he doesn't have a plan to confront the virus. i asked juan to define it and he couldn't. >> you said the biden plan is the same as the president's plan. it's not -- biden wants a national plan. >> what does that mean? >> he wants to have a national plan. >> what does that mean, juan? >> trump wants to leave it up to the states. jesse: everything biden says he would do, trump already did. if he drops the death toll on you, we can play that nasty game all day. the cdc says over 200,000 americans overdosed on opioids during obama. and veterans died waiting in line in va hospitals.

the obama-biden va handled out to. fauci told americans the virus was low risk and to go about their lives. fauci and trump on the same page. they didn't want to panic the people. when biden says trump blew it on the virus. throw fauci back in his face. fauci said the president did an excellent job. biden talks about no social distancing. but when democrats flooded the streets all summer rioting and fighting police, biden didn't care. he backed the mob. biden is moaning about the president not wearing a mask.

but he just wears his as a prop. look at him talking to people close up. no mask. here is governor cuomo. no mask. here is dianne feinstein. no mask. there is pelosi in the beauty salon. here is cnn reporter kaitlan collins who is always mask shaming people. watch her rip the mask off when she thinks the cameras are off. biden wanted to keep the economy locked down longer. schools and sports locked down longer. biden would have killed this country. biden is for lockdowns, not opening up. for the economy, this is easy. in just three years under trump-pence, families got about an $8,000 raise. not even close to obama-biden.

the middle class boom for everybody. whites, blacks, hispanics. the poverty rate went down. trump. those are the straight facts. and today's recovery is the fastest in record. we got back half the jobs we lost in just six months. obama-biden had the slowest recovery since the great depression. biden will kill the recovery with lockdowns and regulations. you can't trust a word biden says on healthcare. >> if you like your healthcare plan and your employer-based plan, you can keep it. if you have private insurance, you can keep it. >> he lied about it. obamacare was a disaster. bernie sanders would be in charge of healthcare in the senate if the democrats win. bernie thinks castro did a great

follow in the last two elections show trump carrying arizona by 5 points. it shows shim carrying ohio. i think things are moving in the right direction. there are two ways to look at this. back when the chinese virus first showed up, the estimates were we could lose over 2 million americans. the president took decisive action and you could argue he saved 2 million american lives. who was on the other side? biden, pelosi, harris, cuomo, deblasio. the liberal democrats thought this was a joke. you can say donald trump is responsible for 200,000 dead or you could say he saved 2 million americans who alive today because he took action.

the first time this campaign, the news media is going after biden because he won't say whether he's going to pack the supreme court. and he has a problem. 2/3 of the country is opposed to it. but 1 1 -- but 1/3 is his base. the news media is pressing him and i don't think he handles that pressure very well. >> jesse: it looks awkward when harris was debating mike pence. she danced air, she played the race car, and lied about honest abe. i want to talk about what you said at the top. >> honest abe was not the same

as honest kamala. jesse: that has quite a ring to it. 2016 after the first debate, the polls didn't start to close, i thought trump did well, then you have "access hollywood," you see october polls, he's down 13 points. the rnc running for the hills. it's similar to where it's lining up today. he does get sick which takes him off the campaign trail. you get suppression polls. saying trump is down in texas and georgia. that makes senate republicans nervous. people are starting to bail. but when you look at the enthusiasm. on the trump side and the

registration numbers, and the economic numbers, there is a survey out that says the majority of americans believe they are better off today than they were four years ago. this is lining up for again, you have florida, north carolina, ohio and arizona in the republican camp. then you just have to pick off one of the four rust belts and you are over 270. >> 56% of the american people according to gallup think they are better off than they were four years ago. that's 11 points higher than obama had in 2012 when he got re-elected. here is the second number i think people underestimate. 55% of the american people think joe biden has cognitive

difficulties. 55%. how likely is it when they get down to voting that they will make a commander-in-chief of somebody they think couldn't stay awake for the whole meeting with xi jinping. jesse: not only did mike pence take her apart on policy. but she did herself damage about it antics, the facial expressions. it was not a mature presentation. she wasn't likeable. you combine them with them not answering basic questions about what they are going to do with the court. i don't see this going in a good direction on the issues. >> i thought pence was as good

a senate to act as the body to slow things down so we took time to analyze the situation. that's why it's tough to get things done in the senate. the reason they want to get rid of the filibuster is not because they think we ought to do more. they are going to go for it all the. you talk to people on the left. they argue the biggest mistake obama made was not going for all of it. single payer and cap and trade. they are going to do that this time. guarantee it. jesse: once you get the socialist hooks in, they never come out. you do amnesty and go after guns, that will change this country office -- forever. here is nancy pelosi. i think this is a big distraction. she is going to say we are going to pull the 25th amendment.

>> i think the public needs to know the health condition of the president. there is one question they refuse to answer. when was -- before he got the virus and admitted to it, when was his last negative test? when was his last negative test? to make a judgment about the actions that were taken after that. we'll be talking about the 25th amendment. but not to take attention away from the subject we have now. jesse: this looks like another coup attempt. does nancy pelosi annoy you with this stuff, senator? >> it's a cheap political trick and you see it for what it is. the issue of when did he last test negative, that the

executive branch function. it's none of her business. just like if someone got infected in the senate, the president couldn't say when was the last person tests. that would be the legislative branch take over and tell the executive branch to to do. it's done because at the end of the day, we are going to find out soon enough. the vie us where goes away or it doesn't. by monday or tuesday of next week it will be obvious where that's at. these are stunts. the sad part is they get away with it because much of the media eggs them on. jesse: a least suppression polls saying trump is down by 15 points. i'm look at two battleground

polls. suffolk university, "usa today" has a tie in florida. another poll has trump up 3 in florida. i think florida is a pretty comfortable state for the president. >> andrew gilham was up 17 points and obviously he's not the governor of florida. >> a lot of people got it wrong. if you look at the fundamentals where there is registration enthusiasm on the ground. i expect him to win florida. but we can't just win it with florida, we have to win it with pennsylvania and ohio. i can say it with this election and 2016 and 2012. i think it will be close. but i think the president will win in the end. nobody is going to win by 5

donald trump by stirring up a scandal, claiming interference by the russian security service. another memo says clinton's plan was meant as a way to quote distracting the public from her use of a private email server. joining me now, former congressman and fox news contributor and fox news legal analyst gregg jarrett. do you think hillary is in legal trouble if this turns out to be true? >> she could be. depending on whether she actually approved a plan that included feeding it too the fbi and department of justice which in the end is what happened. it's a crime for anybody to furnish any federal law enforcement agency, fbi, department of justice, with knowingly false information. it's fraud upon the government.

there is an agreement involving more than one individual, that's conspiracy to defraud the government, not to mention false statements to the government which is 18usc10001. much depends on the evidence. it's in two locations in the redacted parts of brennan's notes. and also other government documents that president trump is demanding that the intelligence community, the fbi, the department of justice declassify and make public. jesse: we heard from the president. he's intent on getting everything declassified. hillary's emails may be declassified by pompeo before

the election. it feels like 2016 all over again. where do we go from here? >> donald trump should be winning award for his openness and transparency. you have never seen a president open up the coffers like that and demonstrate what's going on. but hillary clinton is this magnet. she create all these problems for herself. but it's not just her, it's the democratic machine. they go to such great lengths to give it credibility then go out on the national media and repeat it. for the former cia director to go behind closed doors to congressional interviews an andy i haven't seen any evidence. but they go out and give interviews saying it's just a matter of time.

the questions were. they were not happy he went over his time. but they thought he was vice presidential. they thought he got to the point. they thought he was measured in his presentation. for her they were annoyed she did not answer the question about the supreme court. in fact that's an issue that is still has never been cleared up. what will the democrats do in terms of packing the court? they alouded the vice president fopresident -- they applauded te vice president for pressing for an answer. jesse: real quick, any advice from president trump when he meets joe biden? we don't know when that next debate will be. how do you think he should present his case next time. >> first he needs to show up to
