expect she will make . judge jeanine: don't have a lot of time, how long do you think before she will be confirmed? how long do you think? >> i hope too get her out of the committee by the 26th of october. i will follow the normal rules of the committee. will start on the 12th, we will have four days of hearings and then we will hold over the nomination for a week, consistent with the rules of the judiciary committee and hopefully will come to the floor the 26th. will be up to mitch mcconnell. judge jeanine: quickly, have you spoken with judge barrett since the nomination? >> she called me, she called senator feinstein, a pleasant conversation. i congratulated her on such an achievement in her life. she's worked hard, she is deserving of this honor. everybody who knows or understands she's a complete

test. the strategy and plan is, they say we are not going after her religion, we are going after her on the issues and they talk about where she would be on abortion and roe v. wade and they will press her on that. will make sure it is not going after her faith, they are going after her on the issues, that's the issue they need to be careful on. judge jeanine: it certainly can backfire.he if she is voted in before the election, it is possible she will be involved if there is an appeal to the supreme court from the election in the case involving the president. i suspect the democrats will say she has to recuse herself because she was nominated by this president. what say you about that? >> that would be tricky because then you also have to say justices gorsuch and kavanaugh have to. the supreme court justices, no one can ask them recuse, only

they can makeha that decision. it's different in other courts when you have a petition or way to address that. supreme court justices alone the only ones to f decide to recuse. if justice barrett, if she becomes justice barrett, was forced to step down simply by being the president nominee, i would take three justices out. i don't think theyy would listen to the affordable care act case, that is the real thing democrats will say healthcare is at stake, if can't go after her personally, we got to be careful, this is a very successful woman, that people say, her liberal coworkers and friends have said i can't take that away from her, they want to go after the issues it will be things like the affordable care act, abortion and other things they will push her on. judge jeanine: all right, makes so much. our coverage of this historical day in washington is just

welcome back. the dems want to pack the court if president trump's nominee is confirmed. let's talk about that and more with senator tom, thanksab for being here. we are thrilled to have you on tonight. you have been a member of the senate judiciary and you were there during the hearings of judge barrett when she was nominated for the seventh circuit court of appeals. what is your take on judge barrett? >> i think she is extraordinary. coonrod at notre dame, first in her class, highly recommended by bipartisan group of people who have worked with her. she is an extraordinary pic and i think she will do well in the hearings. judge jeanine: i understand today you were there in the rose

garden and you had an opportunity to talk with some members of her family. tell us about that. >> i talked to her 11-year-old son and asked him if it was true his dad made his favorite dish and he t confirmed that was tru. she has a great family. we are talking about seven kids, too adopted from haiti, there obviously great parents, the children were great to talk to. she's a great mother, she's a brilliant jurist and she's going to be a great addition to the supreme court. judge jeanine: do you think the democrats will take this down the religious path in their effort to make sure roe v. wade is never touched? >> i hope i'm wrong but i told someone the other day that i think is hearing may make the bright cabinet rights kavanaugh hearing like a pep rally. not the work scholarship but

purely political purposes. we will have to stand there and make sure her record is very clear, it is a solid record a great academic record, a great jurist record, she deserved to be treated fairly in the committee. i'm just not sure it will happen. i doo think there will be religious overtones and i think it is disgusting. judge jeanine: i have to agree with you. you are there with senator dianne feinstein what many considered a religious attack, your dog will speak loudly within your. a we know her response was but it was her persona, body language and what did you learn from that in terms of how she will handle within the hearing itself? >> that's why i think she's going to be great in the hearing. she was poised when people were asking unclear questions. that particular question insulted me as a roman catholic

but i think she just demonstrated poised and she understands, she's there to under stand questions related to law and nothing more. the personal attacks, i don't think going to bother her, i think she will stay focused,rs she's very disciplined and brilliant. i think it will come across in the earnings. i'm looking forward to being there, i will be there for theh duration and i am looking forward to it. i think she will do very well, it will be very difficult, it will be unfair in many cases but i think at the end of the day, the american people watching will see with got someone who's an extraordinary pic for the u.s. supreme court. judge jeanine:in given that some democrats voted forrd her in 207 to the circuit court, lucy if any of them do that at times. thank you for joining us. leo are on deck. what does amy coney barrett own

president of the student body of the medic in high school, a girl who made sure everyone was included, she didn't like? and we see that in her later career. i've spoken with people say she's very inclusive, she cultivates relationships over a long period of time. makes it very difficult as the project moves forward, to attack her. this is a mother of seven, a woman who adopted to haitian children, special needs child and i don't know if you saw them today, getting seven people to dress correctly and have everything in place and leave on time.co [laughter] i have trouble with one. she was in total control and drove the car to the airport herself. this slander is not going to work, iwo don't think. judge jeanine: you covered

washington 25 years. how bad do you think the battle will be and how will she withstand it? >> as you heard, i think it is going to be a brutal battle, i think she's the perfect person to withstand it. she's grace, she knows where she's coming from, she started her family and not part of the washington elite. as other recent nominees were, they were worried about how things were going to play. that is not amy coney barrett's style. i think attackinghi her as a mother plays badly in the selection particularly with kamala harris as a member of the judiciary. judge jeanine: allll right, very quickly, in terms of sensor kamala harris, how do you think she will handle her? >> i think, she's going to take the lead in opposing amy coney barrett. my personal take is, if she leans in too hard, you heard ticket.
