plans to nominate a relacement for ginsburg. as for the pick, the president made one thing clear in north carolina tonight. president trump: it will be a woman. a very talented, very brilliant woman. we haven't chosen yet. but we have numerous women on the list. i built this incredible list of brilliant people. we are asking for biden's list, he can't give it. judge jeanine: what woman will the president decide on? will the democrats try to stand in the way, and will any republicans break rank? we have live team coverage as america mourns an icon and navigates a political firestorm at the same time. let's begin with david spunt live at the supreme court. reporter: for more than 24 thundershowers,,000 of people

from her colleagues on the bench. justice sotomayor said i came to feel a special kinship with her. she was someone i could always rely on. she was the essence of civility and dignity. she was a superb judge whether in agreement or disagreement. i had a chance to see her several times in the courtroom the last couple months. but covid really put the justices apart from each other. they had to do the conferences on the phone calls. but she was always incredibly engaged. we know she'll be interred at arlington cemetery. the rest being worked out by officials at the supreme court. judge jeanine: david spunt, thanks for joining us.

45 days until the election and the political mudslinging over ginsburg's death and what is next. here to join us chad pergram who knows capitol hill like no other. >> the strategizing is starting on the right and the left. let me start with the democrats. democrats in the senate held a conference call to figure out what to do, they they would try to oppose this nominee. chuck schumer said anything is on the table, including possibly trying to eliminate a filibuster if democrats get in control of the senate next year. jerry nadler has proposed possibly expanding the size of the supreme court. democrats want to remind voters if there is a conservative justice put on the supreme court. they will try to undercut

obamacare and roe versus wade. how fast could they get a nominee on the supreme court? president trump says probably before the election. president trump: working with the republic cab senators and mitch mcconnell, we'll be making a decision. i think the process can go very, very past. i will be making my choice soon. and when my choice is made i will send it over to mitch in the senate and they will do what they have to do. i think we'll have a popular choice hoff it may be. >> confirming a justice that fast would be extraordinary. most justices take 45 days just to get a hearing. senators do not like to be rushed, especially on something of this magnitude. this is a legacy decision. here is susan collins'

statement. given the proximity to the presidential election i don't believe the senate should vote on the nominee prior to the election. the decision of a lifetime appointment should be made by the president-elected on the 3rd of november. someone else to watch is senator murkowski of alaska. the divide in the senate 53 republicans, 47 democrats. that means republicans can only lose four of their own, otherwise it's game over for this nominee. even if you have republican senators saying we want to vote for somebody, but we don't want to go this fast. this is going to be a roll i can go few weeks as they go through this confirmation process. judge jeanine: it's normally,

it's my understanding, from the nomination to the confirmation the average has been 60 days. so 45 days until the election would be unusual. but given the temperature, the political temperature, the left is indicating they don't want this president to make the appointment. what do you think will happen as soon as the president announces his choice. >> there will be a firestorm. they felt there was a seat stole be from them four years ago when mcconnell refused to consider meri mayor merritt gar.

joanie ernst. judge jeanine: didn't the dems shoot themselves in the foot in 201 3 with the filibuster. >> paybacks are hell. it's true on the schoolyard playground and on capitol hill. harry reid was upset some republicans were blocking the lower-tier nominees. so he lowered the filibuster from 60 to 51. but they left out the supreme court. mitchell mcconnell saw the writing on the wall. they are never going to

filibuster against a supreme court nominee, so he lowered the threshold for supreme court nominees. abe fortis, his nomination to become chief justice of the united states was filibustered. but he did not become chief justice. harry reid opened pandora's box. let's talk more about ruth bader ginsburg's life and legacy as well as some of the women president trump was thinking of relacing her with. i'm joined by shannon bream. thanks for joining us tonight. it appears there are two women who might be the favorites. they call her acb.

amy comey barrett. as well as the woman from florida. barbara lagoya. amy comey barrett is a woman the president already nominated to the 7th circuit. she had her face being brought up in the nomination process. >> you are exactly right. that is something to focus on. she has been through the fire. we know whoever gets selected and has to go through the confirmation process will have to have a spine of steel and nerves of steel. she has been through a little bit of that. during her confirmation for the 7th circuit. she is known as a devout catholic and senator feinstein said the dogma lives loudly in

you. on thers questioned wet -- oths questioned whether she could be a fair jurist and devout catholic. she stood up for herself. that was a bit of a bruising. she showed she was willing to go through it. she says it doesn't factor in for me as a judge. as a judge you interpret the law. judge jeanine: she said it's never appropriate for a judge to impose that judge's personal convictions whether they arise from faith or anywhere else on the law. she is able to push back strongly and has experience with the process.

barbara lagoya is a justice in florida but is not in the federal system as i understand it. >> she was in the state judiciary in florida. she was the first hispanic latina to go to the florida supreme court. now she made it to the federal bench as part of the 11th circuit. she doesn't have a long time on the federal bench. she has less of a federal record for to us track, the kinds of issues she would be deciding on. but she has such a compelling back story as many of the contenders on the president's list do. her parents escaped from cuba 50 years ago. she stalks emotionally about how her father gave up his dream to be a lawyer in cuba because he wanted his family to live in

freedom. she is very moving when you hear her speak, and she does have a great story. she has three daughters and a husband who is also an attorney. she spent her life in the law, and as a woman who raised a family as well. she signed on to upheld a florida law that states that felons have to pay fees and fines before they can get back their right to vote. she sounds like somebody who is not afraid to do what she thinks is right and the right interpretation of the constitution and law. shannon bream, thanks for being with us tonight. >> you got it. >> a quick programming note. tune in tomorrow night at 10:00 p.m. for a special "fox news @ night" with shannon based

supreme court justice ruth bader ginsburg. president trump confirms he will nominate a woman to replace joe biden. before the news broke yesterday i spoke to lara trump. good evening. i understand you were in florida this week on the bus tour and you head to north carolina next week. what's the feeling on the ground amongst americans, especially those who $say they are undecided. >> we had turnouts joe biden couldn't even dream of. we were in florida the past couple days. we are going to north carolina. but i have been all over this country. i have been in iowa, minnesota, nebraska. people are so excited about donald trump. i think it's bigger now than it was in 201. people can't wait to cast a vote

father-in-law? >> you have got to think, joe biden has been in this game for almost 5 decades. i would assume he's a decent enough debate. we saw him during the primary debates. i assume he's doing okay and he will do fine. but he will have a problem when it comes to actual policy. the issue i think comes down to the fact that i think democrats don't have a plan for america. and the only plan so far is to implement socialism. they are trying to slide it in through the back door and make sure you don't see it. he's going to have that on full display on stage with the president. then the president gets to talk about what he's done for america. donald trump in 47 months has done more more the united states of america than joe biden has

media. it's no surprise the president got tough questions. but he did a good job abcing those questions, talking about his record of accomplishment the last four years and what he would do as president. i wish i could say i was surprised they had a total ambush against the president. but i'm not. donald trump takes hard questions every single day. he's no not afraid to do it and talk directly to the american people and put his answers out there. joe biden when he comes out of his basement, it's softball questions from anybody around him. this president has proven he can take on any question, anywhere. judge jeanine: you expect from the mainstream media at least an effort at being objective. they don't even cover up the fact that what they are saying is not in many cases the truth. or they are ignoring the truth.

big stories that the president this week with the abraham accord. what do you think joe biden is thinking as he prepares for the debates? >> well, i think he's probably very happy that he will continue to have the propaganda machine of the mainstream media helping support his campaign and effort in the debate. i don't expect him to have a hard time on the debate stage because i think they will take it easy and give him softball questions the way they have over the course of the campaign. i think they will hold donald trump's feet to the fire at every turn they get. i think the president will help push back on joe biden directly. i think that will be important for him. donald trump used the 2016 debates as a turning point for

his campaign. i think he needs to make sure his performance is strong. i think it's a pivot all moment. one where the president will rise to the occasion and do well that night. but he has to remember. he's not just competing against joe biden. he has to compete against the entire mainstream media that will praise biden if he just puts coherent sentences together. it will be an uphill battle but one the president is capable of taking on. judge jeanine: in the beginning we thought they were freudian slips. but when kamala harris talks about the harris-biden administration. then joe biden is reading from the teleprompter, the harris administration.

♪ ♪ greg: she went from the greek system to the penal system. jail on a million bucks bail in pennsylvania after the police shot a mad man. one suspect is sorority girl charged with felony right, felony vandalism. she basically majored in looting with a minor and phony dresses. a lot of deer meat but the judge has lowered the bail to 50 grand credit him for initially coming down hard. he's an adult gets incentives with an extra syllable.
