pennsylvania so hard right now? >> good morning. both republican and democratic strategists view pennsylvania's 20 electoral votes critical to winning. one of six states with the most electoral votes. if state has gone through voting lawsuits and ballot disputes. former president barack obama will encourage people to vote early and in person. it's happening at the ballpark behind me less than two weeks before the election. a portion of obama's remarks will be directed toward black men highlighting the importance of african-american turnout in philadelphia that caused hillary clinton's loss of pennsylvania in 2016. she won the philadelphia area she didn't win by as much as she needed to and won by far less of a share than obama did to romney in 2012. when president trump learned the biden campaign was pulling

out their biggest weapon he played it down. >> sir, we have bad news. obama will start campaigning for sleepy joe. and i said is that good or bad? why is that bad? he campaigned harder or hillary than she did, you know? he was very ineffective as a campaigner to me. i think that's good news. >> the president's focus last night was holding onto support in one of three counties he flipped in 2016. in erie he hit biden hard over fracking claiming biden will ban it and using videos of biden and harris support for ending fracking to prove his argument. biden's method aims to move away from fracking by not issuing new permits of federal land. his plan does not affect fracking on private land. critics maintain biden would kill the fracking industry by

rolling back president trump's deregulation efforts. it is causing the biden campaign to flood the airwaves. the second most ads of any swing state in this election. >> sandra: trace. >> trace: sources telling fox news the f.b.i. is now in possession of the laptop purportedly belonging to hunter biden and the emails found on it are not linked to russia. foreign interference hasn't been ruled out. gillian turner is live in washington what is the intelligence community saying about this reporting specifically, is the dni or f.b.i. commenting at all this morning? >> so trace, a couple of things to pull out here. threads to pull on. sources confirmed to fox news the f.b.i. is in possession of that laptop that's alleged to have belonged to hunter biden at some point. the intelligence community is staying very, very tight lipped about a separate aspect of the story which is whether or not

there is an investigation into the possibility of some kind of foreign election interference. super important context to keep in mind throughout the day on this story. we'll update you as it comes. last night fox news obtained a letter from the f.b.i. to senator ron johnson about the laptop that says if actionable intelligence is found we'll evaluate the need to provide meetings with you. vice president biden, asked by a local outlet yesterday whether he thinks the senate's inquiry led by chairman ron johnson is legitimate pushed back hard. he said this is the same garbage. it is rudy giuliani. last ditch effort to smear me and my family. there is no basis to this and you know and all in the vast majority of the intelligence people have come out and said there is no basis at all.

ted cruz, a member of the judiciary committee. good morning and welcome. thank you for being here this morning. there seems to be a lot we know, a lot we're learning about this story. now the f.b.i. has this laptop. the f.b.i. and d.o.j. seem to be in agreement with d.n.i. ratcliffe this is not some part of a russian disinformation campaign. there is a lot the american people don't understand about this story. what do they need to know? >> well, one of the most striking things is what joe biden isn't saying. so joe biden has not denied that this is, in fact, his son, hunter biden's laptops. he has not denied that these emails are real. joe biden has not denied that he personally met with the ukrainian oligarch he had sworn up and done he never met with. joe biden has not denied to communist china offered him millions of dollars to do business with them. right now the biden strategy is count on the press and count on

big tech to protect him from answering even basic questions. and i will tell you last week when it came to big tech we saw a major transformation. for years we've seen a growing problem of big tech censoring citizens from speaking online. last week big tech took another step, a huge step and they're now censoring the press and media, in particular they blocked the "new york post," which has the fourth highest circulation of any newspaper in america, they blocked the "new york post" from circulating or any american from posting two blockbuster stories alleging evidence of corruption by joe biden. that is a serious, serious abuse of power by big tech trying to silence the press. >> sandra: the "wall street journal" editorial board takes it up in a piece this morning pointing out the media ignoring the email found on the hunter biden laptop. the bidens and china business. the story won't go away without

explanation even if the v.p. wins. while it is being ignored it will make the case there will be big questions that have to be answered by a potential president biden if he does win this election. the editorial board writes this. joe biden ought to clear the air on this china business in his own political interest. is he the big guy in the email? what happened with the deal? china will be one of mr. biden's toughest foreign policy challenges and the unexplained documents won't go away once he is elected. if republicans hold the senate you bet there will be more digging. so senator, tell us about that. if joe biden wins the presidency, how would a republican-led senate if it stays that way, how would it proceed? >> well look, all of those questions need to be asked. i'm glad the journal is asking them. the traveling press corps with joe biden are not asking them. to be honest it's hard to ask it of someone who is hiding in

their basement and doesn't take questions from the press. and look, we know let's take the china piece of it. if the emails are true -- by the way, if the emails aren't true which the biden campaign has not alleged they're fake. let someone put out the evidence. we want to know if there is fake. no allegation they're fake. if they're true fox news has reported from sources that the big guy referred to in the emails is joe biden himself and that -- this is an important point. this whole issue is not about hunter biden. hunter biden by all appearances has led a very troubled life and a challenging life. this whole inquiry is about joe biden who wants to be president of the united states and about whether joe biden was personally corrupt. the china emails are offering to pay over a million dollars to the big guy, to joe biden himself, cash in his bank account. the questions the journal asked

did the deal go through? did he take the money? how much money did joe biden take from communist china? what did he do for it? those questions haven't even be asked much less answered. you know, abc had joe biden on for a town hall the day after these stories broke. they didn't ask a single question. whether he had received millions from communist china and what he had done in exchange for that. apparently it couldn't get in the way of their political effort to try to defeat trump and elect a democrat president. >> sandra: meanwhile to the suppression of this story and others as you and other republican senators are making the case, you now want to subpoena these technology executives. you have big questions for them. but senator, you know these companies are worth billions of dollars in market capital. you look at google, a trillion dollars. what kind of fight are you up for knowing that they've got big guns behind anything that you and other senators bring?

>> well, this is the fight i've been in for a long time. i think big tech poses the single largest threat to free speech and democracy in america. their power keeps growing and growing and growing. i'm very glad to see the department of justice moving this week to bring an antitrust lawsuit against google. it is worth over a trillion dollars. they have 120 billion sitting around in cash and they use and abuse their monopoly position, number one, to enrich themselves as everyone else's expense but two, when it comes to politics, to silence american citizens and now to censor the media. if you look at what twitter did, if you or i or anybody tried to tweet either of these "new york post" stories laying out evidence of joe biden's corruption, your tweet would be blocked. you would get a warning sign that says this is potentially harmful. they went even further than that and blocked the "new york

>> sandra: a south carolina sheriff's deputy was killed in a traffic stop after an altercation of someone in the car that accelerated and collided with a trailer and the deputy was hit. another deputy collided with the car. the sheriff was pronounced dead at the hospital. four other people were hurt in the incident which is now under investigation. >> trace: the senate judiciary committee set to vote tomorrow on the nomination of judge amy coney barrett for the supreme court. most americans support her confirmation according to a poll. let's bring in guy benson host of the guy benson show.

i want to point to the poll. 51% favor confirming judge barrett. 46% not in favor. that 46% number is interesting because it is the highest against number in the history of gallup's supreme court polling that goes back to 1987. is that kind of the fuel for the fire that democrats are using to try to block this to give them motivation, guy? >> yeah, and i would point out you're right. the negative numbers are high but the positive number in favor of confirmation is a majority higher than we saw with kavanaugh, higher than we saw with gorsuch or kagan. that's a strong number for judge barrett. not the only poll that has barrett at 51% in favor of her confirmation. there is a new poll out this morning that has been tracking this now for weeks and what's interesting to me, trace, about that particular survey is when barrett was announced back in late september, she was at plus

3, right? so above water but barely. she is now in the new poll up in the plus 23 zone with independents favoring her confirmation by 20 points t. more the american people have seen of judge barrett, heard from judge barrett, the more they like her and persuaded she ought to be on the court. per your last guest ted cruz i think it will happen very soon. >> trace: i want to bring up the poll for independents and what caught my eye. in favor independents 52%. that, by the way, was only, you know, was only beaten by john roberts and sonia sotomayor. that's a huge number of independents in support of amy coney barrett. what does that tell you about this confirmation process, guy? >> that persuadeable people have been persuaded. she is a suburb choice, eminently qualified. performed splendidly at the

hearings. whether the gallup poll or other polls, independents and the american people have shifted in favor of her confirmation and even movement among some democrats tugging in that direction as well. i would also note, trace, this is a lot of polling to be talking about. "the new york times" had a poll out just yesterday on a bunch of subjects including this one and asked the american people should this confirmation vote happen before the election or only after the election? democrats have been arguing now for weeks and weeks that this ought to happen after the election. now by an eight-point margin the american people disagree and think the confirmation vote should happen before the election, which is it is going to. it strikes me if you look at the arc of this confirmation process the democrats have tried to argue it is not constitutional. that's joe biden's term. it's false. it is clearly constitutional what's going on. the historical norms here are right on target with what the republicans are doing with this filling of the seat. and the last vestige of the

democrats in terms of a compelling argument the american people don't want this, they are against her. the american people feel like this vote is too soon. now you have polling that shows even that final argument that they are trying to make no longer applies. they are left with nothing. >> trace: i want to get this in there. "the new york times" poll shows in that poll talking about court packing 58% oppose to packing the court. only 31% in favor. it appears to be a losing issue. why won't joe biden just come out and declare his position? >> great question. he should. it's a 2-1 margin in the "new york times" poll. the american people against court packing. independents against it by 40 points. 40-point margin in that poll. i have now seen three major surveys nationwide ask on this question. and probe the american people on court packing and guess what? the number in support, the percentage in support of court packing across all three polls

states that republicans had difficulty winning in states. it is important to defend the states we won the first time around securing another four years in office and maybe picking off minnesota, new hampshire, other places that go blue. north carolina is a very important state in this election. it is my home state. i was born in the very town that donald trump is visiting this evening. gastonia. i have a lot of relatives there and excited about the president. the folks i talk to on the ground are enthusiastic about getting out and voting for four more years of peace and prosperity that they can have with donald trump. >> sandra: a lot can be pointed to in the days leading up to election day 13 days out. polling is one indication that we do use to get some sense of where the two candidates stand. fundraising is another, hogan. i'll put this on the screen. a "new york times" article on the fundraising gap happening now. trump's campaign $63 million. dwarfed by bidens $177 million. the extent of the president's

cash troubles as he is now badly outmatched by joe biden. what should be taken away from that, hogan, as we look for some sort of metric how the president is doing other than anecdotal which your campaign uses so much about enthusiasm and crowd size? >> well look, i think the biden campaign strategy is clear. one that will be led from the basement with a barrage of television advertisements. you can't parachute in in the last minute and get to go out and vote. no one likes joe biden. the media don't really care for him. they just hate donald trump. they're skewing all the coverage against this president. that's nothing new. 95% of the coverage is antagonistic to donald trump. we have a massive ground game organization that is the envy of the political universe. we had more than 130 million voter contact engagements year-to-date. that's extremely impressive. no one has ever seen anything like it.

barack obama didn't have the massive volunteer army that we have. we have enough money to be up on tv in all the states needed to win and pick off even more states. the fact is get people out to vote. >> sandra: the biden campaign is challenging that notion. remember what trump said he would fund his own campaign if he needed? he needs to. he doesn't have the money. two weeks. how do you respond to that? >> i don't know what that means. it's exactly what i just pointed out. the fact that joe biden thinks he can win this thing with television ads. we know he has a 47-year career of failure. he can't point to anything he did do. everything he accomplished crushed the american worker, -- he can't put to anything he will do because it's green new deals and open borders and abolishing ice.

this president has a 47-month in politics of record-setting success, joe biden has half of a century of failure. >> sandra: i want to ask you where the president will focus his messaging not only when it comes to campaign rallies and the debate stage thursday night. mike huckabee made an interesting comment suggested the president is making a mistake by leading with joe biden and this hunter biden story. the question on fox and friends this morning. >> he is leading with hunter biden. is that a mistake? >> yeah, it is a mistake because the average person doesn't understand it. it is too complicated. they care about their healthcare costs, their taxes, they care about safety in their neighborhood on their block and in their yard. focus on that, he wins the election by a landslide. >> sandra: is that a message that's getting to president trump? you heard that. you heard ted cruz saying this is about joe biden, not hunter biden. is the president taking that in?

what will we see as far as messaging on that story? >> i love mike huckabee and where i got my start in politics and friends with his family for 20 years and consider him a second father to me. i think he is a little off here. the president isn't talking about hunter biden. he is talking about joe biden and what the emails now reveal is that joe biden is flat out corrupt. this is one of the big problems with hillary clinton back in 2016. the american people knew about clinton cash. they knew about the clinton foundation and how sketchy all of that information coming out was. >> sandra: that's not the point. he is not suggesting it doesn't need to be looked into or discussed just suggesting 13 days out when it comes to the trump campaign and the messaging from the president talk about the economy and the pocketbook issues. >> he is doing that at every single rally driving that home. that's what matters to the american people. this president's policies have improved the lives of all americans regardless of race,

religion, color or creed. i remember in the mid-terms how the media kept saying why isn't the president talking about the economy? 80% of the speeches in the mid-terms about the economy. they didn't want to cover that. the only time they mentioned the word economy was we don't talk about it enough. >> sandra: will he bring it up on the debate stage. >> he will talk about what he will do for the future for all americans as well. that's what matters. the successes that allow them to put food on the table and clothes on their back is what donald trump brings to the table and what joe biden can't talk about. >> sandra: that's what voters care about. i have to go a few seconds. the debate stage. if it is not a question does president trump bring it up and make the point himself? >> i don't want to get ahead of what the president will or won't do. corruption is a major issue for the american people. they see what washington has been doing. how they've been lying. joe biden is one of the chief, you know, problems in this city and in this country.

african-americans at the hands of police. >> it is not a race thing like people want to try to make it to be. it's not. we were doing our job. we returned fire. this is not us going hunting somebody down and kneeling on the neck. nothing like that. >> trace: mike tobin live in chicago with more. what do we know about this? >> i can tell you that sergeant jonathan manningly spoke to abc news. he said the raid and shooting on her apartment had nothing to do with race. he said police officers did knock and announced their presence before entering that apartment on march 13. misinformation he says such as police were at the wrong apartment or taylor was asleep in her bed fueled public outrage and city leaders did nothing to correct it. >> this is not relatable to george floyd, nothing like it. it is nothing like it. these are two totally different types incidences. it is not a race thing.

it is not hunting us somebody down or kneeling on a neck. nothing like that. >> meantime a grand juror explains why officers who fired shots were not charged directly for taylor's death. following a judges ruling one grand juror released an statement the grand jury was not presented any charges other than the three wanton endangerment charge. the grand jury did not have homicide offenses explained to them. >> a lot of evidence that was provided to the grand jury. however, once that evidence is provided, the assessment has to be made how it applies to the law. the only opportunity that they were given that we can now ascertain from our clients' statement, the recordings and the files were the one endangerment. no other laws were discussed whether it be particular to a certain offense or a defense to

reporting the trump campaign has been frustrated with the idea that this debate was supposed to be focused on foreign policy and now focused on a number of important issues to the american people but issues that were discussed in the first debate we had. that's the first thing. the second thing is the mute button they'll have for candidates for two minutes opening the segments. interesting to watch how that plays out and the moderator doesn't also have a mute button but the screen will be split. i think there will be a lot of reading into what each candidate is saying without speaking, what kind of reactions they're having in terms of listening to the other candidate but that is a new thing that the presidential debate commission did not negotiate with either campaign. just put into place. of course, the trump campaign has said they are willing to move forward with the debate but not happy about the mute button being instituted for the sake of stifling debate in the first two minutes. >> sandra: they forced the debate commission to defend the

harris will be holding her first event. hillary clinton did win this county back in 2016. 57% of the vote there. we'll see senator harris holding an early vote mobilization event there and on to mek len berg county north carolina where hillary clinton pulled off victory in 2016. why spend so much time in these counties that are so clearly blue in 2016 this time around? >> what they may be trying to do is not necessarily persuade voters. we have so few undecided voters at this point but try to encourage greater turnout. charlotte is exactly the kind of place that democrats have had their eyes on over the last few years because they are very suburban, lots of folks with college degrees, lots of young professionals. the types of folks democrats have tried to bring into their coalition in recent years. so it is ripe not necessarily to persuade more voters to come to the democratic side but to

remind some of those young professionals to be turning out to vote. >> sandra: okay. and as we see the president also campaigning in the state, what do the next few days look like. some of the real clear politics average as we finish off here, kristin. get into the stack so you can see the numbers. here is pennsylvania, 48.7%, joe biden continues to poll ahead of the president in that state. flip it to where we see them spending time on the ground. north carolina, a lot of the candidates spending time campaigning there. joe biden leading by just over 2 percentage points to president trump. i'll finish with this, kristin. such a big part of the conversation heading into the debate tomorrow night. when asked who do you trust more to handle these issues, on the economy president trump still polls ahead of joe biden. you heard mike huckabee earlier today said focus on this on that debate stage. it is what the american people want to hear when it comes to handling the coronavirus joe biden polling ahead on that.

stage, for example, or when he is campaigning. he suggests it is because the american people don't really understand this story. james, you are always so good at bringing politics to the kitchen table. what is it that americans might be missing about this story and need to know? >> well, i think there is certainly an effort in the biden camp as you suggest to say that this is about a troubled son of joe biden. but what these documents do, which is biden campaign has not said are fake, they show joe biden involved in this family business. and by the way, even where it's hunter biden, i think a reasonable person would say he probably can't collect $10 million a year for introducing people unless the people he is introducing are very high level, including his father, the vice president of the

united states perhaps. so this question of, you know, how young hunter i guess almost 50 now uses this influence business to collect millions and millions of dollars, didn't some of these people want something in return? we've seen in these documents it blows away any argument this is legitimate business about finance or energy or any of the things that it superficially appeared to be about. this is the sale of influence at a very high dollar. much bigger than we thought before. the document suggests it is a joe biden, not just a hunter biden issue. >> sandra: senator ted cruz joined us earlier, listen. >> joe biden has not denied that communist china offered him millions of dollars to do business with them. right now the biden strategy is count on the press and count on big tech to protect him from answering even basic questions.

>> sandra: so we'll leave that there for the moment. to biden's he can nicks and his proposal on taxes. the risk from joe biden's policies isn't that they will send the economy reeling right away. the problem, the board writes, is that they'll have a long-term corrosive impact by raising the cost of capital, reducing the incentive to work, and invest, james. this is a really important piece by the editorial board as the tax policy institute is looking into joe biden's tax policy proposals and their conclusion is that joe biden tax policy could lead the california and new york people paying 62% of their income in taxes. that would be the highest tax rate on some of those individuals that we've seen in over 30 years. what was the point of the piece that you wrote this week? >> that's right. you are talking about tax rates in a lot of places going so

high because the joe biden plan is to raise the top individual tax rate, also to apply the payroll tax to high incomes that above $400,000 where it's never been before. this is not just about raising taxes on rich people. it is also about raising the cost of energy and raising the corporate income tax. president trump cut the federal corporate income tax to make america competitive. slashed it from what was the highest in the industrialized world down to 21%. the biden plan is to lift that further and if you look at the hoover institution study that we wrote about this week, it is saying over a decade the full biden economic plan is going to cost 5 million jobs. a big part of that it's not just the tax increases, it is the regulation to make energy production much more expensive. limiting fossil fuels, moving us to alternative energy.

center, the tax foundation, the american enterprise institute point out that corporate taxes are paid by the customers of that company and the employees. the employees pay it in lower wages and less opportunities. it will cost a half million jobs directly. that's before we get into all the regulatory stuff that james freeman was talking about in your earlier portion. and even the study that the biden campaign continually refers to saying moody's says we'll have a lovely day and great economy because of the biden plan. even the moody study points out there are 7.3 trillion in new spending and 4.1 trillion in new taxes so where is the other 3.2 trillion dollars going to come from? from higher taxes. you can only squeeze that turnip, that 1% at the top so far. you have to get money from most of the people who pay taxes in america and that's what is going to happen if the biden plan is put in place. you can't spend 3.2 trillion in

additional deficit spending over the next decade without blowing up the economy in other ways. >> trace: i have to go, karl. if you were adviseing the president tomorrow night in the debate lead with the economy? >> i would lead with the economy. if the other issue comes up, fine. put the focus on the pocketbook. make a sharp contrast between his policies and the policies of joe biden. >> trace: karl rove, always good to see you, sir. thank you. >> sandra: north carolina scrambling to inform 10,000 absentee voters about rejected ballots, those voters did not sign their ballot or forgot to add a name and address. they were not notified because court battles held up the process. this comes after a federal appeals court ruled overnight the state can accept absentee ballots postmarked for election day and a week afterward. the state is closing in on two million early votes cast out of more than 37 million nationwide.

and we are less than two weeks to go until election day. more than 37 million americans have already cast their votes with 3 million of those coming from florida. phil keating is live in miami with more on that. >> good morning. on the north carolina tip here in florida, 3 million people have already voted early. mostly by mail. 12,000 of those ballots were rejected and are now being scrutinized and clarified because of signature mix-ups. if you vote by mail you have to make sure you do it right. probably a combination of electorate enthusiasm combined with coronavirus fears has led to surging and record numbers of early voting nationwide. not just by mail but also in person compared to four years ago. at this pointless than two weeks until election day close to 35 million americans have already voted in 35 states -- 45 states. early this morning and has been

the case since monday the longer in-person voting early lines happen between 7:00 and 9:00 a.m. this morning there were about 100 people in line. by 7:15 that line was pretty much gone. plus today is a wash-out. flood advisories and a day of rain all day here in florida. there are still 11 more days of early voting options. so what are you going to do? stand outside in the rain or wait for a sunny day? >> big increases in early voting in every state compared to 2016. the eight states with the largest increases kentucky up 553%. new jersey up 515%. pennsylvania up 356%, connecticut up 279%. virginia 258%. new hampshire, alabama up and vermont up 151%.

so far registered democrats are outpacing registered republicans at mail-in voting. >> what is difficult to tell at this point is whether or not we're having what we might call a substitution effect where early in-person voting and vote by mail is cannibalizing the people that would normally vote on election day. if that's the case president trump is doing just fine. if democrats are moving from voting on election day to voting by mail or early in person it's a wash. >> typically republicans outpace democrats with mail-in balloting. this year flip-flopped. the democrats registered are voting more by mail than republicans. democrats are winning the mail-in vote tally so far. but even democratic strategists expect that republicans will then outpace registered

shields the companies from liability. senator roger wicker, chairman of the senate commerce committee. good morning and welcome. thank you for being here. first up, what is your concern when it comes to these big tech companies and what americans see when they use those social media giants? >> well, listen, these are among the most powerful people in the country. the ceos of google, facebook and twitter have enormous power over the free flow of information in our country. and it is a real concern not only to me. i'm sponsoring this bill but senator graham, chairman of the judiciary committee and other members of the commerce committee and judiciary committee are sponsoring this bill. under current law, they get a free pass and liability protection under what we call section 230 of the

communications decency act. and if they are going to show a bias against a conservative point of view, which we see time and time and time again, i think it's time to re-examine whether they should have this section 230 exemption from liability. our bill would tighten up this language and basically the law as it is today gives them a right to censor anything they find objectable. now, objectionable is in the eye of the beholder. so we are going to tighten that up. we think they need protection if they take down content that advocates violence or self-harm or terrorism. that's okay. but we're not going to in my view i don't think we should leave it up to big tech to decide what is objectionable and what isn't.

>> sandra: these companies are huge. where do you expect to get with companies that have -- they're worth billions. in the case of google a trillion dollar company. do you expect you can actually hold them accountable if it indeed is the case that they are censoring what the american people see when they use these companies? >> let me say this. i'm outraged, for example, by what twitter did to the "new york post" story about hunter biden. that is a story that needed to be out there. the public needs to examine it and americans can decide for themselves. but the concern about big tech is bipartisan. we issued this set of subpoenas on october 1st and frankly in the commerce committee it was done on a unanimous bipartisan basis. democrats have other concerns about big tech dealing with privacy and things like that. we expanded the scope of the

hearing. i think you will hear objections from our side based on the clear anti-conservative bias that big tech has, particularly these three companies. but you will hear other concerns and frankly, i think there may be some bipartisan solutions to the power that these companies have. >> sandra: i have a minute left. are you talking about mark zuckerberg, the head of facebook, jack dorsey of twitter. when you have those executives sitting down in front of you, what's the first question you ask them, senator? >> well, i tell you what, i don't think i'm going to telegraph that. you can be sure that mr. dorsey will be asked about the clear bias in twitter not only not letting people retweet this "new york post" story about potential corruption in a nominee for president of the united states, and not only
