todd: welcome back. almost as quickly as the pick was made, pro life groups swiftly denounce the biden, harris ticket. jillian: with nearly a quarter of democrats identifying as pro life, did joe biden alienate a key voting block. kristin jay joins us live to discuss. good morning. thank you for being here. >> sure. good morning. thank you for having me on. jillian: of course. what is your response to that? what is your thought? did this pick alienate anybody? >> we were already concerned about joe biden and his stance on abortion, the fact that he changed on the hyde amendment that he made the democratic platform the most pro abortion platform we've seen in history. his pick of kamala harris for vice president, while historic, is also very concerning for pro life democrats because her stance is even worse than the

vice president's. todd: let's take a look at numbers. kamala harris was given a 100% voting record on pro choice policies, there you see it is in 2017, 2018 and 2017. 2019. is the selection of harris going to force pro life democrats to vote for trump or sit out the election entirely or are they going to swallow hard and say we're going for biden and hair which is because we are democrats. >> no, right now pro life democrats are very concerned about the platform language, we're very concerned about the direction of the party. even before the pick of kamala harris, pro life democrats were considering staying home, they were considering not voting. they do not like this platform language. they do not like the fact that vice president biden is the most pro abortion pick that we have had. jillian: is that the answer, to just stay home and not vote? it seems like that's not the

messaging that's best, perhaps because people still always want their voices heard, correct? >> by not voting and staying home, their voice is heard. in 2016, a lot of pro life democrats stayed home and be not vote for hillary clinton. there was a large number of them. so yeah, pro life democrats want to be heard and we are continually talking to the biden campaign, pushing the biden campaign and telling them that we want pro life representation. right now, there is a litmus test applied to candidates. they are told that they have to change their position to be in the democratic party and that is just wrong. and pro life democrats are fed up. we're seeing large numbers of pro life democrats coming out of the woodwork now and speaking up. before they were silent. i'm encouraged by the movement of pro life democrats and the fact that we will no longer be silent. todd: take a look at some of the trump administration pro life actions. i'm not going to read them all. we're going to scroll them as i

ask you this question. will this force you, kristin, to vote for president trump on november 3rd? >> i am representing democrats for life and pro life democrats and right now our push is against -- our argument is within our party. we are trying to push our party to be -- to change and to be inclusive and diverse and really embrace the pro life democrats that want to be part of the party. todd: certainly going to be interesting to see what happens because when you look at those swing states like pennsylvania and florida, with huge catholic populations, that like to vote, it's going to be interesting to see if the democrats of those groups decide to just sit at home or go for dru trump. we appreciate your time. jillian: gyms still closed in new york. our next guest is a gym owner, suing the governor to reopen.

jillian: good morning. welcome back. a judge blocks plans to remove philadelphia's columbus statue, hours after being approved by the city's art commission, it's part of a legal battle to keep the statue in a park. attorneys call the judge's order a, quote, victory for civilized society and say the city rushed the removal process. meantime, in chicago, mayor lori lightfoot launching a committee to review the city's policy on

public art work. an advisory committee of a artists, historians and elected officials will review the city's art and identify problematic pieces. todd: while new york gyms sit empty, governor andrew cuomo maintains reopening would just be too dangerous. >> we know gyms are highly problematic. we know from the other states, they opened them and they had to close them. well, let's open o dangerous activities. i don't think that is the time to do it. todd: new york, one of just five states still keeping gyms closed and our next guest is part of a group fighting in court to get that changed. owner of arena fitness in white plains, new york, charlie defrancesco is here with us now. what do you hope to accomplish with your lawsuit? >> thank you so much for having me. we're hoping to get open. we just want our time. we want a chance, due process. we want to be like every other business that's allowed to open.

todd: it seems like gyms are the only ones on this phase four list not allowed to open. let res go over what the -- let's go over what the new york fitness coalition safety plan is. it requires gym staff to wear face coverings, requires regular cleanings of surfaces and equipment, requires gym staff to be trained on safety protocols, implements social distancing within facilities, mandates masks for members when not exercising and implements contact tracing for members and staff. with that in mind, have you received any answer as to why gyms are so forbiden but you basically could ride a bus that is much smaller and more packed, if you want to. >> it just doesn't make any sense of to us. we're looking for the data, the data that they're using to decide this and we just can't find it. as a wellness professional and researcher, i can't make decisions without the data. i need to use experience, data

and peer reviewed stuff to really prove what i'm saying. you can't just say something because you said so. it just doesn't make any sense. you have mcdonald's open but my gym's not open. it doesn't make any sense. todd: you also have a program called fit for all abilities. it helps people with disabilities. your request for an exception for that was also denied. did the states say why? >> we set up a separate area for training children and adults with special needs. my son antonio is autistic so we came up with this program for exercise. it was going great and then we were shut down and we got denied. we tried to get an accommodation. it was a one on one, a separate room, no traffic, no nothing, away from everybody, one trainer, one person. they said no. todd: what do you think is going on here? is there something political that is going on that is transcending a gym's desire to get people healthy? >> you know, i hate to be a

conspiracy theory guy but it doesn't make any sense. why wouldn't we be given a chance. imagine waking up one day and someone -- the government drives a truck through your business with no recourse, no plan, nothing. they give us no information. they expect us to go with the flow and be sheep. and it's horrible. we're business owners. we're important too. our clients are important. our clients' health comes first. that's above all. todd: how much longer can you go on like this? >> i mean, it's painful. i'm very fortunate. i've done very well in my career. i've been a professional for many years. i have different streams of income when it comes to testifying in court as an expert, writing education books, doing my own sessions. i don't know how much longer i can go. i'm fortunate because my landlord at my building have treated me like family. it's been brutal. without them, i don't know you how long i could stay hope.

the place. carley: this after it was discovered the domain name antifa.com redirected to biden's campaign website. the issue appears to have been resolved as antifa.com has been deactivated. the anti-fascist group has been accused of trying to escalate violence through riots across the country including in seattle where the city just voted to defund their police department. >> i'm devastating. i chose to move to seattle for a couple of reasons, one of them was for the agency. i think it's a setback. carley: but the cuts could face pushback. the police department is under a consent decree with the federal government, which requires certain performance standards that could be hard to meet with limited resources. meantime, chicago mayor lori lightfoot is taking a stand against massive looting attacks like these.

charges that won't be pros cuted and it's a long list, interfering with an officer, disorderly conduct in the second degree, criminal trespassing in the first and second degree, escape in the third degree, harassment and rioting unless accompanied by a charge outside of this list. how is this anything other than an invitation to these people to commit these acts? >> that's precisely what it is. i mean, we have a prosecutor that discarded centuries of common sense about criminal law and deteens -- deterrence an. jillian: 45 of the 550 case is that police referred are being prosecuted, that is a very small number. i'm curious your opinion on what type of precedent this sets not only in that city but in cities across the country. >> well, it sets the precedent that if you are providing the

preferred message of the democratic party machines, that you are insulated from criminal law. eventually it takes criminal conduct and it says oh, this is first amendment conduct. but if anybody on the right wing does it's still criminal conduct and it violates fundamental principles of equal protections of the laws. todd: you literally say this is a violation of 14th amendment. is there any recourse? >> well, i think there is. and i think that people who have been prosecuted in the past in portland for the same conduct and who are being prosecuted right now for the same conduct have a powerful case for essentially an unconstitutional prosecution. because we're not supposed to be using the criminal law as a means of shutting down one kind of dissent and promoting another. we have people in portland that have been prosecuted for doing nothing instead of holding up in

front of a crowd of antifa and holding up a cell phone. you have people violenting attacking the police and shooting fireworks and throwing paint bombs at them like a couple hours ago and those people are given a pass. jillian: we heard the plan for what the district attorney is not going to do. that's what we've been talking about. i'm curious if you heard a plan for what they are going to do to try to bring safety back to the streets. >> they don't have a plan to bring safety back to the streets. they have a plan to essentially politicize the police and they announced they want to spend an enormous amount of money creating a giant politicized bureaucracy to control the police and micro manage the police in ways that are fundamentally inconsistent with the law enforcement performing a function of preserving law and order. they don't have a positive plan. jillian: james, thank you you very much for joining us.

jillian: good morning. welcome back. democrats double standard literally on display in new york city. while mayor bill de blasio paints a black lives matter mural outside trump tower, the department of transportation is shutting down a staten island artist for depicting the thin blue line but he's not backing down and artist scott levedo joins me now. tell me when you painted this and what has happened since. >> you know, i've been an artist my whole life. i'm always doing creative public art pieces. i didn't realize how insane it would be. i did this blue line two weeks ago right in front of a precinct in staten island, down the middle of the divider, the median. and ironically, the day after i did that, i happened to hang this giant banner off the staten island expressway, huge, of de blasio holding the severed head of the statue of liberty,

parent who says as a parent who has stayed there, this disgusts me. ronald mcdonald house is a place where parents turn to for peace, normalcy and hope. thankfully, no appointments or treatments were missed because of this violence, also nobody hurt. a scary situation for folks staying there at the time. todd: like these parents having else they need to worry about. unbelievable. who knew that bear safety was funny. >> yeah. the national park service raising eyebrows i guess for this sort of funny facebook post. they sent people who may be going to national parks this summer, they say please don't run from bears or push your slower friends down in an attempt to save yourself. yeah, so pretty self-explanatory advice on the friends front. they also say you should sort of walk side ways slowly in a less intimidating manner which i thought was actually sound advice. i didn't know that.

jillian: i wonder what they say about feeding bears peanut butter sandwiches like this. >> he's taking our peanut butter and jelly sandwich. >> i mean, this is wild. you don't have to worry about bears i guess when you're with this family or maybe you do. just a run-of-the-mill picnic with friends, family and a giant black bear being fed a peanut butter sandwich. the woman says the bear pops up frequently and is never aggressive but i would venture a guess that the national park service would say that hand-feeding a bear a peanut butter sandwich is not smart. todd: not high on the list of things to do. jillian: it looks cute until things go south. coming up in the next hour of "fox & friends first," florida's education commissioner fending off lawsuits as he pushes to reopen schools.
