talking about florida. >> in the case of florida they've done a great job, they've had tremendous success with it but they've been doing this for many years and made it terrific so for florida you can mailing your ballot, you don't have to go, a couple other states worked out a system but this took years to do. this takes weeks or months. >> worth noting absentee ballots widely used in florida differs from ballots without being requested get even that is causing problems 6 weeks after that new york primary still no winner and in michigan some 2 million absentee ballot and this morning votes are still being
1:34 am
tallied raising questions whether state in the u.s. postal service are prepared for this is democrats accuse the president of trying to alter the election, hillary clinton tweeting this. i still republican sabotaging the usps including slowing of mail delivery, trump's ready to make voting by mail more difficult this fall, return them as early as you can. meanwhile on the campaign trail jill biden defending her husband against claims he is too far left. >> joe is a moderate. that doesn't mean his ideas aren't progressive and bold and forward thinking but he's not someone who is left or someone who is right. he is a moderate. that is who he has always been. >> is for his running mate no announcement but most view the shortlist as harris, not viewed as moderates.
1:35 am
>> the trump campaign, railing against mail in voting fraud. what idea they have been shining a light on his patterson, new jersey, 19% of mail in ballots were rejected during the main's election. joining me to react is the chairman of the new jersey republican party, good to see you, thank you for being here. it is important to note that we don't know that all of these were potentially fraudulent but for those folks who don't know what happened give us an update. >> there were all sorts of problems with ballots being left an apartment complex foyers, to being delivered to people getting ballots that hadn't applied for them. no doubt new jersey's vote by mail process was wrong, patterson, all.-- vote by mail
1:36 am
shining the spotlight on governor murphy's week leadership and that judgment, the state was woefully unprepared to handle the complexities of an all that by mail election but governor murphy has shown an inability to handle many of the complexities of the covid-19 crisis from unemployment claims to lines wrapping around motor vehicle commission offices around the state, 6800 dead veterans and counting at the state's nursing other long-term care facilities. jillian: mail in ballots, this is something concerning to a lot of people as we get closer to the election, the question is after seeing what happened in patterson where the mayor says the president isn't telling the entire truth about that. after seeing what happened, how there were thousands of ballots, 19% of them that then didn't count. how do we do this right? can it be done right?
1:37 am
>> i can't speculate on what can or can't be done and clearly the facts in patterson speak for themselves as they do from july's primary vote by mail election. it is incumbent on all of us to educate voters out of it by mail process works and how it needs to work, to make sure we are being vigilant and making sure the laws that are on the books are properly enforced. last but not least if that fails as you mentioned earlier the rnc in nevada has turned to suing to make sure the process is protected. you can get in contact with the rnc and the national republican congressional committee. when push comes to shove, we will do the things we need to do but we are confident the process will be protected. that's an option too. jillian: the supreme court will hear republican lawsuit over governor murphy's $9.9 billion borrowing plan. was can you tell me about what we can expect today? >> 10:00 this morning the state
1:38 am
committee will be heard, join with republican leadership across the state to challenge the illegal borrowing and stately tax, the constitution of new jersey is pretty clear you can't borrow money to meet operating expenses and that is exactly what the governor is trying to do. you have families around the state around kitchen tables every night trying to figure out how to make ends me, the governor borrowing funds to dig the hole deeper and it is getting more difficult for folks to do that. jillian: we will be watching, keep us updated, thank you for joining us, appreciate it. >> thanks your time. >> we are not going back to shutdowns. we understand the disease, we understand the problems with elderly with heart or diabetes or other problems and we are able to take care of them. we understand it now but we are not shutting down.
1:39 am
todd: the economy will stay open despite coronavirus growing nationwide. the president also taking aim at lawmakers stalling relief for millions of struggling americans doubling down and taking executive action of his stimulus plan is not passed soon. the husband of district attorney jackie lacey is charged with pulling a gun on black lives matter protesters outside his home. >> get off of my porch. i will shoot you. get off of my porch. >> database he charged with assault with a firearm for this march incident. jackie lacey defending her husband saying in a statement, quote, my husband acted in fear for my safety after we were subjected to months of harassment that included a death threat no less than a week.

there is no safe place, violence is everywhere. so you have valuable cargo and now police to rely on, who will protect our drivers. >> driver, sales worker and truck driver, transportation, material moving occupations are somewhat connected. how will this impact your business? >> it will affect my business for a couple reasons. the states that are going to defund the police we will not go to because we are trying to avoid those states for safety reasons but another issue i'm seeing in the future, i have cargo insurance, liability insurance, physical damage insurance and i'm curious when i review my contract at the end of the year if there will be

jillian: the ncaa set to announce whether championship games will be played this fall as college athletes hope to return to their teams. joining me to weigh in the status is jason page, good to see you this morning. what is going to happen with college sports this fall? >> what we are going to find out today is the fate of certain college sports but we are not going to find out about the big ones, soccer, volleyball or any of those but the big question is
1:52 am
what is going to happen to college football, big-time college football? they will decide the championship series but we still aren't going to find out, the ncaa wants to hold off and wait as long as they can before trying to make a final decision what to do but at the end of the day you have to wonder why on earth would they even try to formulate a plan when we don't know where this virus will be come the fall, so many conferences trying to decide. a lot about out of the upcoming fall season, some schools are coming back, some aren't. it will be very difficult to try to put a plan in place if you're the ncaa, college championship schedule for the fall sports teams given all the uncertainty right now. jillian: the ncaa president says individual contest, football game, basketball game is quite
1:53 am
different. in the case of a college football playoff talking about the championship game is very different and more challenging environment than adding one or 2 games to a season. you feel guys and girls who hope to play professional sports beyond college. >> not even just that. most of these athletes, the ncaa price itself on this, most of these athletes are not going to play professional sports after these collegiate careers are done so for them this is it. for some of them this is the senior year, their final hurrah, their last chance. they are not going to get this opportunity again. i feel more for them than people going onto the pro ranks because those going to play professionally will still have opportunities to go to workouts and those sorts of things, there

will be adjustments made there. who i really feel for our college athletes going into their senior year that may not have a senior year. jillian: let's talk about baseball. miami marlins and cardinals postponed their fourth game series in detroit. let's look at their positive results, 7 players, staff members, cardinals, seems like baseball is having a hard time. derek jeter said they were not running around town but had a false sense of security, they were not wearing their masks. >> they were running around town. they were in miami. of course they were running around town. the cardinals will not be playing until friday. the marlins played last night, they are supposed to be the laughing stock of baseball in terms of not being a big winner but they are 3-1 so major league baseball has to figure out a way to make sure they make it to games they have to play because with 16 teams making the season the marlins could be a playoff
