this but, the president last night at that rally is demanding answers. watch. >> we have just learned through explosive documents published by a very fine newspaper, the "new york post" that joe biden has been blatantly lying about his involvement in his son's corrupt business dealings. [boos] and this is a big smoking gun. griff: let's unpack that according to emails obtained by "the new york post." hunter biden was in communication with the top adviser to the urken firm. to be politically motivated actions. the information was discovered by the owner of a computer repair shop in delaware who claims hunter biden brought his computer in for service back in 2019 but never picked it up. once he found the information on the hard drive, he says he turned it in to the fbi. that owner spoke to reporters yesterday. listen. >> is there any thought in your mind that this might not have been hunter that it might have been somebody trying to set hunter up? >> no. no. griff: the biden campaign pushing back on the post report campaign spokesman andrew bates issuing this statement we have reviewed joe biden's official schedules from the i'm and no meeting, as alleged by the "new york post," ever took place. as mentioned senator ron johnson homeland security committee has that laptop looking at these emails. now social media is doing an about face. as the story broke, facebook and twitter reacted by trying to limit access to the story.

twitter shutting down the post account and blocking access to share the story saying in a statement that it was in line with their policy. as you see here jack dorsey following up with this saying our communication around our actions on the post article was not great and blocking url sharing via tweet or dm with zero context as to why we're blocking, unacceptable. and there is more. the "new york post" just dropping within the hour another article with more alleged emails and data. these pointing to hunter biden seeking a, quote, more lucrative deal with the chinese firm. so here we are, guys, 19 days to go and a big story out of the "new york post" with a lot of questions to be asked. we will find out if anyone asks about it tonight. brian, ainsley, steve? brian: thanks so much, griff. how can george stephanopoulos not ask about this? now, just be prepared, george, if you are watching, although i think he is busy. he starts working next hour. you will get yelled at. because every time you bring up

hunter biden you get yelled at and say there is nothing there now you actually have emails there they haven't said yet these are not hunter's emails. this is not him in the video, which is horrendous, you got problems. and you have to justify it. and you have to justify terms like who's the big guy? it seems as though logic would lead touted vice president who is referenced in these china documents. meanwhile, it's hard to imagine that joe biden could be more definitive in his denials that he knew anything about hunter's overseas dealings. here's a look at when he did get the question how he handled it. >> mr. vice president, how many times have you ever spoken to your son about his overseas business dealings? >> i have never spoken with my son with his overseas business dealings. >> i have never discussed with my son or my brother or anyone else businesses, period. what i will do is the same thing we did in our administration.

deal. so, keep in mind how this took place. the laptop dropped off to a delaware repair shop. the delaware repair shop tries -- the guy is legally blind. he does not know who dropped it to him. but he does know that bo biden's sticker is on the laptop. it got water damage, allegedly, that's the reason. and then when he tried to get someone to pick it up. no one would pick it up. looked at the hard drive while the impeachment was taking place he saw all these disturbing emails and really disturbing video at which time he contacted mike lee's office. he contacted other senator lawmakers' office. got no response. then he ended up getting ahold of rudy giuliani. steve: rudy giuliani gave the "new york post" a copy of the email, et cetera this past sunday. this particular guy who ran the mack shop. you know, because of his visual impairment he said he could not identify whether or not the guy was hunter biden. he said he identified himself as

meeting never happened. others reporting it could have been informal meeting like passing in the hallway or something that's thought on the calendar. this is the cover today of "the new york post." it says sensorred because kayleigh mcenany is a spokesperson for the white house. steve: sidelined right now. ainsley: her account has been locked now because she tweeted out this article that was yesterday, the story yesterday in the "new york post." and they said twitter wrote we have determined this account violated the twitter rules. jack dorsey did say as griff mentioned that this is unacceptable our communications not great blocking it. unacceptable. this is what kayleigh said about it. it's not american. this is called censorship, listen. >> this is not a temporary blockage when i log on to my twitter account it says i'm permanently bland have me at gunpoint unless you release a news story reported by the "new york post" i cannot regain access to my account. this is censorship. not the american way. not how a freedom loving

own mind. steve: okay, so what's going to happen today? she actually will not be in the seat. instead, senators will do some speech aphiing. say why she is appropriate or why she ask not appropriate. plus they will have two panels. one panel people who have known her, worked with her on why she would make a great supreme court justice. and other people who apparently tell personal stories on things like abortion and healthcare issues that the democrats are really foundational to somebody who sits on the supreme court, ainsley. ainsley: each of the senators get 5 minutes each for questioning. the open business meeting starts at 9:00 this morning. and they are bringing the confirmation up for a vote. however, it's expected to be held up until next thursday, which is the 22nd. brian: right. ainsley: okay, brian? brian: they found seven speeches that she did not list that she gave. most of which on roe v. wade. i'm wondering if that is going to be problematic. i will ask jonathan turley that

>> originalists -- clear wording of the constitution establishes a right and you will not acknowledge it. >> well, senator, it would strain the canons of conduct which don't permit me to offer off-the-cuff reaction and as justice ginsburg said it would display disregard for the whole judicial process. brian: our next guest says hay maker. judge amy coney barrett was challenged on originalism. so how did she do? let's ask fox news contributor george washington university law professor. i think we can still call it george washington university. jonathan turley. great to have you on. great to have you back. you said that was a hay maker, her answer. in layman's terms? >> well, she is extremely nimble in these confirmation hearings she was when she was up for the appellate court. you could see the senators were trying to stay a bit out of her reach because they have grappled with her before she is very, very hard to connect with to do serious damage.

and the exchanges between cure bin and barrett were actually the most substantive parts of the hearing. they were very interesting. both did good jobs in raising their views. but she was very successful in pushing back at this and saying that i'm applying the same rule that the democratic senators supported nominees like kagan in invoking. these same questions were asked to kagan and sotomayor. and the democratic senators supported them in not answering them. brian: when they put up the poster board of the families and heart wrenching stories and we mapping they are true about healthcare and families, they weren't really talking to her, were they? they were talking to whom? >> that's the interesting thing is that she was about as relevant as the ficas plant in the hearing room. didn't expect no answers and no answers were given because they could not be given under the canons of judicial ethics. i objected to those pictures

which i thought were highly inappropriate. they made her look like some type of judicial serial killer like these were her victims. they're not. those pictures are based on a wildly misrepresentation of the aca case. the aca case is not likely to resolve in the entire overturning of the affordable care act. it's based on a very narrow and at least indicated in past decisions they believe in severability. so it was really unfair to her but there were many of her cases were being misrepresented and it was hard for her to deal with that but i thought she did a very good job. brian: jonathan, the jenning go case subtly saying listening to it and put it our terms but in legal terms trying to say from what i see the aca would survive. that's a message that republicans should embrace at this point because they have no

healthcare replacement on the recusal. you should recuse yourself when you were younger bush v. gore you fought for bush. should you recuse yourself this election so tight it gets kicked up to the supreme court. what do you think about the recriewfl requests real quick? >> they are utterly absurd. the judicial rules on recusal are meant to deal with issues where you have a personal or financial interest in the case or you were involved in the underlying litigation. none of those apply. it would be facially ridiculous for a nominee to take herself out of a major challenge later just because she was nominated, confirmed before an election. and you wouldn't want that because it's the way -- what the democratic senators were doing was trying to influence the outcome of any case by getting her to remove herself and reduce the court to eight. that by the way could result in a tie, which is not what you

want in a major traumatic moment for this nation. brian: jonathan, finally, i know you were preparing for a segment with me which you find emotionalliality and mentally taxing. could you show me the notes you took to prepare for this interview? misrepresentations and errors. what about the steele dossier? buzzfeed just spread it throughout social media. there was no push back then, and that was just a tissue of lies. so it seems that big tech only censors media companies and stories when they're negative toward the biden campaign. steve: well, you know, after 2016, social media companies took a lot of heat because supposedly they spread information that was not accurate. so, what they are saying here is that this information -- facebook says, you know what? we might put it up essentially after some fact checkers look into it. and twitter said, you know, it was unacceptable the way we didn't explain things. ultimately you say this just reveals their hand. they have been all in on the biden campaign all along. >> yeah, it sure does. and, look, that tells you

something quite disturbing. because these are some of the biggest multinational corporations in the world. and what they are doing amounts to election interference or as senator josh hawley said in his letter yesterday to the fcc it amounts to basically a donation to an inkind donation to the democratic party which may election funding more. i guess somebody has to look into that. i think it just shows, if anything does, the monopoly of the big tech companies needs to be broken up, just like the railways were years ago. steve: that's why the president keeps saying get rid of section 230 because it protects online companies because essentially they are supposed to be neutral platforms not publishers but they're acting like publishers in this case. ultimately, miranda, what it all comes down to with twitter and

facebook blocking your "new york post" story is the fact that it's the story that is damaging. and if you block the pipeline the people aren't going to hear these allegations which you at the "new york post" say are not in question because they clearly come from these email and photographies of hunter biden. >> well, that's right. this isn't a he said, she said sort of story. it's not conjecture. it's not anonymous sources like so much of the "new york times" and "the washington post" stories about russia collusion were. these actual emails. actual documents, photographs which come from hunter biden's laptop which he abandoned at a mac repair shop last year. so, you know, it's very difficult to kind of refute the email that actually shows that hunter biden set up a meeting between his father and one of

the top executives at burisma. the corrupt urken energy company paying as much as $83,000 a month to sit on its board even though he had no discernible talents or skills or knowledge to do it. you know, this just looks like on the fails of it a, you know, an influence, carkin for influence or influence peddling operation by the biden family. now, it's open to vice president biden to candidate biden to come out and tell us about it. but, yesterday, he just hid in his basement. he did not do a press conference. let's see what he does today. steve: in fact, the campaign not disputing the basic facts. they just said it wasn't on his official calendar. but then again why would you put something like that on an official calendar? anyway, if people want to read the story that started all of this. you can't see it on facebook or twitter go to "new york post" doubt come.

your head at the time. >> absolutely. and, you know, i have experienced as a life coach. so i knew that the focus -- i i knew about fitness from my years as a professional athlete and as a trainer. and i needed to sort of get my mind in the right place and concentrate on what i could control. these clearly took over my body. i lost 25 pounds. it tried to take over my mind. taking me to a very dark place. questioning the existence of god and so forth. but the one thing i did not let it break was my spirit. steve: and your spiritual life because you say really this is a story about faith. you were worried about, you know, what's going to happen to you next. you didn't know. who do you talk to? you talked to god. >> absolutely. and i had an army, steve, of guardian angels both living and dead storming heaven's gates for me. i will share one story that's in the book. my workout routine in the hospital consisted of my cardio of a trip to the window and back.

and i needed to rest after that. and i tried to turn the television off they were spewing out the death toll numbers. they were talking about people like me and that's when my mind started to drift. and instead of turning the television off, i pressed the channel up button by mistake and heard the words our father hail mary i opened my eyes little lady on the television i learned later her name was mother angelica and praying the rosary. i believe god sent it her to me that moment giving me that spiritual food that i needed for my soul to attack the next round of exercises. and there were so many prayers. you know, when two or more come together to pray in jesus' name for someone there is power there. the holy spirit is present. and i had an army working for me. and i am so blessed to be here to share this story with the world. steve: dan, when you were released from hospital they said we have never had somebody in here only four days. usually they are here for much

longer period of time. and not always that good outcome why do you think you were able to get out so quickly because you were in great shape, because they gave you therapeutics? what? >> several factors, i spent lifetime as a personal trainer, right? i hut playbook there i knew i needed to work my muscles out. i also had the playbook in regards to getting my mind right. and in the prayer. and they gave me hydroxychloroquine and i was 11 days with fever for 103-degree fever for 11 straight days. and tylenol did not do -- did not help me at all. within 24 hours i took that and my fever broke and it hasn't been back sense. so i'm not a doctor. i'm not a politician. i'm just a father. i'm a husband who desperately wanted to get home to his wife and to his two sons. and there is no doubt that i think that that was a game changer for me. but, faith, focus, fitness, and hydroxychloroquine it's right there in the book. and i hope that this story will

things on trump that was itself illegally obtained. so what we see going on here is a blatant display of favoritism and of hypocrisy among these tech companies. deeply disturbing. brian: so just so you know part of these emails one of the references is on hunter biden talking about this chinese energy firm that says saying 10% for h for the big guy here it is. one email sent to biden on may 139, 2017 with the subject line expectation. guy on including details of remuneration packages for six people involved in unspecified business venture. email outlined a provisional agreement under which 80% of the equity or shares in the company split yale among those people corresponded to the sender with h apparently referring to biden.

and it's stunning that much of the media wants to ignore it. and as you know, not only that, or facebook and twitter decided to do more than ignore it, to censor it and silence it to prevent people from even finding out the facts of the press story. ainsley: yeah, we want to ask you about that because look at the front cover of the post today. kayleigh mcenany put on her personal e-mail -- or twitter account, she posted this story, yesterday's story about ukraine. and then they wrote, these were their words, twitter's words with,. >> she violated the twitter rules, therefore, they took down -- or they blocked her from being able to use her account. jack dorsey then later in the door said our communications was not great, locking the url sharing with zero context as to why we're blocking is unacceptable. finish but what do you, i mean, will the mainstream media report the latest which is they're reporting that he basically did the same thing in china with his

business partners, they're reporting that hunter biden introduced his dad as vice president at the time to his business partners in china, they flew over to china together on air force two in december of 2013 according to these reports. what do you think about the censorship three weeks from the election? >> i think the mainstream media's entirely in bed with joe biden. i think their only priority is trying to elect biden. and big tech, look, big tech has been getting worse and worse and worse, but they really crossed a line heres that is very dangerous. for years i've been focusing on big tech censorship of conservatives, of conservative ideas, of shadow banning. i've chaired multiple hearings on it. but the line they crossed here is "the new york post" has the fourth highest circulation in america. they did two things on this. number one, they blocked all of their users. if you wanted to share this story from the new york post, you clicked on the link, and you went up to a page that said blocked, this information is dangerous. well, maybe it's dangerous for biden's political fortunes, but that's not really twitter and

facebook's call to make. and then secondly, "the new york post" itself was sending out on facebook and twitter their own story, and they blocked the post. they blocked the post from sending it. i don't know of any precedent of a major news outlet being blocked by twitter and facebook, of them deciding the following news outlets are not allowed to report major evidence of corruption from one of the two presidential candidates a couple weeks before the election. it is stunning. and for everyone in the media who says, well, it's unverified, you know, that didn't stop "the new york times" from going on and on and on with what they say are the prime minister's tax return -- the president's tax returns, and it stop the steele document. now, that is unverified. in this case i don't know if the new york post story is right or not, but that's actually what people should be debating, and joe biden ought to be answering those question right now. brian: and they said there was

you would ally yourself with justice scalia's jurisprudence. >> i do share the originalist, but in the litany of cases you've just identified, i hope you aren't suggesting that i don't have my own mind, that i couldn't think independently or i would just decide, well, let me see what justice scalia has said about this in the past. i assure you, i have my own mind. is. steve: what was senator coons trying to do, and what did she do? >> well, look, they fried to throw -- tried to throw some rocks at judge barrett. the big news out of yesterday is that the democrats surrendered, that they've given up. by mud day they were all gone -- midday they were all gone. and i think they recognize that on the merits, her credentials are impeccable. she's going to be confirmed. and, you know, it's interesting, that exchange where chris coons, he talks generally about equal rights, but he doesn't get into any specifics. yesterday when i was questioning judge barrett, i walked through

all of the cases at the court that are hanging in the balance 5-4. as you know, these are all the cases that i talk about in my new book, "one vote away," going through free speech, our rights to create size our politicians and talk about public issues, hanging in the balance 5-4, religious liberty, our rights to worship according to our faith, according to our conscience, 5-4. the second amendment, the right to keep and bear arms, the radicals the left wants to put on the court, they have four votes for, essentially, erasing the second amendment from the bill of rights. and i'll tell you, it is very revealing that not a single one of the democrats wants to debate the for thes or substance of that -- the merits. they know that their radical agenda for the court is really unpopular. and so so instead, they want to talk about different topics. they don't want to talk about packing the court which i also believe is part of their agenda if they win, increasing the number of justices from nine to eleven or thirteen to try to

immediately politicize the court. that's a wildly unpopular idea. but i think it's where joe biden and kamala harris are right now. ainsley: the polls show that biden is ahead. if biden and harris one in 19 days, then what happens with court packing after that? is that the next fight? >> yeah. ainsley: you're warning america about that. >> that is exactly right. you know, it was interesting this week, we saw the democrats trying to redefine what court packing means. it was a very concerted effort. their talking points, they've got a lot of message discipline. they're trying to say, well, you know, republicans have been packing the court for four years. no, that's not actually what court pack means. court packing does not mean nominating a justice to fill a vacancy. that's what all presidents do, that's what happens. court packing is very different. it is expanding the number of justices. fdr trued it in 1937 -- trued it in 1937 at the heart of his

power. he wanted to increase from 9 justices to 15. his own party, the democratic party, said no and resisted him because they said it would destroy the independence of the court, it would politicize the court. fdr was wrong then, the democrats were right then. you know, joe biden in 1983 said court packing was a boneheaded idea. and now that boneheaded idea, i think, is their agenda number one if they win on election day. brian: and they won't tell you, which shows they know it's not popular, but they're going to do it. senator shouper says everything -- senator schumer says everything's on the table. and number three, bernie sanders might have lost the nomination, but he's going to be head of the budget committee if you guys lose majority in the senate. he's going to have more power, in many cases, than the president of the united states. people should understand holistically what's at stake this election. senator, thanks so much. congratulations on the book. >> thank you very much. and the book was number one bestseller on amazon national --

mean. i mean, it's remarkable stale of a woman who is -- style it's about self-confidence, it's about owning the nature of what it is you're going to saw. whatever it is someone says to you does not even really offend you because you know who you are. we haven't seen that in a very long time in that kind of an environment. so it's quite remarkable. we we also saw it in some exchanges with senator harris. we saw it in an exchange even with lindsey graham when he was also asking her about justice scalia, and she said at one point another favorite was, you know, you're going to be getting justice barrett, not justice scalia. but it's also concerning, ainsley in that, look, we still need to see more women in positions of power, clearly. but the more that we see, the more we see an expansion of the kinds of women who can be powerful and yet we still kind of see women as inheritors of the men who influence them.

inheritors of power, inheritors of ideas. it's very exciting when you see a woman being able to have a mentor, just like men do, and yet expected of themselves and by other people to have their own ideas, to be able to move forward and beyond that. and that's what she's accomplished. she is very exciting. ainsley: all right. so, tammy, another topic making headlines is the exchange between mazie hirono, senator hirono, and the judge about the judge using the phrase sexual preference. watch this. >> i is never discriminated on the basis of sexual preference or -- >> sexual preference is an offensive and outdated term. ainsley: so merriam-webster, the diction flower, here's the old definition -- dictionary, before it said orientation, sexual preference. and now after that exchange between the two of them on tuesday, now it says offensive.

what's your response? >> it's really dumb, and that's one of the problems with, you know, the online framework. before you would have a team of people who would make discussions about definition. that's very important. this start ld, i believe, when some expert check on twitter made that point, which is idiot you can. as a gay women, many in the audience may not know that i am, for me it is a preference. for others they would identify it as being an orientation. what's remarkable here is that you've got -- and preference, by the way, has been approved and okayed couple until maybe, you know, the day before yesterday. ruth bader ginsburg has used it, joe biden has used it as a phrase, and this was no problem there. but what's ironic here is anyone from the gay community would throw in a dash of stall the when it comes -- stalin when it comes to policing the words we can use with. all the civil rights movements were about being able to define ourselves, to live life that best studented us.

and -- suitedded us. and they are the last people who should be punishing people or determining as the adjective police what it is we can use. and that's, i think, the danger, is that you've got now this clan trying to make it seem as though either everyone's homophobic, or you've got to be careful with every word. you know, maybe we need to have a list on our fridges that are tacked up -- written in pencil, of course -- with the day-to-day changes about what's okay with definitions. especially coming from the side of politics who say that there are at least a dozen genders. so don't look -- for anybody to complain about any heterosexual or homosexual who's going to identify as, let's say, as a preference that is the case sometimes, ask we're not homophobes or hostile to the gay agenda. that's bunk. and i think it's important for people to realize that. but this is part of the technique of making people afraid and sending a signal that

someone like judge barrett is an immoral individual. and, of course, that's a liement ainsley: this statement from merriam-webster, our scheduled updates which add new words and also add new definitions takes place several times per year. in this case, we released the update for sexual preference when we noticed that the entry for preference and sexual preference were being consulted in connection with the scotus hearings. as always, all revisions reflect evidence of use. are you satisfied with that? >> no, not at all. they felt the heat. it's an excuse. it's certainly not a coincidence, and it's something that they've got -- they're not going to let some blue check one guy on twitter or others who parrot him determine what's offensive and what isn't. from this woman who identifies as my homosexuality as sexual preference, how dare anyone suggest that that's offensive

discussed foreign business with his son. never's a big word. it covers a long period of time, never is big. so if he did discuss it with husband son, then his credibility is legitimate questioned and should be questioned. even if he didn't discuss business, let's assume he told the truth and he never discussed business with his son, his son is out there trafficking in his father's name and reason talkings making lots of money, wouldn't you want to know that? so the relevance -- there's also the issue of the authenticity of the underlying information. we're assuming the information is authentic. the fbi could answer that before the end of this segment if they wanted to -- brian: they have the laptop. >> they've got the laptop. ron johnson has the information, but i don't think senator johnson is equipped to determine the authenticity of the underlying information. the fbi, which works for the executive branch which the president heads, could tell us before the ten of this segment whether or not those e-mails are authentic and reliable or not.

steve: and, you know, the other thing, congressman, is if the fbi's got the laptop -- and, supposedly, somebody who identified themself as hunter biden drops it off at the shop in delaware -- the fbi, i'm sure, has figured out whose fingerprints are on the outside. you're suggesting that the fbi, at the direction of the president, could release that? >> well, they could certainly tell us whether or not there's any reason to suspect this is russian disinformation which is always the left's argument. if the e-mails are authentic, then there is potential criminality under lobby registration acts. but, i mean, the fbi's not supposed to get involved in politics. that's hard for us to believe after 2016, but they're really not supposed to. if the information is reliable, then the media provides the noncriminal oversight in our culture. and i've seen no stories -- there have been more stories about whether kamala harris saw

to have someone -- these professors are so busy, but to really take time and invest in her students, it was amazing. and that's kind of how that initial experience went during my first year of law school. brian: and, of course, the experience you had fighting for the country adds to probably what a great lawyer you'll be. you also went through an adoption process. was she interested in that part of your life? >> yeah. you know, at the time, you know, i mentioned my wife and i one day want to adopt, and we had great conversations about that. and, you know, as recent as a couple months ago, we started the adoption process, and we knew she had adopted two orphans from haiti. who better to reach out to. to our surprise, i mean, she's sitting there on the seventh circuit, mom of seven after going through all the confirmation hearings for that position, she reached out to us and just overwhelmed us with resources and sharing about her experience and books she's read, and, you know, we just felt so loved and surprised. but i guess if you talk to nub

who actually -- anybody who actually knows judge barrett, it's not surprising because she really does pour out, encourage and love everyone in her life even when it's selfless, even when it costs her time during her busy work schedule. brian: and she'd walk in a class and say i'm pro-life, i'm a catholic, did that stuff ever come out, her beliefs? >> never. i was doing an interview the other day, and they asked the question were your political beliefs different than judge barrett's? i said, to be honest, i don't even know where she stands on those issues. she came into the classroom and made sure we understood the different arguments. as long as we were prepared, we asked questions and had free discussion. she never once came in and said this is how this should come out, this is why i should think that. it was a standard of excellence, it was a respectful environment, but everybody was free to learn and discuss and throw ideas out and really try to rationalize what is the best outcome in this case or the best reasoning to approach this text. brian: and finally, chase, how's law treating you?
