fill the open seat despite defections. political analyst ron meyer joins us. are there any other landmines that could prevent this confirmation? >> just like last time with brett kavanaugh the media will do everything they can to stop the nominee. instead of looking at various senators which it seems the gop has 51 pretty well locked up i would look at the media to see what they will try to do to derail it and which senators would be vulnerable to the media narratives. that is why donald trump is taking extra time to pick a rocksolid nominee that will face of the media scrutiny as possible. that is the interesting thing. people acted surprised when mitt romney made this decision but it is not surprising because he may be a never trumper but unlike so

many in the media, he is a never trumper but has conservative values and will support the values long-term on the supreme court. i'm not sure romney is a swing vote but we will look at some others the media attacks when the nominee gets hotter. jillian: look at what susan collins has to say. if there is a vote i would oppose the nominee not because i might not support the nominee under normal circumstances but too close to the election. what do you think of that? >> she is in maine and going to be a state that goes against donald trump but also not necessarily consistent with how she's been her entire career, someone who has been the center of the senate, tries to force that. everybody looked hypocritical on this issue.

democrats and republicans switched sides, the historical precedent usually says people with the votes win these issues. if the senate and the same party as the president get a nominee and they get it fast. if they have opposing parties it doesn't pass. it is politics. it should be no shock to anybody but susan collins, also smart for her considering she is up for a senate race. todd: donald trump holding a rally in pennsylvania, joe biden campaign in north carolina, the president won both of those dates by narrow margins but look at this. he's not leaning in the current polls in both of those states. with that is the backdrop keeping in mind these polls were before the death of ruth bader ginsburg. how big a deal with the supreme court fight be for voters in the states? >> it is a game changer i think.

the polls are shifting a little bit. reuters has a poll out from yesterday and centerleft polling as far as the data shows and they had trump tied with joe biden in north carolina down by 3 in pennsylvania. it shows things are starting to tighten and put the backdrop of the supreme court you have evangelical voters and people who are on the fence about donald trump's personality saying this is a bigger deal so it will help the race tighten even further and the debates coming off, another game changer, the polls will tighten and continue to tighten. i don't think north carolina is in play for the democrats, pennsylvania will be the biggest swing state so i think that is want to continue watching. jillian: don't forget in 2016 hillary clinton was up by 7% at

women, create strong bonds that could not be broken by prejudice. how her whole life was fighting prejudice and as a young woman, one of nine women, when she was 23 years old and at age 30, law professor but she couldn't get a job at a law firm. at age 38, before the supreme court she is a member of the supreme court. jillian: how should we remember her? >> we should remember her as a woman who lived her life looking for ways to fight prejudice, to bring equal opportunities to men and women but in particular women and you see so many women today on both sides of the political aisle recognizing that she paved the way for them to go to law school, to give the more equal opportunity in the

workplace. that is what she -- we should remember about ruth bader ginsburg. jillian: as we look ahead many people remember her, we see people gathering outside the supreme court especially when her death was announced, people paying their respects, the president will announces supreme court choice friday or saturday. what do you think this means going forward because this could potentially shape what the supreme court looks like. >> absolutely. whenever there is a justice nominated to the court it does shift the court in some way but this is a big shift and the us constitution gives the president the authority and power to nominated justice to the supreme court, doesn't matter is what point in the president's term or specify in the constitution, and give the power to the senate to
