todd: the fact that biden and harris haven't said whether they will pack the court, they definitely deflected on that question. is in that proof positive they will pack the court if democrats are in power? >> from where i sit as a democrat if you have the court that is 6-3 weather is conservative or liberal that is already a pact court. senator harris did answer the question when she spoke of the american people will decide. if the american people elect her and joe biden as president and vice president perhaps the american people are signaling something they would be open to but it may not be, if joe biden is elected that he can just do this with a pen like an executive order. it is more complicated than that. >> kristen, your biggest take aways of the night and we spent a lot of time talking about the economy, we did earlier this week. what did you think of a narrative of the economy from both sides? >> i thought mike pence did a fantastic job building a contrast between the two parties

on the economy which is a top issue for voters and honor their issues like the green new deal. kamala harris wouldn't even answer basic questions voters deserve to know the answer to like we should pack the supreme court or what she and joe biden would have done differently to handle covid-19. this is a great night for pence, a clear winner and he assured americans who watched the out-of-control presidential debate that there is a calm and steady statesman on the trump ticket. i don't think the debate will move the needle much but it could help voters feel more at ease voting for trump, specifically suburban women who have been breaking for biden in recent polling. >> let's listen to more of the candidates on the economy, take a listen. >> you have donald trump who measures the strength of the economy based on how rich people are doing which is why he passed a tax bill benefiting the top one%. day one, joe biden will repeal that tax bill, get rid of it.

11.4 million jobs recovered as of september. what has been your biggest struggle and what do you foresee as your biggest struggle the next two months in fall and winter? >> a lot of what kevin said. we are in a state where they have mandates the restaurant can only have 25% capacity and you are waiting for them to change it and they changed the 50% for a week or two and then change it back and that is the biggest struggle, you don't know what is coming down from the local governments, what they are going to say and it puts you in a position you have to just be at their mercy and that is tough, businesses are out there trying to do everything we can and we don't get much guidance. nobody can tell us how long things will last for how long we will have to be at a certain capacity and business owners are so innovative and especially right now and trying to shift their businesses on a dime and

jillian: kamala harris facing off against mike pence with some expressive reactions during the debate. todd: joining us in the facial frenzy is beverly holberg, how to kamala harris and specifically her face coming across? >> reporter: not even the plexiglas could contain the strong side i she was giving the vice president and that was the stand out of this debate. i think americans appreciated it was more civil, there were more topics covered even though both candidates dodged a lot of questions but i do think the means from the facial expressions of kamala harris, they were trending and what people took away was a bit of abrasive, condescending, the exasperated look, this may have worked out better should she been debating somebody with a style of donald trump who can be abrasive himself but mike pence
