everything. eric: that is a big issue this week hello everyone i'm eric shawn and this is "america's news hq". arthel: hello everyone i am arthel neville. president trump and senate majority leader mitch mcconnell both pushing for a swift boat to fill justice ginsburg's seat, the president said he could reveal his nominee as soon as this week by top democrats are insisting the senate should wait to consider a nominee and they are willing to fight even if republicans try to hold the vote during a possible lame-duck session of congress, we have fox team coverage, mark meredith is live at the white house. mike emanuel is tracking the political fight underway on capitol hill but we start with jacqui hein rich, she is in philadelphia where joe biden spoke a short time ago. >> that afternoon, this was a speech unit republicans, those in the senate who would vote on a potential nominee and those

[cheering] we haven't chosen yet but we have numerous women on the list. i built an incredible list of brilliant people. >> even the president nominating someone this week doesn't mean the senate will move right away, ready to republican senators have come out to say they will consider nomination before the election, the president singled out gop senator susan collins last night. >> everything will time, nobody said let's not fill the seat, we won the election, then we have some senators, forget it. think of it, i will not say it, i won't say it susan, i won't say it susan.

ahead and also likely to be a major issue for the first presidential debate which a little more than a week away. eric: that is amazing that it is creeping up, thank you, in a moment we will dive into some of those names that you just mentioned of one of the women who can get it. arthel: meanwhile in congress, a few gop senators saying they are not fully on board with starting the process of approving a supreme court nominee so close to the president election. chief congressional correspondent mike emanuel is live in washington with more on that. >> good afternoon, several of the remote under republican senators don't want to vote on confirmation of any justice before election day. maine senator susan collins is facing a very tough reelection in november and collins is given the proximity of the election she does not believe the senate should go on the nominee before november 3. alaska senator lisa murkowski saying for weeks i have stated that i would not support taking

up a potential supreme court vacancy this close to the election, sadly what was then a hypothetical is now a reality but my position has not changed. a key conservative says the possibility of the presidential election could get tied up in the courts is a reason the senate must act. >> that could make this presidential election drag on weeks and months and well into next year, that is an intolerable situation for the country, we need a full court on election day given the very high likelihood that we will see litigation that goes to the court and we need a supreme court that can give a definitive answer for the country. >> another republican is utah senator mitt romney, he voted for article of impeachment against president trump, the gop has a 53 - 47 so mitch mcconnell can lose a maximum of three senators. arthel: in meanwhile, speaker pelosi, she is claiming the decision by president trump in the senate majority leader to move along with filling the seat

considering. >> the president has a menu of strong choices, he is obviously previewed some of the candidates he is looking at by issuing his public list and pretty much to a person, their strong conservative with long track records of opinions that you can review with confidence that the white house has in fact been prepared for this day, they are pretty confident, i think they have a lot of information about ground on the possible judges and i think the president will look to a judge who will be conservative and willing to uphold the rule of law in our constitution. ericeric: here's the president k about that as he left the white house. >> i have gotten to know many of them probably from a legal standpoint from a sophisticated understanding of the law from a constitutional standpoint, i think it's a greatest list ever assembled. i think that the other side should show the radical left list and i think you will be surprised. >> radical left list from joe biden waiting for that in his

words. let's start with the person who has been mentioned in name as potentially the leading contender that is judge amy coney barrett, she is from indiana, she was a notre dame law professor, her mentor was leah, obviously maybe she has mike pence in her corner, she is conservative, catholic, she has called roe versus wade and erroneous decision and here is she being grilled by diane feinstein during her confirmation hearing about her religion. >> the dogma lives loudly within you. and that is of concern. >> if you're asking whether i'm a faithful catholic, i am although i would stress that my personal church affiliation or my religious belief would not

bear in the discharge of my duties as a judge. eric: you know the democrats are trying to make hay out of that what do you think? >> john kennedy face the same questions when he ran for office. i think judge. testified very powerfully during her confirmation hearings, you really have to look at her as a favorite, the white house is very familiar with her, she was a runner-up for the seat that went to justice kavanaugh and having sat on the federal appeals court in chicago for some time, she is already having a track record of conservative judicial opinions that will give the white house a lot of confidence is what they see is what they will get. eric: a few years ago she talked about roe v. wade and the issue of abortion. that's us into that. >> the core case that women have a right to an abortion, i don't think that would change but i think the question of whether people can get late-term abortion, how many restrictions,

i think that would be change. eric: do you think she will be asked about that in terms of the statements that she has said in the past among other things questioning. >> i have no doubt, it is no secret that abortion is one of the most popular talkin topics e hearings and both sides no doubt will try to pin her down. what i suspect she will see she's the nominee that she will do a very judicious job of walking the line between on one hand answering the senators question on the other hand not committing to vote one way or the other. eric: and then there is judge marlmarcella goa. let's listen. >> she's an extreme report in, i heard incredible things about her, i do not know her, she is hispanic and highly respected in miami. eric: could the fact that she's from florida help considering we have an election in the electoral votes in her being

hispanic? >> i'm sure the president is aware of the electoral benefits nominating someone from florida at this point in time but at the same time let's not lose sight of the fact that she's a highly respected justice who is confirmed with serve on the supreme court for decades, potentially after the selection. i think one of the advantages from the white house perspective she has experience in the state judiciary and served on the floor the supreme court in the federal judiciary, she now serves on the federal appeals court in atlanta. she would bring a lot to the table if she is the nominee. eric: we will see who it could be, it could be neither. we will know in a few days according to the president. tom thank you for your insight and reviews.. arthel: we have now dipped into the greek alphabet to name hurricanes that they go to when we run through first names in one season, tropical storm beta is taking aim at the coast of

arthel: an absentee ballot snafu in north carolina drawing claims of a rigged election and waiting for president trump last week. election officials there setting the record straight, the

director of elections for the county which is in the greater charlotte area is about 500 voters got to duplicate ballots in the mail due to a labeling issue, he says no one will be able to vote twice. >> we track it in and hit the barcode, it says this is john smith and if i get another one from john smith again i know it to duplicate and it will not let me go through with that process in place to make sure that everything is up in safe and secure, trust me we will get through this. arthel: the 500 duplicate ballots for tenth of 8% of the ballots sent to voters in bloomberg county. eric: how about that. many states are bracing for a surgeon absentee ballots, that's because a coronavirus. that could mean that we will likely not know who has won some

key states until well after election day november 3, more than a dozen states will not start counting their ballots until election day, they cannot do that by law, including swing state pennsylvania which will accept ballots as late as friday november 63 days after election day, but it would have to be postmarked by election day which is the third, what can we expe expect, the white house correspondent associates editor at politico, most of us would stamp on election night if it's late, 2:00 o'clock in the morning, 1:00 o'clock the president last time was about 3:00 o'clock in the morning when he was called, man-to-man when will this be called, he likely could be days not counting court challenges even longer than that because of some of the laws. >> you are exactly right, election experts are saying let's call it election week, they are gonna be calculating both after the election, some of the swing states that were

decided, they were very close to 2016 and some of the key states, wisconsin, pennsylvania, michigan, all of the states will start until the day of. as of right now a lot can change before then but if they start on election, there are thousands and millions of ballots, it will take a while. eric: let's take a look at the map of some of the states, some of the major states, by state law cannot start counting until actually on election day, they include alabama, georgia, illinois, indiana, mississippi, michigan, minnesota, new york, new jersey, ohio, pennsylvania, tennessee, texas and wisconsin among others, 15 states can start processing ballots before election day but only one can count, that is florida, maybe we will know florida earlier than others because they can count,

do you think the state laws will change or could change or the clock authority run out and we will have the election week as you say. >> the timing is unusual because ballots have already gone out and already started to go out in some states including north carolina, even as the ballots are going out there are states considering changes so we talked about pennsylvania, michigan, both of those states are currently considering state legislators are considering changes to the dates to allow them to process earlier, that could still change and then there is almost 200 lawsuits around the country of all sorts of things, some of them relate to the issue of how late can your ballot come in, if it's postmarked on election day in their 40s later, can you process it and it relates to how early you can process these ballots. any number of things can change even if the election has already

started. eric: in 30 started now, people are already voting already, you just mention pennsylvania, they have been changing the laws and trying to tweak this and ballot boxes and other things, here's the wall street journal editorial on what's going on in pennsylvania and the court cases saying they call it supreme chaos in pennsylvania, saying a ruling in terms of delaying it and letting it go until friday not the vote but the counting, the ruling can help mr. biden, about 20000 ballots were rejected in the june primary even after the deadline was extended in some counties, if the polls are right that biden supporters are more likely to vote by mail, and the newly absentees can rebound to his benefit and if ballots are disputed lawsuits sent to the court, any doubt which candidate the pennsylvania supreme court will favor in the pennsylvania heavily tilted democratic.

what if it gets down to one state and it is in court, remembering 2000, the lawyers nitpicking every single vote, it is going to be -- i don't have any words at the moment, just try to imagine what we will potentially be going through. >> if you do remembering 2000 that was all about florida, we can see a problem in one particular state or a problem in many states, by problem i mean a couple of things, one there is still ballots that have not been counted and they are being disputed, that connects collate to courts, there is a lot of ballots, the president likes to talk about fraud and very little evidence but what there is evidence of his problem, people that are not following the right directions and they don't get their signature matching the signature on file, the forgot to put on the second envelope, the mail did not get there on time, there are a lot of different things that can happen and we have seen both sides, democrats,

republicans, biden in terms of talking how they will watch very closely and watching what is happening in precincts and states and they will not concede until every vote is counted, that can take a while. eric: both sides the plane armies of lawyers out, you did mention something very importa important, folks i want you to hear this, we will do a story next week and on this, the issues with voters, a lot of thousands of volunteer in new york state were bounce because the voters, you have to sign outside of the envelope and a lot of the voters did not sign outside the envelope, every state is different and they all have different laws. thank you. arthel: you are right, it's good to be fascinating to watch, as we approached six weeks to election day, the nation's intelligence agency continued to battle cyber wars with some of the fiercest allies, we look at

cyber warfare, examining the pros and cons of whether our nation should take an offensive or defensive approach, former chief counsel and senior advisor for the senate foreign relations committee jamel jaber writing we are at war in cyberspace for around a decade, we have been in series of consistent small scale conflicts, these conflict have intensified recently particular since the start of the covid pandemic and have had massive impact on the american public and private sectors. jamel jaber joins me now. you say the way i boil it down, you say the u.s. needs bigger, bolder more aggressive cyber warfare we need to announce it to the world, what action do you propose and would over offense oriented cyber attacks jeopardize u.s. strategy insistence? >> i think it is a hard question, number one what is

clear we have and constantly under attack in china has come after the property and stolen billions per year end trillions overall, the russians have gone after him election in our trust of rule of law institution and the iranians have the destructive activities and in order we have to tell people what they might do to us that will cause us to respond and demonstrate than what we can do to respond in it for going to deter them, we can be prepared to do that, unfortunately today we have not shown a willingness to do that and we have not made by ron or russia or china paid a real price for the activities in order to determine them we have to be able to do that. arthel: before the house homeland security commission last thursday, fbi director christopher wray confirming current analysis from our intelligence committee -- community i should say because russia is at it again, also the u.s. has not seen targeting of our election infrastructure like we saw in 2016 and still efforts

to so doubt about the election integrity are a serious concern. let's listen. >> what concerns me the most is the steady drumbeat of misinformation and amplification of smaller cyber intrusion that contribute over time, i worry they will contribute over time to a lack of confidence of american voters and citizens in the politically of their vote. arthel: he went on to say that he thinks americans can and should have confidence in our election system and certainly in our democracy but he feels like we as a country should begin to take on a feeling of utility with the constant misinformation out there. again, you say the u.s. should be far more aggressive with cyber deterrence, what do you say to those in the field of

intelligence and cyber warfare who say this could push the u.s. into a real war. >> absolutely, it's a concern if you get too aggressive in my call to real war, the fact of the matter we are war in cyber war phase, we've been hit by the chinese and the russians, i iranians for the better part of the decade and we have not effectively responded, we do need to engage in defense, today we lead companies, individual states alone to fight on themselves and going up against nationstates who have virtually unlimited resources, that does not make sense, the government industry together in a collective defense to defend the nation when it comes to cyberspace. arthel: are you suggesting the government should give a cyber system or weapon to american companies so they can fight against the cyber attacks? >> not in a offensive way but a defensive capability, the u.s.

government has intelligence all around the globe, and to translate that information back to the private sector in a way that is effective and actionable and they can better defend themselves, we don't expect american companies to have surface-to-air missiles on the roofs and buildings and defend against russian air bombers, when it comes to cyberspace we expect that of every american company whether large or small and it does not make sense. arthel: i have 30 seconds left with you, i want to recap what you said, i want you to tell us again what do you think the u.s. should do in terms of how bold and aggressive they should be and what happens if the u.s. does not adopt your tactics. >> two things, we need to get much more aggressive and respond to cyber attacks and tell people what they might do that will cause respond and then respond we need to engage in collective defense to bring industry and government together to defend the nation and at the end of the day if we don't do this we will have the electoral walk out the back door and our enemies will get more together.
