discussing her commitment to interpreting the constitution the way it was written i think you can expect her to be relatable to american people as she discusses her family and her large family of nine, and just seeing her and her ability to be not only capable behind the bench but also capable behind the wheel of a honda odyssey i think you can expect to see both of those this week. >> couple of key issues brought up this week include health care, abortion, gun rights, immigration, but for me the cloud hanging over this week's proceedings is going to be how much are they going to be like the kavanaugh hearings specifically with regard to religion. how far do you think expect democrats to push on religion? >> well, i think every time they bring up religion it just demonstrates democrats have really no criticism about her qualifications. i think despite the fact that bringing up religion and asking questions to candidates about their religion is a violation of

article 6 of the constitution we've seen in the dos that over and over again. including ann barrett's hearings when she bill a 7th circuit judge. so we'll have to see how it plays out but we know that judge barrett will come out looking capable as she is. and i don't think that democrats are going to be able to do anything to distract from that. >> as we know judge barrett is resolute in being a textualist here's part of her opening statement it reads courts are not designed to solve every problem or right every wrong in our public life. a policy decision and value judgments of government must be made by the political branches elected by an accountable to the people. >> what about that worries democrats when literally that is what a judge is supposed to do at every single level of being a judge? >> well, i think the main worry is that you know she will commit to the constitution and not

based on any political partisan preference i think at times is something that the democrats have pushed for and advocated for is this legislating from the bench, and judge barrett has proven that she's not willing to do that and she's committed to interpreting the constitution as it is written. she will look at the facts of an individual case and you know evaluate the constitution and see what to do. but she's not interested in applying her personal opinions or what she thinks should happen few be she's interested in doing exactly what law says should happen. >> finally we're about four hours away from anything getting underway there in d.c. on this yet senator chuck schumer called on amy coney barrett to recuse herself from affordable care act case if she's confirmed to the supreme court. now, under schumer's standard of conflict of interest, would ngt every schedule judge that has written an opinion or law review article or anything on any topic need to be recused for basically

unfortunately in areas that were hit hard as we mentioned all last week, from many storms across louisiana including laura which was a category four now remant of this season and now getting in new york heavy rainfall for much of the day today. you can see it from parts of new jersey, all the way up towards new england and that is going to be through the story throughout the day today and then we have another area of low pressure that's coming down from the great lakes going to kind of interact with this. so nasty weather for the northeast not only today but through tuesday as well and they thinks will start to lighten up a little bit but as you can see some of the forecast rainfall several inches especially as you get up towards northern new england. now, on the flipside of this an area that needs the rain is the west. where we still have many wildfires burning. the temperatures are geng to remain warm today especially across southern california.

aggressive if you will, tough senator kamala harris during kavanaugh now she's the vice presidential nominee does she need to temper her comments or will she go full steam ahead? we expect democrats, obviously, to go really after barrett on obama care, the affordable care act, because of the ramifications of the court expected to rule on that after the election. let me step back, though, and date myself todd. i have to tell you, the first job, the very first job i ever had on capitol hill back in the 90s was an intern for the judiciary committee during the justice david souter kifnlings hearings he's now since retired. the chairman at that time was joe biden. to now cover this and watch it come full circle in such an unprecedented period with a pandemic it is really going to be fascinating and i look back at the volumes and volumes as an intern of research and background that we have to
