at headquarters, staffers do not seem eager to revive that second debate that president trump doesn't want to do if it's virtual. >> clearly doesn't want to have to face voters, he doesn't want to answer questions about his handling of covid or the economy so he's trying to rewrite the rules. we're not going to allow that. we agreed to three debates. joe biden is eager to talk to voters. >> the head of the commission for presidential debates which decided to force the second dewait into a virtual format told brian kilmeade today that camera men and lighting people were very unset. they're concerned about their family's health since they could have been exposed to covid-19. the president might pass on virtual debates. he said that virtual rallies are a-okay. he ran one with rush limbaugh that ran two hours from here. biden will go in for a drive-in

to the white house. thanks for your time. i was listening to the president a moment ago. he sounded good. give us the state of his health at this hour. >> yeah, absolutely. thanks for having me on, bill. the president is doing great. your viewers know, he conducted a nearly two-hour interview with rush limbaugh answering tough questions for the millions listening. he's feeling great. he's eager to get back out on the road safely once he's cleared by doctors. i mean, i can't think of a starter contrast of two candidates that even while sick with covid, the president has boundless energy and taking questions and being as transparent as possible. the fact that we don't have basic answers on policy from the joe biden campaign. >> bill: talk about transparency. will you tell the american people about positive and negative testing? >> we're being forward-looking. we'll give an update when the

president tests negative and cleared by his presidential team to go back out and interact with constituents. for medical reasons, we're not revealing specifics of his medical treatment prior. we'll let the public know when he's been cleared. >> bill: i'm not a doctor. is he negative now, can you say? >> i don't have that information. i'll get you an update when i do. >> bill: is it possible or not? >> he's close to the period that he could be done shutting virus. he has high energy, he's going, mentally sharp. he has more energy than i do and i'm significantly younger than he is. he's doing great. whether he's still shedding virus is a question to the doctors. >> bill: will he have a rally this weekend? >> no updates at this time. what i can tell you is the american people will be continue to be hearing from him. whether it's through earned media like his phone interview with rush limbaugh. he's sitting down with one of

your fox correspondents shortly. he will be answering questions and visible to the public. >> bill: so pennsylvania and florida on saturday is -- that's not confirmed now then. >> nothing is confirmed at this time. >> bill: what about the concern the campaign has for the possibility of only getting back on stage one time before the american people vote? >> well, just speaking from the white house perspective, we think it's incredibly important that we draw out the true policies distinction between what this president has accomplished in four years and what his opponent has failed to accomplish in 47 years. the best way to do that is to have both of them live on stage together. it's not the same. you know this, to do a zoom interview where you can pass notes be i staff, read off of the script. it is what the the american people and our democratic republic deserve, to have them both on stage answering tough questions. >> bill: joe biden will be on stage thursday. he's going to do a town hall on abc. is there a possibility of counter programming that same

night? >> i think you can anticipate counter programming. >> bill: more than a rally? >> nothing to announce at this time. >> bill: thanks, alissa. appreciate it. we have breaking news on this big storm. hurricane delta buries down on the louisiana southwest coast. could have life threatening storm surge. an area still recovering from hurricane laura. it whipped up buildings and flooded roads. people getting ready for what could be another round of destruction. phil keating is on the ground there in jennings, louisiana. a city in the cross hairs. how does it look now, phil? >> it's been heavy rain the last couple hours. it's been raining all day. really picked up. you can see down the streets the wind blowing all the rain around. you know, a lot of the businesses here in downtown, which is a ghost town, mandatory evacuation in effort for

jefferson davis parrish. they've boarded up. a lot of damage in this town from six weeks ago from hurricane laura, which was a category four. that really raised lake charles. the federal and state government says they are prepared. fema released these photos today. a couple of things on standby. big convoys of 18 wheelers as well as a bunch of boats. in total, they have 1.6 million meals ready to eat, ready to distribute. they also have 1.5 million liters of water available to distribute as well as 40,000 of those big blue tarps to cover a roof when it gets ripped off. a bunch of high profile vehicles. 115 of them so that, you know,

they can get through flood waters. that is what is expected right now. it's going to be a lot of heavy wind increasing by the hour tonight, hurricane force. a huge age that will be tropical force winds. remember, even though hurricane delta is now 110 miles an hour from the peak of 120 miles an hour to now technically it's a category two. well, that's one mile an hour shy of being a category three. this is the kind of storm that will and can cause extensive damage. a lot of people evacuated this town. so if you didn't evacuate by now because the wind and rain has been steadily increasing all day, basically hunkering down at your house. that's the latest. everybody is waiting. >> bill: a remarkable thing. three storms in the same spot in six weeks.

strip the president of powers if they're not fit to serve. andy mccarthy, you wrote a piece today. speaker pelosi revs up the 25th amendment. the president is covid positive. we believe as we speak now he's still positive. we have not been told he's negative just yet. is this move necessary today, andy? >> it was unnecessary, bill and i think it was really unwise. because i think it was done for political purposes. legally it's a nonstarter because the president has an illness. he doesn't have a disability in the sense of the 25th amendment, which is narrowly tailored for medical incapacity of the kind that woodrow wilson had in 1919 when he suffered a stroke. that's what this is addressed to. so the situation doesn't apply.

no chance of enacting what he's talking about. you would need the vice president committee to join. the senate would entertain the legislation. the president would never sign it. it doesn't apply to this situation. >> bill: so why do you do it today, andy? >> i think what she wanted to do is take a jab at president trump. you know, underscore -- she's been very loud about his, as she has it, his recklessness and irresponsibility. i think the foolishness here is she didn't do this for four years and now she jumps in at a point that arguably joe biden is favored to win the presidency. the way it's now being spun and i don't think she anticipated this is that she's laying the ground work to remove biden so that kamala harris could become president. i don't think that was her intention but that's the way the

narrative bounces. >> bill: another topic here. bill barr says the durham report wouldn't be out before the election. does that surprise you, andy? >> that's the reporting from axios, bill. doesn't surprise me because i really have thought all along that if they weren't able to get something out by the latest mid summer, that this starts to look political. i think they put in a lot of hard work on this. they don't want it to be dismissed as a political stunt rather than a good faith investigation. >> bill: does the -- andy, does the law take this long to work? >> it can in a very complicated case, bill, particularly where there's no obvious crime. i think durham got unlucky. when covid hit, the grand jury shut down. you couldn't travel to see witnesses. interviewing a witnesses if you're a prosecutor you can't do over zoom. you have to get in the room,

the hour headlines. the world continues to grapple with covid. new cases in a single day since august. johns hopkins university reported 56,000 testing positive yesterday and the total deaths reach 213,000. in spain, there's a state of emergency in madrid. the order lasts about two weeks. madrid is one of europe's coronavirus hotspots at the moment. the lights will stay dark on broadway until at least may of 2021. the broadway league said they're suspending ticket sales and performances till may. more questions today about widespread mail-in voting after 50,000 voters in ohio received incorrect ballots in the mail congress the franklin county elections board. that is columbus now. franklin county, ohio. a key battleground state.

a lot of votes there. officials say new ballots will now go out. the president tweeting about it calling it a rigged election. want to bring in chris wallace. he moderated debate number one. good afternoon to you. these stories pop up every day in a different part of the country. what are we to make as we follow this ping-pong and this bouncing ball on? new ballots and bad bottle lots in various states. >> well, look, obviously the system is going to be stressed. there were about 33 million mail-in votes, absentee and mail-in votes in the 2016 election. we'll get double that. 60 to 70 million. the only thing i say about this particular case, they found it and they fixed it. so you know -- it's like king -- i remember as a kid reading ant

hacked in both of those years. i don't know, was it a hack? are they direct messages? was it filed incorrectly? what do you believe the state of the play right now for the debate commission that is on some level fighting for credibility? >> well, all i know is what i'm told. i can't go in and -- i'm not even on twitter. so i don't even fully understand it. i have the say, one more good reason not to be on twitter, what happened today. steve skully is an honorable man, a fair reporter. he says and the commission says that he was hacked, that -- by hacked, i don't mean like john podesta where he was hacked and they dredged out e-mails that he sent. skully says he never sent this e-mail. somebody else using his

accounting getting into his account sent it for him or sent it using his name. and until it's contradicted, i'm going to believe steve skully. he has a very good reputation in this business. i find it hard to believe that he would be lying about this. in addition to which, i should say, skully in addition says he has no relationship with scarramuci. >> bill: did you see the clip with peter doocy earlier? he was asking about the second debate. joe biden said he doesn't think it will happen. clearly it's not going to happen right now. there still could be a third debate. move the second debate, whether you can get this in the next three weeks. how do you believe it playing out? bowden is doing a town hall on abc. we thought we would be watching the two men in miami on the same

night. >> well, i think the debate on the 15th is dead. and there's not going to be a debate on the 29th. we're talking five days before an election. there's not a chance in the world the biden camp will agree to that. the biden camp has been straightforward in this whole thing. they said there's three debates that were set forward for the president and he to be together. mine on september 29th, the 15th and the 22nd. the president made a big mistake when he pulled out of the second debate when it was made a virtual debate. you know, the man that wrote the art of the deal should understand, you can only negotiate when you have leverage. he has no leverage because he's behind in the polls right now. yes, i understand why he would prefer an in-person debate but a virtual debate is better than no debate. that's what he's going to end up

with on the 15th. there probably will be one more on the 22nd as the commission said. >> bill: and more than 20 million americans watched wednesday's debate and more people were getting more about the bernie-biden agenda for the first time. what she's going after there, whether or not mike pence fired a few shots at kamala harris and the agenda. how did you see this debate while you watched from the comfort of your home this time around? >> yes. well, the studio. yes. i thought pence did a good job. that's one of the other problems with the president so narrowly on thursday morning pulling out of the debate. a lot of republicans that would have been happy to have the story line of what mike pence did thursday night play out a few days. questions about the -- what they call radical left wing agenda of the biden-harris team.

the question that harris refused to answer as biden has refused to answer about whether or not they would pack the court. those are all good questions. >> bill: still are questions. >> and would normally have come out of that debate. they didn't because of the fact that the president said he was president going to hold his debate if it was virtual. >> bill: the thing about the supreme court question, it's not been answered yet. you know from your own experience, chris, the longer you go without answering the question, the bigger the story it becomes. this is a story about the biden campaign. would you not agree? >> absolutely. and i don't think -- what do we have? a little more than three weeks. 25 days until the election. i don't think that biden and harris are going to hold on. look at the answer that biden gave yesterday. he said if i give you my answer, it's going to be the headline. so what is it he's going to say?

have been cast as of october 8. in 2016, there were 57 million cast. many people expected this number to go way up. could be 80 million or plus. it's anybody's guess. early voting right now is a real thing. i show you the general election here. give you one state right now where we see this becoming prominent. you go to -- let's take the state of wisconsin from 2016. you know how close this race was. the president winning it less than a point. hillary clinton and donald trump, 1.7 million votes cast four years ago. here's the advanced vote in the state of wisconsin to date as of october 9. ballots requested 2.5 million. ballots rounds, 614,000. early voting doesn't start for another week or so in wisconsin. you're at 10% of the total
