voters would be trying to vote on election day or close to election day and election officials would be overwhelmed with those mail ballots, getting them in sooner means they can spread the workload over more weeks and helps them manage the throw of the election better >> bill: you took away my next question. when you see the numbers that you see every day from various states, what trends do you think are popping up in front of you well the unprecedented number of democrats registered democrats in the states where we have party registration who are requesting and casting mail ballots. usually this is a bright spot for republicans. usually in most states, registered republicans are voting by mail. instead we're seeing lopsided numbers in favor of registered democrats. conversely, in person early voting, that usually is where democrats tend to vote, it's a

mixed story. generally we're seeing the in-person early votes look more favorable to the republicans than the mail ballots, i think what's going on here is republican voters are listening to donald trump and deciding that mail balloting isn't for them and they would rather cast in-person votes which is why not only do we need to see what happens with the in-person voting period which is happening right now and for the next two weeks and election day is going to be important as well >> bill: you're right about that. republicans would argue democrats are can balance liesing the vote. do you find that to be the case so far or not? absolutely. there are some people who have voted on election day who are volting earlier. that's a good news story because it's helping our election officials. i also think we're going to see later turn outs. maybe this craters over the next

two weeks and nobody shows up to vote any more. but right now texas already at 50% of their 201235 turn out. vermont over 40% >> bill: i don't think we can say yet whether or not we're going to go by that number i think we're looking at 150 million people voting in this election. i said that last year, nothing in the data i'm seeing makes me change that opinion. those all mail ballot states these ballots have to be back to election officials by election day. if we see high turn out, look for colorado, vermont and others look for them to see how many people have already voted. i think they're going to beat their 2016 turn out sometime at the end of next week >> bill: why are you so good at this? why? >> bill: it's so effective, how

filing a lawsuit against google today, the most significant antitrust case against a company in two years. jillian turner has the reporting on this bill this suit has been more than a year in the making. justice department sources are telling us that attorney general bill barr himself directly involved in some of the planning, now the doj plus eleven u.s. states are at excusing google of violating american antitrust laws. google no longer competes only on the merits but instead uses it's monopoly power and profits to lock up key pathways to search on mobile phones, browsers and next generation devices. no one can feasibly challenge google's dominance in search and search tieing. fox news learned this began with a broad investigation and

>> bill: late last night supreme court ruling 4-4, it goes back to the lower court. pennsylvania can accept votes up until friday which is november 6th, 5:00 in the afternoon. michigan has something going on, maybe wisconsin as well. how do you see this breaking? well it's very unusual. it was a deadlocked us supreme court dee circumstances 4-4, which let a lower court stand. pennsylvania law is clear, you have to have that ballot did returned to the election authorities no later than 8:00 on election day tuesday night. yet the pennsylvania supreme court which is 7-2 democrats held 4-3 that the law needed to be set aside because this was like a natural disaster like a flood, covid so they needed to extend it. i don't get that analogy. the mail is still being delivered. you can still put your ballot in

the mail on friday and know it's going to be postmarked before and received before 8:00 on monday. and they went further. the pennsylvania supreme court said if there was knowledge postmark on the envelope, to indicate that it was sent by the deadline or that it was the postmark of the i am legible, then illegible then you had to assume they mailed it before the deadline unless the preponderance of the evidence suggests otherwise which is an open invitation to litigate every one of these balance ballots >> bill: on screen ballots received that lack postmark or other lack of mailing or for which the postmark is illegible, will be presumed to be mailed by election day unless the preponderance of the evidence demonstrates that it was mailed after election day. is that clear as mud or is that

the januaried jury is still at no one now, liechd as go grand juror number one. saying essentially the only option were the three wanton endangerment charges that were level leveled. i'll read it to you word-for-word. the grand jury was not presented any charges other than the three wanton endangerment charges. the grand jury did not have homicide charges explained to them. the grand jury never heard anything about those laws, they talked about self defense or justification. that was not explained to them. additional charges were answered with the statement that the state did not believe they could make those charges stick. so she said that he or she said that the grand jury was not in agreement that all of the actions were just identified and did not think necessarily it that these should be the other charges but as it was explained to the januaried jury, the
