years of our judicial standards and he's saying i'll tell you after the election. this is egregious that this candidate is getting away with this. todd: mcdaniel will talk more about the major issues when she joins "fox & friends" in the 7:00 a.m. hour. police declared a riot in protester as protesters topple statues and smash windows, monuments pulled to the ground, their bases vandalized with spray paint. the rioters smashed windows of several buildings including the oregon historical society. unclear if police made any arrests. to los angeles, police made several arrests as celebrations for the lakers championship get out of control, a s.w.a.t. team was called in as protesters looted outside the staples center, ruining an otherwise memorable night. >> this historic 2020 nba championship belongs to the los

personal life of amy coney barrett. they're going to emphasize the importance and respect to the united states constitution. they're going to talk about the excellence of donald trump's judicial appointees with a highlight of amy coney barrett. she's a former justice scalia clerk. she is a law professor. she's a mother of seven. very well respected person, not only as a judge, and as a legal scholar, but also as a person. in contrast, i think when you look at the democrats, they're going to use this hearing, this week, as an opportunity to try to score further political points against president trump and his agenda with an emphasis on highlighting senator kamala harris and his views on healthcare. so basically you're going to see a lot of discussion about healthcare in this confirmation hearing because the democrats think that talking about healthcare and the supposed risk to it from the appointment of amy coney barrett to the supreme court, you're going to see a lot

of political points trying to be scored on the healthcare issue for suburban women by the democrats and you'll see dueling narratives throughout the week. todd: let's look at procedure. are you worried that the democrats will pull procedural shenanigans over the course of the next week? >> i don't think they're going to go after procedural shenanigans. i think what they're going to focus on is they're going to use this opportunity to talk politics and the reason why they're going to do this is i think they have concluded that they really don't have any sort of magic wand they can pull out of the back pocket on procedure or anything like that. they don't have the votes. the republicans have the votes. the republicans are motivated to allow president trump to have this third tremendous victory by virtue of putting a third supreme court justice on the supreme court in one term which is an extraordinary accomplishment by this president. and i think that the republicans know this and want to use this to their advantage. so the democrats think frankly

they're not going to be able to stop it so the question is what do they do and they're going to try to score political points along the way, as best they can, to help them with the election because they're not going to be able to stop amy coney barrett from getting on the supreme court, in my opinion. todd: one of the points trying to be made is by senator chuck schumer calling on amy coney barrett to recuse herself from the affordable care act and election related cases. let's take a listen to chuck schumer talking about that. >> given judge barrett's conflicts of interest, she should recuse herself from any decision involving the affordable care act and any decision related to the election that we will have on november third. todd: mark, does schumer's standard as to what rises to a real, legitimate conflict of interest make any sense to you? >> no, it doesn't, todd. and i think this illustrates the point -- what chuck schumer is trying to do with talking about amy coney barrett, potentially

having to recuse herself in healthcare cases including the affordable care act is doing exactly what i said earlier, which is about talking the politics of the policy and not her status as a judge. bear in mind that ruth bader ginsburg took many positions before she became a supreme court justice on women's rights, constitutional rights that applied to disenfranchised groups. that would be like saying since she took public positions and advocated particular views that she wouldn't be allowed to sit on cases involving women's rights. that's an absurd standard. the reason he's talking about the possibility of amy coney barrett recusing from cases about the affordable care act is about to score political points and not trying to discredit amy coney barrett herself. todd: joe biden, this line from the weekend, voters don't deserve to know his answer on whether he would pack the supreme court, is that another biden of gaffe or is there something deeper there?

>> i actually think that joe biden, turning to the american people, saying that you have no right to know where i stand on a critical issue involving the fundamental structure of the american constitution may be the 2020 version of the deplorables comment. he's basically saying you don't deserve to know, you have no right to know where i stand on this critical issue. the question is, what is he hiding? is he so radical he doesn't want to tell the american public before the vote or is he scared he will offend the radicals which shows another side to him to the american public. the bottom line, the electorate deserves to know where he stands on this political issue. the fact that he refuses to tell us is telling about what kind of a person and president joe biden would be. todd: it's going to be quite a week. thanks for teeing it up for us. president trump returning to the campaign trail today after his physician says he is no longer at risk of spreading covid-19 but dr. jeanette nesheiwat says

todd: president trump headed back on the campaign trail today after announcing he has tested negative for covid-19. >> i've been tested, totally negative. i'm ready to go. i feel so good. i feel so incredible. i can't say i would have said that to you five days ago. but 100%. todd: so what does this mean for the president's health? fox news medical contributor dr. jeanette nesheiwat joins me now. doctor, there's a lot of noise this weekend from everybody on the president's condition. help us cut through it. first, is he contagious? >> good morning, todd.

no, he is no longer contagious, according to his doctors at the white house. they tested his viral genomic material and it's found to be not replicating, meaning he's not contagious. he has no symptoms, no fever, no cough. he tested negative yesterday, late last night he told supporters that he tested negative. this is good news. he's having no symptoms and it's been at least 10 days since his diagnosis. so this is why he is now cleared, todd, to go back out on the campaign trail. todd: so to follow up to that, i think we know the answer to this based upon your first answer, the president's got of lot of campaign events this week. we're going to show them on the screen right you now. is there a risk of the president getting anyone sick in any of these locations? >> according to the data that we have and according to cdc protocols, no, because he tested negative, it's been at least 10 o10days, so the risk of transmission is extremely low,

probably unlikely. but what i always like to tell my patients, todd, is take it easy. don't overdo it. because remember, there potentially could be long-term lingering effects of coronavirus that we don't fully understand that we don't have all the information yet. we're still learning about it. sometimes we see neurological complications, sometimes we see cardiac, heart mri cases. we -- complications. we want to take it easy, take precautions, don't overdo it and continue to practice safety preventative measures. todd: now i can stop asking questions like i was rapid fire. we'll be more relaxed on this one. w.h.o. official there urging world leaders to stop using lockdown as primary virus control methods. this is a biggie. take a listen. >> we in the world health organization do not advocate lockdown as a primary means of

controlling the virus. the only reason is to reorganize, regroup. by and large, we would rather not do it. todd: this is a seed change. how significant is this? >> this is actually really good news and i'm very happy to hear this coming out of the world health organization. we do not want to use a blanket lockdown, shutdown, whenever we have an outbreak. instead, let's focus on practicing social distancing, physical distancing, wearing a mask, hand washing, avoiding large crowds and tight social gatherings. this is how you can pick up the virus, highly contagious, jumps from one person to another and it's important to make sure since we're entering the fall and winter seasons to make sure you get your flu shot. so very reassuring, important information. i agree with the world health organization. we should not just jump straight to a lockdown because the economic impact can actually have a significant medical impact on patients as far as anxiety and depression, loss of

todd: in just a few hours, confirmation hearings will kick off for president trump's supreme court nominee, amy coney barrett. she is expected to praise the late justice scalia in her opening statements and clarify that the court should not make policy. david spunt has a preview of what to expect. >> reporter: a busy week ahead, republicans in the senate want to transform judge amy coney barrett into justice amy coney barrett as soon as possible. if confirmed, she would be the fifth woman to sit on the high court. president trump wants to get this confirmation through as soon as possible. several important topics to be discussed. some of those, abortion, gun rights, immigration and healthcare. democrats are expected to focus heavily on healthcare during

barrett's hearing. her views of the affordable care act well-known. she is no fan. and that worries democrats who are concerned that republicans want to get rid of the aca in the middle of a pandemic. listen. >> when i spoke with a constituent in delaware last week, someone with a pre-existing condition, she said i thought this was settled. i thought years ago that the supreme court upheld the affordable care act. i said that's right. >> reporter: republicans argue that the president has every right to appoint a supreme court justice while he's serving as the president. >> when she puts on her black robe in the morning, she knows what it is to be a judge and that is to cloak your personal preferences. our judges don't wear red or blue jerseys. they don't advocate for policy position. >> reporter: fox news obtained barrett's opening statement. quote, when i write an opinion resolving a case i read every word from the perspective of the losing party. i ask myself how would i view the decision if one of my children was the party i was

ruling against. even though i would not like the result but i understand the decision was fairly reasoned and grounded in the law. and to top it all off, just one week after the election, the supreme court justices presumably with barrett on the bench are set to hear arguments about the merits of the affordable care act. at the supreme court, david spunt, fox news. todd: david, thanks. florida governor ron de santis says the biden campaign'sy fuseal to answer on court packing should tell voters exactly where the democratic tickeparticular stands on that . >> the constitution doesn't set the number of justices at nine. it can be changed by statute. i think the question is, would it be legitimate to do it in the eyes of the public, simply to pack it with left wing activists. any time the court's numbers changed early in the he republic it wasn't to try to create more spaces for ideologes. if they weren't going to go in

that direction, wouldn't biden and harris say we don't support that. it's not popular with the public. the fact they won't say that tells me that's what they want to do. todd: president franklin roosevelt was the last president to make a push to adjust is thes to the supreme court, but that failed. police identified a private security guard accused of killing a man in denver. he was hired to protect a local television station. he was not licensed to be a security guard in the city. the victim is being identified as a pro police veteran. michigan governor gretchen whitmer says gop leadership is to blame for the foiled plot to kidnap her. >> i do believe that there are still serious threats that groups like this group, these domestic terrorists, are finding comfort and support in the rhetoric coming out of republican leadership in the white house, our state house, so

i remain concerned about safety and integrity going up to this election. todd: 13 men are behind bars and charged in the alleged plot to kidnap whitmer. the washington post naming pennsylvania as the tipping point battleground for joe biden anand for president trump. which president has the keystone state support? joining me now is congressman fred geller. it was a fascinating article, confirmed a lot of what so many people are saying this election season. but with that, what should the people of pennsylvania believe from joe biden when it comes to fracking? >> well, it's hard to tell where the former vice is because he's really pandering. he tells one group one thing, another group another thing, depending on his location. he needs to stop saying i'm from scranton. we care about more than your

hometown. we care about what you're going to do to help us with our jobs and education, the things that matter to us. it's disingenuous that he's paps pandering. and we need straight answers. maybe he should debate himself so he knows where he stands on the issues. todd: congressman, are you worried that all the points that you just raised which are valid points are not getting through to the voter of pennsylvania, based upon recent polls that we're going to pop up on the screen that quite frankly show biden with 5 point lead. >> well, the thing i think about the people of pennsylvania, they're very hard working, very thoughtful, intelligent people. they can see through this. i would say the poll that matters is the one we take on november 3rd and that's the poll that's going to show that president trump is going to be reelected for another four years. todd: meantime, congressman, a federal judge tossing a trump lawsuit to block ballot drop

boxes in pennsylvania. here's the president on the general topic of ballot fraud. take a listen. >> we've been winning a lot of cases, where they don't even want the election to be determined on november 3rd. they want the election to be determined two weeks after the vote comes in. they're trying to steal the election and we're watching it very closely and the people are watching. todd: congressman, this is unlike anything i've seen in my life. i remember growing up we had the election day bake sale in your school, parents would go, everybody would go to the local school, they would vote, buy baked goods and by the end of the night you would have a result. it doesn't look like that will happen this year. what does that mean for our democracy, quite frankly? >> well, it is election day for a reason. and they're trying to change the rules. our governor, democrat governor tom wolfe, our supreme court are trying to do these things weeks before an election is going to take place. in pennsylvania we've done

absentee balloting and voting for a long time, have known how to do it and all of a sudden you've got people -- that goes back to your question about the president, i think if they weren't certain they wouldn't try to do these things right before an election. we need to look at these things. we found ballots in a -- we found ballots that were found in the trash. i think pennsylvanians will show up on election day and make sure wee reelect the president. todd: all eyes are on the senate confirmation hearings beginning in a few hours for judge amy coney barrett. democrats vowing to harp on healthcare. it's interesting, the horse race that we've seen. it was all about religion specifically judge barrett's religion, then it went to you abortion, now it seems healthcare is in the lead. at the end of this week which topic do you think is going to be they number one headline maker from the hearings? >> the democrats are going to do the thing they always do, they

try to take a poll and see what the most important thing is and they're going to hammer on that. it's hard to figure out what their motive is going to be this week. they're going to hit on all of the above. they're going to try the affordable care act and what they really mean is hard to tell. i think at the end of the day the headline will be the president nominated a qualified woman to be on the supreme court and i think she'll do a great job and look at her experience and what she's done as a judge is what will come through. that's what we want. we're not after a judge that's going to set policy, we're after a judge that's going to interpret the law as it was intended to be interpreted. todd: congressman, dealing with a state divided after yesterday's steelers, eagles game. congressman, we appreciate it. thanks so much. now to some extreme weather. hurricane delta being blamed for at least three deaths in louisiana. an 86-year-old man died from a fire from his generator.

todd: iran backed militia groups agreeing to a cease fire against u.s. forces in iraq but there's a catch. trey yingst live for us in jerusalem with the conditions the groups are demanding. trey, good morning. >> reporter: todd, good morning. a number of iranian backed militias inside iraq announced a cease fire against u.s. targets, now this pause in attacks does come with a contingency plan and that is the iraqi government will release a timeline for u.s. troop withdrawal. america has thousands of troops assisting in stabilization efforts and a continued fight against what is left of isis. a spokesperson for arraignan backed militia group says if it doesn't withdraw they will resume military activities with all the capacities available to them. they are responsible for various rocket attacks on the u.s. embassy in baghdad over the past year.

the group is responsible in part for the storming of the u.s. embassy in january that led president trump to target qassem soleimani in a drone strike. if the cease fire holds it could mean americans will maintain the u.s. embassy in baghdad. there was talk of pulling out u.s. diplomats over concerns over future rocket attacks. todd: president trump hoping to strike a last minute nuclear arms deal with russian president vladimir putin. the two have spoken several times over the past six months, focused on tweaking a deal on limits of nuclear stockpiles. michigan governor gretchen whitmer promising not to rush election day results. >> michigan will be able to you announce results but we are not going to have artificial deadlines, we're going to get this right. it will be soon after polls close. i not going to put a number on it. todd: early voting now underway

in that state. governor whitmer is encouraging people to vote early, saying it is more likely their vote will get counted by november 3rd. some big name democrats could be on joe bidens' short list for attorney general if he wins the 2020 election. new york governor andrew cuomo, former acting ag sally yates and former georgia candidate stacy abrams could be considered. cuomo who served as new york's attorney general is reportedly early favorite. his office says he has not been contacted about that role. did you see this? a u.s. navy veteran and republican congressional candidate taking aim at maxine waters' luxurious los angeles living in a new campaign ad. watch. >> do you know where i am right now? maxine waters' $6 million mansion. you know where i'm not right now? maxine waters' district. todd: collins blasting his opponent for increased crime and poverty in the district waters has represented for 44 years.

todd: take a look at this. bottles and other items thrown at officers during a protest in wisconsin. officers now warning protesters not to escalate the situation. former tucson police officer brandon tatum joins me to react. we talked to you all summer long about violence and unrest in big cities. but this is unrest in a pretty quiet suburban community. are officials there handling this the proper way? >> well, i think that when you have leaders that have come out and said look, enough is enough, we're going to protect our officers, we're going to protect the community at all costs, i think that's when i would consider them handling it the right way. i think they had the proper rhetoric, they displayed video of what the protesters are doing which justifies use of force against them. i think they're doing the right thing. we live in america. we live in a country of law and order. if they want to act like kids,

we have to give them a spanking. that's how it works. i appreciate when officers stand up, leaders stand up and take appropriate action against rioters and people breaking the law. todd: is there anything you would do different there? >> no, i think they've shown a reasonable amount of force. i listened to what the chief said. he's clearly articulated exactly what he's going to do as far as warning the people who become unruly gatherers and he's going to use appropriate force. some of the force i saw in videos looked reasonable. people had adequate amount of time to disburse. i think they're doing good. i'm always for a little more force to set as an example but i think they're doing appropriate measures. todd: meantime, president trump hosted a lot of folks for a peaceful protest at the white house this week and you were there. what were the key take-aways from the president's message? >> well, first i want to set the record straight. i think people were out saying there was only 300 people. there was over 2 you thousand

people that -- 2,000 people that joined us in the peaceful march down the streets. we walked past the black lives matter mural and there were 1700 people at the white house hearing from the president. what i hear from the president is hope. i hear that the president cares about all americans ands especially black americans and the president is very courageous in what he's been doing and i think he gives us courage to stand up and do what we need to do, go of to the polls and vote and my whole thing is this. our movement blexit.com, we are not concerned with political parties. we're concerned with what's right for our communities and we believe the president has expressed exactly what we need to make this country great and to keep this country moving according to the constitution. so people that are interested in what we're doing, go to blexit.com if you want to support our movement. todd: but brandon, we have an election in three weeks. is that message that you just beautifully put forward on our screen, is that message getting forward or getting into the

minds of the black voter? >> yeah, i mean, i think god is allowing us to plant seeds in people and i think that it's pushing forward. there's so many people that have woken up, myself, candace owens, which we both founded blexit. we were democrats in 2016. now we have millions people who follow our social media platforms. we speak all around the country. thousands of people are going to the white house. it has grown exponentially and we will see when november 3rd comes if people show up to vote. todd: quick question, because i know you're an arizona guy. does trump win arizona? >> 100%, trump will win arizona. i will do my best to help the president win. we don't want leftist communists and we're not going for it. arizona will be red, mark my word. todd: thanks for letting me turn you into a pollster. we appreciate your time as always. thank you, sir. >> thanks for having me. todd: a navy lieutenant
