speech is a hot topic right now across the country. they are lifetime appointments. they do deserve a lot of debate and a lot of thoughtfulness. the question do people believe slightly over 40 days is enough time to let the process play out in a way that makes people feel comfortable. we saw what happened with brett kavanaugh. that went on and on. i put out a tweet yesterday, pete, i am looking forward to what the females wrote in the margin of their high school yearbooks. i was being partly funny. i was being realistic. democrats will pull out every last top on the round. pete: the clock on republicans don't end in november. they go to january third that fights within the time frame that justices are concerned. i found out that they deliver the "new york post" here on sundays. here is the "new york post," full court prez.

what struck me in the last 24 hours since the show, how predictable the reaction has thus been. the big plot twist was the passing of the justice. notorious rbg they call her the left's most beloved jurist. the person replacing that person is mitch mcconnell who is the left's most hatest lawmaker. effectively said we'll fill the seat. republicans more or less fallen behind that the president rallied for that. susan collins one exception, may be willing to wait. that could change until after the election. it comes down to a couple of republican senators. if they're asked the question would you rather have joe boyden fill the court spot, rather have donald trump whether you like him or not. on issues of life, religious liberty second amendment, would be faithful to that. president was in north carolina. a raucous rally as usual. his supporters there in person

justice ruth bader ginsburg. he went on to say that exact fact. listen to this. president trump: both the white house and senate majority have a moral duty to fulfill the promises they made to the voters and that is exactly what we're going to do. we said that if for any reason we have a vacancy on the united states supreme court we will fill that vacancy. so we will uphold equal justice under the law for citizens of every race, color, religion and creed. i will be putting forth a nominee next week. it will be a woman. [cheering] pete: president trump not only saying he will put forth a nominee but it will be a woman. here are names he already put out that are women, potential nominees for the supreme court. there is judge amy comey barrett. federal appeals court judge

barbara lagoa, and appeals court judge allison rushing. i would prefer president not commit to anyone based on their gender, race, superficial characteristics. i would prefer the priority simply what is your judicial philosophy, what is your background, what is your merit. if that happens to end up being a woman we will celebrate that fact. i don't like filling quotas based on who held the seat prior or what is currently asked for by the electorate out there. just find the best person for the job. pete: absolutely. we'll learn a lot more about all of these women. there is a report from "axios" from a year ago, the president saying effectively, i'm saving amy for ruth. this idea that amy comey barrett was this close to being chosen last time. it went to brett kavanaugh. she seems to be a front runner. when you look at justice roberts the way he bent to the left or middle, been disappointing on

outcomes, i think for conservatives, interest will be a lot of pressure to pick someone, amy comey barrett, right there, who you know will stick to their core. who bill be alito, scalia type, don't grasp at something because it might look good on paper, jed. >> just a quick point to will's's point on issue of choosing the best person for the job. i agree with that sentiment. that is how it should be. however, i recognize women around the country do like to see women in position of leadership being chosen. they want a president that trusts women in those positions. that feels empowered to put women in those positions. i think it sends a message. we're in times where identity politics is real t does happen, you like it i think him making that statement will be a woman. i think that only helps him politically right you no. i think he knows that because of the political moment he is in and that is why he is doing

that. there is a lot of questions about joe biden what he is going to say. we know he come out right now, we should give this a minute. the next president should be filling this seat. this put should not be doing it, he seemed very vocal on that, when we look back at his record in the past, back in 2016 for example, he had a a little bit of different tune he was singing. let check that out right now. >> i made it absolutely clear i would go forward with the confirmmation process as chairman even a few months before a presidential election. if the nominee were chosen with the advice and not merely the consent of the senate. just as the constitution requires. will: there is joe biden. jedediah: this is politics, guys, right? not just, you can't just say it is joe biden, yes joe biden is doing that in this moment. this is what politicians do, when it is convenient for the

point for them they make it. wait a minute, five years later you said that this drives people crazy on both sides of the aisle. joe biden is no exception in this moment. will: you and i got into the conversation about the conversation about hypocrisy. what is laid out is blatant hypocrisy you can find. anybody can find a clip of lindsey graham contradicting themselves from four years ago. you suggested it is politics. but the truth is, it's a check and balance. it is politics. it is power but the bottom line is republicans had the power to block president's obama nominee four years ago. they have the power to replace ruth bader ginsburg today. that is what happens in politics. hand over of power. pete: i don't think it is hypocrisy. elections have consequences. politics is about who has the votes. in this case mitch mcconnell has the votes. the question, will he get the votes.

hopefully i will be the next president but we're here now, right now, we're here. and we have an obligation to the voters, all of the people, the millions of people that put us here in the form of a victory. we have an obligation to them, to all of those voters. will: that was president trump yesterday. he is expected to announce his nominee to replace justice ruth bader ginsburg on the supreme court next week but could some republican senators like mitt romney, susan collins end up delaying his plans? let's ask bret tolman, a former u.s. attorney for utah. he previously served as legal council for the senate judiciary committee hearing including confirmmation of roberts and alito. bret, thank you for being with us this morning. who is key in this process in both leadership and members and how quickly do you think it can move? >> look this will all boil down to one man that is senator lindsey graham. if you look at the last two chairman of the judiciary committee you have chairman

grassily and you saw his calm and really seasoned and strong leadership that he exhibited, i think was only reason that kavanaugh got through that hurricane of a mess on the last confirmation. and then before that senator arlen specter. so those were very seasoned, very strong personalities. they have a role to try to keep all of the republicans in line. if that happens, mcconnell will get this through in that narrow time frame. pete: that narrow time frame. we heard about susan collins, lisa murkowsky, saying maybe we should wait, mitt romney is wild card. does it happen to before the election or could this move into november and december as well, bret? >> it could go past the election. everybody at the judiciary committee right now, whether elected members or senate staff and attorneys are, are going to be 24/7 from now until then. it is grueling and exhausting.

there is already people right now who have been selected who are vetting on both sides good and bad issues with every potential nominee. pete: speaking of potential nominees, who do you like? who is the right pick for this president right now? >> i think it is clearly amy comey barrett. this is one that the country, republicans and conservatives all over the country hoping would be the opportunity for them to put her on the bench. i think she is the one that can withstand this, this fight that is coming and it will be a fight. so you know, this 2020, just continues to get more and more interesting. i would never expect this is going to happen. here we are. pete: we have three more plot twists in us, bret, for sure. a key criteria the ability to withstand the firestorm, hurricane. she has been vetted before. as far as conservatives who want to see someone faithful to the constitution as textualist, is

she rock solid on this. >> she is. she will come on the bench. she is a force to be dealt with. she holds to her guns. she is strong. if you look at the women that have been appointed to the court, they have had to be strong to get where they are. pete: how would they attack her? how would they attack her brett? >> before kavanaugh, i would give you the standard response, pete, they will attack her writings, opinions or decisions. i don't think that is in play anymore. i think now what it is, they will go as far as to make up an argument or an issue that comes in from left field in order to deal with it. we've seen it. there is that level of desperation on the democrat side. pete: very true. brett tolman, you know what you're talking about. thank you for coming in. >> thanks, pete.

suspension, why was the tweet a problem with twitter what is the issue. >> either two things. don't want factual spread or penalizing us because the president retweeted our tweet. we rewritten. asked for reconsideration. we were told recently as last night, if we don't take the tweet down they will not give us access to our account. makes no sense. jedediah: we reached out to twitter for comment, we haven't heard back. what is your plan now? will you take it down? >> you know the deadline for the military voter and overseas empowerment act push which is required is that 45 days before an election those military ballots get sent out overseas. we were encouraging people to make a call to their county to ask if the ballots had been sent that deadline has passed. so, on one hand the tweet did what it needed to do. on the other hand, on principle, it, we have to be able to get

good information out there what is really happening. voters don't have information that they need. this is just going to become more and more serious as we edge towards november 3rd. because there is so much confusion. we need an outlet and, i'm not sure where we're going to go. jedediah: yeah. as important to note that the tweet itself did not look partisan but the fact it was retweeted by the president suddenly made it seem so in the eyes of twitter. we have another topic we want to talk with you about today. mail-in ballot laws in pennsylvania, there is a new one out there, driven out nearly a quarter of the state's top election officials. why is that happening? >> the pressure that is being put on these election administrators at this point is overwhelming. you've got them being pummeled with lawsuits that are changing the dynamics of what has to go on the ballots having to be printed and reprinted. they don't have the resources to do it.

morning. answer that question. how does this reshape already what we shall say a very dynamic race? >> good to be with you, pete. we finished our quarterly state republican executive committee meeting. this was one of the topics we did discuss. without a doubt it will intensify already intense election cycle. it will draw clear battle lines, the idealogical differences between constitutional conservativism and socialism. the% has the opportunity to affect the court system in the land, really the culture of the united states of america and court decisions that come from that esteemed body going forward. so i think that you're going to see an incredible amount of pressure that is going to come from the left the left. you will see a lot of heinous behavior. earlier you talked about the way that justice kavanaugh was treated. i think it is going to be even worse because of the left will

not be able to contain themselves. but this is a great reason for constitutional conservatives and people that believe in the rule of law and law and other to come out to support this president. so i think that gives him even more reason to be reelected. it also gives even more reason for our senate to be strong as well. will: colonel west, replacing justice ginsburg has its own importance in terms of the supreme court. also, as you discussed has the ability to impact the presidential election some different ways. the left will be obviously animate what they see as hypocrisy. the right will be animated that supreme court justices are so important why they elected president trump. as you point out the battle itself will be so ugly. what do you think, which one of those factors plays a bigger role in the 2020 presidential election? >> good to be with you as well, will. one of the things i talked to

with the republican election committee is about messaging. you have to dominate the narrative. not allow the left to dough that they will continue to talk about the hypocrisy. senator mcconnell said, others said this is different situation because you have the senate and president of same party as opposed to the barack obama the senate was under gop control. but see the thing is, all the left has to do say republicans are hypocrites and republicans have to take more than a minute, a minute 1/2 to try to explain that rule. a lot of people, a lot of voters out there don't understand the rules and they will think it is a bunch of trickery. i think managing of the message, i think they're getting nominee out, i think amy barrett will be front and center, top of the list, that will be very important. as far as the timing, i don't know if you can push this through before the election but i believe if you get a good, strong candidate out there, we've got to put the left on their heels f they are seen attacking a woman and a woman who is a of catholic faith a

very strong mother, who adopted children from haiti, that is really bad messaging for the left. always try to maintain that high ground. jedediah: lieutenant, i want to shift over to some foreign policy briefly because the united states reimposed u.n. snap back sanctions on iran. pompeo announced that what does that mean for our relationship, for our foreign policy implications, what does it mean? >> well it means that the united states of america is once again operating from a position of strength and it goes back to the reagan mantra, peace through strength. we are now assuring our gulf cooperation council countries, partners as you have seen with the historic agreement with bahrain and u.a.e., that we will not be supporting the number one exporter of terrorism across the world and that's iran. we'll not allow iran to have that regional hegemonic dominance you saw during the obama-biden administration which will continue on in the harris-biden administration f they're starting to see a

two women claim they were fired for standing up for their religious beliefs. the lawsuit brought by the equal employment opportunity commission alleges they told managers at a kroger in arkansas they would not wear an apron that had a rainbow flag supporting the lgbt community. they say the symbol goes against their religious beliefs. they were terminated for violating the dress code. kroger does not comment on pends lawsuits. he may notable able walk yet but this 6-month-old is getting his feet wet. they posted photos of the baby boy water skiing, his mother calling him the world's youngest water skier. that is amazing. may possibly the cutest thing i ever seen in my life. i don't know if i would put my 10-month-old on water skis. it looks kind of cool. i will not lie, pete.

and all of sudden now, it is improper to do it. it has been done 16 times prior in our nation's history. it should be done. it must be done. and not only is this election hanging in the balance but every decision that the supreme court makes while there is a vacancy is a missed opportunity for justice to be fully and appreciated. pete: brad, you have been in the middle of this. i had the pleasure, we had dinner, you shared the shenanigans what went on in florida. it is really amazing when you hear the entire story. what is the potential of what the left may do? we talked about court-packing this morning. the ballots recounting, what are you anticipating? >> well i'm anticipating chaos. this is exactly what the democrats are sowing. they're telling us how chaotic things are going to be yet they're making the rules, and they're fostering and festering the chaos they hope will take place. the more uncertainty that happens, they figure they will

be beneficiaries of it. let's take florida back almost 20 years ago. there were 67 counties in florida that were machine recounted as a matter of course. and then gore picked only a handful of counties for hand recounts. that was a mess. can you magnify that over many states and thousands of counties? we don't have the wherewithal for oversight. mail-in balloting itself invites chaos just by the sheer volume alone and manpower it takes to count those ballots. so democrats are hoping that there will be chaos, that they will be able to benefit from it, either in the reef count itself -- recount itself, state or federal. we saw it in florida. we saw battle keeping recounts honest and transparent. we saw a battle in the state courts. eventually it made its way to the supreme court around they ended the shenanigans.

i see i'm amazed people normally not involved with the political process knocking on doors, handing out flyers, putting out signs, they have an affinity toward this is president. it is surprising to me. although i have not been in the leadership role for more than five years, i've been around politics, paying attention. i just haven't seen this energy on the right in a very long time. pete: talk to me about voting in north carolina. what is the process? when does it start? i know vote remembers lining up in virginia. the election has started. where are we in the process in north carolina? what is being done in north carolina? >> it runs starting the 18th through the election and of course november 3rd is the election. in addition to that, there are record numbers of absentee ballots have gone out.

absentee ballots have gone out shortly. we want to focus on the integrity of the vote. we want to make sure every north carolinian votes once of course and they have the security and assurety, that they know the vote will actually count. will: let's go over a few of the polls over battle of north carolina. this is the "real clear politics" average right now. shows 47.3% to biden, 46.4% to trump. contrast that with 2016 when it was 46% for hillary clinton and almost 50% for president trump. i want you to respond to those polls. ask you this. we asked everybody who is coming to us from different states like minnesota. what is the issue really resonating with people in your state? when you talk to people in north carolina what is the issue that is motivating them? >> the first thing about the polls is this, i'm in a peculiar situation where i get to talk to a lot of people and we're surprised when we do the door knocking we're talking to

stomach it. talk to us about this councilman's role in all of this. >> councilman trager is education chair on the city council. throughout the whole summer he has been pair losting the union line that the schools can't open, the schools can't open. now he commissioned a study which surprise, surprise, shows that the schools can't open. so he has been really working on their behalf to get remote learning to be the thing that new york does even though our covid positive rate is extremely low and is absolutely no reason we shouldn't be back for in-person schooling. he really represents the interests of the unions and not the interests of the new york people and definitely not the interests of students. jedediah: you know there are so many added costs coming into play here when you talk about remote learning and talk about the hybrid models. the new york city budget office released a statement on the added cost. this is what it says. we project added cost hiring additional teachers will account 60% of additional cost for operating public schools,

19 million a week. schools across the city would require 20% increase in number of general, special education teachers on their rosters compared with last year. your comment on those increasing, those numbers are hard to wrap your head around. >> this is crazy. no other country is doing this. when i talk to friends in other country, scotland, france, greece, sweden, how do you open the schools? we open them. there is no social distancing. most places they're not wearing masks under 11 years old. we turned into a simple thing into extremely complex thing. the other daymare bill de blasio saying new york was taking all the best practices from all the different countries and combining them into one school system. why are we doing that? why don't we not do that and just open schools? jedediah: i just lost you. i have you back i think. so, i just want to wrap this by

[cheers and applause] will: it will be a woman. so who could that be? here's the women on the that president trump has already put forward as potential nominees. here's judge amy coney barrett, judge barbara lagoa of the 11th circuit court of appeals. two points, jedediah, it will be great and we will celebrate if a woman is nominated, but whatever the qualifications are, i want the make sure we pick someone who is of the highest merit. their judicial philosophy should guide the way, not their belonging to any particular group. i just want the best person for the job. and this brings me back to the point that i was making to pete, the potential pseudoshow. colonel allen west was on earlier, and if it is amy coney barrett, the left will have a

hard time making a side show out of that nomination process. this is a woman, a religious woman, a devote religious woman who has adopted children from haiti. if this goes low, that could very well backfire on the left, jed. jedediah: yeah, and it will go low. it absolutely will. expect it, wait for it. pete, you mentioned the word insulated earlier. i believe you were talking about amy coney barrett when you said try to find someone who's since lawsuited. no one will be insulated because they will find something. if she's religious, they'll argue she's too religious, and then the pro-life argument and overturning roe v. wade will come into play. we are in a it heated political time. i promise you no one will be insulated, and if you find someone that looks great on paper and people struggle to find something, they'll dig back into their middle school behavior, and if they threw a spitball at somebody in the sixth grade, that will be fodder. we've seen that with kavanaugh, and that's likely to happen

again. i understand the point of trying to find someone on paper that doesn't have any outstanding problems -- pete: yeah. they will make you regreat that sixth grade spitball. you're right, it will absolutely be something. and part of the reason, will, we've talked about the fact that they're talking about democrats packing the court, adding justices which they're going to have to change the law to do is they realize they don't have the process. they can yell and scream and do everything you can, but ultimately, if they had the presidency and they had the votes, of course they would fill the vacancy. and we're reminded of what joe biden said in 2016. he's going on the on the campaign trail today, but this is what he said in 2016 about moving forward with the process. >> i made it absolutely clear that i would go forward with the confirmation progress -- process as chairman. even a few months before presidential election. if the nominee were chosen with the ad vice and not merely the

nominee. they have already written the press releases and are waiting to fill in the name just like they did with justice kavanaugh. and the process will be that the president will make his nomination, we will wait to hear from him, we will wait to hear from leader mcconnell on the time lauren. generally -- timeline. generally, it's going to take about 30 days for someone to get a hearing once they have been nominated, and then, you know, justice ginsburg was confirmed in 42 days, justice kavanaugh in 89 days, john paul stevens, 19 days. we will see once we get past that point. i look forward to voting for a good constitutionalist judge. jedediah: yeah. we're looking at just over, i believe, it's 40 days now, so it really is getting quite close. and you see that there is not unity on the republican side in the senate on this. you know, talking about collins, murkowski, mitt romney potentially not wanting to sign

on and say yes to a vote like that. so is that a problem, that on a key issue like this with so little time remaining til the election, there is division within the republican senate? >> well, we have to look at the fact that there is precedent when you have the white house and the senate of the same party, you move forward. it's been done 29 times. you would have to go back to 1880 to find a time when that was not done. and you will see unity once there is a nominee, once we begin the process of the hearings at the senate judiciary committee. chairman graham will lead through that process. and i fully believe this is what we were elected to do, the american people elected us to do this. the supreme court was a big issue in 2016 and in 2018. and you're going to see us move forward as is our responsibility

to be certain that we have a full court and are able to address the issues that are, that the american people expect to be addressed. jedediah: yeah. and, you know, president trump has floated some names on this, and he has said that it will, in fact, be a woman. just quickly, if you would give your take, amy coney barrett somes to be in the lead. do you want to give an opinion on that today? >> we have amy coney barrett, great story there, barbara lagoa, who's the first cuban-american on the florida supreme court, she would be the first cuban-american on the u.s. supreme court. you also have joan larson out of michigan, allison rushing jones -- i think i'm saying her name properly. these are all well qualified, very experienced women. they have been on the bench, they have been on the circuit.

these are women who would full that well. so we'll wait and see what the president has to say, but quite frankly, to i've been pleased so far on judiciary we've put 216 judges under the trump administration -- many qualified women. jedediah: yeah. and i just want to get this in, those are some great points and very accomplished women, of course, because you are among 16 senators who introduced an important act creating federal penalties for people who target law enforcement. just some points on that, if you don't mind. >> yes. what we're trying to do is make it a federal offense if someone attacks a law enforcement officer. we're doing this because of the uptick in violence against our law enforcement officers, our men and women in blue. and i have to tell you, it is time for us to stand and back the thin blue line, ands that is what we're doing with the legislation. jedediah: well, that's something that should be appreciated by

governor, thank you for being here, always love having you. one thing we saw in politico on this line is about the timeline, when does this happen, how quickly does it happen. a writer is arguing that maybe it's better for the president to wait to replace justice ginsburg because if you keep republicans wanting a more conservative court -- consider the source, but what's the best strategy on timing of this nomination? >> well, since the constitution is one of those three cs you just mentioned from my book, i would say the president does what he's constitutionally required to do, and that's put a nomination in place. the senate then has the opportunity to vet that person and to vote on that person. that's how this whole thing works. we simply need e to go back to what the constitution says, follow it, live for the law are. that's what most of us would like to see happen, and that's why the president's going to put a name forth this week. jedediah: yeah. and i think, governor, that is what we will see happen. you know, i want to ask you about rallying at polling

places, because trump supporters were recently seen rallying at an early voting site in virginia. they were chanting four more years, and what's interesting to me is that you see people rallying for trump. i don't see people rallying for joe biden on the left. i see them rallying against president trump. is that a problem for democrats? >> i think it's a huge problem because the enthusiasm gap is often the difference in an election. you always want to have your voters who are willing to swim the river at flood stage to go vote for you rather than looking out the window seeing three drops of rain and instead of getting an umbrella, pull the coffers back. if they pull the covers back, they're gown to be the -- going to be joining joe biden because he's been barely coming out of his basement. he shows up and he's about 20 feet away from the 20 people that show up to hear him, and they're all sound asleep by the third sentence that he makes. and i'm not trying to be overly

and underneath that message is often vote a certain way. it's an implied message about who you should be voting for, but those aren't the only places in culture where we are putting voter registration efforts, trying to encourage people to get out to vote. that, by the way, a message to get out and vote is a great message, and i know you're working with some things to help mobile eyes others to get out and -- mobile use others to get out and vote. >> my faith votes is a nonpartisan organization. its primary focus is to get people of faith to the polls to vote. 61% of christian voters actually did vote in 2016. now, in that particular election, that was the difference between donald trump winning or not winning. here are the facts, there are 80 million evangelical christians in the united states who identify that way. but half of them aren't even registered to vote. and of those who are, about half of them don't show up. now, a bigger number showed up in 2016, but this is not just

apparently went pretty viral. i had no clue the camera was there. jedediah: and have you spoken to the family as of yet? >> not yet. that's what i plan to do. jedediah: so what is your message here? we're in a time right now where so many people are rushing to support law enforcement, really challenging times. what is your message about the flag and about patriotism and law enforcement that you can share with us today that may have led to your decision to rescue that flag? >> well i know what it means to me and it's a sense of pride and a sense of pride for many officers and i know i'm not the only officer that does this. i know for a fact there's been several out there who take it upon themselves to do this it's a sense of honor for our country and those of us who have served and continue to serve our community. jedediah: and you mentioned that you are a vet that you were in the air force we thank you so
