costa county said her prosecutors should consider whether looters have been arrested for stealing, before charging them they should consider the looters' needs. if the looter is poor and needed something, maybe they shouldn't prosecute. in manhattan the mayor is telling the d.a, make sure there isn't police brutality. how are we going to change this criminal justice system? will it ever change? >> npr had a woman on there talking about why looting was justified. wouldn't that violate twitter's policy that you are not supposed to be inciting violence? looting is not violence? in chicago the store fronts were broken running around saying this is reparations, baby.

joins me now. is the mortality rate really reflecting the people who were dying of covid? >> that's the big question. what we know is that the vast majority of people who die from this disease are very advanced age or they have more than one serious life-threatening condition. these co-morbidity conditions can be characterized as bad health, diabetes, high blood pressure, heart disease. it shouldn't be a prize to anybody that these people are at risk of dying. these are the people who pass away during heat waves and seasonal flu. what's striking is the cdc data suggests that had we paid more attention to the preexisting diseases and used that as a

factor in who we should protect, in other words, we know who has diabetes and hypertension and heart disease. if we focused our isolation measures and protective measures on them and allowed the rest of the population to go about their business, we might be in different position today. >> if we used money for diabetes and respiratory illnesses. there was some argument at the beginning that this would be so horrible that the president shut down the economy. now we are looking at it and people are saying only 9,210 people died from covid alone. should we have closed down? why did we listen to that hysteria at the beginning? >> hindsight is 20-20.

instead of getting some distance. it seems like there is a war and reality. a certain set of the population, they don't believe what president trump was just talking about. they don't get to see the videos of the violent protests because they are not showing it on the other networks. depending on what channel you watch or what youtube show you watch or the algorithm is giving you. we'll live in two countries, not just geographically. but intellectually and philosophically if your information is catered to make you think one thing or another. judge jeanine: the sad part about that is people are so committed to listening to one source for their news or the other, and they are not

interested in looking at the other channel or other station. whatever the url might be. and that doesn't make for a country coming together. in terms of the election, 59 days before the election, and a lot of talk while you have been gone about the mail-in votes and all that. the people dug in right now are dug in. there is a small group in the middle who i believe will decide this election. what's your sense about what's going to be happening? >> it's a great question. i think the small group isn't as small as you might think. i think most people -- maybe not most, i think 30% could be swayed one way or the other. if you are the average person and you are watching your business burn or your local restaurant not open or the rest
