after the election, joe biden cited arguments for 2016 when republicans blocked president obama's nomination of garland, gop leaders like mitch mcconnell and lindsey graham argued against the supreme court vacancy in an election year saying the american people should have a voice in the election, biden estimated by october 1 up to 40% of americans may have cast their votes, until voters determine the next president, congress and senate, the current senate should not push through this president's nominee, biden said if president trump wins reelection the senate should move forward, but if biden wins try nominee should be withdrawn and take no action until the election is decided. >> i'm not speaking, president trump will do whatever he wants, i'm not speaking to mitch mcconnell to do what he wants and he does. i am speaking to those republicans out there, senate republicans who know deep down what is right for the country

any names of his potential nominees saying that could gin up anger and emotion and subject those people to political attacks months before and potential vote. jon: jacqui heinrich in philadelphia, thank you. more on all of this let's bring in john decker fox news radio white house correspondent and an attorney, you just heard from jacqui, joe biden suggested a constitutional crisis is in the offing, is that may be overstating it a little bit? >> absolutely we are nowhere near a constitutional crisis, the president is fulfilling his constitutional duty now there's a vacancy on the court, this week apparently will name a replacement for the seat of ruth bader ginsburg and then the obligation of the senate to pick up that nominee and already we heard from the senate majority leader mitch mcconnell, he will move forward as will the senate judiciary committee chairman lindsey graham, the people that are really the focus right now

are the republican senators who have not spoken up, that's how they feel about voting on a nomination this close to a presidential election. jon: there are 22 presidents that have made supreme court nominees or nominations during the final year of their terms in office, that includes george washington, this has been done before. >> it has been done before but i think the argument that is being put out there by democrats, if you look back four years ago what took place with eric garland nomination, some of the things said in regards by some of the players that are involved in this nomination which would be announced this week, the things that were said by mitch mcconnell, his actions and the things said by lindsey graham as well and that perceived hypocrisy and democrats right now are certainly playing up among their base.

jon: then you had a republican led senate and a democratic white house, the democrat president, this time you had the same party in charge of both of those wings of the government and republicans are saying that's what makes a difference. >> that's argument that's been put forward by mitch mcconnell and by lindsey graham as well as other individuals who are up for reelection like joni ernst to his running for reelection from iowa. last time four years ago, she was against putting forward or voting the nomination of merrick garland, this time around she's more in, time to listen same thing, he is all in supporting the majority leader on this, if it's a numbers game, we're looking at whether or not democrats can convince two additional republican senators to break ranks, i don't see that happening right now, anything is possible, we don't know who the

nominee is going to be or their background but as it stands as a unified republican party in the senate right now except for the two that were mentioned earlier. jon: let's take a look at the timing of all of this in the timing of past nominations and confirmations, it took 88 days to get brett kavanaugh confirmed to the supreme court, we all know what he went through, neil gorsuch it's 65 days, elena kagan 87 in sonja 66 days, we do not have -- were less than 66 days out from the election, does that make a difference? >> it does and it does not, if you listen to the various things that were said by the republican senators that were played just before you came to me, they are all on the same page in terms of the timing of all of this, they say this will happen by the end of this year, that does not necessarily mean that it will happen in terms of a vote up or

down vote on the senate floor before election day but the election that it would happen before the end of the year even if it means that we are talking about a president such president trump losing in november or a president who is recently been reelected, i think that is a proper timeline to talk about and also when you consider, it is not until january the 20th of next year that we will swear in either president trump or joe biden, there is a lot of time that is at work between now and then. >> you're an attorney and you stated the constitution that states the president shall appoint in the senate shall confirm a supreme court justice, does not say anything about the timing of all of that. you heard senator coons saying an appointment could challenge the legitimacy of the court and you heard nancy pelosi threatening to stop all of this

through some action in the house and some are speculating could include impeachment. it seems a little over-the-top. >> a lot of that is rhetoric, some as empty rhetoric in terms of what you just mentioned, as far as the threat coming forward of what you mentioned the possibility of impeaching president trump once again or impeaching the attorney general of the united states, those are threats that are out there but the senate can still do its function, even if those actions are going on simultaneously with the confirmation of president trump's nominee. jon: it will be a fascinating couple of months. john decker fox news radio correspondent, thank you. jon: a makeshift memorial to justice ruth bader ginsburg continues to grow a at the supre court, mourners spent the weekend bringing flowers, signs and candles to pay their

to be an issue for voters in 2020, that's what you saw president trump released his list for prospects of the supreme court in 16 and a few weeks ago and it's why we have consistently called on joe biden to release his list, in june joe biden said he would release his list of supreme court nominees and now says he will not, the president has released his list, you play the clip from the rally last night where he said it would be a woman in the constitution is very clear, the president selects a nominee in the senate provides advice and consent, those are the rules and the only rules the president will do his part, we elect the president for a term of four years, not three years and nine months or whatever the democrats would want the president to behave like, the president is good to do his constitutional duty, select the nominee get him in front of the senate and we anticipate and hope the senate will move on that nominee. jon: as you mentioned joe biden is not too pleased with the prospect of the republican president and the republican

people have spoken both entities that will be involved in the process, the president and the united states senate, the people have spoken in 2016 they elected donald trump president and in 2018 the people expanded the republican majority in the senate and that is the senate as it was constituted in the election of 2018 that will take up the president's nominee and decide whether to vote up or down, this is exactly the president and the senate discharging their constitutional duties and i know joe biden does not like it very much but the president is elected to a term of four years, not three years and nine months in joe biden cannot suddenly say stop doing the things that you are supposed to do as president as outlined in the constitution because there is an election coming up, you don't stop being president because there's 45 days to go before an election, he still the president and there's a vacancy on the supreme court, this is happened 29 times previously in the history of the united states and all 29 times when there was

driving the issue on this, conservatives care very much about the makeup of the court, over the course of the last many decades conservatives have seen activist judges on the left making laws from the bench and they are tired of that, that's why they want to put constitutionalist on the court, the president has installed two solid conservative justices on the supreme court and now is going to nominate a third, i know the left gets hot and bothered about everything this president does and i don't see why this would be any different. jon: very quickly you know something about campaigning and the exercise of political power, why is joe biden not releasing his list. >> i think it is pretty clear he could not release his list because we know he's in the grip and under control of the extreme radical left in the judges that he would have to put on the list to satisfy those people on the extreme left would not be palatable to the majority of the american, these will be justices that have very extreme positions in the past, the left is energizing and raising money and

jon: with a vacancy on the supreme court bench, susan collins became the first republican senator to say the appointment should be made by the president elected on november 3. her statement comes as collins faces a heated reelection battle in her home state of maine. here is a closer look at the important senate race.
