the white house. is it fair to say the white house understands how people would see this as rushing just a bit? >> yeah, especially when you consider how long ago it was the president was actually over at walter reed. they say if he is healthy enough to get out there he should take his message directly to the american people. will there be a rally? very probably yes. just what form that rally might take on is anyone's guess. we've seen rallies before, right? the in person with the president in packed arenas and air force in person holding rallies and also seen a number of rallies across the country without the president. vote rallies and road rallies and boat rallies. the president will push on with the stops in key battleground states florida and pennsylvania. states he won in 2016. the question is this. how confident is the white house that he is healthy enough to get out there again so soon

after his covid-19 diagnosis? well, here is what his doctor said yesterday. since returning home his physical exam has remained stable and devoid of any indications to suggest progression of illness. i think it's fair to say, if he gets out there to have a rally, it would be the american people's first chance to see him in person. we heard interviews, radio interviews and other interviews without seeing the president. we've seen him on video on the south lawn but this would be an unvarnished, unfiltered opportunity for the american people to see him. for his supporters to get a chance to rally around him. and i can tell you this as well, especially given the state of the race, this may be, trace, his last best chance to make that final push. so looks like based on everything we know so far, he will be out there again soon. trace. >> trace: kevin corke live at the white house. thank you. >> sandra: thank you, kevin and trace.

let's bring in louisiana senator john kennedy. he is on the judiciary committee. a big week next week. first to the president not wanting to commit to a virtual debate. the second planned presidential debate. does it help or hurt the president to not commit to this? >> a virtual debate in my judgment is a weird second cousin to a real live debate. i don't think that the debate commission is doing this for the american people. i don't think they're doing this for the candidates. i think the commission is doing this for themselves. i think they didn't like the first debate. i think they think that the moderator or moderators will be able to control the candidates better in a virtual debate. but you know what?

that's not their call. i say hold a live debate. i think it can be done safely. we just did a debate in person with the vice presidential candidates. and let the american people see the candidates in full. once again, the permanent wash types in my judgment, sandra, they think the american people are morons and can't make decisions for themselves. i just think this virtual debate is a bad, bad idea. i don't blame trump for not participating. >> sandra: the difference is the president has tested positive for covid-19 and has since been on the road to recovery since then thankfully. the commission says they're doing it for safety reasons. >> sure they do but they're not. they're not. just move the debate back a few days and require both candidates to get a doctor's

distance and practice good hygiene and i hope the people who attend the rally do the same thing. >> sandra: you mentioned the presidential debate the other night when kamala harris was pressed on what their intentions would be should they win the president to do with the supreme court. she was pressed and did not provide an answer. joe biden has further been pressed on the issue. here is his latest response to that. >> president trump: you'll know my opinion of court packing when the election is over. now look, it's a great question and i don't blame you for asking. but you know the moment i answer that question, the headline in every one of your papers will be about that. other than -- other than focusing on what's happening now. >> sandra: senator, you will know my opinion on court packing when the election is over. you have to elect joe biden to find out what his intentions are with the supreme court. this piece in the atlantic takes on that response and says

this. i'm read it. maybe the biden team thinks court packing is a distraction from the fight over barrett. maybe the question is still unresolved within the campaign. whatever the reason, if democrats win big in november court packing will be an urgent and live question that biden and harris will have to take on within their coalition. evasion isn't a good enough answer. what is your response to joe biden and kamala harris continuing to dodge that question? >> let me say what i think is obvious to the american people. mr. biden is a tool. bernie sanders is the oracle. mr. biden is the nominee but senator sanders is the head of the party. i believe mr. biden has promised senator sanders that he, mr. biden, will pack the court. but he doesn't want to say that

because he knows undermining the independence of the united states supreme court and essentially destroying it is not popular with the american people. so mr. biden has adopted this if i told you what i'm going to do i would have to kill you. why is he doing it? because he can. many members of the press are letting him get away with it. contrast this to 1992, the way the press treated bill clinton. remember when bill clinton was asked about marijuana and he said well, i puffed but i didn't inhale. the media chewed him up, spit him out and stepped on him for trying to have it both ways. but they let mr. biden have a pass. >> sandra: senator, before you go i would like to turn our viewers' focus to the side of the screen where you see hurricane delta heading towards louisiana coast. how is your state preparing for this and what are your

expectations for delta, senator? >> oh, sandra, you know, if 2020 ever slows down, i'm going to get off and walk, you know? six weeks ago laura hit us full in the face, now hurricane delta will hit us full in the face. our first concern is loss of life, you know, the most important things in life aren't things. it breaks my heart. i don't know why bad things happen to good people. we're as ready as we can be. but you know louisianaians, our motto is knock us down seven times and we'll stand up eight and we'll deal with it. but, you know, it just breaks my heart. >> sandra: my best to the people of your state as they brace for that hurricane as it makes its way potential landfall later on. always appreciate it, senator kennedy, thank you.

>> trace: hurricane delta gained a lot of power and lost power over yucatan and back in the gulf gaining a lot of power. hurricane delta a category 3, winds 120 miles per hour. let's bring in janice dean tracking this in the fox weather center. it appears to be both a wind and water event. >> absolutely. and in any given year this would be a bad hurricane. because it's coming on top of many storms. i just want to show you the 2020 u.s. landfalls. this is a record. this will be 10 named storms making landfall across the u.s. it will be a record. the fact we've had all of these storms target the gulf coast including louisiana and this storm really going over the exact same regions as laura did as a category 4 six weeks ago is heartbreaking. the senator is absolutely right. no other way to put it except prayers for louisiana because we already have homes that are

almost completely destroyed and this one is just going to put salt in the wound because it's so devastating. already seeing the heavy rain, the wind certainly, the storm surge again east of the center of circulation will be 7 to 11 feet. it will put things under water in a lot of vulnerable spots and still a category 3. still a category 3. we expect the storm to weaken but not a lot of time left. the landfall will be this afternoon. so the fact that they're going to see hurricane-force winds, relentless rain and pounding along the coast for hours and hours is just not a good news situation. we have at least tropical storm-force winds not only for louisiana but down towards texas shoreline as well. there is the track. we'll get a new one in the next hour or so. still a very strong major hurricane right now, 110 mile-per-hour sustained winds with wind gusts of 120 miles per hour and the heavy rainfall.

chance to weigh in on the fitness of this president in just a few weeks, right? that issue will be resolved by the voters. to talk about removing him from office and sort of tease we'll talk about the 25th amendment tomorrow, please tune in. i think the american people would prefer the speaker of the house to be doing her job and shepherding through a covid-19 relief package that can be supported by both parties and help the american people, right? she has been saying for weeks that she would rather americans who are hurting and suffering get nothing than get something that isn't perfectly aligned with her values. that's not acceptable. she is now trying to complain and blame everything on the republicans, the republicans are back at the table yet again. they've put forward proposals. she has put forward her proposal. it is such a massive distraction from what her actual job is and what the priority ought to be. it is politics and trolling and that's what nancy pelosi is about almost 24/7 it seems.

weeks ago. phil keating is live in jennings, louisiana for us this morning. >> good morning to you. here in jefferson davis parish, like every coastal parish in louisiana, even some of the coastal counties in texas along the gulf all right now under the mandatory evacuation. take a look tt downtown of jennings. everything is closed. nothing is open and it will be like that for the rest of the day. now as the day goes on things are only going to spiral down badly. we'll get hurricane winds, super bands of heavy rains. a lot of possible flash flooding and, of course, that potentially deadly storm surge. multi-foot storm surge along the gulf coast. as we were driving through louisiana yesterday and got to baton rouge and kept going west, this is the scene.

is why not coming out in favor of court packing won't make the decision on that until after the election. they said kamala harris debate the other night said a couple of times she didn't favor the new green deal. there are some kind of nuances there that we should look at. what are your thoughts on that, david? >> joe biden can't remember when he actually went to delaware state university or didn't go to delaware state university. so to expect him to stay consistent on any given issue could be asking a little bit more than where joe biden is right now. as far as the packing the courts, the reality is the bigger -- democrats are going to be opposed to that whether it's joe manchin who expressed it or dianne feinstein who already said she is not for it. the bigger issue is are they going to give state hood to washington, d.c. to add two democratic senators? let's keep the reality in focus. congress passes far more laws than the supreme court rules on in a given year.

issue. that being said, i'll bring our viewers to take a look at 2016 results. in the state when it comes to how president trump fared against hillary clinton and as you can see -- that's the entire state. here is clark county. hillary clinton over a 10-point -- 11-point advantage over drufrmd there. is vice president mike pence spending his time in clark county with the rally. why do they think they can make up ground there, tom? >> well, it's -- i think it's dominated by the unions. unions have traditionally turned out for democrats. there has been some movement towards the trump campaign among different union sectors. so that's one reason. the other thing hispanic voters. the trump campaign feels like they're doing better with hispanic voters this time around than last time. hillary clinton won that county by 10 percentage points and took about a 75,000 vote lead out of clark county. only won the state by 27,000

and the debate still days away. but joe biden is responding to the change in the debate format and put out a statement to this. as a result joe biden will find an appropriate place to take questions from voters directly. given the president's refusal to participate on act 15th we hope the debate commission will move the biden/trump town hall to october 22 so the president is not able to evade accountability. they said move it back a few days. we can do it then. then they also asked to move the third debate back. but chris, it is almost difficult to keep track of all this but at some point we are getting pretty darn close to election day to be having presidential debates. >> i actually don't think it's that complicated. i think there is not going to be the debate next week and pretty clearly and i think the president made a big mistake. i can understand where he

wanted an in-person debate for he and biden to be on the same stage. i don't think it was unreasonable for the commission to say look, given all the concerns about people's health that we are going to make it a virtual debate. you heard the chairman or co-chair of the commission say there would have been people in the room to make sure people weren't reading off teleprompter. where i think the president made a mistake is maybe a virtual debate isn't an in-person debate but better than no debate. that's what the president will get now. he is behind in the polls. he has two opportunities it seems to me two big opportunities to flip the script which were the two debates and he gave one of them away. looks like there will be one final debate on the 22nd. there won't be a debate the last week. i know the white house is calling for that. the biden campaign has said all along we're going with the debates as scheduled. there is not a chance in the world there will be a debate

we've got some brand-new information on the second presidential debate moderator steve scully from c-span. let's bring in chris wallace. what are we learning? >> we're learning lot. you and i had a conversation at the beginning of the last hour about a tweet that steve scully had supposedly sent to anthony scaramucci, former trump aide. now trump opponent asking how he should respond to an attack from the president? what i'm now told by officials in the commission on presidential debates is that steve scully never sent that tweet. that someone was able to get into his account, to use his twitter handle, and made up this tweet exchange with anthony scaramucci and that it was a hacking of scully's twitter account that he never actually sent that tweet. so if that's the case and we need to hear from steve scully, who works for c-span directly,

the commission on presidential debate says that tweet never happened. it was made up. i also got more information from the commission as to why they made the fairly dramatic move to move from an in-person town hall next thursday to a virtual town hall next thursday, a proposal that the president rejected. and what i'm told by officials on the commission on presidential debates is that nobody wanted to be in the same room with president trump as he is just recovering from covid at the adrian art center in miami. when you say nobody wanted to be in the room are you talking about staff, cameramen? i was told yes, them but also members of the public who would have been asking questions of the two candidates so they were having great difficulty recruiting people undecided voters to appear in the room because they were concerned that they would get the covid virus from the president, who

to where the debate would be held, the format, etc., do you find that odd? >> no, because i think there are serious questions as to how the president behaved in the first debate. the white house has refused to say the last time that the president tested negative before he went to the debate. and so i think there is some concern. you know, the timeline really is very questionable. if the president tested positive on thursday night as he did, we're talking now a week ago, for having the coronavirus in the middle of the night on thursday night, two nights after that debate, you oftentimes don't get a positive test until the virus has built up to a considerable degree. so there is a real question that i think a lot of people have as to whether the president and first lady in fact had the virus when they

have insisted there be discussions between the biden campaign and the commission and his campaign to see if they could arrive at a solution. let me look at the bigger problem. the debate commission which often acts in an impeerous fashion. we dealt with them in 2004. a sitting president with an international meeting on one of the days they picked to be a debate day and refused -- long in advance of their decision what days would be debate days, we had an international meeting and had to move an international meeting because the debate commission said take it or leave it we'll use this date. we don't care if you have a long scheduled international meeting. you have to be here and do the debate. the decision that they made unilaterally to cancel the in-person debate because of concerns about whether or not the president would be shedding virus in the meeting. they should have sat down with the white house doctors and said when will you be able to affirm to us that he does not represent a daingner that respect? instead they made a decision

if he says that he didn't send an text message to anthony scaramucci i would believe steve scully. we need to hear from him. the debate commission is shredding its reputation by doing things like -- look, they were so tone deaf. they don't seem to understand what america has been seeing for five or six months is that joe biden was in his basement and apparently with a teleprompter so people could pop up talking points while he was being questioned by local news people. they could pop up talking points appearing on a teleprompter in front of the tv screen so he had assistance in answering questions. and what kind of guarantee do we have that wasn't going to happen in a presidential debate that one guy would be relying upon technical tricks to help him keep up with things and the other guy would not be reliant upon a teleprompter? they have to have steve scully come out and say what happened and then i think the american people have better credibility and believe in it.

water again. so this is such a terrible situation. any day you have a hurricane bearing down on the coastline is terrible. to have this coming within 20 miles of where a cat 4 hit just weeks ago is devastating. there is the forecast radar. the good news if there is any, it will move quickly once it makes landfall and move across the mississippi and tennessee river valley on the weekend. flash flooding will be a big concern for parts of louisiana, texas, into mississippi, up towards arkansas. we have that greatest flash flood risk for southeast texas, southwestern louisiana and again the threat for tornadoes as well. weak tornadoes that could cause more structural damage. a lot of these homes are already damaged from six weeks ago. it is not going to take much to add a terrible situation to an already devastating area. sea surface temperatures warm enough to keep it together for

president trump out of office right now. this is not impeachment 2.0. here is how the 25th amendment works. if the vice president and a majority of the cabinet determine that a presidents is unfit for office he can be sidelined. what this legislation would do is introduce a congressional commission. the vice president, the cabinet and then this special commission. you would have to have two of the three to remove the president of the united states. here is the speaker of the house nancy pelosi. >> this is not about president trump. he will face a judgment of the voters. but he shows the need for us to create a process for future presidents. >> the reason pelosi wants congress to inject itself into the process is a president can fire the cabinet which can vote to remove the president or a vice president may be unwilling to undercut the president. but section 4 of the 25th amendment said congress may by law establish a process to
