we can confirm the supreme court vacancy is going to be one of the topics discussed at the first presidential debate which is happening tuesday the 20 ninth moderated by chris wallace. that is one of the topics, we can bring the other ones up for you, trump biden record, covid-19, the economy, race and violence, the integrity of the election. todd: obviously this is ground breaking news, all eyes will be on the supreme court nomination, but let's not forget about violence in the cities. for donald trump, for his perspective, he needs to stay on message between now and election day to get that undecided suburban woman in the swing state. that will decide this election based on the pollsters you speak to, not saying -- there are swaths of voters will vote on the supreme court, i feel like he has those people, stay on message.

carley: kentucky attorney general daniel cameron is preparing to announce the officer involved in breanna taylor's death will face criminal charges. it is unclear when the decision will come but the mayor has declared a state of emergency. >> we hope that announcement is coming soon so the city can learn the facts, and begin to heal and take the next steps in the ongoing fight for racial justice. jillian: it has been barricaded off as police restrict access and businesses are being encouraged to have employees work from home. >> l mpd and others are trying to ensure that any reaction is one where people can give voice but at the same time we don't see violence or property damage. jillian: the protesters marching

>> i am not. mitt romney is a good man. he represents one of the most conservative states in america, use our. i don't think he could sleep at night if he passed on an opportunity to give utah another supreme court justice. this has been a sore spot with conservatives for decades how liberal the supreme court has been. this will be the president's hopefully third nomination to the supreme court, a third of the supreme court under donald trump and if this selection is as good as his previous two i think the people of utah will be happy and mitt romney put aside his disdain for the president and is going to do the right thing and fill the supreme court seat. todd: are you worried about how democrats can retaliate to this? >> i am. we all heard rumors for months the democrats have been whispering in their big donors liberal base's ears that if they

bars and restaurants could not afford the rent, 34% not being able to pay their rent at all. what do those numbers say to you and how do we turn around? >> you were spot on when you use the word devastated, these small business owners have been financially devastated. someone didn't like their burger or there is bad service, we've been mandated by government to close down and stay shut, now we need the same government to help these business owners get reopen and stay reopen, if our restaurants are gone, cities, towns and country start to the road, restaurants are the backbone of the united states. jillian: a lot of restaurants trying to figure out their plans for the winter. a lot of them have been allowed to utilize outdoor dining, filling in streets and sidewalks and things like that but at some point that will end and indoor dining starts next week in new york city, 25% capacity.

do you think that will help a lot of these struggling businesses? >> whether it is 25% or 50%, we have a roadmap to get to, that is not going to be enough because pre-pandemic, it there was 100% occupancy so we need government officials to pass the restaurant act, bipartisan piece of legislation that will help cover their rent so we don't see default throughout the system to pay vendors like the farmers, produce, the fishermen they get their fish from and the person who seldom beer. we are part of the economic ecosystem that needs to rebound for the country, to rebound. jillian: what to the restaurant owners say to you? >> your heartbreaks for them. their personal savings trying to

>> good morning. thank you. jillian: were you surprised when you heard this. >> look, it's no mystery that senator romney does not like this president. and i think if he had any chance to frustrate him without compromising some basic fundamental and foundational beliefs that he has, he probably would. but, at this point, i think it tells you how important and vital this nominee is and how the republicans have a purpose here in trying to preserve the constitution in their eyes. todd: take a look these are the likely scotus nominee breakdown as it stands there 51 g.o.p. senators in favor. do you see any land mines that could derail confirmation? >> well, you know, we didn't see anything coming with kavanaugh. and if you look back at sort of the history of the nomination process, the democrats have been very open about their attacks on

these nominees from bourque and thomas to kavanaugh. so, you know, it's anybody's guess what is going to happen, but i will tell you there are some nominees right now that i think are going to be very difficult for democrats to deal with. jillian: it's interesting though when you think about whose base this might energize even more as something the people are thinking about when they are going to the polls or when they are voting right now, a lot on the left as you know don't want this to happen. do you think this energizes the democrats' base more? >> well, there is no question it's going to energize them. i hear from a lot of friends there is rallying going on. but the problem they have is this is going to rally the republicans. i think it's an opportunity for the president. it's more significant for a sitting president of the united states to nominate a justice. i think there is a lookout of memory about what happened to brett kavanaugh.

and so, you know, we will see what happens. but, i would be hard-pressed to believe that the democrats are going to rally more than the republicans on this, if they get the nominee through the senate. todd: are you worried about retribution from democrats in the future? >> you know, i never thought i would hear, you know, threats of packing the court. it's concerning to add additional seats. they complain about mitch mcconnell about him controlling and utilizing his power and authority. at the same time, they are willing to alter the fundamental foundation of the constitution when it relates to the supreme court. and so that's a drastic move that i see no end to because what will the republicans do when they get in power after the democrats pack the court? jillian: let's change topics here and talk about this for a second. the doj announces the largest international opioid bust in dark net history. what do you know about this? >> well, you know, i know the

focus of the department of justice has been to attack fental and the opioids that are being districted. it's a new ear wrath drug distribution. it's very challenging to keep up with the technology. so, you know, the aspects of this case that are fascinating are both the use of technology but also the cooperation of international authority. that's very unusual to see. some countries fall in line and work with the united states to take down such a large operation. todd: how big a dengted, brett, will this make in the opioid crisis? >> well, sadly, you know, there is case after case that seems to be coming down the pipeline. there is no end to the money that's being made. it's easy to make this stuff. and it's being districted from, you know, college students to hard core dealers across the country. so, i don't see an end to it. we have to stay on top of it. but it's going to take a lot of effort by countries working together to try to root it out.
